These are companion items, so I'll read through them all first. Item 14. It's a plan amendment to redesignate the existing lineage category from business employment to outlying neighborhood on 1.28.1 acres, generally located west of Moapa Valley and south of Wildlife Road alignment within Moapa Valley. Item 15. Zone changes for the following. One, reclassify one acre from RS40, residential single family 40 zone, to an RS80, residential single family 80 zone. And two, reclassify 50.03 acres from IL, industrial light zone, to RS80, residential single family 80 zone on a portion of a 128.1 acre site. generally located west of Moapa Valley Boulevard and south of Wildlife Road, alignment within Moapa Valley. Item 16, vacate and abandon a portion of right-of-way, being an unnamed street located between Moapa Valley Boulevard and Saddle Street alignment within Moapa Valley. Descript... Sorry. And then item 17, is a use permit for mining and extraction, waivers of development standards for the following. One, reduce gross lot size. Two, reduce net lot size. Three, increase building height. This request is for the Simplot Mine, which is out in Moapa Valley and has been out there for almost 100 years. Actually, the mine is further outlying from this area, and this is the area where they actually process the silica. They load it onto train cars, and then there's a railroad spur that they load it onto, and it gets transported elsewhere. And this all started when they went in for a temporary building, which is like a membrane building, because when the wind blows, and as you know, in Southern Nevada, the wind blows quite a bit, the silica would blow all over, and we weren't being very good neighbors. So it would blow onto the neighboring property. So we went in and requested the membrane buildings, and then that sort of opened a whole can of worms. It turns out that the... Again, the mine's been out there and the property's been owned by Simplot since 1928, so almost 98 years, almost 100 years. But as people have decided they wanted to move out or sell their homes or relocate, they came to the mine and asked them if they'd like to purchase it, so they did. So they've accumulated property around them, but they didn't go back and get a use permit. And again, the mine's been out there since before zoning even existed in Clark County. So when we went to get the permits for the buildings, the fire department authorized us to have a temporary building, but in order for us to have permanent, we have to have permanent zoning. And so we thought it would be best if we master-planned it all for residential because in most of Clark County, most of the mines are actually in what used to be the RU zone. It's now the RS-80. So we're master-planning at RS-80 with a use permit for the mine. Really what we have our concern is about is on agenda item 16 and 17, and that's where staff has asked us for a drainage study. We're not changing anything, we're not adding anything, we're not grading anything. And so for us to do the drainage study, which would take quite a few months, one either to prepare and then get approved, that holds us up and fire department will extend our temporary permits these structures on the site to keep the silica from blowing on our neighbors and away from our site. So we're happy to any condition that in the future if we do any major construction or any building, and I don't know how you would word that, but we happy if we're gonna actually build something, change something, grade something, do something different, then we'll be happy to do a drainage study. But we just, we can't get our permanent permit on the site without, with the drainage study condition. So with that, we ask for approval. Sands, that condition.

So this is a mine. This is for storage of mining materials, in this case, silica sand. And you want to leave every structure in place which are really not structures. Maybe if you could just flash some of those photos I saw earlier about what is on the site.
Okay, and overhead, this is what started it all, whatever the temporary membrane structures to keep the silica.
Right, we'll end with that. So just show us the site right now.
The site is, this is the equipment where they, This is not really in my wheelhouse, but this is apparently where they bring the silica to the site and then they load it and they transfer it over to train cars and then it's taken off. And I don't know the year that these were out there, but they've been out there for quite a few years. So we're not grading, changing anything, not adding any new equipment. The only thing that is new is the temporary structures. And then there's, you know, there's some houses that were there that were acquired. And then there's like some warehouse. This is like their main office. We had a neighborhood meeting in the area and that's where we had it in the main structure, in the main office. But for the most part, it's really just mining equipment.
Okay. So go back to that arched structure you guys are proposing. So this structure here is a glorified Rain fly to protect the courts silica sand that you've piled up correct. there's it would appear to me that there's no finished floor elevation defined by concrete, as would normally be. expected in a habitable structure with doors and windows which is typically what we are looking for on a drainage study to elevate finished floor to protect life safety of people that uh either are working in it or living in it in this case this is again a glorified tent over a pile of sand um so you know uh this vacation and then the subsequent use permit i don't see a need for a drainage study right now i would i would probably add a condition that in the future anything of habitable building with the finished floor uh that the whole site be evaluated with the drainage study but right now um i don't see it near Any regional flood control master plan facility or even a regional facility? So, Mr. Chairman, I'll hold off if there's any other questions, but I'm ready to make a motion.
And if I might add, we still have to go to the county commission in about a month, and we're happy to work with staff and see if we can address what their concerns are with regard to the drainage.

