So under the action items we have ordinance 202501 evaluation and appraisal of the report of the comprehensive plan amendment for the city of Daytona Beach Shores. Gwen, good morning board members. This is ordinance number 2025-01, an ordinance of the city of Daytona Beach Shores, Valuchia County, Florida, relating to comprehensive planning, enacting amendments to the city's comprehensive planning update 2030 to among other things, ensure consistency with the community planning act as set forth in the Florida statutes, providing for implementing administrative actions such as transmitt to the Florida Department of Commerce and other agencies of government, providing for severability, providing for conflict/ratification of prior actions, providing for instructions relative to codification, and providing an effective date.

chairman and board members. Good morning again. I'm Gwen Hurst, the beach tours city planner. This agenda item ordinance 2025-01 pertains to the evaluation and appraisal worker or EAR. This is an earbased comprehensive plan amendment which is required to be performed every seven years. this comp the comp plan and the land use the comp plan you probably know this but it's a land use some of you have heard this three times now probably um every seven years maybe not quite maybe just maybe just two this comp plan the comp plan is the land use policy document for municipalities in Florida it's a local it's the the local constitutional policy document the tenants of which are implemented through the land development code. Every seven years, we evaluate our comp plan. We want to ensure that it includes changes made over those previous seven years so our comp plan is consistent with Florida law. Director Cruz completed an analysis and through ordinance 2025-01 recommended the necessary updates. These updates were presented to the planning and zoning board on January 13th and approval was recommended. The city commission approved them at first reading on February 4th after which the prepared changes were transmitted to the state planning agency, the Florida Department of Commerce, and to other agencies like FDOT, um, FD, the Department of Education, and the St. John's River Water Management District. That analysis recommended extending the long range planning horizon to 2045 and included changes to
five of five of 12 of the chapters of the comp plan which are called elements. We received summary comments back from the Florida Department of Commerce on April 18th of this year when they return comments uh if they have any. And when I say comments, that's used loosely. Um um there are comments, there are objections, there are other ways that they can communicate how our plan met Florida statute. When we received that letter uh on April 18th, it's called an objections, recommendations, and comments report. We call it an ORC report for short. The ORP report contained one objection and two comments regarding the city's submission. And I'd like to take you through these and the staff's responses to them. As you've already recommended approval for all of the rest of the changes that were included in that first version of the ordinance that you saw, there was one objection which is mandatory to address before this ear can be approved. It required the comprehensive plan map series be updated and that means that it's updated to where we are today. Updates are made, the new data is is placed on it and it includes all sorts of things like annexations, um changes to um road classifications there. It's a whole map series and any changes over the last seven years that would affect those maps needed to be changed and were done. Staff's response included securing the assistance of the east central Florida regional planning council to make these updates to future land use element and the transportation
element maps by including like I said annex properties reflected reflecting road class changes etc. This is one example of all of the maps that were changed. Um, this map is called 2-1 major thoroughares by functional class. And this was updated. Two of the roads actually changed classification in the last seven years. And so this updated them um and made it official in our comp plan. After that objection, there was uh there were two comments made. Comment one from this ORC pertain to our lack of including in our comp plan a provision to conduct feasibility studies for developments of more than 50 lots with more than one septic tank per acre. Uh though we don't have any developments fitting this description a current or current or potential any any um current potential for such development. We have recommended one objective and two supporting policies should we be in such a position in the future. Also, and this is a what you can see on your screen is the objective and the two policies outlined in that fuzzed yellow area that we've simply added. Um, is it possible that we could be in such a position to need that objective and policies in the future? Yes. And so this satisfies the state um and make sure that if something does change and we are in a position to meet that objective and policies, they're already in place. A statement acknowledging this was also
added to page four of our DIA and that is um and also you can see it on page 41 of 110 of your hearing packet. The DIA, if you have not heard that in a while, is the data inventory and analysis. And it informs, basically, it's data that's compiled and analyzed and that informs all of the goals, objectives, and policies in our conflict. The second comment pertains to updating the city's water supply facilities work plan in the public facilities element of the comp plan. So it they wanted us to update the city's water supply facilities work plan in the public facilities element of the comp plan. The Florida statutes require that we updated it that we update it through 2034. We currently have agreements from our water suppliers through 2033. So that made that an interesting um um there are a couple different ways that that could be approached. Director Cruz extrapolated the available data and indicated such in the comp plan and uh and we have been advised that that there won't be objections from St. John's River Water Management Group who would be the one who would weigh in primarily for objections to such.
