We're going to have the second reading of the rezone ordinance for Amagansett 4, LLC. The first reading was done on May 18th. Meeting and planning and zoning conducted their hearing on April 28th for the proposed ordinance and a rezone for a parcel at 298.00.100 for urban reserve to combine zoning residential. and urban reserve for the remainder of the parcel and recommended approval of passage. The proposed ordinance, if approved with the second reading, will be published on June 11th and effective July 1st. And a motion and a second is required to approve of this ordinance.

Moving on to new business. We have the airport grant agreements back on the agenda for tonight, and we are discussing this one issue and not 10. So let's keep it to the issue at hand. And the first item is the airport grant agreement with KLJ engineering has submitted an FAA grant for a fuel project design for $56,050 that will be funded 95% through this grant with the state and local contribution covering the other 5%. Attached, if you go on the website, is an agreement and a motion is needed to approve the FAA grant agreement and authorize me to sign it. And we've been putting this off for a few weeks. Everybody's had ample time to examine this as they see fit.

That would be the consulting time to put the plan and specs together for upgraded system. We're still, you know, undecided on how big and how, you know, we put some preliminary research together, but we haven't started any capacity of design work. So, We're still deciding whether we go with 100-volet AM jet A, which may be the better idea, two fuel types, and then get the user of the jet A on the field, potentially bringing him under the same location, but if it's decided that we which is needed because they're running through the 2000 gallon tank very often with all the flight school operations that are going on this year and starting the last couple of years. Your flight school hasn't been there that many years, but every year they,
Yeah, I guess for $56,000, I mean, you told me what you're going to do, but how are they coming up spending $56,000 on a study?
Well, that's the time putting it in AutoCAD, drawing it, pulling the specs together. They've got to follow the right install methods and specs. And it's all, we're planning a new, I don't know what the date is of the old system, but drawing review you know and then you know review time with fa and city folks so that's all and there's a scope that goes along with this that's been looked at you brought this to us two months ago whenever it was correct then you had a picture of how it uses you had looked Well, we've been just idle. We haven't started anything since.
What did you bring to us two months ago?
The same design agreement.
That was for $100,000 or $200,000 or whatever.
Yeah, this is for phase one.

Yeah, because that's what the EFA will only do because we didn't get enough There's not enough time to, there was environmental clearance that had to be reviewed. There's not enough time this year to go through design and getting a tank installed. It won't get done this year if we start and try to bid it by September or whatever. If we tried to get things drawn, spec book put together, tried to get it out for a bidding phase, there wouldn't be and the FA doesn't want to go through that schedule. They're the ones that kind of review what we're doing as consultants. And they've said it's off for this year. So it's just a design package to step into the project to get the design part. But yeah, before I was trying to package it, design and construction. And then you have grant money that comes every year and you can keep compiling some grant money to get through the construction phase.

Basically is the, this part of it is, is we're talking about 1475 is what the city shared this with that 56. So that's kind of what the portion of it is. I mean, we're only paying two and a half percent of that.

Yes. But anyway, there's two, there's two things I want to, I want to talk. I want you to explain, to explain because I've talked to quite a few people and there's quite a few people that are listening tonight. Number one, you bought 1500 gallons now you bought fuel on may 20th and you brought 1800 gallons so 1500 gallons lasted you a month and a half so if you take that you're using roughly a thousand gallons a month
forward to what we're doing. You're mentioning 1,000 gallons a month. We're going to a busy time. When I talked to earlier what Joey, Dakota Aviation, said their needs were this year, they figure they're going to use about 16,000 gallons this year. Just for them. That's not anybody else. So our usage is going up exponentially. He's bringing in, he's got two aircraft. He's got a twin that's going to be on board soon. is kind of that's old man we're going forward you know in in the future and it's not going to get any less right now i don't know what the current usage is but i know based on what we're doing right now it's a thousand gallons a month but this is now when it goes into this heavy time of the year we're about to enter the heavy iron we're not there yet typically that's just a typical year you know so july would probably be so this year i have to
where he's up to along because he has a huge amount that goes into it's only 2 000 gallon tank so so kind of tonight hold on do you think you get fuel and then he's not the only operator as you grow um you could get you could capitalize on transient travel and so other other plate schools that come through
passengers so right now we're kind of situation is is it's kind of as we've talked with extensively on it i think we kind of need to move forward and get this done so we can go on the next phase of this and um can you answer paul's question though how quick can you get fuel you know that's the problem is sometimes you can't get fuel immediately