One, increase the area of electronic message unit, static sign, and two, increase the number of freestanding signs in conjunction with an existing shopping center on 25.59 acres in a CG commercial general zone generally located south of Silverado Ranch Boulevard and west of Eastern Avenue within Enterprise.
Good evening, Lexa Green, 1980 Festival Plaza Drive, here on behalf of the applicant, who is Silverado Ranch Plaza. This application is a request for a sign design review. The subject site is over 25 acres. We're located on the southwest corner of Silverado Ranch to the north, and then we have Eastern Avenue to the east. The site is Master Plan CM with a zoning designation of CG. We are proposing a freestanding sign in this northeast corner of the site. Currently existing on the site is a pylon sign that is at the eastern entrance. Currently sits back 123 feet from eastern, so you lack visibility of that sign when you're driving down eastern. If you can see here, it kind of gets lost in the traffic and landscaping and also the other buildings. You can't really make out what those tenants are. So with that, we are proposing and requesting a second freestanding sign. It will consist of an LED screen that will be an addition to this existing Silverado Ranch portion at the bottom for a total of 310 square feet. It'll be static, so it'll be a certain time limit for each portion. display and it'll rotate and it's strategically angled towards the center of that intersection to not impact their residential neighbors around there so in addition to there is a automatic dimmer so it'll dim in the evening times and just based on weather conditions it'll also factor in that natural lighting as well so based on that i thank you all for your time and consideration and i'm here to answer any questions you may have

Good evening. Erin Ben-Samakan for the applicant, 5600 Boulder Highway. Okay. So this property is at 5660 Boulder Highway. Our owner, Mr. Brennan, has owned the property since the 70s. It used to be a bait and tackle store and a bar. About five years ago, we did close the building down due to safety concerns and liability concerns. We have been looking for alternate uses for the property in the last five years. The adjacent property, Sportsman's Royal Manor, is also commonly owned by us and managed, and we have very proudly made it a very quiet, safe area of Chop and Boulder, trying to keep it that way. So we've been looking for alternate uses. A few years ago, we came in looking to put storage units and that was approved at the town board level. But due to construction costs and the over absorption of storage units in the area, we decided to hold off on that. So this brings us to this evening. We are looking at a business that we have entered into a franchise contract. It's called Cool Bins. It is not in Las Vegas. We would be bringing the entire valley or we would own the entire region. and they are portable, I'll show you a picture, portable storage units, kind of like a pod, but they have AC units. So this is the map of the area. The office would be at the building, so we'd have the office at 5660 Boulder, and we are asking for an outdoor storage and display so that we can display the units inside the fence, but along Boulder Highway, They're vinyl wrapped. They're really nice. They're brand new. And basically, they would be out for rent in the valley. So they would only be on the site when they're not rented unless customers want to store them there. But our goal is to have them out for rent. So our goal is not to have them on the site. We do have room, though, if they want to store them. We do also feel that our tenants at the adjacent property could use them as well. So we are just trying to find a business that has low impact, low crime, Monday through Friday, eight to five. We're trying to use all the existing improvements that are there. So that is why we're asking for the fence to stay. We have a very expensive wrought iron fence that is not screened currently that we'd like to use. The building, we have been gutting to renovate it. We'll put new signage. We want it to look nice because we also own the property next door, so we're not trying to make it not look nice. We have 24-hour security on site that would also be checking out the property at night, and our staff would be managing it as well. So I'm here for any questions.

So if you're moving, we can deliver the pod to your driveway. You fill it in, you fill it up, and then we would deliver it to your new home. But if you're not ready to move yet, we would store it for you.
And how long will you store it for?
There's no maximum or minimum time.
So I can order one, fill it up, and tell you to come and pick it up, and then you're going to charge me to keep it there? Yes, ma'am. Correct. So there's kind of two uses to the model. One, renting the pods, and that's that. And then there's also the pod and the... Property. Yes, ma'am. Yes. Okay. My other question is, you said a wrought iron fence. Do you have a photo of that? Yes.
Let me find that here. You can kind of see a part of it right here. The fence is completely all along Boulder Highway right now and Tropicana. It goes around the entire Sportsman's and... it goes all the way down boulder it's already been there and it was very expensive so we're trying to keep it and it looks really nice we think so we keep it up we paint it we keep it nice so that's why it does not have any screening that's why we're asking for a waiver on that
So your fence, it's not just part of that cool bins, but it's along your other businesses, you said, right?
Yes, it's completely fenced in, but this property also is fenced in. You can kind of see here, there's a front gate. There's also a fence to block it from our apartments, so it is its own section.
So it's kind of uniform throughout your businesses?

Just so I'm clear, this is kind of like a mini-warehouse. except they're individual. Am I correct? It's not like in a building where you have overhead doors that go up and down and you can put your stuff in?
Right. These are completely individual. Here I have a picture of them. They have a couple different units. I just was talking more about the... There's also a freezer unit. There's a concession stand unit. There's a flex unit, like for a construction site. So there's four different types, but the majority will be the pod type of unit with an AC for residential.
Okay, so you have other models that it can be utilized for? Yes, ma'am.

