I'm an architect. I have a 30-person firm in Salt Lake City, Utah. My wife and I moved here five years ago. And we've always loved Cannon Beach. We brought a short years ago down And it's been a dream for us. We're just, I can't believe that we're here. It's really a magical place.

First item on our agenda is DRB 2630. That's an application to alter an existing commercial structure. This is a quasi-judicial hearing regarding DRB 2630. Steven Gerber of Gerber Architect LLC on behalf of Neuronper Inc. is an application to alter an existing commercial structure into a mixed-use structure. Property is located at 280 North Hemlock Street, Tax Lot 01-602-5101, dd and a limited commercial as a C one show the application will review against the criteria of municipal code chapters. 1770 oh to 1770 100 design review criteria say one objective jurisdiction of the design review board to hear this matter at this time. Does any Commission Member or anyone on zoom oh no. All right. Does any commission member believe he or she has a conflict of interest or personal bias?
I have a potential conflict of interest. I am a noticed property owner with a tent across the street that also sells beer to go. Thank you. Thank you. All right. Well, if it's an actual conflict of interest or potential conflict. So I agreed that to the board to decide whether I should be refused or participate in the discussion and voting.

No, I think that's up to your discretion as the board side if you think that that's, you know, she has admitted or proposed that it's a potential conflict, so it's a practice.

right can we please have the staff report i guess there are two things i do want to add public comments received through close of business yesterday september 16th were distributed to the designer view board and posted to the city's website yesterday evening and mr dean alterman who is counsel for the applicant has submitted a comment on behalf of the applicant that has been distributed to the design review board as a hard copy. It was received too late in the day to post online or distribute to the website. It will be posted tomorrow, but that has been distributed to the members of the board for their review. Moving into the staff report, just a moment while I bring this up. Can we get that out of the way here? Okay, moving into the staff report, The applicant proposes the conversion of an existing former gas station and auto repair garage at 280 North Hemlock Street into a mixed-use building containing a convenience store and one dwelling unit. The property is zoned C1 Limited Commercial and mixed-use buildings where the residential space is less than 50% of the floor area are a permitted use in that zone. Moving into the approval criteria, and this will be a somewhat long staff report because this is a fairly detailed application. Moving into the approval criteria from 1770 design review standards, starting with the site design evaluation criteria. Regarding the The function and uses and improvements being designed as to reflect and harmonize with natural characteristics and limitations with the site and adjacent areas. The staff comment is the subject property measures 100 by 100 feet and proposes a 40 by 82 foot structure on the southern portion of the property and 10 feet of off street parking spaces on the northern portion. Vegetated landscaping will be present along the northern portion, eastern and western property lines. The property is relatively flat, with a retaining wall along the western edge separating it from a hotel property to the west. Municipal Code 1740.050J specifies the maximum floor area ratio for a limited commercial C1 zone is 0.7. The proposed building has a floor area of 4,750 square feet, resulting in a floor area ratio of 0.47 on a 10,000 square foot property. Municipal Code 177120 specifies the minimum portion of a lot that must be retained for landscaping purposes. Non-residential uses are required to reserve no less than 20% of the property for landscaping features, including walkways, benches, and vegetated features. No less than one half of the 20% area is to be vegetated. According to the site plan, 673 square feet or 7% of non-parking hardscape and 1,770 square feet, 17 to 18% of vegetated landscaping will be provided. This results in a total of 2,443 feet or 24% of the property being retained for landscaping purposes. Continuing on. The building is set back 8 feet 9 inches from North Hemlock Street's public right-of-way. This includes the roadway, on-street parallel parking, and the public sidewalk. This setback area consists of a 3-foot, 9-inch landscape strip and a 5-foot covered walkway with two benches. The C1 Limited Commercial Zone requires a landscaping border of no less than 3 feet between the sidewalk and street frontage of all buildings facing the street. The proposed configuration conforms to this requirement. There are no features such as streams, rocks, etc. on the property. The proposed structure is generally similar to surrounding buildings in the downtown area. The current building is significantly out of character with the surrounding area and consists of dilapidated improvements such as a disused freestanding sign mount on the northeastern corner of the property. The subject property does not consist of any pedestrian pathways that connected to the property to the West. At present, pedestrian traffic is limited to the public sidewalk along North Hemlock Street, and the proposed configuration will retain this traffic pattern. This portion of North Hemlock Street in the north end of downtown does not provide any significant views of the beach or other scenic areas. The southern wall of the proposed structure