I can't guarantee I didn't repeat, but I'll do what I can. Sue Engelman, Brookings County resident. I'm asking for an immediate temporary ordinance moratorium or whatever it takes to halt all energy companies to include the 765 kilovolt transmission lines, industrial solar complex, and battery energy storage system from filing with the PUC to build in the Brookings County until safety factors have been researched and new ordinances have been established. By definition, a moratorium is a legally authorized period of delay in the performance of a legal obligation, a waiting period set by an authority, a suspension of activity. A moratorium is a type of ordinance that a municipal legislative body can enact that temporarily halts certain specified development to give the municipality time and opportunity to plan for accommodating or managing the development or banning it altogether. Respectfully, what can be done at this meeting to stop Power On Midwest from filing with the PUC to construct the 765 kilovolt transmission line? I have been asking to match the Dual County 2,000-foot setback since March, six months ago. As you know, there are readings that need to happen before an ordinance can take place, and our deadline is September 2026, just a few weeks away. I testified at the County Commission meeting this morning and they were making the decision to restructure the 765 kilovolt subcommittee. One of the county commissioner members had spoken with the PUC and he also was convinced that the county ordinance was to be set in place before The Power On Midwest files with the PUC. The PUC always takes into account the county's ordinances. The PUC knows that the county has its own best interest in mind. Therefore, the PUC will rule with the county ordinance. The commissioners used the pipeline ordinance as an example. The pipeline ordinance was put into place prior to the pipeline filing. With the 765 kilovolt transmission line, We need to act today to have enough time to complete the timeline needed for the ordinance to be enacted. I am asking that we connect arms and utilize the 2,000 foot setback dual county ordinance. Dual county has done the legal research and that ordinance was put in place already to have the setback. The ordinance does not stop the company from making deals with landowners. It only gives a 2,000-foot space from a residence. The Power On Midwest is suggesting a 250-foot setback so they can use whatever land that best suits them. By adopting this 2,000-foot setback tonight, there would no longer be a need for a moratorium. Also, I attended the NextEra Energy Resources LLC open house on July 21. I gathered the information sheets and found my residence on their proposed solar map. NextEra is connected with Power On Midwest, and they are proposing an industrial solar complex just north of Brookings. They are also proposing a battery energy storage system near Elkton. I spoke with a number of their experts, but none of them were able to answer the questions that I posed to them. The next era representative that addressed the county commission that same day gave me her personal phone number and email address to send my question to her so that she could answer them. I emailed her over a week ago and still have not received any answer. In the email information that I sent you all, one of the articles states that Italy now bans the installation of ground-mounted solar arrays on active agricultural land explicitly to protect soil health and food production. The question for any landowner or community is not whether a scientific paper calls the risk minimal. It's how soon, how much, and whether you are willing to roll the dice. These projects are not temporary. They are designed to sit on your landscape for decades. The metals, polymers, and chemicals inside the panels don't disappear. They weather, break, and move into the environment.

When the acceptable probability is zero, Anything above that is gambling with soil health, water quality, and the long-term viability of the land. And unlike a financial risk, you can't just sell out of contaminated soil or water. Your community and the next generation inherit whatever damage is done. Thank you so much. My name is Rick Bible. I'm not representing the city of Elkton, but I am one of the council members there. Our city has not been advised of the solar installation that's happening near our town, nor have we been advised of the battery installation near our town. This is important for two reasons. Number one. We're the primary firefighter department in the area. We don't know what we're getting into. Number two, we're the primary ambulance service for the area. We don't know what we're getting into. We have not had a sit down conversation with these assets that are potentially coming into our service area. That is not a good position for the county and for my city to be in. We need to get our act together and get on top of this and force them to come to the table so that we can understand what is gonna happen. Because even with high power voltage, that can have an impact. Right now, our 911 service, our radio services, don't work in the county completely. So now we're going to add another burial before we fix it. Not good. I'm imploring you slow this thing down so we can sit at a table and discuss this and make sure we do it the right way. If we're going to move forward, thank you.

My name is Rufus Dizale. My wife Patty and I live on a farm north of Elkton on Highway 14. In the past year, we've been approached by three different companies, InvenEnergy, Doral LLC, and Xcel, all wanting to do some form of energy project on our land. The easements they wanted us to agree to included a 30-year, 50-year, and with Xcel for the 765 kV transmission line virtually forever. They each promised large sums of money to try to entice us into allowing their project on our land. To each, we said no thanks. We are unwilling to obligate ourselves and future generations to the risk and irreversible changes to our operation that each project would entail. In recent weeks, we've heard of more projects planned, plant, not farm, and a battery storage facility in Brookings County. It feels like we're turning eastern Brookings County into an industrialized energy complex, turning thousands of acres of productive farmland into something I believe wasn't intended for. Once this farmland is industrialized, it is highly unlikely it will ever be farmed again. This industrialization will have a life-changing effect on all residents, particularly those that live close to these projects, and will also affect businesses that sell inputs to farmers. Think about thousands of acres that no longer will need seed, fertilizer, chemical, etc. Some neighbors have indicated to me that they will move rather than having to live close to the power line or a substation or a solar complex or even a battery storage facility. One has to think that a data center will be next, and I think there would be many who would not like to live near it as well. Before decisions are made, before a conditional use permit is authorized, before you allow our county to go down a road there's no coming back from, I would ask all of you to pause and ask yourselves, is this really what we want Brookings County to turn into? Do we have the proper regulations in place that will protect all county residents? Are we willing to allow all of this to happen because of a true need for more energy in this area? Or is it only for perceived financial benefits? And that poses the question, who stands to benefit the most? Money matters, but it cannot be the only measure of a good decision. Once a county begins rezoning rural land for industrial use, it becomes harder to argue that the next property should remain protected. One approval becomes the justification for another, then another, until the rural lifestyle everyone claims to value is gone forever. Therefore, I ask you to pause granting any of these companies any approval until you thoroughly examine what all the effects will be on Brookings County. What my family what we want to pass on to the future generations is not an industrialized landscape. But rather one that preserves our rural heritage that we cherish and enjoy. Thank you.