So that's why we're asking for outdoor storage and display. We're going to display one of each. on Boulder Highway inside of our fence, and then if customers want to store them, they'll be stored there. Our goal is to have them out in the valley and not stored, but just in case we need both uses.
So they can always be seen from the street then?
Yes.
Okay, I'm not certain I like that part. I think we should have some sort of screening because then it looks, I don't know. That's my concern is that they're not screened. And I don't want them to look like a lot of pods like you see in people's driveways. And I don't know if that's the look we're gonna have when we're trying to revitalize and beautify Boulder Highway. So I don't know if that's the right way to go.
I will say our frontage has artificial turf and the wrought iron fence. We're only putting one of each type off of the fence. The rest will be set back.
But you'll be able to see them from the street.
when you're driving down Boulder Highway. So that is pretty quick, too, that people drive really fast down Boulder Highway.
I know, but I drive Boulder Highway quite a bit, and I see a lot of the stuff down there.
I think we also think they look really nice. They're brand-new, vinyl-wrapped. Okay.

I'm pretty okay with this. I hate to say it, but my concern is that people are going to try to live in these things, and they're air conditioned and climate controlled. And so although I am sympathetic to the idea that maybe it's not going to look so nice, or some people might not think that it looks nice, these pods, that putting a big wall around them may make securing having security there and making sure people aren't jumping the fence and living in there and trying to do stuff. We were talking about this with that compound we saw, whatever, last week or two weeks ago. So I would say I would be a little bit concerned about the security here and would really want, like you said, there was going to be 24-hour monitoring, like cameras, daytime hours, on-site security, like making sure that people aren't, you know, putting any people in these things, quite frankly. I know that sounds grim, but yeah.
We do have over 60 cameras on the site. The site right now with our apartments is 20 buildings. We do have over 60 cameras. We have 24-hour security, usually more than two guards roaming in a golf cart. They're going to be responsible for this site as well, because these are really expensive, so we don't want people stealing them or living in them. But like I said, our management has really learned what, you know, on Boulder Highway, how to navigate these things. We do have a lot of lighting on the site and in the area.
And maybe not just visual cameras, but audio cameras. So if someone's inside of one of those things and they're banging on it, I mean, I don't know. I don't know what people do on regular storage units. Maybe that doesn't get required, but those are my thoughts.

And I think I don't have a problem with it as long as the applicant is open to a two-year review. So that means that in two years after you get your permits to get going, that you'll come back before us so we can have a chance See what the neighbors have to say about your operation and see what kind of issues there have been if there have been anybody living in them There's been a lapse in security Those kind of things we'd need to review that so with that I will if long as you're okay with the to your review
I believe two years is better than none, so yes.

The homeowner engaged the services of a contractor to construct a carport It's our understanding that a neighbor nearby wanted to construct a similar shade structure and they may have started investigating the requirements. It's also our understanding that this may have somehow sparked a notice to the homeowner. As such, like the term says, buyer beware was emphasized in this case as the homeowner believed that all the permitting would be taken care of by the contractor. We are here to request the waivers mentioned, which are mainly setback requirements, setback waivers, and we recognize that if approved, there will be more requirements to address. As an example, we've already met with Clark County Fire Department, and they're okay with the carport, but they may likely require a firewall along the side perimeter. and we've already met with Clark County Building Department and they will likely require a structural wet seal review from a structural engineer saying that it's okay or retrofits may be needed to adequately make sure that the structure is sound and safe. And there might be other requirements as well, perhaps additional welds or a weld log. With that said, we're here to write something that we thought was moving in the right direction. But like I mentioned, buyer beware, and we're here to answer any questions you might have.

