City Council - Regular Meeting

Okay, I will call to order the regular meeting of the Batavia City Council scheduled for July 6, 2026. I would ask that you all please rise for a brief invocation to be followed by the Pledge of Allegiance. Tonight, I find my community in a very sad moment. We are being told on TV almost every newscast that there was a very tragic boat accident up in the northern part of the state near the Wisconsin border and that several children from Batavia were killed. And for whatever reason, we have not been advised who those children were and where they are from in Batavia. So I don't have any information. I will tell you, as the mayor today, I was besieged with information requests from people wanting to know more about this. And I didn't have any. And I had checked earlier with the police department and I just checked with the chief when I walked into the room here. And he is still not had been advised. So we really still don't know. But we have a very tragic situation here. impacting some nice family in Batavia. And I just wanted to ask that a special prayer be showered upon them and all this troubling that they are going through, because this is a very, very delicate and demanding and problematic situation that I know many people are being impacted by. So we just ask that a strong prayer be given in their direction tonight. Tonight, as always, we want to ask for understanding and direction and advisement by the members of the City Council as they go about their business of acting on the items on the agenda before us, knowing that in the hearts and minds of each of them, they are here to do what they sense and feel is in the very best interest of Batavia and its people. Tonight, also, we want to just ask that a special blessing be showered upon all those who continue to be ill or infirmed in our community and that steps that are occurring that will allow them to feel better. As always, we want to ask for a special remembrance and special blessing of those who serve our community through the public works and the police and the fire department and the city staff in general, as each of them goes about their vital missions and does an outstanding good job, in my opinion. So we just ask that Batavia be remembered on a very positive note at a very sad moment in our community's history. We ask for all these blessings. Amen. working it's working thank you mayor good evening everyone thanks for having me and letting me give a chamber update this this evening I want to begin welcoming our newest chamber members members that have joined the chamber this past month we have loads of loaves and fishes community community services Jung family painting Martin tech services and Pavich law group These new members represent the wide variety of businesses and organizations that make our chamber so dynamic. We look forward to helping them build connections, become more visible in Batavia, and find new ways to contribute to our community. Please follow them on social media. That really gives them a boost. I want to mention our annual golf outing was last month on June 22nd. So many of you were there. It was a great success. Thank you for joining us, and thank you to the city for sponsoring us. It is a great way for businesses and representatives to get together. So it was a great celebration. Thank you. July is a very full month for the Chamber. Later this month and next week, next Thursday, I'll be taking State Representative Matt Hanson and Senator Linda Holmes on a Batavia business tour. We'll visit several local businesses so they can hear directly from the business owners and organizational leaders about what they're expecting, what they're experiencing day to day. this gives our businesses an opportunity to share what is going well the challenges they are facing and what would help support them particularly regarding funding workforce needs regulations and other issues facing our businesses i appreciate rep hansen and senator holmes taking the time to listen and learn from our community these visits give batavia businesses a direct voice to those representing our community in springfield For the month of July, we are featuring Riverside Pizza and Pub as our Chamber Eats restaurant. Good evening, everyone. And first of all, thank you, Margaret and the Chamber of Commerce and also the City Council today for giving me an opportunity to be here and introduce my business to everybody. So my name is Sunny and I'm the owner of ASEL, it's spelled A-S-E-L. Asian treats and tea, and we're located right in front of Walmart on the North Randall Road. So we specialize in Korean-style shaved ice that is actually come out like snow texture. It's very fun to eat and refreshing, and that dish is called bingsu. And then we also have a ceremonial-grade matcha, which is one of the popular drink that people would come back at our cafe and Because once they try our matcha, they get to test the real high-level grade of matcha that they never had before. And that would bring them back to our cafe. And of course, the boba tea that we had, everyone knows boba tea. But what makes ASO specialized and special is we're not just having regular tapioca brown sugar. We also have a golden boba, which is coated in the honey. So it's lighter, chewier, and it tastes more refreshing. So we offer that that nobody else around here has the golden boba. And we have the Asian style dessert and hot tea served at ASEL. We have been open ASEL for three months now. And so far we have been open. have a great support from Batavia communities and even from the cities around here. I have people who drive 30 minutes, 40 minutes, or the longest is an hour and a half by their motorcycle, Harley Davidson, and They came and they told us that they drove, like, they ride for one and a half hour just to be at ASOL to try our shaved ice, Korean bingsu. And that made me so happy, not just because we have people come to visit us, but because that giving me an opportunities to introduce people from different cities to see Batavia city as well. Because as me, I'm also not from Batavia, but I choose Batavia for the business. and I'm falling in love with the city. And I wish that everybody that can come to Batavia can experience the same thing that I also do. And I choose the suburb area because I believe that suburbs of Batavia we deserve something special and authenticity. Not just you don't have to drive or go so far to Chicago to taste something authentic. We would like to provide that to the city, to the Tri-Cities and people around here to experience something that I experience that in my own country because I grew up and born in Thailand I met my husband here and he's Korean so we bring both culture Korean and Thai and we create something that is special like right now we have a special menu it's called mango sticky rice bingsu so mango sticky rice is the dessert from Thailand and the bingsu is the shaved ice from Korea so we bring both culture and we introduce to people around here and so far Last Monday, I sold out since 5 p.m. And we tried to make more to make sure when people come, we don't say, sorry, we sold out. And so far, we have been people, the customers, they're bringing their friends and family that visited from different city, different family from different states, and even different country. And they choose to come to ASEL. And they're saying they choose ASEL because they want people to experience something different. And that made me feel very special and appreciated every supported, because as I mentioned, it's not just about ESL. It's also about the city of Batavia as well, because this city is deserved that people should know more about this city because it's so lovely. And I'm falling in love, as I said that twice already. Yeah, so our location is located right in front of Walmart in the North Randall Road. And I have all the social media, TikTok, Instagram, Facebook, YouTube. It's called asil.cafeus. And if you Google us, you can find A-S-E-L and you should see the website and every information on the internet. And so far we have such a wonderful business. nice review that my customer gave us to us so you might be able to see some pictures and to see what they experience if you've never been there i would love to welcome all of you to be there and if you already been there thank you so much for the support so if you have any questions well i just want to say number one that we're very pleased to have you in town and