Bill Lansman, I'm a landowner east of town. I guess I've got a couple things that I'm looking at is why about 10 years ago my daughter wanted to build a house out on our farm and the only way we could build that house there is if we put 40 acres of that land up with that house to take and have it so she could get a permit to build that house. And I'm just wondering this. They're coming in and they're taking up. Like on our land at 7.2 or 7.3 acres on each strip they take, but they're coming in and they're put a 5050 by 50 lot in each one of those. That's that's more than what that house was that we wanted to put in and we had to have a permit. So why do these people not have to have a permit to do it? The other thing is why the The land electricity is built here in South Dakota and from what I read that it is all shipped out of state and what benefit as South Dakota as a landowner. What do we receive from this? Is it just all one sided? Thank you.

All right, I'm Zeke Engleman and I'm from Brookings County and I don't really have a lot to say that others won't be able to say better than I can, but I do have two things that I want everyone to think about. First off, I do have nothing against progress, but this solar farm will be replacing ag land and that damage can never be restored to what it once was. And once the damage has been done, it's done forever. The beautiful peace and quiet of the country that we know will never be the same again. And secondly, it's one thing if the power is going to go for Brookings, but if this is going to be, if we're going to get nothing out of it, if it's going to go elsewhere, then why does it have to be here of all places? Other than the fact that there are no ordinances that can tell these companies what they can and can't do here. And as such, I propose a moratorium to halt energy companies from filing with the PUC until more research has been done. That's all.

My name is Rachel Engelman, and I've lived in Brookings County my whole life, and I'm currently attending SDSU as a history and political science double major. I am asking for an immediate moratorium to halt all energy companies from filing with the PUC until more research has been done to ensure these power structures are safe for us and future generations. As I said, I have lived in Brookings County my whole life on a little acreage a few miles out of town. My parents bought it when they were freshly married and have owned it and lived there for the past 40 years where they raised me and all my siblings. For as long as I have been able to form conscious thoughts, I have dreamed about raising my own children on the land where they can grow up surrounded by trees and nature and can experience the quiet stillness of the prairie on a windless day. Knowing that, you can pretty easily see why I'm very concerned with the construction of these power structures in Brookings County. Ignoring the obvious health effects these structures have on the local natural habitats and the residents that live near them, I think we can all agree they are an eyesore. My room at my parents' house has a south-facing window, and I love to look out it because it overlooks our front yard, where my siblings and I used to ride our bikes in circles as we talked about our ideas for a book we wanted to write. Then beyond that is the pasture where my parents' cows graze, where my brothers and I spent hours helping our dad rebuild the fence for the animals. And after that is our hay field, where I've spent nearly every summer of my life putting up hay with my family for our animals to eat during the winter. And beyond that are our neighbors' homes, cornfields, and trees. I look out my window, and for as far as the eye can see, everything is green and full of life. after I heard about this industrial solar complex that's being proposed and how my parents' acreage, aka my future acreage, is in the proposed area for the solar complex, I've been looking out my window and imagining what it would be like if this solar complex is allowed to be built. Because if it is, when I look out my window, I won't be greeted by green plants and the warmth of life. All I will see is black. Black, lifeless solar panels. And as someone who has debilitating chronic migraines that are brought on by bright light, the last thing I need is sunlight reflecting into my eyes, incapacitating me when I'm in my own home. Once again, I'm asking for a moratorium to halt these energy companies because I know I'm not the only one with these feelings and concerns. And finally, these solar companies claim that they can restore the land to its former state after their lease is up. Whether or not that's true, they will never be able to restore to me the memories that I had on that land before they defiled it. Thank you.

He has applied for conditional use 2026 CU008, which you just heard this evening and approved. for an accessory building greater than 2 000 square feet square feet the lot is t-shaped and is one acre in size hanson addition was planted on november 14 2000. public notices were published in the brickage register on july 21st and 28th 2026 and the white tri-city star on july 23rd and 30th 2026. letters were sent to the joining landowners and all the lake hendricks township officials Here's his variance application. Here's the site plan again. It'll be five feet back from this red line. Here's the elevations of the proposed structure. Beacon map again. It's just the same photos we used as last time, but here's the wheel would be 10 feet from the proposed existing house that's there. The grade would be graded down so at the same level as the house. This is the wheels at the north property line. This is where the drainage tile would be installed. This is the wheels at the north edge of the building, five feet from the property line. This is looking towards the west there from the east side of the lot. This is looking south where the proposed site building would be. This berm, which is the old railroad line, that's why the berm is there. The berm has never been removed until now. So that's why the existing berm is in place. There. And this is just looking at the west side of the lot looking south. And this is just looking from the east side looking west where the proposed building would go. That drains from east to west down there and just water cannot get over that so that's where the natural waterway has been since the railroad bed has been there. The developers of the lot across On the back side of that, I have said they're going to put a drain tile in there, and Mr. High has agreed to that, so they're going to work together. This development has just started within the last year and a half, so they're still in the construction phase and getting everything figured out out there. That's why that was put in the findings of facts with the conditional use for the accessory building. This is for the setback to the rear property line.