faces a driveway, accessing the off-street parking area behind Bruce's Candy Kitchen. The property to the north is owned by Cannon Beach Conference Center, and the portion of the property abutting the subject property consists of an off-street parking area. This property is separated from the hotel to the west by a retaining wall and a landscaping area. Based on these conditions, there is no apparent impact of solar access to the surrounding properties. The off-street parking area consists of seven 9 by 18 foot nose-in parking spaces and three 9 foot 6 inch by 22 foot parallel parking spaces. These areas are separated, by a 22-foot, six-inch aisle. Municipal Code 1768020D specifies the number of off-street parking spaces required for retail and residential uses in the downtown area. Based on this code, one space per 400 square feet of a commercial building and one space per dwelling unit for a mixed-use building. The ground-level commercial space consists of a publicly accessible merchandise area, coolers, kitchen, stockroom, office, and bathroom and measures 3,195 square feet and requires no less than eight off-street parking spaces. The parking spaces themselves conform to the minimum dimensional standards detailed in Municipal Code 1768030A2. The required aisle width for a two-way traffic pattern is 22 feet 6 inches as per Municipal Code 1768030C. The minimum width is provided by the proposed configuration. The site plan indicates that the aisle will be used to accommodate after-hours deliveries to the store. There have been public comments that have described the property as a drive-through restaurant or facility. There are no features on the site plan that are consistent with this description. There are no drive-through lanes, signage, windows, anything like that on the site plan that would be consistent with the description of a drive-through restaurant. Continuing onward regarding the arrangement of improvements on the site, the portion of North Hemlock Street in downtown does not provide any significant views of the beach or other areas. The proposed layout is typical for a commercial building and off-street parking and a portion of the property reserved for pedestrian walkways and landscaping. The application does not specify where refuse bins are to be placed. An area measuring 12 foot 9 inches by 9 foot 6 inches is present on the northwest corner of the property where this may be placed. The property is not adjacent to or visible from US Highway 101. And the site plan provides one ADA off-street parking area with an unloading space. The public sidewalk has a pedestrian connection to the on street walkway that is separate from vehicular access to the parking area. Moving on to the architectural design criteria. The proposed structure will be a single story on the eastern half facing North Hemlock Street. This will step up with a second story on the western half, which will contain the dwelling unit. The structure will use a peaked roof with gables on the northern and eastern facades of the roof type, and this is consistent with other buildings in the surrounding neighborhood. The proposed materials, such as cedar shake siding, are commonly found in the downtown area. The ground floor of the structure measures 82 by 40 feet with a footprint of approximately 3,280 square feet. It will be oriented east to west in order to allow for an off-street parking area on the northern portion of the property. The proposed building, again, will be sited with cedar shake siding. The gables will use a board and batten siding pattern. Windows and gutters will be colored dark bronze as per application materials. The structure will be roofed with composite shingles. Three of the four facades include features such as gables, two different types of siding, doors, and windows. A covered walkway is present on the northern and eastern facades. The southern facade, which faces a non-public area on Bruce's Candy Kitchen property, has the fewest features. The total square footage of the structure is 4,750 square feet and is spread across two stories. Continuing on. Regarding the project being unusually large, likely to become a village landmark or is located so as to become a part of an introduction transition to the city or a particular district. The staff comment is the design review board will need to make findings on this criteria as to whether or not the proposal is likely to become a landmark or is located in a way that it becomes an introduction or transition to the city or downtown. Continuing on regarding the height of the structure. Municipal Code 17-040-050 standards for the limited C1 commercial zone states the building height, the maximum height of a structure is 24 feet as measured from the vertical distance from the average of the elevation of the existing grade to the highest point of a roof surface on a flat roof. to the top of a mansard roof, or to the mean height level between the eaves and the ridge for a pitched roof. The ridge height of a pitched roof shall not exceed 28 feet. Pitched roofs are considered those with a 5-12 pitch or greater. Based on the elevations included with the schematics, the eastern portion of the roof... will have a maximum height of approximately 15 feet 9 inches above grade. It should be noted that the application does not include an average grade calculation. Therefore, all elevations are based on the approximate location of the finished floor shown on the project schematics. The two-story portion of the structure has a ridge height of approximately 32 feet 4 inches, which exceeds the maximum ridge height of 28 feet detailed in Municipal Code 1740. Proposed condition of approval number