I've already had some people tell me what a nice operation you're doing in the product that you're serving. So it really goes very, very far. I think the one thing I want you to do, if I don't think you did it, is tell us the times of day you are open and what days you are open. If you don't, tomorrow I'm going to get some calls from somebody. Why didn't you make them tell you, have her tell us when we can go?

Yes, we open every day for now, from Monday to Sunday, every day from 12 until 9 p.m. every day. And my husband is working so hard. He's there every day. He got a day off on the 4th of July for less than half of the day. Okay. Since we opened, because we close at 4 on the 4th of July.

But every day we're there, yes, from 12 to 9 p.m. And the best way to cite you to those who are listening to this on TV is you're in one of those nice stores out in front of Walmart in the parking lot.

The members of the IRP task force to be appointed for this project are Max Weiss as a staff liaison, Steve Allen as a staff liaison, Sebastian Wedig from Wedi Corporation, Carrie Aschenbach, a resident, Patrick McVeigh, a resident, and Ian Johnstone, a resident. I would note that there is yet one position to fill on the IRP task force, and that is one member of the Batavia Environmental Commission, and they are meeting next Wednesday. So they should be able to select their participant at that time. Yes.

Next Wednesday as in this Wednesday? Yes.

Our meeting is on the task force meeting is on the 15th. Are they meeting this Wednesday? So the eighth, I'm sorry. Yeah, they'll, they'll be meeting on the eighth.

Did I make the suggestion? I mean, I think this is a great idea. Could we maybe have the task force know that maybe two, three months where the council would expect him to come in and give an update of what's going on with them?

Yes, actually, this is a four month project. So they'll be meeting about eight or nine times. And we'd be happy to like maybe at the halfway point, come in and report on the progress.

think that would be most helpful. And I think the council members would like to have the opportunity to throw their observations and input into it if there's that's allowable.

Yes, there's also a spot for a council member to attend. So there there should be at least one member of city council attending each of the meetings.

And we put out some kind of a schedule or deadline for this meet for these meetings. So I mean, I may want to go to some of them.

And I can share the schedule with you, Mayor. They're the first and third Wednesday of every month, and the first meeting being on the 15th. And they're at 5.30pm in this room.

Public Works Director. Okay, this is Resolution 2026-076-R, rescinding Resolution 2026-069-R and authorizing the execution of a contract with Building Pavers LLC for the construction of the 2026 street resurfacing and sidewalk replacement program. This is a big one.

