Mr. Chair, before we go to the staff report and to the case, we have to qualify Mr. Shaw as an expert in land planning before he can provide his opinion to you guys. Okay. Okay. Just for clarification, my name is Elizabeth Thompson. I'm an attorney with the Law Offices of Stark and Keenan. I am appointed town council for the town of Bel Air. I PROVIDE REPRESENTATION TO THIS BOARD. I AM HERE GENERALLY SPEAKING AT EVERY SINGLE BOARD. I ALSO REPRESENT THE DEPARTMENT OF PLANNING, THE COMMISSIONERS, AND THE ADMINISTRATION STAFF AND DEPARTMENT HEADS HERE. SO WE HAVE A UNIQUE SITUATION HERE. HASN'T HAPPENED IN QUITE A LONG TIME. I'm going to ask you a series of questions related to your experience in the field of land planning and I ask that where appropriate that you refer to your CV or the resume that has been provided to the board and that you produced. It has also been entered into evidence as exhibit A. Briefly describe for this board your educational and professional background in land planning and project management.
I possess a master's of professional studies from George Washington University in sustainable urban planning in 2018 and a bachelor's of science.

In my current role with the town of Bel Air, I assist with development and zoning review projects. I assist with zoning applications. I facilitate site visits. I coordinate interagency reviews on hearing level projects as well as zoning enforcement.

And what was the purpose of those reviews?
Those projects were specific site plan and site site plan, architectural and landscape review, as well as special development projects before the Planning Commission, where it was your review, a part of an administrative review. Hearing level review.

I have reviewed over 30 projects in the state of California in the levels of hearing body as well as administrator reviews.

I have prepared none in other states. However, I have reviewed a comprehensive rezoning application in the state of Virginia with the Fairfax County Park Authority as a park planning intern.

All right. Now we move on to new business. We were to review a special exception request for our 32 bed assisted living facility to be located in 908-910 South Main Street, submitted by Platinum Sprinkler LLC. Previous special exception was approved on April 20th, 2023 and expired on April 20th of 2026. I'd like to start with a report from Mr. Shah.

