Planning Board - Regular Meeting

Friday, March 6, 2026

The Cicero Planning Board approved the minutes from a previous meeting and discussed two main items: a second plan sketch review for a property to the east and a minor site plan review for a new bakery, Upon Farms, which will replace a vacant gym. The board requested the bakery consider architectural modifications to the building facade.

to the Council of General Planning Committee. Could you please join us in a pledge of allegiance?

0:25 – 0:37Speaker 4

I pledge allegiance to the flag of the United States of America, and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all.

0:41Speaker 5

May I see the first order of business of the approval of the day, 20 minutes from Monday. Any questions or not? And the motion to approve.

0:50Speaker 8

Motion to approve.

0:51 – 1:26Speaker 5

And we're in the second. Second. Jen? Yes. Chuck? Yes. Mary? Yes. Zach? Yes. And I have a question. Approved. Now we'll open the meeting to public comment. If there's anybody in the audience that would like to address any active application, you can do so now. If there's nobody to approach, we'll close the public input. We'll move on to the first agenda item. This is a second plan sketch review for THE PROPERTY TO THE EAST.

1:26 – 3:12Speaker 4

THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. THE PROPERTY TO THE EAST. Stated when she has a tenant selected to come back to play more approval, the canvas. Occupational center it's a private building for them to be working in a facility will be. HIGH EFFICIENCY CARBON BUILDINGS. ANY SMELLS OR ANYTHING LIKE THAT OUT OF THE AIR. THEY WON'T GET READY UNBELIEVABLY TO GET READY TO SEND THEM TO A HOSPITAL. THEY PREFER NOBODY REALLY KNOWING WHAT THEY'RE MAKING. SO THEY WANT IT TO BE A CLEAN AND KIND OF FULL GROUP HOSPITAL. that her utility next door for a lot of passengers will be affected. She seemed to decide that won't be. So we'll move on with that. Do you guys want to move? Great. Welcome for questions. Thank you. And this is just for call to motion. We want to go right to you. You can say hello. . Yes, there is. This is Natalie, the public.

3:12Speaker 5

Which one? I'm strange and open, but this would be my first application for this building?

3:21 – 3:36Speaker 4

No, the building was approved via code when they first built it. But when they had no tenant, she wanted to get it constructed. That's why we're reaching out now. She finally does have a tenant. No matter the tenant, they said that we would have to come here for a week.

3:37 – 3:50Speaker 5

The place you submitted there dated January 24, so that's 1-1-1. I'm looking forward to hearing more about it. The process and such.

3:51 – 4:12Speaker 4

Oh, well, I'm not the provider of the business, but it's nice to know. You know, they have grow lights, everything is done indoors. Everything is trimmed and cleaned and packaged before it leaves. So, again, that is brought to the staff throughout the area. So, we're looking at it.

4:14Speaker 5

I should not go over that rhythm, but it should be like essentially the arc area.

4:26Speaker 8

So you said that the new tenant wants to do their business and no one will know they're there, so there will be no sign?

4:35Speaker 4

No, no sign, just the access.

4:38Speaker 8

How many employees?

4:47Speaker 8

And any customer coming now? So they have sales people that go out?

4:54Speaker 4

Yeah, it's really more bringing the product to this time series. It's sort of so they won't have any public sales.

5:07 – 5:19Speaker 4

Similar to any of the other dispensaries, Air, Moon, or any of the other companies. Can you describe traffic quality?

5:19Speaker 5

Just to say, I remember that we're very typical 85 and 95.

5:48 – 6:08Speaker 4

What kind of talk with the delivery trucks? Probably, you know, two per day. Oh, probably every other week maybe. It won't be that much. Is it a vehicle they own? I believe it will be a vehicle they own, but no sign that you're branding or labeling on it.

6:09Speaker 5

And you mentioned the taking care of the order situation, mostly on the property thing or not?

6:18 – 7:09Speaker 4

Um, similar to like, um, any other, like, hospital and facility, like, this would have the carbon filter, so it has had the exhaust, um, but it has the, you know, the micro, uh, sorry, I can't remember all the technical terms. Um, yeah, the activated carbon filtration has millions of microscopic pores that track the organic compound that's rotated as it's needed for the manufacture of space. So they're trying to keep everything clean. So that won't be, it won't be perfectly odorless, but the smell is nothing that would be smoked or burned. It's just from the site itself that it naturally gives. So it wouldn't be a smell that would be as recognizable compared to a piece of snow.

7:11Speaker 1

I have not yet. No. Yes.

7:14Speaker 5

Let me know the names for them.

