Okay, we'll call the meeting of the Board of Zoning Appeals June 18th, 2026 to order. Has everyone had a chance to approve the minutes of last meeting?

0:31Speaker 5

I'll make a motion we approve the minutes.

0:33Speaker 3

I'll second.

0:34 – 1:00Speaker 4

Motion to approve and second the minutes. All in favor say aye. Aye. Opposed? Moving on to the next item, approval of the agenda. On our agenda, we have our last item on our agenda been deferred to July. Anything else that needs to be changed? Do I hear a motion to approve the agenda?

1:01Speaker 6

I'll make a motion to approve.

1:02 – 1:36Speaker 4

And I'll second. Motion been made and approved, or seconded. All in favor, say aye. Aye. Any opposed? First item on the agenda, special question, a five acre minimum in an A1 zone, 86 Cruise Hall Road, Margaret Johnson. Is anyone here to speak on that? Okay. Who would like to speak for her or tell us what you really want to do?

1:40 – 2:49Speaker 7

Yes, my name is Mark Patton. I'm the neighbor of Margaret Johnson. I own the property 8.01 up there on the map, on the other side of Antioch, Church of Christ from her. And for years, Margaret was going to leave me her property at the time that she's no longer with us. And because I've been pretty much taking care of her for years, and she was my mom's best friend. Mom, before she passed away, she asked me to do that. So I've been upholding it. And her granddaughter moved back in with her here a while back, and I think she needs to have the trailer and about an acre of property right there to where, for taking care of her. We have to get it surveyed in order to get it laid out right, but I'm in the process of getting the property right now from her. I'm getting all the surveyors set up and the lawyer to draw it up and everything.

2:49Speaker 3

Okay, if this goes through, what's your plans for your four acres?

2:57 – 3:50Speaker 7

I'm going to keep it because see, it joins on the backside of me right there, and I might fence it up so I could run cattle on it. My mother and father used to own 8.04 and 8.05 years ago, and they sold it off at auction, and then the guy split it up, and it was not the verbal agreement they had at the day of the auction, but he split it up, and... I kind of want that property because it was for Margaret and everything, something to remember her by. I'm more sentimental than a lot of people. I believe the wishes of the elderly or the retiree people are to be fulfilled. Well, thank you. I mean, I have morals to me, and we've lost that these days.

3:51Speaker 3

That existing one-acre lot that's got the mobile home on it, does it satisfy all the setback requirements, or do you know?

3:59 – 4:30Speaker 7

I'm not for sure on that, but I'm thinking it does because I think everything is in order. It's like 25 feet off the property lines each end, I think it is. It's off the road the correct distance. The septic tank runs out the back because it's on a slope. The well is out front, so there's no contamination that could come to the well from that. I'm thinking it falls under everything correctly, as far as I've been told. But I ain't got no...

4:30Speaker 4

In that area, of course, it's A1. How long was this trailer put in there?

4:36Speaker 7

It was put in in 99.

4:38 – 5:10Speaker 4

Okay. Before... codes and now in that area it's 50 50 50 so the side setbacks we can't do nothing about if we could be sure it's 50 feet from the residents back when you do your survey oh yeah it's over 50 feet from the road no no in the back your property line they at least have a 50 foot setback okay wherever you are you're lying here needs to be 50 feet back see where the hand is here yeah it needs to be 50 feet back from the furthest point of this trailer right here

5:10Speaker 7

No problem.

5:11Speaker 4

I mean, that's one rule that we need to be sure we uphold. Okay. On that.

5:17Speaker 7

No problem.

5:21Speaker 4

Mr. Duke, you have another question?

5:24Speaker 3

No. No, that was good. I'll be glad to make a motion that we accept this, contingent upon it, and it satisfies the setback requirements. Okay.

5:36Speaker 5

I'll second that.

5:37 – 6:02Speaker 4

Motion's been made and properly seconded. We need to probably figure out where, which we need to quote here on our special questions. If that makes, and it meets the requirements.

6:09Speaker 6

Should we put our heat sheet in here first?

