It is on the agenda, but it needs to be voted on to be put back on there because we tabled it. It's a variance request uh for five acres at 170 Hendricks Lane. Evening everyone. Um Nicholas Northcut. I am representing the Hendricks on this and um basically the long and short is on this is the Hendrises are seeking a variance on the 5 acre minimum to be able to carve off one acre um for his son to build uh roughly in the area that I've got highlighted. Um there's a pond kind of there in that little wooded area on the east line and they're wanting to cut an acre off and put his house up behind that pond and then uh access it with an easement. Um so they're hoping to be able to get the variance as they're going to be uh carving it off and conveying it to family. So, um,
um, he really didn't want to have to do the five acres and and so they're seeking y'all's approval to be able to carve an acre off in that field back there. Why is he wanting to do an easement instead of a right or giving him um direct a direct driveway to that? They they Oh, pardon me. Oh, go ahead. So, I'm actually going to give him rope frontage 50 foot and go ahead and just let him go all the way back. But the stipulation is in the writing for me giving it to him is he's got to if anything happens to my father-in-law or anything, it comes back to me. No selling it, no nothing. Okay?
We're putting it in the language for lawyer, however, however we got to do it that it comes back to me because he's going to help us with our our kids and help us bush hoging and farm animals and all this other stuff. Wow. Me and my wife work full-time, so we don't have any daycare. So, we're taking care of our daughter by herself and our son and we don't have no help. So, he got to drive an hour down here to help me bush hog, mow, and all this stuff. So, it's much easier for him to just be on the property, step out the door, go help bush hog, take care of the cattle, take care of the goat, take care of the chickens, rather than driving an hour from Murphy'sboro, getting stuck in traffic. And who knows what happens on 24. I drive it every day going 11. Yeah.
And that traffic's crazy. So, we're hoping to get him in Manchester, carve out the land and so he can live here and help us with the grandkids and but but the question I have is why why are you doing an easement instead of giving I'm going to give him road frontage? You're going to give him road frontage 50 foot? Yes. Okay. Alongside the house right there that says 2701 I believe right along that going straight back right behind that little pond is right here. Yes, that's correct. Okay. And he'll be there's a fence row and right before that fence row, it's going to be acre to acre and a half because of the given 50 foot of road frontage.
So this is your father-in-law, not your Okay. I thought he said okay. I was thinking. Okay. It's your father-in-law. So in the deed when he passes the land reverts back to you. I don't want to do the five acres. Understand? because I worked my whole life to get all this land and now it's just me and my wife are having kids and we need help. We don't want to do daycare because one we can't afford daycare no more. So that's the reason why we're trying to carve out just anger anger have his plan is to sell his house in Murboro move down here build a small house where he's debtree and hopefully can retire without any issues and that's his family.
Yes. So, so on this map right here, you'll take and come up 50 foot right here and then cut over down that 50 foot. Right. It don't matter where he drives. Yeah, I I get that. But but the 50 foot access would be right there. Correct. Yeah. Right where that two blue lines are. Right in that area. Okay. Well, then you would landlock this is what the problem is. But that's going to be his too. I'm cutting out all that because like you said landlock. I'm going to cut out all that and his house will be all right. I I just wanted to clarify that. So that way we didn't create a future problem.
No. And that's one reason why we didn't do the thought about doing the other easement. That way I knew he couldn't do nothing. But we're just going to go ahead and put in language that it reverts back to us if anything does happen. Is there anybody here to speak on the other side? Like I said, he just trying to get him down here because he's the only family we have in Middle Tennessee. We're from West Tennessee. We moved up here in 2017 and I worked at Nissan for a little bit and then I went to another job and living in. So, that's one reason why he's our only family we have up here. Don't have any other family up here. So, he's the only one that can help. Okay. Well, since this is Yeah, this is his family and and the verbiage is going to go into the deed that way, I make the motion that we accept this variance because it's family and it's going to be deed. It'll come back to him and I'll second.

We started this project in March. He sold the north property to Mr. Bro, his neighbor, 40 something acres. He'd have kept enough if we knew, but we turned it in a day late when the rules changed, but nobody told told us, you know, we tried to got in there earlier, but we can, you know, if we need acre, we get it, but you couldn't use this straight off hollow. So, he just likes a little he his house is the brick house, and he's he sold that land. And he wants to buy a new double wide
and put it on that other piece for him and his wife to live out the rest of their life. A lot too. Yeah. Okay. And he's got two soil sites. Got one in a backup. Okay. And I understand he just going he's not going to rent that house out. It's just storage. He's I think he's got a lot of stuff in it already. So this is going to be the new area right here. This is existing house. The double wide to set just off back of that one soil sight cuz right behind there it starts dropping off quick. It's hillside. It does. It's bluff. And you see that pipe down there we got in there? You can walk. You can stand up and walk through that. That's how big that is. And you say the house that he's not going to rent out. Not going to No, he's just got it full of stuff.
The best I remember. Now, help me remember this. He said that the house was the dipated. Yeah. It's in bad shape. It's in bad. And he sold that land buy. He's done bought the double wide. Yeah. Yeah. I'm here to ask for an exception uh for the zoning. I currently run a uh an online business. I do vehicle antique and classic vehicle title acquisition. And I do that for people actually nationwide. Um the state of Tennessee because of the quantity of titles I was doing has asked me to obtain an auto dealer's license. Uh to do that uh I want to continue to run it out of my house. I do not sell cars. I do not buy cars. I strictly do title acquisition, but I still am required by the state of Tennessee to have a auto dealer's license. So uh in their guidelines paragraph three says I have to have a zoning compliance uh in which the address must be reflected in the letter and the letter must state that automo automobile sales are a permitted use and again I want to stress that I I don't sell cars. I don't plan to sell cars. I just do title acquisition.
So So there won't be any traffic in there will be no there's no traffic. It's all online. I'm sorry. Is it all online most? It's online on my phone or through the US mail because we have papers we send back and forth and whatever and of course through the title bureau up here in Coffee County, but there'll be no no vehicle traffic, no pedestrian traffic, nothing like that. You're generating taxes for Coffee County, too.