Excuse me. Our two water sources are the city of Port Orange and Daytona Beach. Correct. And we split our city twothird of it we get it from Port Orange and one third from Daytona Beach. Is that about right approximately? Okay, that's correct. All right, just for confirmation. The split line is about in the middle, but you're correct as to the distribution. Absolutely. This summary slide shows that when approved, these changes along with those approved in February will total six of 12 chapters updated, three of 46 objectives, and 19 of the 203 policies in the comp plan. As updated, our comprehensive plan will be consistent with Florida planning law and general planning law and staff is recommending approval as presented. Any questions? Thank you, Quinn. I noticed through there's reference to Beach Off Street. we have an elaboration that you could give us on that?
That was uh basically a change that was recommended back uh when you saw it in January. It was initially recommended and my understanding of it is that it allowed public land and quasi public land to be used for offbeat parking spaces. And it was so it it was a change and we can talk about exactly where if you'd like chapter five, the coastal management element amended the policy to remove basically outdated community redevelopment area of off- beach parking and replace it with a commitment instead of instead of basically um it basically committed to maintaining existing off-beat parking spaces rather than adding more.
Mr. Chair, I may add that particular amendment was um to eliminate a mandate that was required by the county while we when we had the CRA. So, in order for the CE city to get the CRA back in 20067 or whatever it was, the the county obligated the city to provide 500 off each parking spaces, but because the CRA doesn't exist anymore, there's no need to have that mandate. But the city is committed in as the city mentioned to maintain the existing ones that we have. So, it doesn't mean that a couple of the existing parks that we have, we're going to convert them into parking. That that's not is not what that says, right?
That's not what that commitment is at all. Okay, I that was my only concern. The first thing that came to mind was a couple of parks that are we committing to turn them into parking lots. That was my concern. That is not at all what that commitment states. It basically says what we have established through that commitment u in in the CR when we had the CRA that we will maintain those and not eliminate them.
Are those locations we share with the county? are those locations. Now, these are all referring specifically to ones within the city of Daytona Beach Shores that are not on county land. The county does have two parks in Daytona Beach Shores, but these are referring specifically to off beach parking both in the parks and adjacent to to some businesses. um places where we reclaimed um extra wide um rights of way to establish off- beach parking spaces. So not not only shared with the county. No, these are we don't maintain those. We do, but that's a whole separate entity. This commitment was about strictly non-county Daytona Beach Shores land. Just a question then. If somebody's going to the beach and they want to park there, is there a way to control that at all if they've parked there? And have you um had to have cars removed from our park areas?
So, it's an interesting question. We have uh recently um placed signage regarding specific hours where you know when people can park in places especially at those places where it was becoming an issue where people were parking overnight or leaving vehicles etc. Um, and we do have an agreement now with a um with a company who will tow, but they will tow not based on um driving around and trying to find cars that they can tow, but based on phone calls um that staff has noticed vehicles are staying beyond the time frames allowed on those signs.
Thank you, Mr. I don't want to go, but just to add a little bit more information, the city does not charge for office parking. sure if that's where you're trying to um to go. So essentially any anyone can park in the city off beach parking spaces uh during daytime hours and it will not be Okay. Thank you. Thank you. Any other questions?
I I do have a question concerning um affordable housing. Are we in because there's been some questions concerning the Florida statue to make sure that every city has a portion of affordable housing. Are do we comply with that Florida uh statute for affordable housing in the city of Daytona Beach Shores?
Yes. So there there there are different moving parts in the requirements in the Florida statues for housing for affordable housing. What I can tell you is that the city of the human shores um uh meets whatever requirements that chapter 163 requires for housing. Um you might remember um that the city of the shores relatively unique in terms of our geographic and demographics. Um but after the analysis that we conducted originally back in January for the first amendment that we proposed we transmitted um you know all the requirements were met and that's the reason why when the FDC proposed or or provided the made the objections review and comments report that the city planner just mentioned. There was no comment absolutely no comments about affordable housing if we had not met any of those requirements. That would have been a comment or or an actual objection.

So um board member Rosenor um thank you so much. I've worked with you for such a long time. We've had personal conversations on the side, you know, officially and all that, and you've been um such a pleasure to work with. So, I really thank you from the bottom of my heart from staff and from the city's perspective. But officially, the formal and and all those other uh uh nice cities will be presented on the 23rd. So, um I hope to see all of you there.