one will require the applicant to revise the maximum roof height to conform to the development standard. Proposed condition of approval number two will require the applicant to include an average grade survey with a building permit application in order to verify that the structure is being built in a manner consistent with the code. Continuing on regarding the overall height of the structure, a two-story structure that conforms to maximum height standards in the limited commercial C1 zone will not have an adverse impact on scenic values to the surrounding area. Regarding the ability of the design to sufficiently address the relationship of the structure to the sidewalk and pedestrian activity, The design places the commercial portion of the building and the public entrance close to North Hemlock Street in order to facilitate ease of access by pedestrians. No signage is included with this application. Project schematics show a sign on the eastern and northern gables of the first story portion of the roof facing the off-street parking area and North Hemlock Street. Signage is subject to municipal code 1762 signs and a permit will be required prior to the placement of any signage. No freestanding signage is proposed by this application. Regarding lighting fixtures, No information is provided about building mounted exterior light fixtures. It should be noted that convenience stores are typically well lit internally, which may create conditions out of character with the surrounding area by casting glare during nighttime hours. Proposed condition of approval number three would require the applicant to adequately screen the windows in order to avoid casting glare during nighttime hours. Moving on into the landscape design criteria. The design plan consists of 10 different plantings. The design review board will need to make findings as to whether or not the proposed landscaping plan conforms to the criteria of the design code. The proposed building will create a vegetated landscaping border along three of the four property lines and provide a buffer between the public right-of-way and the building. The landscaping plan consists of the following plantings, showy abelia, California lilac, fountain grass, European hornbeam, Spanish lavender, Mexican feathergrass, wildcurrant, shore pine, evergreen huckleberry, and creeping rosemary. the application does not include information regarding on-site the maintenance of the on-site landscaping there are two benches included under the covered walkway that would face north hemlock street at present the only vegetated portions of the property are west of the retaining wall adjacent to the hotel's off-street parking area and along the northern property line The proposed design will increase the overall amount of vegetated landscaping on the property. The landscaping plan includes 10 different plantings which have been discussed. The paved surface of the property will consist of a combination of asphalt and concrete, and the site's topography is generally level, with the exception of an elevated portion along the western property line. According to the application materials, this portion of the property will be planted with California lilacs, which is a flowering shrub type of plant. The design will retain this existing wall and not make any modifications to it. The majority of the property is publicly accessible access to the upstairs dwelling unit has a significant separation from the public entrance to the store. And the landscaping plan shows four bollard lights located in the landscaping along the northern portion of the property and three foot lamps located along the pedestrian walkway. The application's narrative states that the exterior illumination will be limited to 630 lumens per parking space and that the fixtures will have shields casting the light in a downward direction. And that concludes the staff report.
Is there any additional correspondence on this application?
No. As stated prior to delivering the staff report, the public comments were distributed to the board yesterday and Mr. Alterman's letter was distributed prior to this meeting.
It is September 17th at 2.30 p.m. So it is on the web. It is on our website. And we have a letter from the applicant dated September 17th with an overview of the position of the applicant as to . So we'll hear more about that during the public meeting. All right, so we're going to call for public testimony. The pertinent criteria to be considered are noted in the staff reports. and listed in the criteria sheets posted on the meeting page of the city's website. So the rules of the public meeting are testimony, arguments, and evidence must be conducted toward that criteria or other criteria in the comprehensive plan or the municipal code, which the person testifying believes to apply to the decision. Failure to raise an issue accompanied by statements or arguments supporting that argument to afford the decision-maker and the parties an opportunity to respond to the issue precludes appeal based on that issue. So prior to the conclusion of the initial evidentiary hearing, which we're having tonight, any participant may request an opportunity to present an additional testimony, arguments, or evidence regarding the application. The Design Review Board shall grant such request by continuing the public hearing or leaving the record open for additional written testimony, arguments, or evidence. So persons who testify will approach the podium and will first receive recognition from the chair, state their full name and your mailing address, and if appearing in a representative capacity, identify whom they represent. First, we'll hear from the applicant.
