We will conduct this meeting in regular format and will allow commissioners, applicants, and interested parties or participants an opportunity to speak. This meeting is being broadcast live on PEG channel 181 and can be streamed on the city's YouTube channel. We will now conduct the roll call of planning commissioners. Commissioner Whitmore here. Uh item three, planning commission chair personal announcements. I don't have any announcements or action items at this time.
What's that? Do I You have two. Oh, I'm sorry. Okay, we have uh I'm sorry. Item 3.1, review of the 2025 Planning Commission annual report. Um see the Brookkins Planning Commission met in quorum seven times in 2025. Uh the commission is made up of seven members and is chaired by Skip Watwood uh with Gerald Wowitz serving as vice chair. The other members and commissions include Sage Bruce, Anthony Bond, Nicholas Chapman, and Amanda Whitmore. One position is vacant. Staff leaison include Tony Baron, public works and development services. Uh that's the PWDS director, Lori Zeamer, deputy PWDS director, and Michelle Robbo, PWDS administrative assistant. Uh during the year, and the planning commission acted on the following matters. Uh approval of four conditional use permits for short-term rentals. Approval of two minor changes of ownership and conditional use permits for short-term rentals. Uh, approval of two minor partitions, one splitting a parcel into two parcels and one splitting a parcel into three parcels. Approval of one planned unit development consisting of 47 lot subdivision to be known as Bedrock Estates, phase one and two on London Lane. Uh, members of the planning commission participated in an Oregon planning procedures workshop presented by John Morgan, which was excellent. I really enjoyed that. Um, the planning commission looks forward to the upcoming year in serving residents of Brookings with a fair and unbiased decision-making process, as well as advising this Brookings City Council on matters affecting its residents. Um, so item 3.2, consideration, I'm
sorry, I move the planning commission approve the two-year contract nonstate thought we were supposed to approve this, but you can make a motion because it does go to the city council next. And I just want to uh we need to at least state the Lone Ranch for the record. Okay. Just title it at least. Okay. Oh, yeah. So everybody knows what it is. Yeah. Yeah. So it's the Lone Ranch subdivision.

we do have um representative for the development group um in the audience. If you have any questions or would like an update, you could certainly ask them to step up to the podium if you're interested. If you are, no need if you don't need to. It's probably going to be probably not this summer. It's going to be the following spring before we actually start moving dirt. Maybe maybe we're lucky late late the summer in the fall or something, but u a lot going on. Um about it probably just that. Yeah. And especially with the transition of ownership.
Yeah, there was a trans and actually that's gone real smooth. U because the ownership didn't change the company at all. All they did was buy all the stock. So the South Coast Lumber still stays in place. The ownership still stays in place. Um but there's different people there. And so that's been a little bit of a challenge, but been okay. Okay. I've been waiting 18 years for this. I voted on the last ranch approval of the PUD itself. So

So just remind the uh commission that you know our code we changed the code I want to say like 10 years ago or seven years ago is maybe um this particular extension we didn't have the option to do that but one of the caveats to this is that there's progress still being made on and of course you all know we're doing the um infrastructure uh package to get Lone Ranch tied into the city services and then parallel they're working on um finalizing some of their details on on their um plans they're going to submit for civil engineering for their development. So there is progress and so with that we we um typically would uh recommend extension.

Commissioner Wam. I motion. Thank you. Uh we are about to begin the public hearing portion of the agenda. The following information applies to all of the applications being heard today. The public hearing will be conducted in the following manner. First, the planning staff will present the report. The applicant will then make his or her presentation. Next, anyone wishing to speak in support of the appro proposal will be afforded an opportunity, followed by anyone wishing to speak in opposition to the proposal. Finally, any interested parties or representatives of public agencies will be asked to testify.
All speakers must state their names and mailing addresses. Any person who wishes to speak may be asked questions by the commissioners. The applicant will be afforded the opportunity to re rebut evidence. Planning staff will then be given the opportunity to make any final comments at the end of the public testimony portion of this hearing. Testimony and evidence must be given under the following guidelines. All testimony and evidence must be directed toward the criteria outlined in the staff report comprehensive plan or land use regulation which applies to the decision except for the applicant. Testimony shall be limited to 5 minutes unless otherwise stated by the chair. Any exhibits presented will be marked as part of the record and will be kept by the planning staff until appeal opportunities expire. Failure to raise an issue accompanied by the statements by statements or evidence sufficient to afford the commission and parties an opportunity to respond precludes appeal to the Oregon Land Use Board of Appeals Luba. Based on that issue, failure of the applicant to raise constitutional or other issues relating to the proposed conditions of the approval with s sufficient specificity to allow this commission to respond to the issue precludes an action for damages in circuit court. Prior to the conclusion of the evidentiary hearing, any participant may request additional time and the opportunity to present additional evidence or testimony regarding the proposal. This is limited to those who have spoken on the request. Repetitious testimony is not necessary and is discouraged. We have a minor change of the conditional use permit for a short-term rental for a new owner at 96335 Dawson Road. This is a quasi judicial hearing and the planning commission will make a decision on this matter. By a show of hands, does any commissioner commissioner have any

