Here on behalf of the applicant, this property is located on the east side of Decatur Boulevard, just north of the Diablo alignment. It's approximately 12 acres, and it's entirely planned and zoned for industrial.

Thank you. Okay, so as I mentioned, this is just on the east side of Decatur here. It's about 12 acres on the north side of the Diablo Drive. The property is completely planned and zoned for industrial. As you can see, it's completely surrounded by industrial as well. This property has been operating as an outdoor storage yard for many years. In fact, there's been some code enforcement issues and complaints on the property. So the proposal for a new warehouse building on this property will significantly improve the area and be compatible and harmonious with everything in the surrounding area. The proposals for a 257,000 square foot warehouse building, as you can see, there's potential offices located on the corners of the building, so it'll be built and potentially split up depending on who the tenants are that come into this property. We have four access points, two on Decatur, two on Cameron Street to the east to help with the flow on the site and make it a better situation. The waiver requests for the throat depth waivers we've worked closely with Public Works on. In this northwest corner, we added a right turn lane after working with Public Works on that, so that'll help the queuing along Decatur for this northern drive aisle. On the southern drive aisle, we've agreed to have this access in only, and we can certainly provide signage to that extent, so this would be access only, no exit on Decatur. We've also worked with them on this southeast corner. As of last night, we had a proposal to slightly revise and lose a little bit of square feet in this southeastern corner. Got an exhibit that I've shared with Antonio, but basically this would straighten out this drive aisle so that a full turning opportunity can be had on Cameron. This is important for the operation of the site just because since it will be limited access on Decatur, the overall usage of this site is important to have northbound access and southbound access on Cameron Street. So you can see we'll lose some of this building here, about 2,000 square feet, and provide for a straighter opportunity here with the truck access into the property. So I'll submit this exhibit to the record, but I think we've addressed the concerns there, and I'm unaware of any concerns with the driveway on the north side of Cameron. We also have a waiver for retaining. We are a little bit higher than the industrial site to the north, so we've got about five feet of retaining we're requesting along this north property line. Also, we're over-parked, which now requires a waiver to have additional parking. So we have 210 parking spaces where 131 are required. We did have a parking study produced. And so my understanding is it's no longer a waiver. It's now a design review because of that study. But the idea is just to make sure that there's plenty of parking, especially for customers if they come and this is broken up into different end users. We do have a lot of trees. We exceed the trees on the property. So from a heat island effect, we should be. um contributing or trying to mitigate that heat island effect by providing all of the trees but with that said we'd ask for your approval we think this is obviously a great improvement to the area opposed to the outdoor storage that was happening on this property and we'd ask for your approval thank you this is a public hearing on items 21 and 22 anyone wishing to speak please come forward

I think it's very strategically located to have some kind of something to address the homeless issue that we're projected to have a big problem here, but we are definitely getting on top of it. There are other issues going on. Now, I drove there. I saw a lot of trucks over there or something, um let's not forget that in this general area is where we closed that um the wash over off of sahara and boulder which is definitely piling up and we definitely got to go get some service down there but there's not many residents area in there it's a high industrial area it's a perfect place to address the homeless issue maybe have some homeless uh DIVERSION PROGRAMS OR SOMETHING OR WHERE YOU CAN CONTRACT THIS SENIOR LIVING. I THINK IT'S A VERY, VERY WELL-PLACED PROJECT, AND I TOTALLY SUPPORT IT, AND I DO BELIEVE THAT WE DO NEED TO PUT A LITTLE BIT MORE ATTENTION IN GETTING THOSE RVs. THERE'S RVs, THERE'S ENCAMPMENTS. WHEN WE CLOSE THAT WALKWAY ON ARROYO, THERE'S A LOT OF HOMELESS STUFF, AND WE'LL BE ADDRESSING THAT. I'LL BE WORKING WITH THE COMMISSIONER ON THAT, BUT I STRONGLY SUPPORT THIS PROJECT. THANK YOU.

Item 29, VS26-0216, Vacate and abandon easements of interest to Clark County located between Russell Road and Quail Avenue and Rainbow Boulevard and Torrey Pines Drive. Good morning, Jennifer Lazovich. Welcome back. Nice, thank you. 1980 Festival Plaza Drive here this morning on behalf of the applicant. The site is located on this map in green. It sits just east of Rainbow and north of the alignment of Quail Avenue. Immediately to the north of us is a two-story office building. Kitty Corner in this area is a commercial project consisting of inline retail and then a gas station. As you move to the south, this whole area, this is developed as a substation but has the ability to move through this entire piece. Just south of that is a multi-level mini warehouse building. To the south of that is an approved church and immediately to the east of the site is an approved and operating community residence. We are asking for a plan amendment to go from neighborhood commercial to business employment as well as for the corresponding zone change to IP. The proposed plan is for an office warehouse is for an office warehouse. We would have access coming in off of Santa Margarita right here. The building sits over to the east side. This is the area where that substation expansion could occur, and over to the north is where that two-story office building would be. this gives you an idea of what the building elevation would look like the roll-up doors that are at grade have glass in them as well as the front door that kind of gives you a bird's eye view of what it would look like this is somewhat of the alignment of where santa margarita is we do have a waiver for an offset of that early on we met with public works to lay out the site and although we have a waiver for that they felt that the Placing the building on the east side would be better than placing the building on the west side and having more of a waiver for an offset. We do have some additional landscaping buffer requests, but at the Planning Commission we did withdraw The waiver for the width of landscaping on the east side again the use to the east of us is an operating community residence But we will comply with the landscaping required on the east side your Staff report for your waiver reflects that change And that change was that we withdrew the waiver for the landscaping on the east side It also in when we did that meant that we are now providing 39 parking spaces instead At our neighborhood meeting, we had one couple who lives in the area attend. They expressed no opposition to this plan. When we went to the town board, they did approve the plan amendment. For various reasons, they denied the other applications, but they did approve the plan amendment. And then the planning commission also recommended approval of the applications that are before you today. So with that, I'd be happy to answer any questions.

