Madam Chair, I move that ordinance number 861-26, prohibiting data centers within the municipal limits of the town of Bel Air, be approved by the Board of Town Commissioners.

We've discussed this many times, this cleans up the list of uses that are prohibited in the town by clarifying that there's not in fact one list of uses prohibited, but rather that by omitting an approved use that that use is not permitted. And specifically clarifying that both junkyards and data centers are not permitted by any of the uses found within the code or the tables therein. Mr. Barrett, I think I've accurately summarized that. And so for the sake of time, that is all I have to say. I think that this is clearly the will of the people. It is also the direction that Harford County and surrounding municipalities are headed in. I think it's good policy for the town.

I couldn't agree more. The county has done the same thing, so has Haberdegrace and Aberdeen. And I understand Harper County was the first county in the nation to ban data centers, but we are hard on their heels. And I am glad to see that we have picked this up as well so that whatever happens in the future, however small or big they might be, they won't have a home here in town. Anyone else?

I commend Commissioner Taylor for taking quick action on this issue, and Mayor Edding, you've been a vocal opponent of data centers, so appreciate both of you.

Thank you, Commissioner Foss. And Ms. Rachel Dean. Deaner, I'm sorry. Welcome for your first presentation, which we have discussed many times.

Yes, we have discussed this many times. And for the fiscal year 2027 sewer fund budget, we included a recommendation to increase the town's sewer rate and base charge by an additional 7.4%. above the normal automatic consumer price index increase of 2.6%. The recommendation was made due to Harford County's bulk sewer user charge to the town, increasing 50% from the fiscal year 22 to fiscal year 26, while the town's rate for our customers only increased 21% during that same period. So the primary issues are the town receives a Harford County bulk sewer user charge calculation in December of each year, which is retroactive back to July 1st, making budgeting very difficult. In an effort to be more proactive by either covering our expenses, mainly the cost for the county to treat the sewage, or setting aside the money in the sanitary sewer capital improvement reserve for future capital projects, staff is making this recommendation. The usage rate and the base charge were last required to be updated in the code in February 20, 2014, when the board approved a rate increase above the normal automatic CPI increase, which does not require a change to the legislation. The usage rate would increase 75 cents from the current fiscal year 2026 rate of $7.50 per 1,000 to $8.25 per thousand, which is 20 cents for the CPI increase and 55 cents for the additional requested increase. While there are different meter sizes, residential customers generally have a five-eighth meter. So the base charge for that meter would increase from $3.47 to $3.82 per month. The new usage rate and base charges would effectively would be effective for the July 25th, 2026 billing. For a residential customer using 5,000 gallons of water a month, the total increase will equate to an additional $4.10 per month or $49.20 annually. The staff recommends the board approve ordinance number 862-26, which includes a 75 cents increase, 10% in the town's sewage usage rate, and a 10% increase to the town's base charge. know we've discussed this a number of times and it's largely being driven by the price increase passed along to us from the county because they actually treat our sewage and we don't get that until six months into our fiscal year which makes a terribly difficult uh time for you guys to budget so yes thank you i agree any

And part of that increase, just for the public knows, part of that increase is also, because this is an enterprise fund, that to pay for the capital expenses that we have to do, like a pumping station and we have, Mr. Klein, how many pumping stations do we have in town? Pardon? 13. 13. And some of those cost upwards of a million dollars each. So to keep from having to take loans out and go into debt to rebuild those, which occur every 20, 30, 40, whatever the lifetime is, that this helps by taking it a little bit more each month that we can now pay for those as they break down and not have to incur debt.

That is correct.

So I just want the public to know that, although we are increasing it higher than the CPI, it's so that we can pay for those big capital expenses when they occur.

Yes, and Harford County had also been increasing it more than we were increasing it in the long run. So it's sort of we're catching up.

All right. Next is Resolution 1273-26, Fiscal Year 2026, Budget Amendments. May I have a motion?