Matt. This is Matt, Chair and members of the Commission. My name is Dean Alderman, ALTDR, and my address is 805 Southwest Broadway, Suite 1580, Portland, 97205. I'm here as an attorney for the applicant and property owner, Deer and Carr Incorporated. Short version of the agree with the staff report, we asked me to adopt staff report as your decision. The staff report identifies only one way in which the project as revision will be submitted does not meet criteria and that is the height. The height of the building as revision will be designed and submitted conforms to C2 that this is a C1 for which the standard is four feet short. I have attached to my letter a revised which the applicant can readily do. We need criteria. I have gone through the objections.
So the nearest height would be 27.8, right?
27.8 would be the original. As I understand the code, 28 feet is the maximum. Yes. 24 feet under the definition of height where it's the average. We would need that as well. Yes. All right. Thank you. If you have any questions about the architecture, Mr. Gerber is here to answer. I read through the objections and the only one of the criteria that any of the objections seems to touch on at all is 17.6. including a separate service area for delivery and goods. I say that the objections touch on the bagel man is not really relate to the arrangement of the parking lot of the dry animals that appear to be a more generalized complaint about traffic on the parking lot. So that people do not have to try to back out into a monster that I think was an issue before you earlier and the Apple was resolved that issue. That's the only objection that relates at all criteria. Mr. St. Clair brought up another point 1770.090 F, which is Relates to whether a site is likely to be abandoned. to become a landmark under the redevelopment. The first reason is that although it's a much nicer building, it's much more in keeping with its environment for what is going to be built in the current gas station. This current gas station is much more intrusive than is a landmark in a negative way. This building is not . Second is that by the time people get to the frontage here, they are already going north or south on Hemlock Street. This is not a building all the others. One final comment, although I don't see it as being a conflict because the issue before me was not the use of the design, I do appreciate Commissioner Duber's sensitivity to that issue and stepping down. It's a tough position for a Planning Commission to be in, but I do appreciate that. So thank you very much.

So I'm speaking as a proponent today, and there are three things that I want to touch on. The first is that according to the staff report, the builder is complying with all the city codes. So if that's the case, my second point would be to ask what codes are they not in compliance with? Because as far as I understand it, if someone is building something in compliance with the city code, there's nothing to do but to approve the proposal. to some of the city council meetings recently. We talk about it a lot, but as noted in the last presentation, the city's built three significant developments in the last seven years, and that is not on track to meet what we need. So I would just add that, I know that's not the main point today, but there are people who would like to be a part of this community that can't necessarily afford a two million dollar house. And so I would like you to consider that in addition to focusing specifically on applying the code uniformly, And not, as you pointed out, finding different ways to get to know. So that's all I wanted to say.

Okay, cool. My name is Michelle Vallegura, PO Box 719. I would like to echo Amber Fowler's written comments, especially where she points out that Cannon Beach should not become this town on accident. In the comprehensive plan, it states visually attractive commercial areas, which reflect the coastal location and incorporate a high degree of pedestrian anemones and landscaping. A rustic streetscape that permits informal private landscaping and irregular lines to roadway improvements. Public spaces that foster a high level of community interaction. Small-scale family-owned business. Okay, I repeat, small-scale family-owned businesses. Commercial use that detract from the unique character of downtown are detrimental to the small-town atmosphere. This includes formula food restaurants, places to hinder places like Taco Bell and McDonald's. So I went on this deep dive recently when the Only in Cannon Beach store opened. literally appeared overnight. Almost every locally owned business sells sweatshirts in town. After a quick Google, come to find out, there's also an only in Depot Bay, an only in Newport, an only in Oregon, not to mention an only in Sausalito, only in Santa Barbara, and only in Palm Springs. The parent company email leads to Sauk Harbor, which is exact cookie cutter locations in Cannon Beach, Oregon, San Diego, California, Santa Barbara, Solvang, Sol Salida, Monterey, Newport Beach, and Huntington Beach. The parent company of all of this is owned by and operated by a company in Fairfield, California named Ocean Beach Sportswear. From their website, they describe themselves as an efficient production team that can produce things quickly and cost-effectively. This by no means is a small-scale family-owned business. We need to take care of our community and not roll over to big business with deep pockets. On that note, I personally am not a fan of what's happening in the north end of town. If the site plans, I feel like, oh, wait, see, nope. If the site plan is approved, we'll now have four parking lots in the north end of downtown, the opposite of what the comprehensive plan suggests. After spending four years on DRB, I'd like to encourage a denial on the site plan on Section F, the degradation of scenic value and surrounding area, and H, the design not encouraging a pedestrian over vehicular. There's probably more, but I stopped reading after the parking lot. One more side note, positive side note. The application for Sandpiper Square is beautifully and respectfully put together. Just obvious upgrades without degrading a beloved landmark. Thank you so much.