Good evening, Mr. Chairman, Commissioner, Stephanie Gronauer, 1980 Festival Plaza Drive. Here with me is Lexa Green. We've been tag teaming this application this evening. We are here with a very small infill parcel. If I could direct your attention to the overhead. This site is under two acres of property located at the corner of Grand Canyon and Serene Avenue. It's just to the south of Blue Diamond Road. It's a unique parcel because it really is infill. You can see everything around it has pretty much been developed out and is being developed to the south of it. Interestingly, the master plan on the property is corridor mixed use, which is the most intense commercial mixed-use zoning you could have on a piece of property, which really does not fit in the neighborhood. As you can see on this map, it's the one red dot in the entire area. On the corner, there is a Green Valley Grocery, actually, that I represented. This is at Blue Diamond in Grand Canyon, so there is some commercial zoning. on the corner and then up and down Blue Diamond you've got a ton of commercial obviously in this area so huge saturation of commercial in the area and this is just not the appropriate site for it so in looking at the property Summit Homes looked at what would make sense on a small two acre site from a residential standpoint and we're before you tonight with a townhome for sale townhome project Lexa is going to get into the details, but I do want to tell you we appreciate you holding the item at the last planning commission. The reason that we held it was to address some of the comments that came up at town board. There were no neighbors in opposition, but town board did have some good suggestions, so she'll walk through the changes that were made between town board and here, and then we're happy to answer any questions.
Good evening. So yes, as Stephanie said, we did hold this item to address some of the concerns that were brought up. So I do want to talk through some of those. One of the concerns was parking. To help address the parking, we did add two additional parking spaces here. Some additional up here just north of Lot 17, as well as two additional just north of Lot 6. So we're providing a total of 65 parking spaces where 58 are required. Additionally, we are... of meeting and exceeding open space requirements. So code requires 120 square feet per unit. We're providing just about 132 square feet per unit, so a total of 3,434 square feet of open space in addition to connectivity throughout the site. So as you can see, we have sidewalks along the site which then provide access to this open space area which was moved as one of our modifications. It was initially along the west sides of lots 22 through 26. We relocated it here to provide that buffer between those residents to the east. as well as to provide connectivity. This is a very walkable area with the detached sidewalks, so we're providing the detached sidewalks along the perimeter, which then provides safe access to the Blue Diamond Trail that's up to the north as well. So with that, we're also providing, within each of the 26 units, we'll have a minimum rear yard, private rear yard of 10 feet in addition to the open space that we're providing. As you all know, and we've discussed with you on other applications, code does allow a 10-foot driveway, which causes a lot of issues with residents attempting to park in those driveways with the cars hanging out into the streets and blocking the pedestrian access with the sidewalks. So we are coming in with a PUD to request the reduced driveway, which we feel is a benefit, versus the RS-2 and RMS. RM 18 standards that would be permitted here with the 10 foot driveway so Additionally in meeting with Commissioner Commissioner Brady Did request some more greenery so we are adding additional trees So we will be providing 34 trees where a total of 19 are required that's putting us at about 79% over what's required as far as the tree count goes so with that I thank you for your time and consideration and
Just real quick, because we had this discussion just a few weeks ago on the driveways, and I think it's important because Summit Homes, when they were making their revisions, I specifically said, do not come back with 10-foot driveways. The Planning Commission does not want 10-foot driveways. So the only way to do a five-foot driveway is with a PUD. So that's the reason for our PUD application, or one of the reasons for the PUD application. Also, if this were just a straight RM18 application, you wouldn't see those benefits that Lexa just walked through, which is the added parking space. All of these townhomes do have two-car garages, so they will have their own personal garages that they'll be able to park in, but then also 13 additional guest parking spaces. So about one per every two houses they'll have an additional guest parking space, which is not required if we didn't have the PUD and the flexibility to do that. Also, this open space here along Serene is internal to the community, so it is actually usable space. They'll probably put some benches and activate that space a little bit for dog areas or benches. So I did want to point that out because she mentioned the usable open space. But we think that this very much is compatible, more compatible with the area than the commercial mixed use. It would be a really intense use to put on this corner. There's all homes around it, so what can you do on two acres or less than two acres? It's difficult, but we think that this layout is a really positive layout for the neighborhood, for sale products, so it'll help the price points in the area or it won't hurt the price points in the area. We very much appreciate Public Works approving approval on the two of the three waivers. We worked closely with them on that. One of the waivers is impossible. You have to have the waiver to do townhomes in Clark County, so that's the reason for one, but the other two, they do support. We appreciate their support on those applications. So with that said, we're happy to answer any questions and we would ask for your approval.

Starter type homes have kids, and there really is no place before I get to play. While I appreciate the additional trees, I also think that if we lose a couple of lots, then you can at least try and build a community here. I understand it's only two acres. I understand that losing two lots will not pencil. I get that. but I just don't see any other benefits that this design is showing me. And so with that, I can, the plan amendment I can live with, the zone change I can live with, the PUD, no, design review, no. And so that's where I'm gonna probably land when we do our vote.
thank you much any other comments commissioner rickman um i i tend to agree with commissioner kolarski for certain and you on the plan amendment and the zone change i you know if the alternative some heavy commercial use there i just don't think that's going to fit in the neighborhood um you know i i'm looking at the walking path i see what's going on there like Like you said, they can follow that to the trail. I'm okay with the PUD. I don't have the same maybe fundamental problem with it generally or in this instance. So I could support that part of the application as well.

This improvement is going to be automotive related, which is compatible with the surrounding neighborhood. The construction is going to consist of three buildings. On the west side of the property, we are going to have US Auto Service, which does minor auto repairs. On the east side of the property we are planning to have auto sale and on the back side we are planning to have automobile related details. We are planning to have a loading bay over here on the front of the building property. in order to reduce the conflict on the ongoing traffic over here and also we are going to have 19 extra parking which is desirable for like auto sale businesses. So I'm glad to answer any other questions if you have.

Yeah, I have a problem with a couple of your waivers. The first one would be the reduced landscape. I happen to agree with comprehensive planning with staff's comments about reducing landscaping. I don't see why there's a need to do that. And number, waiver number four, I also agree with staff in regards to Lake Mead Boulevard and Arterial Street and high traffic street, and that would create stacking of vehicles. So I would not be able to support item 33.
Regarding the reduced landscaping, we have like 255 feet, almost 256 feet of frontage on Lake Mead, and we are just reducing landscaping from 10 feet to 5 feet only on almost 20 feet of that section. And also regarding the reduced drought depth, This property is not going to be a busy shopping center, so we are not going to have any heavy traffic in and out. So we believe that cars are not going to line up and go back to the Lake Mead Boulevard. That's why we think that 10 feet of throat depth will be sufficient. And also, if we look at the other adjacent properties, we are compatible with the orders. None of the auto sales and auto-related businesses have 75 feet. All of them are almost 10 feet.
They have 75 feet and you're requesting 10?
Yes. No, the requirement is 75. We are requesting 10.