Will they make your building commercial? Will it change to commercial zoning? This the uh state's not really asking me for that. I have their whole list of minimum requirements and it's not in there. There's a few things I have to obtain a license, but you know, I'll whatever I have to do through the county to obtain license and tax license and whatever. This license that you've already gotten or you're pursuing? No, sir, I'm pursuing it. What is the uh what's the cost on this? uh through the state. I'm not sure yet. I guess I depends on they'll adjust whatever my volume is temporary use. Yeah.

Um or if you require yard more more than your yard for the open space and you won't

I'm wanting to get I think it's a little bit less than two and a half acres for my house and my husband passed and I'm trying to settle his estate and I have to divide it with my son and my grandson and I don't have cash to be handed them. So I'm hoping, you know, to use property that we have to be the greater portion of what I have to divide. I don't know if there's anything else you need to know. I left I thought I left u something with the lady in the office next door of the
pictures or uh a drawing or something. I didn't remember to check and see. I should have had another copy, but I forgot to see about picking it up. See if it's in our packet here. There's the application.

But uh we went and um made a few recommendations and they they made their recommendations were accepted
and there may be more coming down the line, but um they said, you know, we got to go. What is what Steve tell you that they wanted to only do two or three at a time so that it don't confuse? It takes a little while to explain to people, especially if you're not involved in the zonings and the in the codes and stuff. So that way they don't feel like they're being hoodwinkedked or anything straight up. And that way people, are you on the planning commission? No, sir. No, sir. Anna is Oh, you are? Okay. I think they only had one objection which was a comment about um using your land freely and I guess that that was the only section that somebody objected to like you know the comment was made. Well, it kind of varies to everyone what freely means and I think that was the only comment that was you know questioned. So I think they were considering about making an amendment about that change to the to that section or uh other than that there was I mean um there was no other opposition.
I was asked uh recently by an individual who has a parcel of property quite a quite a quite a number of acres and he said lower what I've really got on my mind doing is going down on a nice road is going down and selling one acre lots and then I'll come in behind and this 70 acres back here in the back. I'm I'm going to keep on farming that. Can I do that? And I said, I really can't answer that right now. Not at this present time. He can't do what? Not at this present time. He cannot.
If it's an A1. Yes. But if it's in the UGB, yes or he can or or RS4. Yeah. Depending on where he's located at now. If he's in agriculture one, he can't right now. Okay. But and they're working on that for plans and stuff. Planning commission is Well, I just they encourage each and all of us to use some common sense as we go down this road. Yeah. But I think a rapid we don't need to do it rapidly. We need to do it hastingly, but we don't need we need to think it out and think it through. Yeah.
I think a lot of counties are slowing down. Wilson counties was mentioned uh two days ago. Is it Murray County that's having problem with water? Spring Hill 1.9 billion with a B to pull water from the Cumberland River to Spring Hill. Take that shot in the head. Colombia is also an issue. So what they're going to do is soak our lake dry. Normandy is the only watershed for them right now. Columbia.
Uhhuh. And and if the the TVA gave back the land to TWWR, my understanding of this is TWWRA now owns the Colombia Dam land that was taken by imminent domain. And under Tennessee code annotated, if TWWRA gives up land, it has to be purchased by the state of Tennessee to somewhere else. So if they go back in and try to build the Colombia dam and take that acreage away from DWR, states on the hook to pay for that land, right?
But I couldn't be imagine being on the hook for 1.9 billion. Not with a M, it's with a B. And that's today. If they were to start today, that's what it would cost. I don't think that there would be that much growth to ever justify paying for it. That would be they're going to have to come up with something because they're going to rob our lake. Yeah.
And and to me, they have taken a lot of people land around here and they've made a lake with it and it should be for recreation and for water. Uh, but you going to get me off on a tangent, but I if we're in a like now we're pulling a lake down now. The lake's 3 foot below summer pool where it should be sitting. Um, you shouldn't be watering your garden. You shouldn't be washing your cars. Colombia shouldn't be doing anything cuz to me, we're the head of the water and uh I don't know. It's it's going to be something that our children are going to have to stay on top of because water is just going to be a precious commodity.
Manchester City got a grant the other day for $2 million to rehab some of the sewer. Uh I know they're getting in trouble for illeg. It's not illegal, but blowbyss that contaminate Normandy Lake and there's just raw sewage sometimes that runs in there. So, it's going to be a problem for all of and then that's where growth is coming, but how do you manage that? Do you leave your kids on the hook with a huge bill at the end when we're all or my people my age are gone and then look back and think about how foolish we were. So, l the long answer to what you just said.
It's a it's not quite as simple as just saying, hey, you do whatever you want to with your property. is everybody else is paying for these resources and we got to figure out how to manage that money and be able to get those resources to people when they need them.