All right. I will be doing a lot of repetition of information because we're referencing former conditions of approval that were provided to the applicant in their approval letter. from the april 20th 2023 hearing special exception hearing so just to start greetings board of appeals member my name is saeed wakar shah deputy director of planning and community development i'm presenting a new special exception request for wellwood assisted living a proposed 32-bed assisted living facility As mentioned, the project involves constructing a 32-bed assisted living facility divided into two separate buildings, one located at 908 and the other at 910 South Main Street, with the existing structure proposed to remain. The applicant previously came in on April 20, 2023, where the Town Board of Appeals approved the initial exception, along with a special exception approval extension on September 16, 2025. for the approval to be in effect until April 20th, 2026. As this applicant has come in more than once, I request that the applicant provide further details of the residential amenities and function of the facility during their discussion, along with the clarification of the development timeline for the Wellwood assisted living facility So in the original approval, the original special exception that was dated on April 20th, 2023 was subject to the following conditions of approval, some of which have been met during the submittal for special exception. And I will outline them below. So the first one is contract with a local ambulance company to be provided to the town. photometric lighting plan for exterior fixtures will be submitted to the Planning Commission for evaluation which was also included in this application package and was not reviewed during the October 5th 2023 Planning Commission hearing but it was part of their application package it just was never signed off on And lastly, number three, revise the site plan to include building setback information, structure distance from curb and clarification of disposition of the existing fence. This revision was submitted and completed during the final site plan review after October 5th, 2023. After the October 5th, 2023 Planning Commission meeting, and it was approved by Planning Commission on October 28th, 2025. So just a bit of background about the project. The subject property is located in the residential office zoning district and is approximately 300 feet southwest of the East McPhail Road and South Main Street intersection. The area is characterized by a mix of residential office, residences, and institutional uses comprised of one to three story buildings. And the lot is currently developed with an existing business office on a 0.940 acre site and is heavily buffered with existing vegetation. now with review with review of the site plan so after reviewing the site plan it's noted that 17 total parking spaces are provided two of which are ada accessible spaces and one loading and unloading space the project will exceed the 11 spaces required or one space per three beds required by town of bella code section 165 51h vehicles would enter and exit from a new entrance on south main street and the existing entrance through 900 South Main Street labeled on the site plan as CGH 59-40 will be abandoned. Additionally, a photometric plan dated September 20th, 2023 confirms the installation of 10 Hakuro 1 light outdoor lights and 15 Hubel Geopack Series 1 LED wall pack lights. To discuss some of my areas of note on the site plan on the plan review, it was imperative to note and request that access to emergency medical service will be addressed. Wellwood is required to enter into a contractual agreement with a local ambulance service provider. The applicant has outlined a plan in the submittal and anticipates obtaining building permit and beginning construction approximately two months after special exception approval. With construction expected to take about 12 months, during the construction phase, Wellwood would finalize its emergency operations plan, including the ambulance service agreement. Both are required to be in place prior to use and occupancy and commencement of operations. Now in regards to the conditions of approval and findings. The following conditions of approval have been revised since the April 2020-2023 special exception approval and the finding of the facts have not been changed. At minimum, approval of the special exception to allow an assisted living use in the RO district is based on the following recommendations. Parking and loading are provided at the rear of the site. The space along the front circle drive is for drop off and pick up only and will be signed accordingly. Spaces within the side yard are adequately screened from public right of way and neighboring properties. Adequate access to medical services, shopping areas, recreational and other community services desired by elderly and handicapped persons is also available to residents or provided on the site for residents. And the third one, no business uses are provided to the public and no exterior signs for an interior use other than the institutional facility are proposed. And then the fourth findings of fact basically explains that the Board of Appeals Staff recommends to the Board of Appeals the following specific conditions necessary to minimize effects of use on neighboring properties and meet the performance standards given identification of concerns specific to the site. So the first one will be contract. Contract within the local ambulance company will be provided to the town prior to use and occupancy. and number two a photometric plan for exterior lighting fixtures will be submitted to the planning commission but since it was provided to them in the previous planning commission submittal in september of 2023 i'm going to defer to liz for further comment
Okay, not to steal Wakara's thunder. After this came back before me, I was not here for the original approval back in 2023. I was not town council at that time. I had a chance to take a look at this. Your original requirement for the applicant to submit the photometric plan is inconsistent with the requirements of the code. Under 165-53K, photometric plans are approved by the director of planning. so I would suggest to the board it's up to you that that be modified because the Planning Commission doesn't have the technical expertise in order to review photometric plans so I would just suggest that that be reviewed and approved by the director of planning That's what the code says How would it be inconsistent?

No it's inconsistent because it's just a procedural issue you guys are saying to the applicant you have to take this photometric plan and get it approved to the by the Planning Commission and the under the code the Planning Commission cannot review photometric plans it's just a procedural thing so This concludes my presentation I'm available for questions Any questions for Mr. Shah?
uh yes has anything substantially changed in this application since the first submission and then the re-approval there has been no substantial changes okay thank you any other questions all right i'd like to now um
John Watts 1374 West Jarrettsville Road Forest Hill Maryland 21050 we went through got special exception and then after special exception we have to go through what comes after the special exception this is Board of Appeals correct correct so Planning Commission Planning Commission so then in order to do that and everything that they requested things took time we have water we have sewer outside of the property both Hartford County and the town of Bel Air we it makes sense for us to just tap into harford county's water well this is maryland americans territory they would not allow us to tap into the water so that went back and forth for months to try and figure out who was going to service this system state highway administration took I would say almost a year to get approval. So just along the process of all of this, it took way longer than anticipated after we got our special exception. So it expired and that's why I'm here today to just get it hopefully re-approved. Nothing has changed. Nothing in the plan has changed. We're just trying to push it forward and get it done. you mind outlining your development timeline so i'm um i'll let tom speak to that a little bit as well um hopefully within the next two months we'll have building permit in hand and from there we would like to break ground and we're projected to do 12 months for construction so 14 14 to 16 months i would like to say 18 just to be safe but
all right is now um are there any questions from the board of appeals i know i have a couple questions um so when we met last september 16 2025 we'd extended your your your special exception until April 20. And at that time, you didn't indicate you we'd asked, you know, what was required for you to break ground and start construction. And it didn't seem like it was going to be a problem at that time.
No, it didn't seem to be a problem. And then I'm still I'm still finding out that I need stormwater management. And what was the other one, Tom? so that then we were in under underwriting for a bank and we're going through an sba loan didn't realize that takes over six months so that that's another that was another problem and the the loan wasn't applied for three years ago when you started the project no how could it be i don't know the dollar amount i didn't know had no idea what the dollar amount the way that the market moves now I mean, we're still getting final prices within 30 days. I mean, at this point in the building world, it's like we almost have to put in escalation clauses again. So it's not an easy matter.
Three years seems like a long time. Does anybody else have any other questions?
I was due diligently working on the project and it's just been the process through state, I mean there's a lot of bureaucracy that you have to get through in order to get answers.