The longest time you'd have to wait is two days. If you're going through 1,000 gallons a month.
So if you've got two days, you're going to have to wait for fuel if you've got people who want to fly today. Why do you have to be out before you call? That can be an issue, and sometimes it will. Flight is not just on a regular schedule. you can have a situation where you can not be flying for days because of weather. And in a week's time, you can blow through a lot of fuel very quickly. And at that point, you've got students that haven't been able to fly and now they want to fly right now. And so you can go through that 2,000 gallons and not
constantly checking the gauge and tracking. Why? That's his job.
That is his job. That's what we pay him for.
But that's, I mean, he does satisfy his job with the maintenance part of the airplane too. That's not the only part. It's just not how, I mean, it's not a very convenient or good operation to
maybe running out so often so that's my opinion you can have a different opinion but that's I feel like it's needed okay if you're so upset again I thought about it and I I I'll make this a motion if you're so set that you need I'll make a motion that we do this but of this $1,500, this one, and then the next one we got to talk about is another $1,500. And we have 14 hangers out there, 14 people out there, correct?
I guess I'm not sure the exact number of it.
So I'll make a motion that we surcharge each hanger 200 bucks to cover the $3,000. I had a meeting with the person that is involved with the T airport, and they're surcharging them, and they're happy to pay it. And the other part of this thing that we're sold that we need it, and what you failed to tell the people that are listening is the grant is not free. The grant has got to be paid back 100% if this airport closes. And I've had a talk with you guys. The average age of the people that are out at the airport are 54 years old. We don't know that this airport is going to continue on. If it doesn't, this hundred and some odd thousand dollars that you want tonight, plus the $8 to $9 million that we already have in it,
you're asking the city to come up with eight to nine million dollars if this airport closes correct i think when you talk about surcharges or first right so i think as a body city and airport that can keep on being discussed whether or not you charge more you know that's that's just separate from a project from a practical standpoint so understand this is the grant that's before starting the project, but surcharges can be adopted at any stage and they don't have to be.
We have a surcharge on our water because we had to fix something. You're asking to get a grant, but you're asking us to pay for it. I don't see the difference of surcharging the people that are benefiting from this grant. I looked and I heard that your tank was a 1991 tank. To buy a new 2,000 gallon tank, if you're worried about it rusting or whatever you're worried about, your cost for a new tank is $3,650. I got it in price for you today. A pump similar to that you got on there is about a $1,500 pump. So roughly... I can put brand new what you have out there for $5,000. I didn't grow up spending $100,000 to do what you want. April 5th, you paid, because I checked for you, you paid $4.35 a gallon. You got fuel on the 20th and you paid $5.44 a gallon. Let's say this tank would have came in and now you would have had to fill up. You had to bring in 10,000 because you're so adamant that you're going to save so much money. You would have paid 544 and you might have saved 15 to 20 cents buying a semi-load. You know what that cost is today? More than 50 cents less.
You're right, Paul. But we wouldn't have to buy that much. We can only buy what we need.

When it's high, we don't. When it's low, we do. That's the advantage of anything. It's any different than a farmer or someone that in the beginning of the year, they contract for their fuel oil or their propane going forward.

which one of the things that we are actively doing right now in fact they just didn't want to play our hand I guess and how we do that but you just recently got some other airports on different things and revenue generating things that we talked about a little bit with Sarah when she visited us

are paying their way and actually that's a great observation because the money that is coming from the federal government are airport user fees it is actually not coming out of the general budget it is the grant that it's been a long
your planning and alp like alp stands for airport layout plan we're already working on that and some of those recommendations that you're that you're all wanting there will be a report that i think a lot of us are in the dark a lot of us are in the dark about the airport and i'm having folks reach out to me saying i i want to see the minutes i want to see who's even on the board just like he said the tank was from the 90s the last alp was done project and things are progressing. Talk about potential growth and what's the right

