The two additions are for signs now and the claim to remove is for GM development. Is that correct, Jo?
Yes, the one that was submitted for the commons. Okay. There's some things that need to be worked out on that. So I talked with GM development and we thought it was best just to pull it, get those things worked out, and then resubmit. And the signs now, those were submitted to be on the docket and were dismissed, which was probably good because the ones we submitted to be put on the docket were actually a little bit higher. The dollar amounts changed. So I guess it was meant to be that they weren't on the docket in the first place.
So I'll make a motion that we approve the claims with the two caveats you just stated. I'm going to talk about that later.

I'll be glad to answer any questions you have about the report. In particular, I wanted to talk about Shadow Lake Park. In the report, it said we had not heard back from Duke since we met with them on site, and they want to get an easement for putting additional power lines through that adjacent to where they are now. We did hear back from them. We do have a copy of the appraisal now, and the mayor and I have a meeting with, or a virtual meeting with Duke tomorrow afternoon to talk about the easement and compensation. So that's an update from the court. Collins and Short Street Parklet, I'm glad you all could attend the ribbon cutting there on Friday night. I thought it went really well. And so there were some things I want to talk about regarding that. There are some, I think we all know about the lighting, that it was delayed by the manufacturer several times. That is coming, and that will be installed. Everything's in place to install those lights. There were some other items that we talked about potentially adding as well. We're waiting on some costs for that, but I wanted to bring them up tonight just so you could think about those and get your thoughts on whether you wanted to move forward with those. Obviously, I don't expect you to say that until you have costs, but one of those things would... in the original project we had where the pergola is on short street we wanted to go ahead and finish out the sidewalk all the way to main street but the cost at the time was a little bit more than felt comfortable moving forward with and at that time the city had someone on staff that could do sidewalks that has changed and so we've asked the GM development to give us a price to go ahead and finish out that sidewalk, put in a new sidewalk. The expense is putting in, there's three lights, three street lights. That's the expense and that's one of the things that we're waiting on cost-wise from GM is how much that will cost. Then we also, at the last walkthrough we had, which was the last Wednesday, It talked about the slope has changed drastically behind the pavilion. I don't know if you all remember, if you go on Google Earth and kind of look at some of those, it was more of a gradual hill. Now it's fairly steep. And with the new trees that were planted, it makes it pretty steep to mow. And then also, I mean, you might have to weave that whole side, which will take some time and maintenance. So we discussed... maybe putting some ground cover there so you wouldn't have to mow that. So those, the team is getting some options together for that. As well as at the top of that hill, either put some fencing there by the switchback or maybe put some shrubs there like we have along Market Street where there aren't benches, there's some small shrubs there just to keep people from, clumsy people like me from tripping on down the hill. or keeping people from sliding down the hill. So that's something we also talked about. And then, let's see if that was, I think that was it, talk about ground cover. The last thing you have in front of you is this CTEC quote. That is to put Wi-Fi at the commons. And so that came to me and so I wanted to talk to you all about that. That is something we have a cost on, and if you are so inclined, we can approve that to be added to the claims stock as well. I didn't bring it up during the claims discussion because I wanted to have the rest of the discussion about the comments with you at the same time.
So this is the infrastructure installation. What about sustaining costs?
Redevelopment can't pay for that. We can't pay for ongoing, but the city can.
Do we have a price?
I'm going to look at the mayor and see if she knows.
We're prepared to pay it because this is essential to not only provide security cameras out there, but also for the Christmas light show when we get ready to move that over or add that space.
Yeah, those are minor things we don't need. I was just curious, so you don't have any idea with it?
Well, I know we all talked about security cameras and stuff while we were out there, so that's something we don't want picket tables to come up missing or
People can get assaulted.
We've watched on cameras before people carry tables across Highway 3 over to the Renaissance building. We talked about that years ago. So I'll make a motion. We do the Wi-Fi. The city will pay the rest of the bill, but we need to install for security. I second.