Hi, this is Amber Fowler, PO Box 657. I just want to reiterate you've gotten my letter in the packet. I want to reiterate that this requires this specific plan that's before us, an application that's before us, requires us to be very thoughtful and use our powers of interpretation and understanding and application of context. We are not in Seaside. We're not in Warrington. We don't need a stop and go in the center at the beginning entrance of Cannon Beach. We don't need a 7-Eleven in Cannon Beach. This was everything that all of our predecessors had worked hard to stop so that we could create and keep the character that is Cannon Beach right now. We have several other markets. I understand that the purview of DRB is not to go against the actual type of business and to go toward the design and the concept. But I will question that this is not what we want to see visually. as you enter Hemlock, the first thing that you see. And I agree that the gas station is not aesthetically pleasing, but that doesn't mean that we should lower our bar or resort to giving in to convenience stores. That's all. Yes. Staff recommends approval of the application subject to the following conditions. 1. The roof height shall be revised to comply with the maximum roof height standards of Municipal Code 1740.050. 2. The applicant shall provide the Community Development Department with an average grade survey when applying for a building application. 3. The applicant shall screen the interior windows in order to avoid casting glare from interior lights during nighttime hours. 4. All required building permits shall be obtained prior to the start of work. and a proposed fifth condition of approval that would address comments related to the concerns being raised that this is a formula food restaurant, and that would be that a determination be made by the planning commission regarding the status of whether or not the activity meets the definition of a formula food restaurant. Now, that being said, this appears to apply only to the deli counter portion of the application, which is an interior feature of the structure. That is a feature that if the Planning Commission does make a determination that that would be a Formula Food restaurant, that is something that could be deleted from the interior of the building, and that would not affect the site plan, architectural plan, or landscaping plan being reviewed by the Design Review Board at this time.
That. So what you want to be urban and you're this.
Chair. First, as to the parking objection. Code requires 13 per. It's very difficult to build a building with no parking under your code. So if anything is ever going to be built on this property, there is going to be a parking lot. That is to be a requirement of the code. This applicant had really got asked to reduce the parking requirement to have a smaller parking lot. And the city turned the applicant down on that issue. So if they're providing what the code requires, they're not providing an excessive parking, they're simply providing the code. I appreciate that Ms. Valliford is objecting That she's a Japanese something the applicant has no choice but to build on the side. With regard to chain clothing. Can beaches code doesn't prohibit chain source it doesn't read that chain clothing this isn't important story any cases, and it isn't relevant, but it ties into the other attraction this following waiting to formal food restaurants. Your code, your zoning code does not define what a restaurant is. The only definition you have of a restaurant is in chapter three, full taxes, and that defines what a restaurant is. There's no suggestion that some outside force is going to require Mr. Singh to have the staff wear the uniform of somebody else. Whatever requirements, they are for exterior design, they're not coming from headquarters, they are coming from the city code from this day. That is not a that's not an element of speeds. There isn't that sort of chain element to food corporation, the sense you might have for a franchisee of a McDonald's or a Burger King or another fast food restaurant. There's no obligation to offer standardized names or ingredients, whether or not the deli calendar is a restaurant. And therefore, all of the objections that are related to formal restaurants, however, within the for can engage simply don't invite this project, because the applicant is not supposed to be operating. Yet you took that the interpretation that I believe miss Fowler is. Encouraging me to take I think you have real problems with with finding a pancake operates. This is not a restaurant. It's certainly not a formal food restaurant. It complies with the code. And again, I would ask you to adopt the staff report with the conditions, with the revisions to the building height and the requirements of the grading plan and grant deferment. Thank you. Thank you.

uh warren hasn't been presented at this meeting um so um i i would refer you to the um public comment um from wall champion uh and it does ask in the uh subject line there while regarding drv from the 630 uh 280 north hemlock opposition request for continuance uh Ms. Jamping hasn't presented anything tonight, but, you know, to, I think, be cautious. I would, you know, recommend that we do continue it. I mean, there's the alternative to continuing it to the next hearing, or you can do the 777 option, which would leave the record open for seven days. Then participants can then reply for seven days, and then the And it closes it. So you have a couple options on that. But I would recommend it continues.

