Thank you. Okay, our agenda this evening is as follows. This was posted on the town website and the town board. Number one, Brunswick Acres, major subdivision. Applicant proposes a major subdivision in regard to the Brunswick Acres planned development district on approximately 44 acre parcel of land located along the north side of Brunswick Road, New York State Route 2. just west of Heather Ridge Road, Brunswick Road Development LLC is the applicant. And that is the only item we have on our agenda tonight. So moving forward with the approval of our minutes of May 6th. Has everybody had an opportunity to look at those? Is there any corrections, additions, Changes?

Hi, good evening. Andy Brick from the Brick Law Firm. Thrilled to be first on the agenda. So thank you. We were here at your last meeting and Russ Reeves, the town designated engineer reviewing the project, had requested that we get updated correspondence from the Army Corps regarding the project. My client was able to obtain that on Monday, sent it right over to Russ. I would defer to Russ, but I think we closed the one loop necessary in order to schedule a public hearing on the application.
Yes, we did receive that. We did receive copies. We also tonight received a copy from the Corps back in February of 12th of 2020 to compare the two. So... I think the question I have now is for Russ Reeves to come up here and possibly make a comment on this, whether this suffices what we were looking for.
Good evening. Commissioner Bradley of the Water Department and Director of Code Enforcement, Mr. Minello and I, we reviewed the document. And we found that acceptable, that a jurisdictional determination was made by the Army Corps of Engineers. And I guess best on our review, we found it reasonable for the board, if they wish to, to advance it, to have a public hearing, scheduled public hearing at this point.

At this point, no. What we plan upon doing As we indicated to the applicant that moving forward, we'd like to have a technical meeting between the town engineer, Wayne Bowen-Steele, myself, code enforcement, Bill Bradley. We thought we'd invite you, Mr. Chairman, and the planning board attorney, Chris, and anyone else who you feel should be at this meeting to discuss steps moving forward, technical steps moving forward with this project, because this was dormant for a little bit, and I thought it would be very fruitful to have this technical discussion to discuss next steps.
Okay. Are you referring possibly to the list of conditions for the approval, the conditional approval?
No, we discussed that, Kevin and myself discussed that today. We found that we'd like to basically show, they've addressed everything we've requested. What's remaining is the, shall I say, The approved easement. It's my understanding from the applicant that by the end of this month, that'll be signed by the public service commission. So I think what we'd like to do is as part of advancing this project, meet together, discuss construction issues. moving forward so that we iron out these details now before he gets final approval.

That's our thought. And what that does, it just sets the tone for moving forward with construction just so that facilitates that activity. That's the purpose of it.
But you have no issues with scheduling the public hearing everything we do not. We do not in order for the public for review and so it is Mr. Chairman, yes. From a legal point of view, is there any? Things that need to be. Addressed as far as information for the public.
Not that I'm aware of. At the last meeting, we withheld scheduling the public hearing pending updated information from the Army Corps of Engineers. We now have that updated information. Unless somebody tells me there's some piece of information outstanding that the planning board needs or that the public would need, I think you have a green light to schedule a public hearing if you're inclined to do so.

Okay, hearing none, I would suggest that we schedule the public hearing for, at this point it would be the first meeting in, no, it would be the second, no, is there time?

so just right i know what you're thinking right can could we do it on august 6th which is your first meeting of august today is uh the 17th so from a notice perspective i think there's enough of a window i think we had noted last time that you already have two public hearings on for august 6th already one of which on the fisher subdivision may turn out to be a more prolonged affair than this one might be okay you also have i believe mavis is on for a public hearing on the sixth so that would probably be the only consideration you have about whether to put this down on the sixth as well to give you three public hearings in one night or to put this off to the second meeting in august which would be august 20th um i hear you i understand that and uh
think the most we've ever scheduled on one meeting was two public hearings so i would have to say that uh the soonest we can do this public hearing would be the meeting on the 20th okay all right yeah yes so we will officially notice that and that might also provide an opportunity for us to have the meeting that russ suggested yes we should have yes um so that whatever comes of that we'll know that before we come back on the artist 20. yeah very good that's very good yeah okay now it should be noted should we note that we should know okay we should note that i will not be here for that meeting so they will be that is the 20th okay make sure it's not the No, no. So I'll be here for the sixth.
Following up on what Russ said, I also will not be here on August 20th. I'm going to be out of state traveling, but another attorney from my firm will be here. So you'll have a planning board attorney, but she, her name is Victoria. She's very nice. She's not going to be as familiar with the projects that are in front of the board, just because she hasn't sat in this chair like I have for the last several months. So you'll have an attorney, you just won't have me. I tend to think that the public hearing portion of all this should be fairly straightforward. Open the meeting, applicant will give a presentation, ask for any public comment, thank you, close the public hearing. No decision is going to be made that night. We'll do that at a future meeting. Again, The reason why we're bringing this up is if the Board members had some hesitation about having this public hearing on the 20th, because the Chairman won't be here, because I won't be here, the next option would be to schedule it for the first meeting in September. But if there's no concerns, you can go ahead and do it on the 20th.

My gut feeling is that there's not gonna be a lot of input from the public as far as, yeah. So moving forward after that, then we're going to go into a draft, depending on our meeting, what conditions we have to put on the approval, do a draft resolution, and then move forward from there. There was one other thing I wanted to mention that escapes me right now. Do you have any questions on that timeline?

Sure. I can't promise how quickly, based upon our experience with National Grid, it will be turned around, but this would be actually something from the Public Service Commission, which I believe is meeting the 29th. 29th is a copy. So it's their meeting at the end of this month. Theoretically, we could at least get some type of meeting minutes or something. We can't get the actual document, but whatever we can get to satisfy you, we will get. Okay.
Okay, the one question I had is, is there any reason why the applicant has to be at the August 6th meeting? Okay.