We're kind of looking here on Google Maps, and I think you're right, there's like a ton of, auto stuff up and down the street um you know you'll have to get this through the board we're just going to recommend to them so they'll take a second look at that and if they have a problem with it you know this is we're just recommending on that one um i guess more of my issues may be on the i'm okay with the use permit and the vehicle sales for repair and maintenance um i tend to agree i don't know if reducing the landscaping on this is going to make that area you know if we're going to go and increase this and say okay let's put in this maybe more intense use and there's a lot of you know kind of run down cars i see on the neighborhood but we don't necessarily want to say oh because they're doing it let's do the same thing maybe we want to spruce it up a little bit so i think that's maybe one where i would say i don't know if we need that Increase maximum parking? I don't have a problem with increasing the parking, I don't think. Yeah, I guess for me it would be the reduced landscape and the loading space within the front setback, right? So like if we were to say to them, yeah, sure, put your auto repairs and retail sales place here, we have no problem with that. Our comment probably would be, turn the bays inside right which may reduce the parking because they would have to figure that out on the inside um and put in the street landscaping which would probably blow up these waivers so I think, again, I don't know if that's a hill I would die on either, but I think those are probably my thoughts is that I'm fine with the zone change. Again, just to repeat myself, I'm fine with the plan amendment and the zone change, and maybe we could work a little bit more before this goes to the big board on the design kind of aspects of it.

So name and address for the record. Tell us about your applications. Good evening. Mark Mulhall, 1980 Festival Plaza Drive here on behalf of the applicant. So as mentioned, the site is approximately 14.92 acres located at the northwest corner of Dean Martin Drive and Silverado Ranch Boulevard, indicated in yellow. The green portion is going to be reserved for future commercial development and is not a part of this application we are just west of the i-15 so as mentioned we're requesting a plan amendment to both compact neighborhood and low intensity suburban neighborhood the site is currently planned for commercial with the more intense corridor mixed use along the more let's say 60 percent of the site which will be reserved again for that future commercial development and neighborhood commercial with our proposal um approximately 1.8 acres at the northern portion of the site will be low intensity suburban neighborhood to provide that buffer zone at the northern end of the site with the compact neighborhood being there in the middle as you can see along the i-15 there's planned industrial uses on undeveloped land and planned commercial uses that's been approved for the Maverick gas station. To the west is currently land owned by the federal government. And then to the north, we do have those ranch estate neighborhoods. The applicant is proposing 113 lots on the site. As mentioned, this is the compact neighborhood, RS 3.3 zoned portion of the site. This is the site being proposed for the low intensity suburban neighborhood and RS 10 zoning. All of those lots will be greater than 16,000 square feet, single story. We'll have the commercial down here eventually. you'll have the homes in between, and then you'll have that buffer at the top. This creates a cohesive transition from Silverado Ranch to the commercial, to residential, then up to Richmar where those ranch estate neighborhoods exist. So on this site, we do have three waivers of development standards. The first waiver is along this southern boundary line of the site. And so the site requires six feet of fill, so a six foot retaining wall. Ultimately, this is where it will be located. So it's significantly set off of Silverado Ranch Boulevard. Once there's subsequent development, no one will ultimately see it. So the aesthetic concerns are mitigated by that from the future commercial development and being set off from Silverado Ranch Boulevard. Additionally, there's a waiver regarding buffering. That's for these three lots. So this area has the RNP overlay. It does have a planned land use designation of open lands, which is not residential. And as mentioned, that is owned currently by the federal government. Staff is recommending approval of such waiver. additionally for the site we have access off dean martin drive and the important part about that is that dean martin drive has a signalized intersection so that residents can come out access silverado rents from there access to 15 allowing for a full range of motion we did increase that entrance to reduce any queuing and traffic concerns on dean martin drive public works is recommending approval on that and noted that it will enhance the overall site circulation. Dean Martin Drive is the ideal location for site access here. Additionally, for the tentative map, staff noted that we have the one access point We have addressed concerns related to emergency access via the stub streets. We'll all have emergency access. So this one is not currently shown, but we worked with fire to address any of those concerns through the common element. There's also emergency access to access this portion to address any of those concerns. The stub street down at the site is not wide enough to accommodate a gated entrance point. and there is not enough throat depth, this access point is more than capable of accommodating that. And again, Dean Martin Drive is the appropriate place for an access to be located for this development. So happy to answer any questions. Thank you. Thank you very much for your presentation.

