good evening everyone and welcome to the Cal Planning and Zoning Commission meeting for this Tuesday January 21st 2005 may we start with a roll call please beer here ality here P gr right here McMahon here chair Maxwell here pres thank you very much uh we'll move on to the approval of the agenda if there are any additions or deletions if not I'll ask for a motion to approve so so move by right may I have a second I second second by FL all in favor say I I all oppose same sign uh we'll move to the approval of the minutes from January 6 2025 again if there are any additions or deletions or Corrections if not I will ask for a motion to approve so moved moveed by Becker may I have a second seconded by right all in favor say I I all oppose same sign this is the public participation portion of the program where we have if anyone has anything they'd like to speak to that is not on the agenda you could step forward now uh if not we will move on to new business uh we have a public hearing a petition by cillo Mendes for special use permit for automobile sales for the property located at 2050 East Lincoln Highway um and I believe we have a staff report cour yes um the applicant cillo Mendes is in the audience he has his niece with him adelene Flores it will help him interpret uh for us tonight um Mr Mendes is requesting a special use permit for automobile sales at the lot 2050 East Lincoln Highway the zoning like commercial District Auto Sales is a special use in that District uh the site's about 1.15 Acres uh it was four standing into the city in August 2011 a year later so it was automatically zoned single family A year later it was rezoned to the Light
commercial District which it's has the same zoning since then the current owner Mr Mendes purchased the property in 2021 uh applicant initially approached the city late that year regarding establishing an auto sales operation at that location uh City staff worked on some draft of some possible condition s if that were approved um and many of those are recommended tonight in the recommendation for approval uh the home on the site it's a little closer is um right here and there's two detached garages uh Mr Mendes currently living in the home but intends to uh put it into a sales office uh for the car dealer uh the owner Canucks interet sales now it's a business identified is JW Auto Sales uh the owner States the automobiles are sold over the Internet brought to the site uh they're just clean and stored they're not sold from there then the vehicles are taken to his Chicago location for delivery um one of the requirements of a special use permit is a um site plan is required which uh Mr Mendes did submit it's in your packets shows um the access current access to Lincoln Highway there's a paved area for the car sale displays 14 spaces uh there's a parking area five cars including a handicap space meeting the requirements a proposed detention Basin here there's some Landscaping shown per the Udo long Lincoln Highway in the east and west perimeters of the site uh so that's been submitted with the last few months showing what we're uh on a plary basis that was our city
engineer looked at it was comfortable of course before they approved before they do any construction they'll have to submit more detailed engineering plans showing more detail that they're meeting the requirements for the drainage and the auto sales area uh but that's uh meets our general requirements they also submitted a handrawn plary sketch of floor plan what they do our uh C- compliance coordinator uh did review it um and it was done by the applicants contractor friend uh they're going to add a ramp to get it's got to be Ada accessible is kind of the big thing so they're adding a ramp to get into the site uh but all the uh aisle widths U are co- compliance coordinator indicate were were good met the ad requirements of course before any work starts they have to submit more detailed building plans but what they're showing uh generally does meet those uh requirements showing a sales area two restrooms uh a store a waiting room a handicap ramp into the building so the estimated cost of the exterior improvements is uox approximately $122,600 uh and then 70,000 for the renovation of the home to a sales office so uh the applicants aware of that um has no issue with uh what the cost will be um plans to do that work and I'll go through the conditions uh so in the um conditions um many of these were recommended when he first came to the city we modified a few but create and pave a vehicle display area which he shown provide the required parking spaces uh no repair of vehicles on the site auto detailing is allowed as defined by the Edo so he can clean them um the cars out detailing hand wash
that's detailing it's defined in our Udo uh it can't store inoperable vehicles on the site no storage of boats trailers or RVs meet all the EPA guidelines for uh disposal of of liquids tires Parts Etc uh there's an existing well and septic system on the site he can maintain that if it's redeveloped uh do something more intense You' probably have to hook up to sewer water it'd be per the Udo of course provide customers employees to uh sanitation facilities waiting area for the ad requirements and our building code uh can expand the vehicle display area unless the special use permits amended and then the special use permit uh shall expire with a oneyear approval of the ordinance proving the special use unless the paved areas uh is got to pave that the parking lot and the drainage basin Landscaping lighting sales office complete and a final occupany within one year of approval of the ordinance which he's agreed to normally the special use permits for two years you got to start construction or it expires uh we thought to give one year to get he wants to get you know going so uh make sure that happens so the findings of fact um recommending approval the sites like commercial comp plan calls for commercial for the property um it's along a busy roadway so ideal for Auto Sales uh the surrounding area will not be negatively impacted with the development of course you have the Casey's there's a self storage here A1 not shown on C drive on that area uh and other uh uses Furniture Store single family large lot area to the West um so will not uh inhibit surrounding development the surrounding area uh all the utilities are provided