6:25Speaker 7

Can I approach the screen to show y'all some stuff about that property in question to help y'all?

6:31Speaker 4

We've got the motion to accept on the floor and to vote to accept it.

6:36Speaker 7

Just be quiet and accept. I did learn that from Jim Davenport sometimes in school.

6:44Speaker 3

Would that Roman numeral 2A1 or 2, either one, be acceptable in sitting?

6:53 – 7:17Speaker 4

I think it would be. So we're quoting amendment, special question, amendment 1, Roman numeral 2A1 and 2. And at 3, it also does. And no adverse impact. And four.

7:18Speaker 3

It seems like several of them would be acceptable.

7:21Speaker 4

It seems like they fit all criterias of the special question exemption.

7:31 – 7:44Speaker 3

I like that one, preferably, because it addresses the setbacks. Okay. That is. So if we could just contingent upon and the criteria for.

7:44Speaker 6

Is there any question about number three on the back, access and infrastructure?

7:51Speaker 4

Well, there is. It would be adding to his increase.

7:56Speaker 6

As long as he combined, yeah. Yeah, he would have to access through his lot now.

8:01 – 8:30Speaker 7

the way the property lays with it. Between me and the church right there, the yellow line, there's a holler right there. And behind the trailer, the property, the hill is so steep, it'd be incredible to build a road through there. But right behind my property, there's still a hilltop that goes down a little grade and goes to the long section back. So the best access is through my property.

8:30Speaker 5

Your property now. Yes. That's what we say. Okay.

8:35Speaker 7

It's kind of hard for people like a Hillsboro understand from 16th model because they ain't got the hills and hollers like we do.

8:42Speaker 6

That's actually why I brought that up. My grandparents' farm was adjacent to this. That big field there to the right of it, that's actually my grandparents' old farm.

8:51Speaker 7

Kenneth and Laverne.

8:53Speaker 6

Myrtle and Ivy Bush.

8:54Speaker 7

Oh, yeah. I forgot. They were good people.

8:58Speaker 6

Their house was right here on that top right there in front of that apple tree.

9:04Speaker 7

I'll tell you one thing. I never would shoot pool against him, though. He's good.

9:09Speaker 4

Is there anyone else that would like, anything else you got, Mark?

9:14 – 9:36Speaker 4

Is there anybody else that would like to make a discussion, comment on this? Okay, seeing none. We have a motion on the floor made by Mr. Duke, seconded by Mr. Tim. All in favor say aye. Aye. Any opposed? It passes. Okay.

9:38 – 10:04Speaker 4

Thank you. Next item on the agenda, special question, five-acre minimum in A14741 Cathy Ridge Road. Strasser, did I pronounce that right? Yes, you did. Okay. Hello. Hello.

10:06 – 11:20Speaker 1

What you can see on the screen is our house is in the center of the purple. And up in the top corner of the purple, it's kind of blended in, is our daughter's house. And our daughter moved here from Las Vegas after getting out of the Air Force. She's disabled Air Force. and her husband and her three kids we built that trailer for them it's it's a manufactured home so it's a it's a newer 2021 i believe so they've been living in it since then and um when was this when did you say 2021 i see when we put that in everything's permitted we did it all with septic and everything And now they've been approved by the VA, but for a very low amount, which they're not going to be able to buy a house anywhere. So we would like to sell them where they've been living. Plus I love having my grandkids close. So we would like to, and it's a natural line where their fence is right now and where they've been living and just take that little corner out of our property for them.

11:21Speaker 5

Do y'all have the metal truck sitting out in the driveway?

11:24Speaker 1

No, that's Harris Place.

11:27Speaker 4

Marshall Harris' son.

11:29Speaker 6

Okay. I think it's the property next door. Okay.

11:35Speaker 4

You would like to take how many acres?

11:38Speaker 1

It's going to be somewhere between one and two. The surveyor came out already, and we're doing natural lines around the fence that's already there.

11:46Speaker 2

The fence that's there is 1.25.