So, to the point of timing-wise, partially going through, we have the water issue that we had initially. We talked to American, and this is more just to explain why it took three years in stretching this out. Initially, we were under the impression we had tapped in the line right immediately adjacent to the project. We kind of told her it was fine, and then we were later on, like six to nine months later, told, no, you can't. And so then that went down a whole year-long rabbit trail of basically having to do a tap across 924 to then get both the water to the site, even though it aligned right next to the site.
Pardon the interruption. Is that then coordination from Maryland American Water to now Harford County government?
So we had relayed to Maryland American that the line immediately adjacent to us was Harford County. They said, you know, it doesn't make a lot of sense to have you go across for such a limited usage. And that was their initial indication. We had actually created plans to that end. and then when we submitted them they said oh no we're not gonna we're not gonna give it to you um okay which kind of disappointing huge time and cost impact um it was what it was um going across the street is very expensive as you can imagine trying to cut open shut down 924. we went about that went through sha process in addition as we were going through that towards the end of the cycle um the school that's getting worked on right now, we were having to coordinate and trying to get the traffic light, so they were getting their approvals simultaneously, and there's a traffic signal box right at our entrance, and we had to relocate that. Well, they were still working through their design piece, and so we had another, once we got even the Maryland American portion worked out, we then still had to work for another six to nine months after everything else was kind of finalized to get that portion kind of reconciled. And so that took quite a while. Once that got reconciled, then we could go to stormwater management and get things, start getting things finalized. I'll look at the exact process, but I'm pretty sure we got an approval and then kind of got a, oh well. maybe let's look at it one more time, which, Greg, I'm sure you're familiar with that. Not Hartford County particularly, but just generally sometimes that happens, depending if they're using third-party reviewers sometimes, and so that happens sometimes where they look at the project again and have a few more comments. We're pretty much at the finish line for that. But in general, it was a project that seemed to be much more straightforward, but hit a number of hurdles that were outside of what we would normally see when you present something relatively small like a 32-bed in a town setting. So that's where we're at with that. Towards the SBA loan, I'm not an expert there, but they typically want final proof plans.
What other hurdles do you need to get over in order to get this across the finish line? We need stormwater management.
Can you put that mic for me, sir?
Sure. What else? Stormwater management and how to be released from it. building permit to be released, which I believe lives now that we have the agreement with the town. I think that was one of the hurdles to get that released, which I think has been handled at this point, stormwater management and just the financing from the bank for underwriting.
Have you started the application? Oh, yes. Okay. Yes. Yes. So they just need the final plans for final one.
Yeah, we need to finalize our whole construction budget as well. I mean, we went in there, but I explained to them with the market moving. I mean, we have a contingency factor in it, but we're going to button that up probably within 30 days of us closing what our actual hard number is going to be.
So it's not like it was ever conditionally approved or anything like that?
I mean, as far as the bank goes, no. Okay. No. Okay.
Will there ever be a point with the thought of escalating costs in the construction industry that the project becomes unfeasible?
well fortunately I am the builder and the developer so I'm not paying all that overhead to someone else to do that so for myself if that happens I'm just I hope if I have to break even I'll break even that's not the business I'm in but in order to get it done and to to get it moving that's that's what I'm willing to do and sacrifice thank you I understand
It's kind of good timing for you, though, with all the requirements and funding from a small business line standpoint. What Trump just improvised over the last week or so should help your chances.
yeah i mean everything's looking promising everything's you know going very well it's just we got to button up some things this right now is holding me up um they with you know obviously if this isn't approved then it i i don't there's no reason to get a loan sure so this is definitely another once we get hopefully this done that i can get that to the bank and we can continue pushing this forward
could be reminded by the town what is the presuming there's an extension a what's the limitation of the extension and D what needs to be done I remember a project we had in front of this board of several years ago where I don't know if it was in relation conversation was in relevant to this same applicant here but once projects approved and let's say re-extended what needs to be done say there needs to be a meaningful gesture towards construction progress for that approval to be accepted or so approval accepted but like let's say again I don't know why Mike not that it matters why did we only give a you know eight-month extension or whatever, right, from November to, or was that when the hearing was? It was a one-year extension. Late, okay.
Yeah, so just to clarify for the other members, again for your education, this approval, if it's granted today, will be good for two years. The applicant has the right to come back upon showing, now this is the caveat, okay, good cause shown. So then you guys can approve another one year if you believe it is at your discretion whether good cause has been shown. I mean, if he comes back in two years and he's telling you the same exact thing, your discretion would work. So that's what the code permits you guys to do. As far as what that looks like, it's discretionary based on what the board believes is good cost, if that makes sense.
That's the terminology I was trying to remind us of. Correct. Thank you.
Yeah, sure. I had a couple questions if you're okay I'm not sure which is this is better for so I'm kind of going off the board's attitude if you will so yes or no has SHA given you the permit for the access today as you stand here so you don't have it okay Okay, so you have the approval letter. Now you have to finish it up. When is that supposed to be finished up? Gotcha. That's why this is critical as well. Okay, the other question I had is more of a statement and a question for the board, on behalf of the board. The site plan that you guys submitted has a stormwater management pond on it. It was approved by this board and by the Planning Commission. So what's the holdup with the stormwater? It's not a surprise that stormwater management was gonna have to be done with this much impervious surface, is it not?
We were not confirmed initially did the project. Okay. and carry it onto the finish line that's a little more complex than was initially envisioned finalizing and things like that so we were we're now teaming um and so um that's why okay so mr watts yes why did we just now figure out three years later that storm water management plans were going to have to be submitted and where where are they in the in the process We've been in the works for quite some time. Okay. It's not that it hasn't been worked on from day one. I'm just saying that.
He just testified that he just found out that stormwater management plans were required to be submitted and approved.
We thought they were actually, we thought they were approved.