they're going to maintain the well and septic um and again they meet the comp plan recommendation and we have these conditions that will ensure that it's not detrimental the surrounding area we did receive a uh letter from the Boral who live adjacent to the site to the West uh James and Evelyn War who are here tonight 1849 East Lincoln submitted a email and letter concerned about uh there's a drive not pay for farm equipment that comes off Lincoln Highway to this Farm back here goes over their property they were concerned about uh runoff from this site with the detention Basin that would make that wetter than normal and the farm equipment would U destroy the yard or you know create ruts and Etc but I did respond by email and that copy is provided to you indicating the detention basin uh they're proposing detention base will detain the water on site and not increase the runoff to the West that's per law so and uh before they start work they're going to have to submit more detailed engineering to show how that's going to work um but they're showing an area that should be done by an engineer that should be adequate size so there'll be no runoff additional runoff from this site to the West uh may even be less so that's a response I had back to them that's the only public comments we received on the request uh there's a motion sample motion to approve the site plan and also the floor plan subject to the 10 conditions which I just uh summarized okay thank you Dan is there anyone else that would like to speak to this if so you can come forward and step to the podium if not I will close the public
hearing and open up to comments and questions from the commission it it fits the Udo requirements what commercial the only the only actual question I have is relative to promotional signage that was my question too yeah what type of sign are you hoping to put up on the property um I know that there are requirements but have you given thought to that uh I guess they'll come back before us right Dan or uh we have sign regulations permanent ground signs wall signs temporary signs are allowed at 90day period so we do have regulations it would come back to us unless there were some Varian so as long as there as long as as long as you're not requ requesting um a variance from that then they got to meet the code there's no requests for variances to signage yeah well and I think we're all kind of sensitive to that since it's a quarter into C so yeah um basically he says that he doesn't have an idea right now but anything that is allowed by the city would be okay with him okay but he's leaning more into it's like a sign that would go down on the pavement or something like that that sort okay any other questions um Jim did you feel like you're concern was addressed about the drainage or Jim could you go up to the mic uh this identify yourself to Jim if you wouldn't mind just for the record just state your name and address when you yes thank
you um James warl 1840 East Lincoln Highway um we didn't have any abject um objection to the to the project my primary concern was the the this this drainage thing um I don't believe between his driveway the space that they're either going to use for work or whatever and that I don't believe there's room for a a retention pond in that space uh our first was we thought that it would be better to move it to the east side of the property um or to the South because um all that everything there drains to the South anyway uh all the field tiles and everything go south there that ground originally my Uncle Charles or built that house and it was originally part of my grandfather's farm so consequently uh we're very familiar with what goes on out there and we wanted to make sure that you had that same understanding and that um the idea that uh um it just needed to be addressed was all okay good thank you Jim um and to your point Dan I mean Zach obviously is confident that that space would be adequate qu correct yeah this was done by an engineer CSC who's done a lot of work in the city and was checked by Zach so I think it's tending to have the drainage by the area that's going to collect the drainage the asphalt here
with the car sales lot area and the parking uh close by so there's probably um 10 ft or so shown between that and the property line and if it's doesn't meet the requirements it has to be deeper or move further east and and push everything so it's got to meet the code okay and that's yet to be fully determined because there still has to be a study before they get a billing permitted to start work okay he'd have to show that that's adequate size okay is there any reason why you couldn't move the detention point to the to the south of the building uh we're actually trying to work on that right now our best intention is to of course be um super have a good relationship with our neighbors of course uh we do not intend to make anyone uncomfortable um this is the best uh we're trying to do so right now we've contacted the engineers that that this plan and we are trying to get that drainage to either be moved towards the back of the property and that would be to the back uh right side of the property that way uh it doesn't cause any trouble to our neighbors as well okay as long as it's addressed with however the engineer sees that it's the best place to put the water then okay all right thanks for stepping up Jim mhm any other questions comments seems fairly straightforward to me okay if not um I will ask for a motion to approve and the motion can uh if you agree with the sample motion you can you don't have to read all 10 of those you could just say conditions one through 10 in the staff reports if you don't want to read reread all those does that make anybody less shy yeah I'll make I have a motion it's based on the submitted petition testimony presented and findings of fact I move the Planning and Zoning commission forward its findings of fact and recommend to the