Okay, the next one, let's move on to this. Airport KLJ Design submitted the design task agreement. Total was 59,000. We will receive a federal grant funding the FAA and state contribution that will make the city portion $1,475. The agreement for professional services and scope of services are attached. And that is on the website if you want to go look at that. And a motion is needed to approve KLJ's fuel system design and authorize me to sign it. Questions on this?
For the people that are listening that never got answered when we have two or three people standing there, the grant, so $59,000 is hanging out there for 20 years that if some reason that airport would close, the city is on the hook to pay that $59,000 back. So to be clear, This is not only costing the city $1,475. And as of total right now, we're looking at about eight to nine million dollars, million dollars, if that airport were closed, that somehow this city has to come up with eight to nine million dollars. And I'd like for anybody to call me, text me, email me, how you think we're gonna come up with eight to nine million dollars to pay this thing back. And I kid you not, they came up with the average age of a hangar, new owners of the hangars, are 54 years old. And if you happen to drive through Sioux Falls and see all these apartments, it's because this younger generation don't want to own anything. So I think it's time for somebody to start thinking that we want to fix infrastructure so we don't have a hole in the pipe every other week. Yesterday, not yesterday, Monday, whatever, Saturday, I get a call that a kid wiped out on a scooter on 2nd and Milwaukee. And we had a pile of gravel there, and we better get it cleaned up. I drove to 2nd and Milwaukee. It's where we had a water leak. And we haven't retarded yet. People, we need money to run this town. And when we start spending money foolishly, we are gonna come up short. I brought it up to the airport board. If you drive out to the airport, we have two semis and two 560 gallon tanks. Now I've been in the business long enough to where I get audited or whatever you want to say, and it's a big deal. We have two semis out there right now that are not placard. If we would have a fire out there, the fire department has no idea what's in them because it's not legally placard. There's two 560-gallon tanks that are not placard. I cannot see the 2,000-gallon tank that we're using and see if that's even placard. So instead of keep spending money, I think maybe we should take a step back and fix what we already have.
I guess I'd like to know what the difference is between A and B. They're both design grants.
A is the grant agreement with the FAA, and B is the agreement with KLJ to design for the grant.
So it's the agreement that's within A? Like it's not two separate charges?
Yeah, it's two significant charges. the same pool of money yeah it's not it's not two separate $1,500 charges to separate it's just the grant to pay for so it's just one it's just $1,400 75 charge yeah it just happens to be that they pay you back for the percentage and then and then no answer your question

The $56,000. That's the percentage. Right. The $56,000 is what the FAA is going to reimburse us for this project. $59,000 study. Right. For the $59,000 study. And then the state will do 2.5%. and the other two and a half percent so in total the project is 59 000 but the faa grant is only the 56. right yeah and then the data is also there two and a half percent in the state yeah yeah okay right
So it's a second agreement within the same project, same pool of money, not a separate agreement, not separate money. It's the same thing.

The wheel has submitted their operating agreement for the liquor license, signing under protest. Also, their agreement had a slight verbiage change from the operating agreement for liquor and wine licenses that were approved previously. So we require a motion to approve and me to sign the operating agreement, I'm assuming.

Aye. Now as the Planning and Zoning Commission appointments. The Planning and Zoning Commission had two positions open. So an ad was run in the April 9th, May 7th, and May 14th editions of the Sioux Valley News. It was also posted on the city website and Facebook. Three letters of interest were received for the planning and zoning commission met on May 26th and feel that all three applicants are well qualified. So their recommendation to the city commission is that the membership portion of the planning and zoning commission ordinance be updated to allow for all three interested people to be appointed. A hearing, first reading and second reading will be needed for updating the ordinance. And a motion is needed to move forward with the proposed change.
then how many would that make total?
Eight? What I suggested. Let's just say I would stay on it if all seven of them, there's seven of them, whoever asked that question, there would be seven of them. If all seven of them show up, I'm a non-voting person. If there's a person missing, I could sit in for that meeting. I would still, as my obligations of being a planning, zoning spokesperson, I still would go to the meetings. repeating, I would not vote if all seven of them won't be there. So the commissioner next year, if I'm not on it or whatever, it would carry on. They go, they listen, they only get to vote if there's somebody else missing. Because you don't want to have eight people so you could have a time.