Good morning, Liz Olson, 1980 Festival Plaza Drive, here on behalf of the applicant, Matter Academy. We've been before you several times for this school. This is another location that they are looking at. As you know, they're a highly rated Title I charter school here in town. They've been here since 2014 and looking to expand on this site. So as you can see here, we are located on the corner of Sahara and Bruce. About four years ago, the front portion of the property was approved for a charter school and has been operating since. Matter is looking to come in and expand from a K-5 to a K-12. Matter only has one high school currently operating in Las Vegas and they have more than 500 children on the wait list for that high school. So this will really provide an opportunity for those children to be able to stay with Matter throughout their entire education. Our request today is that expansion on the bottom portion of the site. So the northern portion of the site here is that existing building which will continue to operate this year, 26 to 27. This is what we're calling phase one. Phase two would be this building here. We're looking to construct and start school in two years from now, so 2028. And then the final phase would be these two remaining buildings, which would be then another two years down the road. So slowly growing, but eventually getting K through 12 on this property. The access is off of Karen here to the south. Our car loop goes all the way around the property. It can hold 120 cars for pickup and drop off. And our access point over here is going to be used for staff access. Our buildings, we have particularly made them stepped back. So this is the east side of our property here. And you can see where we have a condo development on our east side, we've stepped this back to mitigate any impacts on those neighbors there. And we're also set back 86 feet from the property line. So trying to mitigate any impact to them as much as possible. We have a couple waivers. First and foremost, I'd like to withdraw waiver number two for our attached sidewalks. We will be providing those detached sidewalks. Our second request is for a buffer wall along the eastern property line. It requires, as you know, the eight foot block wall between the residential and our use. We have met with the HOA of that condo, and they would rather see a screen fence with basically what's there now. So they do not have a really tall wall. We sit significantly higher than them, so if we put that eight foot tall wall there, it would block quite a bit of their light coming in. So in working with the commissioner and planning staff, I'd like to request this additional condition for support. The letter of support from the HOA for the residential property to the east indicating a screen fence is acceptable shall be provided prior to issuance of a grading permit. If the letter is not provided, a wall shall be constructed per Title 30. So that will provide an opportunity for us to get that approval letter from the HOA as we've been discussing with them. Our last waiver is for our reduced throat depths and existing departure distance and Public Works was comfortable with those based on our circulation and the existing location for this driveway as it's pushed back as far as it can go from the intersection. This property is located on the west side of Las Vegas Boulevard between the I-15 and Las Vegas Boulevard. It's north of Bruner Avenue. We're here with a zone change that conforms to the master plan to an RM-18. for a townhome development on the property. You can see it's an odd assemblage of property, but we are coming in with all one project for townhomes in this area, for sale townhomes. We are proposing 216 homes with access off of Jonathan, located here to this portion to the north. and then access off of Parvin for the other two portions of the community. We did work with Public Works before submitting this application to discuss vacating Jonathan from Parvin West because it does just dead end at the I-15. So we appreciate them supporting that application And that is part of the application there because it really didn't go anywhere with the I-15 located right there. We've worked with them on the waivers. Specifically on lot 117 was the concern we have a reduction of The 12 foot distance requirement to seven feet and in working with Antonio we've offered to taper this driveway, because this particular townhome has an extra long driveway it's about 30 feet in width all of these have to have two car. garages and 20 foot driveways these have even longer driveways so lot 117 that driveway would be tapered down. to ensure that that safety concern is addressed. So we would offer a condition to taper the driveway on lot 117. Also, we'll have full offsites on all of these three parcels. We would like to remove the condition that requires us to overpave from Jonathan South to Bruner. That's on the PUD and the tentative map application. This is the product type. So you can see it's a really nice looking three-story townhome. All of them will have front yard courtyards that are anywhere from six feet and larger. So they'll have private space in front of their units. The garages are accessed in the rear. They'll also have balconies on the second level. So a really great for sale attached product that certainly will be harmonious and compatible with this area. This area is planned for much densities like this and higher, and so we're excited to offer a brand new for sale townhome product in the area. So with that said, we'd ask for your approval with that added condition that we taper lot 117's driveway to meet that distance and safety concern, and then that we would remove the condition for the over paving down to Bruner. And I really want to thank the commissioners for their cooperation with our community. I also want to thank our Metro. You know, I lived in Orange County. I don't know if you knew what happened down in Newport. Fourth of July was a disaster. They had a TikTok invasion of teenagers. And we definitely want to work with Metro and our commissioners to monitor TikTok so we don't have that. And our... Law enforcement did a fantastic job. We did a great job. We ran a really safe Fourth of July. And I think Clark County and all of our leadership should be commended for that. The other thing that I wanted to say was I wasn't here yesterday. I saw a couple of the items during public comment where the commissioners will be appointing vacant judges. And I totally support that. I wish I could have brought my diagram where it shows the triangle where the county, where elected officials at the state level, at the local level are supporting law enforcement and the public is. And we were having a lot of problems with the judges that are not implementing diversion programs for these homeless people, which we know that just prosecuting them and punishing homeless people, criminalizing homelessness is not the answer. We're channeling it, channeling homelessness to services that will get them off the street One of the organizations that I'm working with, what they do is they detox first, get them off of drugs, and then we get them into paperwork, some other IDs.