Yes, Madam Chair. I move that the resolution number 1273-26 amending the budget for fiscal year 2026 for additional revenues, appropriations, monetary adjustments, and transfers between departments be approved by the Board of Town Commissioners with the following amendments. Number one. General fund miscellaneous income additional $176,457 for the workers compensation 2024 dividend. Number two, general fund transfer from unassigned decreased an additional $4,782 to balance the budget. Number three, General fund, a bonus totaling approximately $155,274 is included for those employees who were employed with the town as of June 12, 2026. This bonus was paid to all town employees on June 18, 2026 and equated to $1,900 for full-time and $950 for part-time employees hired before January 1, 2024. $950 for full-time and $475 for part-time employees hired after January 1st, 2024, but before January 1st, 2025. $475 for full-time and $238 for part-time employees hired after December 31st, 2024. Funding from the Chesapeake Employers Insurance Group 2024 workers' compensation dividend affords the town the opportunity to provide this bonus. This bonus was used to supplement the sworn officer recruitment and retention grant to ensure equity and consistency across the organization. Number four, general fund, town administrator, remove resident rebate $3,045. Number five, general fund. Public Works Administration add $17,286 to MS4SWM program to offset the monies collected from the Roland Park residents for the pond project. Number six, sewer fund, sewer fund revenue. ARPA, $2,010,236,000, mostly money spent for Shamrock and Gateway pumping station repair and replacement during FY26. Number seven, sewer fund expense, pumping station repair and replacement, $1,976,746 monies that were spent for the above. Sewer fund expense salaries add $3,800 for the bonus mentioned above. Number nine, sewer fund expense Harford County charges added $29,690 to balance the budget.

Before that motion is seconded, Commissioner Foss, would you be amenable to withdrawing and reissuing it by saying it was on the $2,010,000. Okay, where? 236. Number six. It was $17,287 as opposed to $17,286. On number five. On number five.

The easement is executed by and between the Council of Unit Owners of Park Manor Condominium and Chair of the Bel Air Board of Town Commissioners after approval by the Board of Town Commissioners. as a condition for the town to provide roadside collection for refuse and recycling it must drive its vehicles on park manor circle a privately owned road the deed of easement formally grants the town permission to drive their vehicles on the private roadway to provide town refuse and recycling services staff recommends that the Park Manor deed of easement as outlined in Exhibit A between Council of Union owners of Park Manor condominium and the town of Bellaire Maryland be approved by the Board of Town Commissioners thank you Mr. Klein any questions for Mr. Klein is there anyone here that wishes to make a public comment on this resolution only

Well a great thing for the people that live in Park Manor Circle and it will be a terrific boon to them and their budget I'm sure.

My staff will be meeting with the residents of Park Manor Circle on Thursday evening at 6 o'clock to just go over how everything works with our refuse collecting services so everybody should know how it all works.

Well, it works pretty darn well as a longtime resident of the town. They pick it up, and I'll be putting it out tonight because tomorrow is trash day.

Thank you, Madam Chair. The town utilizes bituminous concrete material, hot mix asphalt, regularly to make repairs and patches to 41 miles of streets, alleys, and parking lots. Public Works crews typically utilize around 400 tons of hot mix asphalt each year. Funding for the purchase of bituminous concrete material has been budgeted in the street section of the public works budget. The town budgeted $24,700 for the purchase of hot mix asphalt in FY26 and will budget $24,650 in FY27. the town has afforded the opportunity of piggybacking on the prices obtained by harford county government under bid number 23-003 and any subsequent renewals staff recommends the contract between gray and sun inc and harford county government to supply bituminous concrete material for an amount reflective of the government pricing contained in the cooperative perching agreement be also accepted by the board of town commissioners excuse me

If you do win, I would hate to see you leave the commission, although you still have the general election to go through, but you'll still be serving the citizens of Bel Air, so that's a good thing.

we've always known he was the tops because we have the top we have the top police department right here in in Bel Air keeping us safe and keeping the bad guys at bay so I do appreciate that it is Election Day tomorrow last opportunity for anyone to vote 7 a.m. to 8 p.m. you can find all the information you need at vote for one one dot org you can look up your address it'll tell you everything you need to know about where you go to vote and who your candidates will be appearing on your ballot so definitely this is the last few minutes you have to do that research um i cannot believe that it's almost the end of june and the fourth of july is like right around the corner i don't know where the summer has flown it always seems to me that once we hit the fourth of july it's like downhill from there to fall so I certainly hope everyone comes to the 4th of July parade and all the activities that are here I am really looking forward to them four of my grandchildren are coming some will be riding in the parade some will be trying the watermelon eating contest that they did last year and the Uncle Sam says they didn't win but they had fun anyway and it'll be a it's just a great time there's so many great things to do I'm really looking forward to it

One last reminder, I'll say something different as opposed to beating the horse about the election tomorrow, certainly go vote. There may be a misconception among some folks that you can only vote in the primary election if you are a registered Republican or Democrat. While it's true you can only vote in the partisan primaries if you are either a registered Republican or Democrat, even if you are registered unaffiliated, you can still vote in the nonpartisan contest for school board. Which here in our district in the town of Bel Air there is a contested school board race on the ballot So regardless of how you registered make sure you get out to vote. Even if it's just for that one race.
