All right, thank you. So our first item, actually our only item on today's agenda is... PZ 2026-172, to consider a request for a variance to the minimum rear yard setback requirements. The applicant is Curtis Roy White, and the location is 335 Summerwood Drive. If we could, we'll start with having the staff provide information on this, please.
Curtis Roy White, on behalf of Nick Lampson, is requesting a variance to the minimum rear yard setback for the property located at 335 Summerwood Drive. The property is zoned RS, which requires a minimum rear yard setback of 25 feet. The applicant is seeking to reduce the rear setback requirement from 25 feet to 12 feet to allow for the installation of a pergola. We sent out 28 property owner notices. In the write-up, you do have that majority of what's being requested is what's considered city, I'm sorry, city variance or city utility easement. city setback so what's actually at the at the rear of the property that's existing because it did mention something existing as well I'm sorry can you repeat that so it says that there's an existing storage shed in the northwest corner that encroaches 2 foot already is that 2 foot already in this in the setback that's being requested.
So the storage shed is existing we I don't think the request is in for the storage shed.

Let me see if I can get the question. Rear that lot. Go back to the area. So the rear of that lot in the house, they're not parallel. And there's an existing 10-foot utility easement on the plat. So they're not in the utility easement. But the 25-foot setback line by the city ordinance goes far enough toward the house. The original plat required a 20-foot building setback line. The original plat of record. But, you know, the city, their restrictions are different than what the developer put on the lot. So the developer actually allowed it to go to 20 feet, where the city's requirement is 25. But that storage building, if his dimension is right, that 13 feet, does not encroach into the utilities. But by looking at the proposed site plan, it doesn't look like, Looks like he's kind of squaring it up a little bit different. So like the shed would be one place and then the covered area may be kind of going around. He'll have to tell us that in a minute when he gets up to speed. But I think it's kind of almost angling maybe a little bit. But I kind of perceive in the rough sketch.

Okay. My name is Curtis White. I'm the owner of CRW Contractors. I am applying for Nick Lampson, and I'm just his contractor. My address is 4930 Fennette Road. And in regards to yours, we are kind of asking for both because Nick felt like we should get proper authorization, even though the storage shed is existing. We would like to remove it and do it right because it's not built properly. So that's why we were asking for a setback of the whole properties, even though my new structure encroaches only in one corner. But the storage shed encroaches as well, just nobody knew about it until we started our application process. And I did get a variance change through Fitz Shipman to get rid of the original plot, no build of 20. And they moved it to 15, I think. Or it's gone completely, I think. I just don't know how that works. I'm sorry. I'm not a plot amendment type.
That would have nothing, no bearing on what we're doing.
Correct. It was just the city would not even allow me to apply for a permit until I changed the original plot amendment to meet their guidelines. And now I have to come before y'all to encroach on your easements.
