Number two is consideration consider approval of a declaration of taking order and resolution to condemn property identified as parcel 0302-034 for the Brian County Mil Creek Church Road rightway. This is the final parcel final rightway needed for the Mil Creek Church Road rightway project. The county is proceeding with the Mil Creek Church Road rideway for the purposes of construction, continue maintenance of a proposed rideway acquisition to provide suitable, safe, and reliable access to Mil Creek Church Road for the benefit and use of the public at large. Um, this property is owned by Linda Cavalero, Brenda Hamilton, Rose J. Smith, Carlotta Dukes, George Rudolph Johnson, John H. Johnson, and Yolander A. Johnson. This is, like I said earlier, known as Bryant County PIN number 0302-034 and the appraised value for said property is 1,3102. And I can answer any questions on this one. Any questions? If not, we

These are parcels three and six of the Brian County Wilma Edwards Road Church of God Road Highway 280 roundabout project. And the owner of these properties are TMRP Commercial LLC and TMRP Properties LLC respectively. The Here we go. Um, like I said, this this item authorizes the county to acquire from TMRP Commercial LLC and TMRP properties certain right ofway and easement rights upon the property in Brian County identified as tax parcel numbers 0251-049 and 0251-050. The county shall pay $190,000 in exchange for the right ofway and easement rights upon the property. And I'm happy to answer any questions on this one if y'all need. Need a motion on that one. The owners here um are Elaine Turoslavich Shurl and Susan Carlick, trustees of the Alda Smeilovich Turoslavage IR irrevocable trust dated February 13th, 2017 of the state of New York. Um, like I said previously, we are acquiring uh certain rightofway and easement rights from parcel one, and the county shall pay $8,500 in exchange for the right of way and easement rights from parcel one. roundabout project. Uh this parcel is owned by DK&D Ventures LLC and that is Brian County pin number 0251-021. The appraised value for said property is $69,300. Um, Gage, on this one, I do understand that there is some uh still ongoing conversations and that there is a uh presentation from DK&D regarding uh maybe a potential for another consideration uh for their an appraisal that they have received. So, um, I would encourage you through this process to continue to negotiate with them in good faith and see if we can come to an amicable resolution on that. Okay. Certainly. Certainly, we're we'll actively, you know, work towards a settlement with the owners of this property even after the initiation of condemnation proceedings. All right. A motion on that one. So, the county is proceeding with the Brisbane Road Rehab and sidewalk rightway for the purposes of construction and continued maintenance of a proposed ride ofway acquisition to provide suitable, safe, and reliable access to Brisbane Road for the benefit and use of the public at large. The uh property to be condemned here is um a temporary easement and the property is owned by Beatric Simmons, Clarence BS, Charles BS, and Gary BS individually and as descendants of Washington Williams. This property is known as Brian County PIN number 054-062. And the appraised value for that temporary easement is $50. And that is the same for the next several items on this are temporary. Next up is the consideration of a mutual release settlement agreement between Caesar Stone Technologies USA company and Brian County, Georgia. Yep. And this is um a mutual release and settlement agreement. Uh got a background here. Caesar Stone Technologies USA uh entered into a master agreement with the development authority of Brian County, Brian County in the city of Richmond Hill on October 29th, 2023 and then a second master agreement between those same parties on February 17th, 20 I imagine that's a typo, 2025. Um those agreements uh provided for property tax incentive and deductions. Um following that a a dispute arose and the settlement agreement mutual release here allows for um the resolution of that dispute and um a payment related to that dispute to the county which settles and disposes of that dispute. the agreement. Under the agreement, it requires Caesar Stone to make that payment to the county within five business days of the execution of the agreement and um further requires Caesar Stone to acknowledge that um their tax liability moves forward um will be due and payable as of 2025. Caesar Technologies USA entered into a master agreement with the development authority of Brian County. the development authority, Brian County, and the city of Richmond Hill on October 29th, 2023. A second master agreement between those same parties on March 17, 2015. Those agreements provided for property tax incentives and deductions. In December of 2023, Caesar Stone announced that it had decided to shut down and ceased operations at its facility located at one Caesar Stone Drive, Richmond Hill. On June 26, 2024, the development authority entered to a termination of bond documents. The termination of bond documents that acknowledged that Caesar Stone had not met had met all of its obligations and further that property tax incentive and reductions were not subject to repayment, penalty, or capture. In July 2024, without having the notice of termination of bond documents, the board of commissioners authorized the county authorized the county attorney to investigate and make demand if appropriate on Caesar Stone under the agreements. The county attorney conducted an investigation and made a demand without having a notice of termination of bond documents. Since that time, the parties have exhaustively negotiated resulting in a proposed agreement. The agreement requires Caesar Stone to pay $500,000 cash to the county within five business

days and further require Caesar Stone to acknowledge that all taxes moving forward will be due and [Music] payable. Okay. Need a motion on that. Read it in.