We will now proceed with the following application. Agenda item 4.1-mc-1-26 CU-5-19. The time is now 7:11 p.m. and the public hearing to consider the following application is open. In the matter of file number MC-1-26 CUP-5-19, a request for approval of a minor change of a conditional use permit at 96335 Dawson Road, changing a permit into a new property owner's names. The owners and applicant is Janet M. Bear. The criteria used to decide this matter is found in section 17.124.170 short-term rentals and section 17.116.09. 090 minor change of the Brookings Municipal Code. We will now proceed with the staff report.
Thank you, Chair Watwood, members of the commission. This property was granted a conditional use permit on August 2nd, 2019 to use the single family dwelling as a short-term rental. The property was has changed ownerships three times uh with the most recent owner applicant purchasing the property on December 2nd, 2025 with a conditional permit uh conditional use permit in effect. applicant now seeks a minor change of the condition conditional use permit into the applicant's name which is required within 6 months upon sale of the property if the new owners wish to continue using the property as a short-term rental. The applicant does does have a property manager and will continue to submit monthly transient occupancy taxes. Uh they have no proposed changes to the property and the minor change will have no additional impact on the adjoning property holders. We did not receive any written comments from any of the neighbors on on this. So again, this is a minor change uh to an existing conditional use permit at 96335 Dawson Road. Um staff recommends approval of this minor change. Any questions?

You want me to spend 10 minutes on How many How many do we have in the city now? How many short-term rentals do we have in the city now? Um 85. 85. Yeah, some of them are not are not active. Not active. Yeah, there's about nine of them that are not active. Okay. Is there a statute a half? Yeah. No. Well, we would we used to address that. It's such a small percentage that Yeah. The city council has said not enough to Makes sense. They The comment was when we get closer to 250, we might consider it. Right. Right. Makes sense.
Yeah. At this the this new council I don't know where they sit but that was previous council when we talked about that. Um
uh we are we are launching also I want to let you know we are launching an RFP for a housing needs analysis one that isn't compliant with the state statutes rather than the one that we did it we paid for a housing needs analysis assessment in 2017. We kind of partnered um to pay for it through South Coast Business Development Corporation. Um but it the problem with that is more of a market analysis uh report instead of an a needs analysis. So this report that we're going to get out of this process will be a lot more um I'd say userfriendly and will give us the ability to answer questions properly on grant applications down the road. So this is it's a we're getting I think we have a grant that's paying for this as well. So, it's pretty pretty awesome.
But it doesn't really relate to how the H it's more geared towards how do you answer questions on grant applications? No, no, it it's just that there are certain housing needs analysis. when you use uh or when you're applying for grants for any type of housing or any anything to do with planning, um you need to have a housing needs analysis and that housing needs analysis needs to be uh developed per state statute. The one that we have on file now is not. Okay. So, it's not really usable like in that way.
So, it has to meet certain criteria. But I guess what I'm asking is it doesn't really affect the way that like you have this housing needs analysis but there's really nothing you can do on the other end to if it says oh you you need this many houses what can the city actually do to generate it obviously gives direction how would it relate to that would it relate to determining what what property could be zone changed or or potentially yeah we're going to look at inventory we're going to look at there's a lot that's uh the RFP will be out when today.
It's out today. So, you're welcome to look at it. And it has in there the work plan and the deliverables from the from the consultant what we're looking for. Um there's a lot in there that actually it dives a little deeper than what the other one did. But I think like in that in in one of the classes that we went to before or maybe maybe you just told us this Tony, but like the state wants to see like so much, you know, so much residential, so much commercial, like there's a ratio for everything. But if they said if they came in and said, "Well, you obviously need more multif family." And I'm just going to use this for an example. When when the bedrock subdivision when they tried to when they tried to take it back to R1
from R3, I mean, would it lend itself to like that scenario where you say, "Okay, well, this Yeah, it's going to affect how that property gets developed in the future." I I I I'll just I'd say I pro I doubt that it will affect it in that direction. I think it probably affect it the other direction. We probably be looking for more multif family development property. So yes, there there could be some guidance in there for us um to make some comp plan changes and some zone changes, right? Which will give you guys the opport it'll give you the ability to lean on the document to justify those decisions down the road. That's a good that's a that's exactly what is it just for the city or the county or it's just the city. Okay.
We will consider there is consideration of the urban growth boundary. Oh yeah. And that was the only example that wasn't that was the only example I could think of off the top of my head where you know potentially if that could have went the other way. It may be the come up probably right that's why. So um okay and so with that there will be some planning commission workshops the consultant what's the time frame we're not going to award it until March so
the consultant will probably do some work first then coordinate some uh joint workshops and they'll run the they'll sort of run those meetings the consultant will okay so Yeah. Cool. Okay. Um, is there any commission final comments? Did we already go over that one? It is now 7:24 p.m.