Sure, yes. I'm in favor of continuing as well, too. I think this is such an important location. This is really challenging right because we can meet the guidelines. letter by letter, but what is the intent to maintain character. There are some subject just as you mentioned yourself that the gas station is under the as an architect, I see a great opportunity in the charm factor and the character of that building. Just a little bit more reaching now. I understand your client owns the property and so they have the right to do what they like with that, but that the gas station is ugly and, you know, I just don't think that's, I just wanted to make sure that was your opinion. Also, landmark position is it's not the first thing you see when you come into town, but as you make that turn, it is part of the sense of arrival of the town. It really is the introduction to Hemlock Street and the way that You know, with the parking lot. And again, there is an existing parking lot across the street. There's holes in the teeth, right? And I've seen there, and I'd love to see a little bit more, you know, integrity in the language, the continuity and structures to create that just consistency and character of the street. Again, I don't know how much of that we can really get into today, but You made that sort of the partners of the program to now think about for cars and everything again that's contributing to that sense of arrival experience so perhaps extensive landscape, you can help with that. And then. I need your caution. Your caution there against a big strife building. This seems to be generational. So it is. This is a weird but weird, very magical town. People have been coming here for generations. Watching it change is not going to be easy. So that being said, I don't know what we have control over again, right? I must be asked if I would like a convenience store that I've seen on the highway put into the very charming walkable street that I walk down every morning to get a pastry, I wouldn't want that. It would change the character. I believe part of our decision is based on his pedestrians. Well, I see the nod toward the architect for a wraparound porch, perhaps, right? It's going to be like that. Again, I'm thinking of Charlie sitting on the porch or walking down that boardwalk, that can be, it's only, five feet now that almost feels token. I don't see the benches and the columns contributing to that space really being not inviting toward the best dream. Perhaps if that element was more defined and more inviting, more wider so it would actually be functional, that might have to take away from the square footage of the building itself. So I believe there are lots of opportunities to kind of lean into that best dream to become more a part of the towns. Just Trying to say they're doing the character. So much of this is subjective. But because it isn't such an important location. I would like to work with or at least challenge the architect to know, let's Let's make sure that we're really putting our best effort for a fast one of the first impressions. I'm going to see as I think that know i think these things should be really well thought out and um you know mr author just by a sketch lowering the roof four feet we need a lot more information than that right how does that interact with these cables now right is that four feet can be lower than those cables what are the roof pitches of cables we have multiple roof pitches now um i'm not i believe this location deserves some well thought out So really roll up our sleeves and get into the design and make sure that it doesn't just check the boxes of the design guidelines, but that it responds perhaps to the intent of those guidelines to enhance the character of our human. Yes. The applicant proposes to convert an area of vegetated landscaping to a paved area consisting of commemorative bricks that will be placed in support of the Cannon Beach History Center and Museum's fundraising efforts. This application would be for the approval of a brick placement area. Not all bricks will be placed at this time, as the commemorative brick program is going to be an ongoing effort. Moving into the site design evaluation criteria. The staff comment is that the subject property consists of two tax lots with a combined square footage of 33,920 square feet. The majority of the larger tax lot is undeveloped and no proposal exists to develop it at this time. Based on application materials, the papers would be placed in the southwestern portion of the corner of the property near South Spruce Street and West Sunset Boulevard. It is noted that this places the papers in close proximity to the public rights-of-way of both of these streets. The proposed conditions of approval require the applicant to constrain the placement of the papers to the Cannon Beach Historical Society's property and not to encroach into the public right-of-way, and to conduct a survey identifying the southern and western property lines in order to be able to avoid encroachment. The Public Works Department has been consulted regarding this project and no issues have been identified so long as the papers do not encroach into the public right-of-way. Moving on to the landscape design criteria. Municipal Code 1770-120 Landscaping Standards specifies that no less than 20% of the lot being developed for non-residential uses be retained for landscaping. with half of that area consisting of living plant material. The application materials do not specify a total area to be covered by the paver installation. However, it is noted that a significant portion of the property, estimated to be approximately 28,890 square feet, is in a natural condition and will not be affected by this project. No changes to lighting fixtures or signage are proposed with this application. And that concludes the staff report.