Good evening, my name is Pam Kaiser. I reside at 3485 Vicki Avenue. I've seen all of you before. Sorry about that. I would like to address a couple of the concerns. Portion of the development, as he already restated, is in the overlay. Right next to what they're building are two horse ranches. Not even a quarter mile away from there, I have another horse ranch. So we're requesting per, and I believe it was Commissioner Jones that requested this, that along Polaris, those should be 10,000 square foot lots. Because that is the overlay and we are losing all of our property and it is within half a mile of South Point. So relatively speaking, somebody could come in there and buy that for another horse ranch. because right now i have people calling my place which i'm a private facility trying to get their horses into my place this is one of the hottest places around for horse ranches so ten thousand square foot lots i believe would be appropriate being as the overlay is stating it is rural and we do have rural horses there also all of us people that have the horse ranches I open my place up if kids want to come see them. I do not appreciate them coming over my walls, which has happened, and parents allow it, but that puts me at risk. So to reduce the number in the KB homes, which I also helped get the other development for KB homes on Dean Martin. It's not that we're anti-building, it's that they're overbuilding. There's 33 acres there right across the way on Silverado Ranch and Valley View, just under 600 units. So rather than stacking more houses, please adhere to the 10,000 square foot lots along Polaris. I live at the corner of Polaris and Vicki. If you guys wanna look, you can see my horse ranch. I live right next to Wyndham Hills. I have a very good relationship with all of them. but that is one of the things and i'd also believe the enterprise town board recommended also players have the ten thousand square foot lots so that's one of the things we cannot get behind the congestion And is it not, and I'm not sure how they can work it, and if the crash gates work, then I'm okay with it, but is it not supposedly that you have to have two ingress and egresses on these, a lot of track that big? Can somebody address that for me?

I would just like to make sure that you protect us with the 10,000 square footage, which is right across the street from us. You carried on down Richmar, and then you carried around to Polaris. It's been a process forever, and I know it's late, but I know we're last. But it's a constant process to protect yourself across the street when you're in the RMP.

I guess I'll start and I'll start with staff. So let's talk about the site plan and try to answer one of the questions, ingress, egress. So I'm sure this has come before you and is our staff okay with the ingress, egress that's presented?
which part because if the two accesses would be a planning question okay um but with the widening of the driveway for the access um we are okay with it we think having a wider driveway to allow for it to be gated and would go for better movement and reduce any stacking in the street and stuff like that but the two accesses would be better thank you and i'll direct that to
that to ingress, egress question to planning.
So the standard is two through access drives for a property that's over five acres in size. So for that reason, staff had recommended denial of the tentative map.
Okay. All right. All right. So denial. Then I'm going to ask the applicant to maybe speak on this waiver for fence height. And this is a KB product, right? And KB also has the product that the neighbors are speaking about up by, Yeah, Vicki and Dean Martin Windham Hills. Is that the same builder? That's correct. Okay, and so that builder is very familiar with the area and can continue to be very consistent as it builds through the process and adjacent to the RMP. Is that a correct statement?
Yes, that's correct. And if I could just address those just briefly. Well, quickly, I'll address the wall height that it's... It is only occurring on the southern property line. So away from the existing residences of the cross section here for reference that it only occurs down here at the south. So it's not something that's going to be visible to neighbors or impact the aesthetics of their community. it faces out towards Silverado Ranch. And I do think that with this, you know, we hear the concern about the 10,000 square foot lots and buffering, and that's why we have those larger lots that exceed 16,000 square feet at the northern portion along Richmar Avenue. Again, we would just disagree on these portions of these three lots that are adjacent to the undeveloped property with a non-residential planned land use that's currently owned by the federal government to have those buffering. But we do definitely respect those concerns and have the buffer there at the northern part of the property fronting on Richmar.

Yeah, just to be clear, what the neighbors, I think, want is 10,000 foot lots, and that's what is usually we look for as the buffer from the RMP, right?
That's correct.
And these are 16,000 foot lots, so quite a bit bigger than that? That's correct. That's pretty satisfactory to me. When you were talking about the move forward, that's why I was a little confused. I was like, isn't that what's happening here? I agree that you shouldn't have to put them next to the undeveloped land. The other comments I heard were about landscaping and off-sites and maybe the chair was kind of getting at this. I wonder if we can address those concerns by trying to make sure that the landscape is uniform and that if there's a way, maybe this is for public works or planning, but is there a way to allow some flexibility on the off-sites so that maybe we don't Again, I don't want to do anything that's unsafe, obviously, and I think that's probably why some of those things are there, but maybe even on the north side so that they can maintain some of this rural aesthetic.
Thank you, Commissioner. And just a comment on off-sites. This is Public Works. We prefer the off-site improvements because especially when it helps with the drainage aspect of the improvements. We have already received calls from the property owners to the north about the drainage and it reaching their property. So with the installation of all-site improvements, that will get rid of those aspects of it and help the overall development in this area. And also with the KB Homes on Vicki, north on Dean Martin, Public Works had to go back and put asphalt sidewalks on Dean Martin for the KB Home homeowners because they wanted to travel on Dean Martin to reach the park because both subdivisions are separated, so Public Works went in after the fact, after the off-site improvements were waived, to build an asphalt sidewalk for those property owners to reach the park.
Okay, understood. And so there's obviously a ton of different types of off-site improvements, but maybe, so like say we're not talking about drainage or paving, maybe we're talking about certain lights that need to go up or other things that are maybe more aesthetic that could, I don't know.
We are working as far as public works on rule light, down lighting, friendly towards that area as well. We have not finalized that design, but we have been working with Commissioner Knapp's office on that type of, those type of improvements, so.