right so if you approve we'll we'll be back with a full ordinance update for a couple of hearings i was just wondering if there was anything on statute providing for how that commission planning and zoning commission should be created and run i think the the happening uh i guess i'm not necessarily sure what the commissioner form of government but i don't think it's normally a requirement to have a
commissioner alderman or whatever on the planning and billing board i think that was just a local option we just added that last year we hadn't had somebody from the commission on the planning yeah we had jerry shot had been for years okay but didn't vote he sat in again kind of sat in kind of what you're proposing now yeah it looks like it's chapter 11-4 and i don't see anything that says there has to be a minimum number or a number
of commissioners on the board.

Yes. I can tell you that other commission forms of government, specifically the ones that I'm familiar with at the county level, but what they do or how they do that is, yes, they have an elected commissioner sit on that, but they only vote in the event of a tie. So I think that is a better course of following Robert's rule of orders action than what you're proposing. Just my opinion on my experience of attending lots of different kinds of meetings.
Because it could be three people missing. It could be five people, but you could be looking, you have a quorum.

Aye. Next is the issue of mosquito control. City of Sioux Falls has submitted a contract for the 2026 seasonal mosquito control. The City of Sioux Falls Vector Control Program counts the mosquitoes from our traps. The count signifies when the City of Canton will spray to control the mosquitoes. Our program focuses on the control of West Nile and not comfort for mosquitoes. The city attorney has reviewed the contract and a motion and a second is required to authorize this contract. Any questions? We need to approve the contract with the city of Sioux Falls.

We take our mosquito traps up to Sioux Falls. They hand count every mosquito in there to identify which species they are. And if we're an elevated number of the species that actually carry West Nile, then we spray. We can have really high levels, but if that particular species isn't

So i have found that other cities with the commission reform of government have code of ethics within their ordinance under for the commissioners um and it's just allowing the commission to be held to a standard of ethics um it's just something that's probably required in this day and age to have, and it allows the commission members to hold the other commission members accountable for things that may occur. And so under the commission form of government, don't have any way to remove a commissioner whether they are violating a law or doing something unholy um so what we can do is we can pass a code of ethics which allows us to censure a commission a fellow commissioner if something were to happen um so at least there's some sort of way to hold someone accountable for actions that are being done as a commissioner of the city. So most of the other commission forms of government have passed this. And so I have come up with some ideas. I passed them on to city hall. I suppose probably have the other commissioners review them before we bring it forth as an ordinance. But I think it's a really good idea to have just in the world that we live in, it's probably a good idea.

We tried to work with ALK and Novak to see if their trucks would follow us around as we pick up curb to curb. And they both weren't even available for hire, which is a little frustrating. So we'll have to go back to using the side dump haulers that we used last time. We are going to, apart from overall cleanup, we're doing, we're, Need to finalize it yet, so stay tuned for the. the finalized details but we're targeting the week of june 22nd through the saturday june 27th to do electronic pickup at or drop off at city hall okay we're also getting totes from they'll keep the totes in the garages at city hall and you know come in the doors at city hall and we'll take it and we'll go put it in the right tote or if you got a bunch of stuff we'll open up the garage door and then load it directly into the garage.
Will we have times when it'll be after 8 to 5?
We can certainly add an after 5. We're doing a Saturday, but certainly we can pick a weekday and go after 5 as well.
I think one of us could probably hang out and assist with that so that city staff doesn't have to do it.
Yeah, and it's not overly complicated. It's the four categories are regular tube TVs, which I don't think there's too many of those. And then this is the hauling of it away. We're going to go pick up the totes. They dispose of everything, recycle it. And even then, if we haul it back to Sioux Falls, there's no charge. So it's all because Lincoln County is part of the regional landfill. This program is through the regional landfill, so it has to become available in every community here. Just have to reach out and do it.
But we haven't picked any for regular cleanup.