The county, from my recollection, was a free look at the package and said they needed a couple more items to be addressed. Okay, and we just found that out now.
OK. OK. OK.
I mean, the board is, you know, it is up to the board. I mean, I think you can read the room here. Don't come back here in two years and say you don't have this done. For the board's education, again, for this project, so they're like a house of cards right now. And the bottom card, which is your approval, has been pulled out. So if your approval is not granted today, the whole thing comes falling down. Their planning commission approval is based upon this board's approval for the special exception. They don't move on to the next step unless you guys grant them the special exception. So what Mr. Watts was referring to was one of the conditions of their approval at the planning commission is that Mr. Watts, because this is a two lot project and they're utilizing storm water, they're utilizing parking and all that other stuff. So when we have these projects, we started having developers do because they like to sell the lots later on. And now we have an approved assisted living and then this person says they're not taking care of the storm water and this person says they're not taking care of this. We require what's called a development agreement where each lot owner grants to the other side an easement for storm water, for parking, for access, for all of these little basic elements that make up the whole project area. That's what he was referring to. He has complied with that because I would not allow him to come before you guys until he did that. It's a ministerial task. It's not that big of a deal. So I wanted to make sure that was done and he was actually moving forward before he got, but he has satisfied that. So just for your information. So that's all I had.

You have delays. I mean, I've gone through this personally before. Oh, sorry. I'm in agreeance to reapprove it for him. I've gone through this personally, residential and commercial. I know the headaches that you go through. You said the house of cards. I love that analogy. You know, they need this. They get their plans. They get their small business loan approved, which, like I said before, all the regulations and requirements on that have come back. I don't think they'll have any problem getting funding. So I would approve.

Greg? I share the same sentiment. Nothing substantially changed. I think the variables were outside the general control of the applicants and really is kind of not something that they should be you know, held to specifically to the stormwater management issue. You heard it here. You know, the professional testimony that it's the ground shifted from beneath them, if you will. So they thought they were in one position. You know, when they got to the finish line, they were told that that was not the case so they had to start over to some extent in that and that's just one of probably a dozen different agencies to which I'm sure they have to submit and get local approval for
I'm in the construction industry and I really understand the complexity of trying to gather all the information for approval for get your certificate of occupancy. At this point, I would say I would be in favor of the two year extensions of two years.
So this is a new- It's a re-approval.
