So they have an additional um and lastly it's uh the density bonus. So it's just updating um regardless of what was in the code um staff process um uh projects and density bonus uh request per state law. So essentially what the zoning code is uh what the uh this amendment is doing is just aligning that. So aligning state law with the density bonus what what it is as part of state law. Um and then lastly, this is not part of um the zoning code or nowhere really in the zoning code, but um as part of this project, we developed an ADU guide. So, it's essentially it's a a pretty straightforward guide um of what's required for ADUs, what's allowed, what can you do, what your options are. Um and it really it really simplifies the process. Uh simplifies it both for the applicant, both for staff. Um so that applicants, they know what what they need to have when they come in. um it really can speed up the process, speed up the processing for for your staff here. Um again, also with SB35, um so this is

I um with SV35, uh we established just a checklist. Um again, so it's easy to process. It's it's part of um uh California state law. You must have a checklist and an applicant can come in and say, "Hey, I have this, I have this, I have that." Um, and that's also going to be essentially just a sheet that's at the planning counter to to speed up processing for uh SP35 projects in the city. Um, and lastly, the replacement housing. This is the same thing. It's a form um that an applicant proposing a new housing development must fill out this um sheet stating, you know, if you're replacing any existing units um if there's a threshold of five units or more. Um, under circum circumstances, you may have to replace those units elsewhere. um or um uh in very specific circumstances like build them into your project. U with that I'll pass it back to Kelly.

Sure. Okay. So, we did receive um one item of public comment on tonight's public hearing. It was received from the California Housing Defense Fund and they have um a number of concerns regarding the ordinance's compliance with various provisions of the state um law specifically as it relates to ADUs. So um as Bryant discussed, there are a number of revisions that are being proposed in the zoning ordinance. Um but this letter is specific to ADU revisions. So, the city attorney's office is um taking a look at at the letter and will ensure that if any uh revisions are needed to the ordinance that they will be made prior to presenting the item to city council. So, I'll remind the commission tonight's action is a re a recommendation um to this city council um not approval or denial. And so, um any revisions that are needed um per this letter will be um considered again prior to city council's consideration. Um and then Katherine is going to provide us with a revised uh recommended action if you want to go through that.

Well, just one of my concerns. Uh I seen uh the the whole edu situation is going down in San Diego. I guess one of my concerns that you know uh people just find a way to bypass a lot of uh um stuff that's implemented by the city like and so my concern is that you know they're they're going to be stacking up these ADUs you know uh from property line to property line. So that's one of my concerns with it because in San Diego it's already happening. you know, they're stacking them up two, three stories. And you know, these little residential lots have like 15 units on them sometimes. So, and very limited parking, too. So, that's just one of my concerns. It's a resident in here. Good. Fine. Not so far. No.

Yes. Ass always my biggest concern is the state stripping the power from the city which we're supposed to have with zoning. They've decimated our zoning [clears throat] regulations but this comes down from the state and the powers be till we have our next election and replace them all. Yeah, wishful thinking. Um yeah, that's just my biggest thing. Uh I've been up on the ADUs San Bernardino city has been on there and they actually have the processing. I would recommend staff talk to anybody over there. They've actually got a pipeline and they've got their plans that they'll actually give to the homeowners and yeah, they've been on this for it's probably at least three years or something. They were ready for it. So, I would advise staff to check them out. But that yeah, it's what we got to do, we got to do. So, thank you.

Just don't have the exact date on that. Um but once we get that expansion open, I'm sure we'll have additional events to occur at the new park. It's getting closer. It's getting closer.