This is, and unfortunately I have to come back. We were dotting our I's and crossing our T's. We noticed something that was a non-conforming to our bidding specs for what I had previously brought forward. So this is looking to rescind that previous authorization and then award the contract to Builders Paving. We have used Builders the last couple of years. we see no issue with their work and we did check with roman to make sure we were doing the right thing and unfortunately this is what we needed to do so that's why i'm back here in front of you guys this evening looking to just now we have all our i's dotted and our t's crossed um to authorize that contract to builders and then still get everything in motion and they're because we had to they were non-responsive for the previous bid so their price went up slightly I don't have I think it's in the memo what the difference was like a hundred thousand dollars but otherwise we have no concerns with this contractor any questions of the public works director

This is okay with the motor fuel tax transfer for IDOT and all that? It doesn't matter who we give the contract to? Yes. That won't be a problem? Yeah, because they're the lowest bidder. And it's still within the budget?

Thank you, Your Honor. Just a few things to report. The chimney demolition at 21 to 31 North River Street is underway. Our office remediation here at City Hall and furniture installation has been completed for the economic development and planning and zoning offices. So I'm moving out of the conference rooms that they have been conducting business in back to their own departments. I just wanted to let everyone know that we've significantly increased the number of permits that are available online. We actually now have 36 different types of permits online. The firefighter paramedic posting closed on July 1st and our review of applications will begin. This is in preparation for conducting testing and developing a new list so that we can hire those three firefighters that are part of this year's budget. many who attended the fireworks this past weekend, notice that we have purchased the additional safety barricades from Patagonia. And both employees and the public were really impressed and glad that the city had made an investment in a significant safety piece of equipment, especially for large events such as the fireworks. The last change order for the wastewater treatment plants will be at next week's cow meeting. And I can happily report to you that that project was completed on June 22nd and on time. And for such an enormous project and a huge investment, that really is impressive for it to have come over the finish line on time. um engineering along with our consultant held the kickoff meeting for the harvard street reconstruction on july 1st and just an update on the road diet we are anticipating having public information meetings to show them all of the improvements that are being made at each intersection and giving them the opportunity to ask questions and provide us with feedback on that The lead service line replacement has shifted to South Batavia Avenue this week and several in the 100 block. It takes a lot of logistics and coordination to be on such a busy road. So we just urge everyone to use caution in that area. and be patient and to make sure that everyone's safe. Speaking of safety, Firefighter Najin presented part two of a fire safety program to the students at Valley Sheltered Workshop. It's part of their lifelong learners program and we're very glad to be able to participate in that. and lastly i would just like to give a shout out to all of our first responders including public works police and fire um for uh and then you know the streets department electric and water had so many call outs between thursday night and friday morning i couldn't i counted 11. call outs for various issues. Just so glad to have these people there when we need them. And then also to support our public safety at large events like the fireworks, making us all feel safe. So thank you very much. Other business from the council.