Thank you, Mr. Chairman. Just a couple questions. Can you point on the map where the Maverick gas station, I think you mentioned that, right? Yes. Is that already been approved?
That is approved.
Are they under construction?
I don't think they're under construction yet.
And did you have any neighborhood meetings?
And how did that go?
So we had a couple of neighborhood meetings, the first one, and one of the reasons for the Dean Martin access point is that I believe at the first meeting we came with about five or seven different plans. They were laid out differently. We had a Polaris access point previously in the concern with that. is that if people are wanting to get to the 15, they're gonna have to make a right or they're gonna come back up into the area. Dean Martin was the preferred access point. So we work to have that in, expand that access point. so then they can access the signalized intersection. There was discussions too previously about the buffering. There was kind of two camps at the time about having lots such as what we did that front out on to Richmar where you have those or having this 50-foot landscape buffer. We did decide to go with the homes. It would have been a landscape buffer with a walking path essentially to nowhere. So we felt that the homes brought more value to the community in having those buffer homes.
And share with me what the feeling were with the neighbors with respect to the 16,000 square foot lots that you proposed.
Again, I think the sentiment was mixed. I think They like, one, that there is a buffer versus having smaller lots coming up and that they were larger and single story. Again, some wanted more landscaping setback. Some wanted, as the request tonight, more 10,000 square foot lots to continue on.
And what are the lot sizes for the majority of the development?
Yeah, so there are 3.3 standards, so they range from around 3,500 square feet up to 5,000 square feet.
And the property to the west is 40 acres, right?
That's correct.
And that's BLM?
Is that in disposal boundary, do you know? Has it been...
My understanding is that it was a reservation for a school. I don't know if that reservation has changed.
I don't have any money. So my point is this, what we are to do with the board. What we decide on this parcel is going to be what we're going to get next door. I just lay that out there as what's going to happen. Because when this 40 acres is disposed of, and when a school is not built, and it's determined to be residential, we're going to have more of this 3,500 square foot lot. So I'm not saying that's bad. I'm just saying that's what's going to happen.
And it's important to note in that case that this southeastern portion of that 40-acre site is already planned for compact neighborhood, which is what we're requesting tonight.

So my biggest concern on this is the area and what amenities the area has. When it comes into where's grocery shopping, where's restaurants, where is all the amenities that this that really Southern Highlands lacks. It gets to a point where that I just don't, when I'm driving here and I'm driving to California, I'm like, all right, do I wanna stop somewhere really quick and get something to eat? And what I always find is that if I don't want Jack in the box, I've gotta go all the way down really, really far. There's nothing as far as food, there's nothing as far as just, commercial is just really lacked in the area so that's where my concern is we're going to take this from commercial and exacerbate the issue that's my concern here so i don't know how everybody else feels on it um that's that's a strong part for me on on most of this
I would just, before I turn it over to Commissioner Kowarski, I hear all the comments from my commissioners. I am on the fence, I have mixed feelings. And I want to just say to the residents, I do appreciate how engaged the RNP is in our process. I think with the future commercial development, I would like it to be less dense, but I do appreciate the applicant taking the time to put oversized lots up against the RNP. And to Commissioner Kirk's point, that's probably, if we approve this, that's what we're gonna get the rest of the way through. Even though a portion of that BLM land is already designated for RS-10, I would imagine that... we would build it out the same way where we'd have buffering lots all the way on the RNP with the more dense coming back toward, what is that? Is that 15, 215? So I guess I'm on the fence, more so I can support the application, but we'll just see where the motioner goes. And that is, Commissioner Kolarski, do you want to go next?

I think they'd prefer rural. We are currently showing off-sites. As mentioned, it was largely related to drainage, and then also we have land saving, but we are showing off-sites currently.
Okay, so the neighbors prefer no off-sites, but Public Works requires off-sites. So we have to go with public works requirement because we don't want the same problem as indicated before.
We think from a drainage perspective in this area would be an improvement.
So the other thing I want to address is the uniformity to the Wyndham, what they keep referring to, Wyndham Hills, is that what it's called?
I'd have to double check. Don't know exactly if it's Windham Hills, but yes, the other KV development.
So have you talked to these neighbors or is this the first time you see them?
Two out of three of them were at the neighborhood meeting at the McGee's. I haven't spoken to Ms. Kaiser on this project.