7:17 – 8:13Speaker 4

you know there's some quarters sure and we can provide all these books that they talk about that's all i know too so the operator will hold the new york state license from outside of the station for a call over there yeah he knows right now it's very important to see if we get a location And reason injuries, the building has to be up similar to the process to the restaurants where basically in services very angry all that so we're at all soon services as well, so then claim to the same thing over certain the secret of the finished product. And then that's the site plan for the full plan and games label out specified for what you choose.

8:15Speaker 5

Yeah, all set for now.

8:17 – 8:36Speaker 1

I'm set for now. We'll just do a review of the plans. I don't expect there will be much because it's, I don't think you're proposing any changes to the site essentially, right? Just as previously approved. So we should be good. We'll just do a quick review and probably get back next week.

8:36Speaker 8

I imagine there'll be a security system.

8:42 – 9:17Speaker 4

Um, yes, the third year of state security system, uh, secure entries and access. Those of all people steal the original man card player access to a major address on the outside. And anything that doesn't have a key is connected to your system. I understand too, because it's just for you for then watching into the building. Don't set the kind of thing before it's exempt from sort of won't have to get back. Thank you. Thank you. Thank you. Thank you.

9:43Speaker 5

We all come up here.

9:44Speaker 2

I want to be in the way.

9:50Speaker 5

There's a lot in there.

10:11 – 11:38Speaker 3

Good evening, and thank you for your time tonight. My name is Kiefer Kale. I'm with Kettwin & Friedman Associates. Today, I'm representing MEXT, which is a property called the Yellow Sea. We have a project with 58 subsistence. We have 31 in Cicero, as well as the container on Farms Bakery in Dillon. Some of you might remember this site as it was developed in 2022, but quick refresher, it's a 5.8-year lot. The previous use of the site is a metabolic fitness gym that has since relocated, leaving the site vacant. Today we are requesting a minor cycling review and a change of use from previous gyms that those vacant store upon farms, as well as the signage on the northern western building faces. As far as that goes, there's no other site changes to the site. For the wall mounted signs, there's one on the northern face of 30.9 square feet that's facing Route 31 that will be replaced by an existing sign, the metabolic fitness. And then also one on the western face of the building. It's 15.8 square feet based on the fast track. And the inner city can be one, but it will also be replaced by an existing metabolic fitness sign. Well, yeah.

11:39 – 11:50Speaker 4

Yeah, right. Okay, one concern as far as traffic, would people go less early coming out of there?

11:51 – 12:08Speaker 3

Yes, so with the turn lane as well as the shared access easement with the property that's also owned by Next Choice Property in Bowling, there's two entry and exit drives. So with that turn lane, we go throughout the road back up.

12:09 – 12:29Speaker 2

Nicholas Matsakis- Can I also Brian Cohen in some of the drive. Nicholas Matsakis- This use we have a location man this name to speak very similar numbers for traffic now. And it's pretty much the same thing that metabolic gym was doing so.

12:29Speaker 5

Nicholas Matsakis- What's up.

12:31 – 12:42Speaker 2

Nicholas Matsakis- Yeah, spread out more from the day. It's not like they have a class of You know, 40 people in there. It's people coming in periodically. So the traffic is more spread out than the previous increase.

12:43Speaker 5

Yeah, but this one is this property is completely separate to this adjacent property.

13:21Speaker 2

on a separate tax parcel, on its own tax parcel.

13:27Speaker 3

It's on the south side. It's on the south side.

13:31Speaker 4

Yeah, I've got a lot to say. Thanks.

13:35 – 13:50Speaker 5

But yeah, I look forward to the announcement. There's certainly some good fresh bakery, which I'm reading on my phone there, your comments are not all very, very good.

13:52Speaker 6

Yes, we're excited.

13:53Speaker 5

It's going to be a problem for everyone.

13:56Speaker 2

What are you guys coming in from the east of Sistroman?

13:59 – 14:10Speaker 5

Vanlius and Utica. Yeah, so our flagship store is in Yorkville. You know where Yorkville is? In Utica? Yeah. And then we sent it to Vanlius and

14:22 – 14:34Speaker 6

That's it, Cheryl. Yeah. Thank you. I appreciate it. What was your name, ma'am? Heather Petrova. P-O-T-R-Z-E-V-A. Thank you.

14:34Speaker 5

Also, I want to say welcome.

14:43 – 15:17Speaker 8

I'm very excited about having a bakery I was trying to think if we had one. I know we do in our grocery stores. And then there's some in the village, but I don't think we have one in the town. So very excited about that. Thank you. I also have been turning off traffic. Well, just the people that want to unlock. Is there a plan for a median in that stretch?