I'm so sure. I lost my voice from this weekend, so we decided to make a fundraiser. I'm Liz Scott, representing the Cannon Beach History Center Museum, PO Box 1005, Cannon Beach. And I pretty much repeat everything that the staff report said. Yes, we are doing this legacy brick project as a fundraising project for the museum. This is an ongoing project that we plan, we hope to continue It's kind of like a memorial for people that have lost loved ones, people that want to commemorate someone in support of the museum. And so this is a great way to honor people as they can see it as they come through the museum. And we also chose this spot because this is a spot that does not look great. And it has not really grown. The grass just does not grow there. So it has never looked great. So this is kind of why we chose that spot. And so we, that's really all I have to say. I don't really, it's kind of self-explanatory to look at it, so.
And remind us how big this structure will be. Yes, it's flat. I have like 12, about 12 feet by 7 feet.

Application materials indicate that there will not be any changes to the landscaping or exterior lighting. This application does not apply to any tenant improvements at individual businesses. Moving into the approval criteria. For the site design, the staff comment is that the subject property is a rectangular 29,873 square foot lot measuring approximately 150 by 200 feet. No changes to the overall layout, structural plan, or off-street parking areas are proposed. The eastern elevated boardwalk will be expanded to approximately 2,340 square feet, and new columns supporting second floor decks will be added to vegetated areas on the northern and southern facades of the rear portion of the building. No landscaping will be removed in order to accommodate the new decks. Municipal Code 177120 requires that no less than 20% of non-residential properties be reserved for landscaping purposes, with half of that amount being vegetated. Based on the site plan, the property will have a total of 10,660 square feet that meets the definition of a landscaped area, which is 35%, and 5,303 square feet of that will be vegetated. Moving into the architectural design criteria. The limited commercial... Yes. The limited commercial C1 zone allows for buildings with less than 50% of the residential floor area for residential use. As configured, this building has a total floor area of 20,765 square feet per Clatsop County Assessor Records, with two apartments measuring a total of 1,830 square feet located on the second floor of the western portion of the building. The applicant proposes to replace existing windows, add sliding glass doors, and provide each apartment with a deck with a planter box on the railing. New planter boxes are also proposed to be added to existing second-story balconies. Additional changes to the building include... Good evening, and thank you to the committee for your consideration. My name is Michael LaFleur. And your address. It's 80644. This is a Just a passion project for us. We are so honored to be part of the community and then deferred maintenance, extremely. So we're here, we would like to really bring this back as much as possible. That's what this presentation is meant to be. So thank you for that. And I did put together this book, I think it's on with the PDF as well, too. And if we can go through because there are several components of what we're proposing. This is the front two things of an existing fountain there that was being fed from the well that has now been abandoned and it's just quite full of bacteria it doesn't feel like it it can be salvaged but we also think that it might be better purpose for every purpose is just a giant hydrangea garden so we're we're really just that was submitted in our package from, it was a spreadsheet from Rita, but I can get that to the community, but we'll just perhaps lose the fountain. And then the other thing is this boardwalk currently on the existing, you can see at two angles, a brick and a wood come together toward the main door in the middle with the stairs that go up to Jed Riegel's gallery. I'm watching people try to navigate around that tight corner. You can see where it almost posts me close there. It's about four foot opening strollers and everything. We believe it would be more inviting and better circulation to all the tenants here if we were to just just to angle that out. We really aren't losing anything as far as vegetation goes. It's very simple structure. I have a foundation on both sides of the right angle. It would be easy to do that. We would maintain or try to match detracts decking. Unfortunately, that decking is no longer manufactured, but we will get as close to the same color and just the recent version of that. The second page is showing a couple of things. This is the, there's an apartment on the east side here and the existing, you see this railing up there. This railing is falling down currently. That whole deck needs to be rebuilt. do versus the recipient lots of water sometimes. So that's going to happen as soon as we can get access to the deck better. But in the meantime, instead of that, I'd really like to propose just an extension of Rejectory Hole and Carolyn Dunn, their flower boxes. It's such a great part of the elevation of this building. I just believe we could just carry that theme across that would meet the criteria of height for a a guardrail, but we could do it in a much more organic manner, a little bit more pleasing crafts and, you know, a continuity to the language we're trying to achieve here. The other thing on this east façade, you can see we currently have these white K-style rain gutters and downspouts. I would like to propose we change that to a five-inch half-round copper gutter with four-inch diameter downspouts. see um now we're moving to the uh this would be the southwest part of the building again just adding some additional flower