11:50Speaker 1

We're going to extend it out a little bit more because they're crowded in their garden.

11:54Speaker 4

The larger would be better because in that A1 area, the bigger that you can get would be better.

12:01Speaker 1

Yeah, I think it's going to be closer to two.

12:04Speaker 4

I understand.

12:09Speaker 6

Is this the same daughter that got married on the property? Did you have a daughter get married on the property?

12:16 – 12:28Speaker 1

That was our son. Your son? Yes. In fact, they're about to have a baby, and we almost have them convinced to move back. Of course, they like living in Nashville, but that's still closer than Colorado.

12:30Speaker 2

How'd you know about that? They probably catered to that.

12:36Speaker 3

He does everything.

12:37Speaker 6

Was your food really good?

12:41Speaker 5

Whiskey trail, man. The old dairy barn's across the road, isn't it? The old dairy barn's across the road right there.

12:46Speaker 6

Yeah, it is. Yeah. Right there. Yep.

12:50Speaker 3

Yeah, they said they used to milk cows. Uh-huh. They sure did. Yep. They got some beehives scattered around it.

12:56 – 13:18Speaker 5

That's Travis's. Yep. Travis Heatherly. Mm-hmm. I taught him. He was a young man. He came up through my classroom. Does that have to go into the special question or not?

13:22 – 13:41Speaker 4

I think we can do it under special question also because the five acre minimum. And we can also quote the variance for family variance if you would like.

13:43 – 14:01Speaker 5

Well, I make the motion we approve it. And I will say Roman numeral number two, number two, and three and four. No adverse effect in access and infrastructure is right there. Y'all are on city water.

14:01Speaker 2

Mm-hmm. Yep.

14:03Speaker 5

Mm-hmm. four inch water line, wish it was a six, but y'all may have a six inch water line. Four? Yeah, four, yep, okay.

14:10Speaker 7

So, Roman numeral two, number three, four,

14:34Speaker 5

Two, three, and four. Two, three, and four.

14:37 – 15:02Speaker 4

And it's been seconded by Anna. Y'all have any further discussion on this? Is there anybody else that would like to speak on this or talk about it or make a public comment? Seeing none, y'all, any other discussion?

15:04Speaker 4

All in favor, say aye. Aye. Those opposed? None.

15:10Speaker 1

Passes. Thank you.

15:12 – 15:31Speaker 4

Now, what you probably need to do is get with the office over here, Kirk and My mind's blank. Sandy. Sandy, sometime tomorrow, and she'll be aware of all this that's happened, and you can start going down that road.

15:32Speaker 4

And congratulations. I hope everything works out for both of y'all.

15:37Speaker 4

You're welcome.

15:40Speaker 6

Sammy, I see there's more people in the audience, and I'm wondering if they may be here for that.

15:43 – 15:55Speaker 4

Do y'all have something? We were here for the deer trace thing. Okay, that has been postponed until July. We just found out about it today. We got an updated minutes.

15:55Speaker 7

Well, I thought that's what y'all said. Very beginning.

15:59 – 16:12Speaker 4

Yeah. Yes, sir. And I appreciate you not interrupting. Thank you very much. But that's when that will be handled. And any other business?

16:13Speaker 5

Motion to adjourn.

16:14Speaker 4

Motion to adjourn. Suck anybody in it.

16:19 – 16:37Speaker 5

Thank y'all. I don't know if they will send y'all another letter. Did y'all get a letter or not? Okay, I don't know if they will or not, but on Coffey County government website, you can find our calendar down there.

16:37Speaker 6

You can also search the Coffey County Agenda Center. And you can look for the Board of Zoning Appeals in that pull-down, and it'll show you all those, too.

16:46Speaker 4

So the exact date is set?

16:50Speaker 6

It's the third? It's always the third Thursday. Third Thursday.

16:55Speaker 4

Whatever day that is.

16:57Speaker 3

The date's changed, but it's the third Thursday. Appreciate it.

17:01Speaker 4

Thank you. Sorry.