15:18 – 15:29Speaker 4

I do that turn a lot and it's a lot more, like if you're driving by, there's a middle turn lane and you can confidently get into the middle turn lane without, you know, like...

15:42 – 16:02Speaker 2

The biggest problem is if someone is rude and doesn't want to let you merge or something like that. But I, but I go there multiple times a day. We have the other properties. So it's It's not really a big problem, especially the fact that the traffic is much more spread out in the previous years. I think that's, you know, To be okay.

16:02Speaker 6

Does it what happened on the other side of the street when they have to really ask the way that that that works the same way.

16:13 – 16:40Speaker 3

As far as traffic goes, the previous use, we had eight classes a day. They had about 30 people a class. They actually had traffic set up for their project in Lanius, and they expect about 300. between 6 and 9.

16:40Speaker 8

And how many parking spots are there?

16:42Speaker 3

There's three parking spots on the site.

16:45Speaker 2

We expanded the parking lot for Metabolic just a few years ago. So it's a funny apartment. It's a funny apartment, yeah.

16:54Speaker 8

All right, thank you.

16:56Speaker 4

I had a traffic notice question that I didn't touch on, but to be able to hear so many of them, I can do it a little quicker.

17:02Speaker 6

A little harder? You're going to make that turn. Yeah. Awesome.

17:09Speaker 5

So this was last April 22. We've had some architectural modifications, changes, requirements. For the inside of the building.

17:19Speaker 4

For the outside of the building.

17:21Speaker 3

We're not making any changes except for the sign. You've just decided. Which will be replacing the existing sign. We're looking for the buildings to be attached to the water.

17:37 – 17:51Speaker 2

Oh, we did backflow prevention. We, like, modernized that whole backflow prevention system. The building itself. The building itself. Okay. I mean, we redid the facade.

17:51Speaker 6

You're talking about exterior or interior? Exterior. Oh, exterior. It's a really beautiful modern building. Yeah.

18:01Speaker 2

What am I missing? So what's not the code? I'm

18:11Speaker 5

field design standards. We may have talked about it briefly.

18:16 – 18:31Speaker 4

So since that time, I think with the chairman, for instance, since the time of the last site plan for the town, there's a problem. There's a design standard. So to talk about architectural design. And I know they made improvements to the building. I think they put a new side.

18:31 – 19:36Speaker 2

We put a new side on the side of the building. We did a new sidewalk. And I know, I think that the only thing, now I know what you're talking about. The building is next to us. next to this building, we did them in accordance with the new design standards. The only thing that we're really missing is some sort of a break in the, like, I think it's called wadescotting, like two different colors on the building. But at this point, there's not really a way to modify the ethos. Like, we'd have to tear the whole building apart, essentially, to modify, to do that. But it's also difficult What does it mean for us? This is like stucco. It's a modern, it's a synthetic stucco. That's the siding, yep.

19:36 – 20:51Speaker 6

So one of the things that we really liked about the building is that it was so modern compared to all the, you know, this is an upgraded version of a lot of the buildings that are around it. We looked at other buildings and this was very modern, like we wouldn't have to do anything to it. It's definitely upgraded from our standpoint for what we saw in Cicero. We were kind of shocked about that. It was like, oh, that's a good building, but obviously I'm not the decision maker, but I don't know how we would enhance that. I think... You can't put that on that type of building though. Like that is a special material is what we're saying. That would ruin the whole, I mean, I'm into design that would not look appropriate on that building. And also for our, on our standpoint, that was a Hall and Harms building. I can be honest. When we looked at Yorkville, I know we're not in Yorkville, we're in Sotero, but it was a really clean design. I don't know how that would ever happen on that kind of material. I don't think it's feasible for me to do that.

20:53Speaker 8

What color will your signs be?

20:55 – 21:07Speaker 6

So our logo is red and white. That's a little dark for that, but it would be a red. I don't know. Did we submit that or no? Yeah. Yeah, I think the signs are there.

21:07Speaker 4

So this is existing.

21:14 – 21:32Speaker 5

If you were doing this, we wouldn't allow that. Right. If you can look at some options, Mark, I don't know if you have any thoughts.

21:32 – 21:45Speaker 1

I do not. You have an architectural consultant.

21:46 – 22:11Speaker 6

But this one is modernized, but I'm just curious as to what you're, you want it to break up like colors or something? More old-fashioned is what you're saying, not more modern is what I'm gathering, right? Not necessarily. The small town, yeah.