boxes to the existing railings um hopefully that's and again we're working with rita and h we've actually we when we shut down the well we provided now city water and we have water uh locations uh opportunities to all the On the east side again we have some existing sconces and I know it was mentioned that there's no new lighting in this but I am proposing that we could redo those sconces and then I bought a sample of what that disease and I'm open to deliver any additional information on that as needed or requested by the committee. This is the to bring the courtyard back, read it, and add these posts, additional posts with flowers on them. I realized right away, probably I need to get some food from the committee for that, so I apologize, but that's part of the reason I'm here, to help trigger this. There was concern from Jeffrey Hole and Carol, again, what happens in the winter? What will they look like? There are winter baskets we've looked at and we're not quite sure. We'd like to propose perhaps a lantern of some sort that could anchor that same bracket I can get power there. I defrost the lens on it. I have one. I was hoping one could bring it tonight as an example, but it's still being out for delivery. I'd be glad to provide that to the community. And that would just be changed seasonally. So it might also offer a little bit more lighting in the evening through this center. And it could be dimmable. We can have full control over that experience the next where chef jeff's restaurant was for a minute and also um prior to that it was the organic um routine i think and shorter was i think before that too which is an extension of english um the the new tenant was My wife, she would like to add a window on this wall. I agree with that and bring one natural light in. This is something that we do need to ask the committee's assistance on. There's currently a shoreline sign you can see that apparently this never was taken down when that store was no longer in that space. So we would like to perhaps repurpose or relocate that somewhere where it makes more sense as part of the existing store, which should be on that north side. And I'm open to how the community would like to handle that. I don't know how we can go about that. I do know if the window would be improved. We are getting close to wanting to install that because that does work with the interior aspects of the store that we're doing. So I need to get the window in whenever it feels appropriate there. However, we can work with that. I'm sure I'm not sure, but I have a feeling, perhaps the tenant and the hurricane and tubers and shorelines may not want to move that sign, but I feel like he needs to be addressed. So that's something that might ask me how we handle that the backside here. This is a page nine. It's the backside of same tenant improvement. There's a window there. You can see this open in the picture. We would just like to replace that with the door. We can get deliveries on this backside very easily. Also, it would be nice to have a secondary exit. Just you would feel better about that. And we're matching the exact door that is currently on the front. We're just having a remain. We would like to just have it same size. I don't have to change the headers or any structure. I'm just sliding it into the same space and taking it to the floor. This next page, this is page 10. The mismatched decking that's on the back of this building in front of men, it's an existing wood deck and toward toward the east there it's the tracks decking. Part of Providence's, they re-signed their lease and part of their request to do that was that we would make all the deck the same material. So I hate to pull up wood deck for Sympathetic toward that, but I think it would be in the system. So when asked for the request, that's what we're performing. You always want to make sure that things work out. Next page, page 11. There's existing. there's been complaints that those railings are very unstable and so that would be our proposal there. You can see what it was before and what I'm proposing there. Page 12, the building definitely needs to be restained, repainted. This is an example of a color that I presented to Robert and staff. and the color of the trim as well and we're going to do some kind of a mock-up for that i would though love to have the opportunity to to make sure we mock up this color on the building on that uh the back side where we're actually affecting it to put the door in i think i need to repair that and and repaint it anyway and just to make sure we get the right tone and i would love to notify the committee if they would like to see uh you know what that color actually would be for their approval I'm totally fine with that. I'd like to do it as part of a team. I just thought I would love to take the stain off, but I just don't see a way to do that without a lot of parts of the building, perhaps. And so we'll just keep it stained and darker, but just maybe a little bit more, a little more expressive. I'm not sure. That's just where we're heading. I said, there's a lot of window trim that some of us saying some of us painted and some of us not be consistent. We paint Asia. Just kind of bring the building back. Because it's, it's, it's time that means. And then finally, on the back of the building here on the north side on page 14. be a slider, I'm sure, and create a deck there just to make that upper apartment a little bit more inviting, a little bit more engagement to the community, because right now it's just kind of tucked away back there. And I'd like to be the same on the north side. And there was paralysis, you're correct, on our original simile with this loss of green rings. And I'm silly, so it's not a part of this presentation. We've eliminated that. There's an existing Shakespearean that wraps around that. I don't know what to do with it. So for now, I'll just thank you. Thank you very much.