Then the last thing, and we kind of talked about this before the meeting, just in passing, the Charlestown signage, we had a meeting on Monday with the design team to talk about that. They had coordinated with NDOT as far as what will and won't be permitted within the right of way. They are hoping to have a draft plan concept to present to you at your October meeting. So you can look at what what potentially would be out there, kind of give your blessing on it at that stage, and then move forward from there. That's all I have to report on. So I'd be glad to answer any questions that you have related to anything else in the report.

At your last meeting, HWC recommended that you award an agreement to Dan Christiani Excavating in the amount of $296,111. They have prepared a notice of award. And so if you're so inclined, I would ask you to make a motion to accept that notice of award give the president authorization to sign that. As well as, and we could do that in two separate motions, I guess. The other thing that would come after that, the notice of award is what triggers the contractor to be able to get his bonds and insurance. And so the agreement would be the next thing in your packet. I send out a draft agreement for you to review. It's not appropriate for you to review award the agreement today without having that, but if you would also give the president authorization to execute that agreement outside the meeting upon review and approval by your counsel, then that would allow him to sign that before your next meeting.

The idea of amending their contract, this had obviously gone through two bidding rounds. They had not budgeted for that, so I asked them to just send me their proposed amendment. So that was an additional $10,500, which would bring their total contract to $42,500 for that project. If you're so inclined to approve that, then I would ask you to make a motion to approve that amendment. in the amount of $10,500.

amendment agreement um as you know and we went through this uh and matt explained all the tip amendments that you approved at your last meeting that haven't then gone through the plan commission and we'll go before city council next week yeah next tuesday next tuesday um baker tiller your financial advisor has assisted with that and had done so and is still doing so and has then submitted their master services agreement with a work order for the 2026 TIF amendment. That is an hourly rate, not a flat fee, but they have sent that, and I think we need to consider that, not just for the work that they've already done, but the work they still need to do. I think their heavy lifting is yet to come, right, Matt, after that.
The tax impact statement, yeah.
So it would be good for us to have an agreement in place before they really start their work.

As we've discussed in the last few meetings, the city had advertised a request for proposals and qualifications for teams to design and construct improvements at the Little League Park or Little League Fields. At one of your previous meetings, you appointed a selection committee and working group. The proposals were due. I should have written that down because I can't remember a week or so ago. A week ago Friday. Thank you. And the selection committee scored those proposals and three were submitted before the deadline. The selection committee scored all three of those and the recommendation from the selection committee is to enter into a scoping period with GM development LLC. And so at this point in time, that is the next logical step and the BOT is to enter into a scoping period. There's no scoping fee. Sometimes people will put a scoping fee. None of the teams have a scoping fee that's submitted. And this one doesn't either. So the next step would be for you to make a motion to enter into a scoping period of GM development. If those negotiations don't, if you go through the process and you don't like what's provided, then you can certainly go to another team and work through that with them.
And just to be crystal clear, it's not an award. It's a period to negotiate the overall cost and scope of the project. The actual award, based on the city's BOT ordinance, the council is the one to hold the public hearing and make the ultimate award. So this is just energy.
I mean, I was part of that selection team. It was a lot to read through. I think Tree will agree. I think Brown would agree. It was a lot to read through, a lot to go over. I'm one of the ones that are very passionate about the Little League side. I've been for 40 years, so I really paid attention to a lot of things. I think GM development was very good, had a very good plan, and I'd like to make that motion to move forward into the scoping period. I second.

I want to one commissioner bobby had asked whether we could consider moving the meeting on october 6th and i told him that i didn't know that we couldn't move the meeting to be out of town because i think we have all that set up in our timetable to have the final resolutions approved at that meeting with a public hearing possibly that's that's correct now nothing's been published or
sent to property owners or anything like that tax impact statements not been sent out so if we did want to move it there would still be time okay well that won't be good at 60 either that makes a difference okay but it gives you three still i think so it's probably still a quorum yeah i just wanted to bring that up and as commission you all could do whatever you want about that you said the sixth