22:11 – 22:36Speaker 4

It's not modern or old-fashioned. It's just like the chairman's saying, the design standards talk about a base, a midsection, a crown to a building. So whether it be textures or colors, You know, and then I can I can show them to him and like mark said our architectural design consultant will review it and in the comments, but if you've got some ideas. Here we're saying what to think about.

22:37 – 24:03Speaker 7

yeah marco and five to zero, and so they don't just read it, but the building was in terrible shape and the. Gain before you and got what we have now a clue. And that was only three years ago, three and a half years ago. So now to ask us to change the building after three years of being approved by you. It's not like, you know, 10 or 15 years old. The other one was, you know, I don't know how old was terrible looking. So, you know, this went through the plan board. We got approval. I understand your standard state, but it's, you know, such a close time period. And, you know, the tenants. Lex, your idea of having a clean, smooth, it does look quite modern compared to like we did the three buildings next to us, the other buildings that we have with the two, you know, to your new standards, because that was just done last year. So it does, you know, to someone look a little bit more modern and that's the look that I'm asking for. And we did that whole building at great expense, you know, three years ago. approved by you guys, you know, it was approved before. So, you know, you've got a lot to ask us to change the whole designs and look of the building that was just changed completely and approved by you, you know, a few years ago. So, 24 years ago. We didn't implement the new regulation.

24:03Speaker 5

I understand, but I mean, in fact, so we're willing to work with you, but

24:14Speaker 7

What about windows?

24:16Speaker 2

What about like their colors in the windows or something like that? What about window details like metabolic hat? Take a look at the standards. Yeah.

24:25 – 24:39Speaker 5

You can come up with. Okay. There's also landscape standards. You're going to need to add some. I think they're probably going to be dressed up a little bit. You're saying like awnings? Is that maybe also?

24:39Speaker 6

Yeah, like awnings over the windows maybe? Yeah.

24:42Speaker 8

Yeah. Yeah. Yeah, I mean, if it helps to be we get like a conditionally approved with the modification of like over these windows.

24:53 – 25:53Speaker 5

No. But everyone likes the awning idea to break up the facade. Okay. I wouldn't object to the local. Awesome.

25:53Speaker 6

We're trying to try to try to get to the. Okay, I'm okay with that. Something.

26:05Speaker 4

design-wise.

26:06Speaker 6

So we only have so much to work with, so you're saying I can go bigger? Okay. We don't normally get that, so we'll take that.

26:15Speaker 2

Right now, we're kind of just looking at the ratio of what's allowable for the sign.

26:22Speaker 7

You guys say that she wants it bigger, because she has a lot of words in there.

26:27Speaker 2

Okay, that's good.

26:29Speaker 6

Can you go back to the picture? I like the way it looks.

26:33Speaker 7

You like the way it looks?

26:42Speaker 4

So the sign you would be replacing you and the signs the same plan with the one thought and one side. Yeah. Yeah. I don't think so.

26:52Speaker 8

I don't know what signing up.

27:03Speaker 6

Or size time.

27:05Speaker 7

It's probably the same size because they probably got saved in the red, but you're Yeah, it's in the change. So I presume it's the same size.

27:16Speaker 8

So do you think it would look better if your sign was space and community and young? I see you're trying to go in the middle of the building.

27:26Speaker 6

Well, if you're putting audience in, I think it might change where we're going to put that.

27:31 – 27:46Speaker 6

So maybe it could go between those two windows.

27:48Speaker 1

Similar to the last project, I'll take a look. But again, I don't expect there will be much site-wise that we'll have comments on.

27:57Speaker 4

This one as well.

28:07Speaker 6

So what do we do? We come back when?

28:12Speaker 3

Two weeks is the next meeting.

28:15Speaker 3

Will you allow us to come back at the next meeting or do you want us to submit some materials provided to us in a timely manner so we have a chance to do them?

28:23Speaker 5

Okay. So we'll get the materials next week?

28:27Speaker 1

Steve, what's the next one?

28:29Speaker 5

The next one. Thank you. Do you guys have any feedback on what kind of material we put on it?

28:36Speaker 2

Yeah. OK. We'll see what . So in Yorkville, we have different materials. But we do have some metal on that go over the windows.

28:52 – 29:10Speaker 7

I think we're going to have to see what can attach to that. Okay. Cause that might be Kathy. I don't know. I think we're going to have to see what whoever makes the audience, how they can attach it to the campus. Thank you. Thank you.

29:10Speaker 8

That concludes our agenda.

29:12Speaker 5

I don't have any questions or comments. We have a motion to adjourn.

29:22Speaker 4

Motion to adjourn.