All right. The mayor's report. Hopefully I can be quick here. I got two things. Number one, I just want to say some words of appreciation to the Batavia Fireworks Committee, which was now in its 50th plus year of firing this thing off. And this was started in There's a debate as to what year we started it, 1950 or 1949. It was after World War II, and they were trying to do something to begin to pay some tribute to those who had served in the service. And Bud Richter, who was then the fire chief, said, well, let's put together a fireworks program. And he went out to Illinois Avenue, which is today a little athletic field out there that was pretty small. And there weren't any houses built on what today is Republic Road. So we was able to move the shooting of the fireworks off the field and they fired up over the field. And it was a big hit in Batavia and it's been a big hit ever since. And we seem to be the only town around here that does this every year. And I'm very proud of that fact, given, you know, how much patriotism and how much need there is to appreciate what the government is doing and why we were doing it in the ways we do. So I just want to say thanks to the Fireworks Committee. I was told during the four days that it was going on, as you know, we had a delay of the day because of the water. And I had several of the key members, and I'm not going to name names tonight, tell me that they were going to ask to step down from being a member of the committee. So we're going to need some new members on the Fireworks Committee to And if anybody's listening to this or has any thoughts or suggestions of some other people who maybe have an interest, let us know because we're going to be looking for some people to hopefully carry on this tradition. So I just want to say a big thank you to the fireworks committee for a tremendous job. I mean, they had to go way over when that rainstorm came in on Thursday. Fourth of July and basically drained them out of business that they were able to get themselves picked back up and fire it the next night. And, you know, we had a lot of people there the second night came back for it. So it was and I had several people tell me, well, I live in Aurora, but I always come to Batavia because this is the nicest one that is in the area. So we've got a reputation and we really don't know how many people we get. Because what we've done out on Randall Road is we built these big parking lots out there in front of all the commercial stores. And on 4th of July, most of the stores are closed, so all these visiting people can come in and park in those parking lots out there. So we've probably got several thousand people sitting out on Randall Road that may not even be from Batavia, but they want to be part of our show and involve what it is. So the other thing I just want to cover with you folks, because I've become kind of a stickler with this, I'm very pleased with what our Public Works Department has done in rebuilding the intersection at Prairie and Wilson. And as you may have noticed, that's an intersection that's now been built so that there's sensitivity to how many cars are sitting on Prairie and how many are sitting on Wilson. And if nobody's coming from the other direction, Traffic signals will turn over and move people quicker than they have previously. And the intersection is fine. The problem we have is, is that they rebuilt the sidewalk coming off of Wilson on the prairie. And for some reason, the railroads of the opinion that they don't want the sidewalk built up to the height of the railroad track. And so right now, and I invite you to go over there and take a look at this, you come off of Prairie Street or you come off of Wilson on to Prairie or from Prairie on to Wilson. And as you're walking, and I ran into a woman at the farmer's market on Saturday that showed me the big crash she had on her leg because she walks with a cane and she walked down there and put the cane down and the cane just went off because there was no ground to set it on. And she fell into the hole. And she tells me there's another gentleman that she named that also has done this, and he hasn't contacted us. She said he wasn't hurt, but he was embarrassed about it, so he doesn't want to talk about it. But Laura and I today had lunch with our congressman and had a conversation with him about it because we said that, you know, federal government's got a little bit of an interest in this thing because of the railroad track and where it is and how it's going to be. So we gave him a bunch of information and he's generally pretty good about going after things. But I may be back here in the next few months yelling at you that we got to do something here because you can't leave that sidewalk eight inches or nine inches above the rest of this road. And then people walk and fall off of it and It's just a badly designed thing and nothing to do with Batavia. It was put in by the railroad and the railroad tells us they don't want that design that way. So I think we'll probably have some more conversations with them. But I invite you all sometime when you're out and about to take a ride over to Prairie and Wilson and look at this thing. And now a new feature of it is, is that there's weeds now growing off of this uncut area. And we got weeds now growing onto the sidewalk. And so, obviously, there's nobody set to get the weeds out of there. So in the next couple of days, I'm going to go in there and take the weeds out. I do that quite frequently. And it's just a bad situation. I don't know. And we don't seem to have any record. And Congressman Foster today was saying that, you know, these are hard people to deal with. Once they build it, they don't want to continue to rebuild it. And it would mean a very minor adjustment. You just... put some nice rock or dirt right next to the road and just bring it up to the level of the sidewalk, and that would be it, and we'd solve the problem. But I'm fearful we're going to have some other people, probably senior citizens or small children, are going to go flying off this road step i guess i would call it that's there that goes no place on prairie and wilson so take a look at it i'm sure this is not not the last time i'm going to talk about this so just let you know we we've got something here that's not going right in my opinion mayor can i add that um originally the way we had it on the plans had called out for the stone to be put in there to the grade of the

sidewalks and bnsf had us remove all of that stone back down and almost to barren ground so we had to do that as that is their right of way and we were within their right of way um so we have approached them about it and laura sent a letter to them again notifying them of this in these recent incidents so we're just waiting to see if we hear back from them on that and um i'll work with

our streets division but i think a lot of the weeds that you're referring to on private property are within the right of way so we'll look into that though yeah i our public works director is with us and she's doing a nice job trying to bring this around i i don't like to throw my weight around here too much but as most of you know i serve as chairman of the chicago metropolitan agency for planning's council of mayors at cmap downtown chicago in the old post office and i'm in there a couple days a month And we're the ones that approve the federal money to be spent for all these projects. So I have a voice at the table, and I'm probably going to go into one of the meetings with the railroad sitting there and start making some noise about this, just so you know that I have the opportunity. And I don't think they're going to like to be talked about in that format. But if they get this attitude that it's going to stay the way it is, we're just going to continuously have – senior citizens and a lot of other people just going off the side of this thing because it's the only place that we got a sidewalk in Batavia that doesn't have ground right next to it. It's got eight to 10 inches of nothing. And it's just a strange situation. So That's my bad news for the night. So I just want to let you know we're on top of it. You may get, as I did last week when I was over at the farmer's market, I had this woman come over and get right in front of me and said, I want to show you my leg. Okay. And she pulls up her skirt and there's this big scratch on her leg and she'd cut it. So anyway, that's the life of being the mayor. Sometimes you get into those special moments.