So that was nothing new that that went in. The KB homes matched the landscaping, and then recently the new homes, and I believe KB's over on Valley View too, right? Yeah, because I was at the County Commission meeting for that, and they, April Becker and NAF also, I asked for uniformity down Valley View because Wyndham Hills is on Valley View to just match the landscaping so that we don't have a hodgepodge all the way down Valley View because that's all gonna get developed. So they have 10, pardon me? Valley View and Silverado Ranch and all the way down. They've got a whole bunch of different developments going in there. And they're supposedly going to match the landscaping towards what Wyndham Hills has, okay? The KB Homes that has already gone in has already done that. I think you guys can pull that one up and see that. We did work with them.

Good evening, Chairman Frazier and Commissioners. Labanie Ohini, 520 South 4th Street, representing the applications. This series of application, which is three of them, consists of a plan amendment, rezoning, and waivers and design reviews to convert an existing single family residence to an office use office building. To orient you to the site, the parcel is located on the south side of Russell Road, basically midway between Topaz Street to the west and McLeod to the east. On the plan amendment portion of the application, Just to explain this area, this area over the past 20 or more years has been slowly in transition to commercial uses on both sides of Russell Road. So with the land use plan, the northern portion has basically all converted and the master plan shows that is basically the NC category. To the south, which is where this lot is located, a few of the lots have converted, but it's not completed. Therefore, that's why you don't see the master plan changes on the parcel yet. On the zoning map you can see the CP zoning mostly along the north adjacent to us to the east. There's a residence to our west and then there is a commercial center that converted actually when I was still at the county. And so our request is to convert that existing house On the plan amendment and the zoning classification staff has recommended approval. The justification is the same justification I gave, which is the houses front Russell, which is a material and it's in transition. And therefore the plan amendment and zoning can be supported by staff. The third application, which is 41 is where staff has an issue, um, with the application. And just to state as a fact that all the conditions are existing. So the waivers, I'll go through the series of waivers under item number 41. I'll go through the planning waivers first. This residence is more than 3,500 square feet. It is on 0.72 acres. The first waiver, which is 1A, is to reduce the landscaping adjacent to the residence. And so showing you basically the property, this is the existing conversion. This is the residence. These walls exist and the fence was put in to match the other one to the west. So on the landscape plan, The landscape plan, the intent is to reduce it to 10 feet adjacent to the house, but provide 15 along the entire frontage. The next waivers are for these existing block walls. They are 4.5 feet or more. This is to the west and the south, and the request is to maintain those wall heights and Basically, it's not really a reduction. It's basically to maintain existing conditions. To our east, of course, is the other residents. So those are the planning waivers. With the public works waivers, I wanted to show you pictures that depict the frontage. This is to the east, where there's an existing... street light, a public street light, which is about five feet from the existing driveway. So for our first waiver, what we requested was to provide a 20 foot wide driveway. Now on this second picture, if you lay it together, there's the light pole and then there's a water meter. So then code requires that you provide 32 to 36 feet commercial driveways, which is impossible to do because it would mean relocating this street light, also relocating this water meter, which would involve going into Russell Road. This is a small business. It's a pool company, and the intent is to convert to use it as their office and for some display. These are things that are cost-prohibited. prohibited. So we're asking to maintain the current standard. We have discussed the driveway with Public Works. We've been working with them. I believe staff had stated that the report should have said 32 or 36, but it says 24. But the minimum requirement for a driveway per fire department is 24 feet. We're more than happy to provide that 24 feet because it wouldn't involve removing any of their utilities, that will be expensive to do. Based on the driveway as well, Public Works wanted a commercial driveway, which the same would happen, which would involve removing their utilities. And also for detached sidewalk, for miles from the freeway, to into the airport except for newer developments along East Russell that's attached sidewalk. We're located at mid block. This would be the only property that would be providing a detached sidewalk for miles from 15 all the way through the airport unless it's a newer development. So with that said, we did do a neighborhood meeting, conducted a neighborhood meeting on June 24th. No neighbors showed up. No neighbors showed up to the town board. Town board understood the request and agreed that trying to get a small business owner to provide these things and moving utilities out of the way will just stop the project. And so they recommended approval. So we would like to ask your consideration to approve the project as requested. However, we're willing to do the 24 fee to comply with minimum driveway to comply with public works minimum standard. I'm here to answer any questions you may have. Thank you.

Yes, ma'am. It's supposed to be landscaping. They were already moving earth I'll be more than happy to accept a condition that we all know CP, they can't do storage, but sometimes it's good to put a specific condition. But they are supposed to landscape it more as a display for the few customers that may want to see what they provide. If you look here, their patio cover is here, and the intent is, If some people come to the site, not a lot will come to the site because most pool companies go to their customer's site, then they would have that, and then they will landscape this area more as a display for people to see what they can do as well.
Thank you. And then one other thing. With the rewrite of Title 30, because this used to be the old CRT, so the old CRT had the design standards where they had a residential, I remember that, We don't have that overlay anymore, do we?

so per title um it 20 or 32 feet well actually it's an 80 so 36 feet is what's required per code um but fire code allows 24 feet so we did agree with working with her on the driveway geometrics to come up with something that works for public works plus works for a fire
