I'd like to uh give the city a fyi fyi there are a lot of projects going on in the city especially in my district um there's a lot of public works uh projects that are being that are taking place a couple of them are regarding uh street reshapes bridge retailers and i would just like to caution the public that when we get close to these areas, these areas have been blocked out for a reason. And I would ask the public to make sure that we're not going inside. If you don't live in that area and that road is blocked out, just ask for you to be careful in that area and if you can, bypass it so we don't have to worry about tearing up the road signs, the blocked off signs. And there's some of that going on in the city where signs have been put up but they did not now push down or whatever. So, uh, we pay attention, be more cautious surrounding those areas.

Good evening, councilor and mayor of 14. My name is Charles Bradford, 13 and 20 South Washington Street. I had a couple comments on the agenda here. Item number 7A, 8C, and number 9. I'll start with, excuse me, I'll start with the financial committee on the bills and claims report. I noticed that we might have an increase in grantees. I just wondered what anybody's saying, maybe, why Mr. John's fee has been so much increased. I think it was $7,700 maybe, something like that.
Mr. Johnson, would you like to answer that?
It's not an interesting question, sister. Well, let me make it to the public that Mr. John fees have been extended from 4800 to some 75 plus 8,000. I mean, $8,000 per month. And I just want to have the city council approve that. Let me move on. Thank you, Mr. John. I put it in each month. It's detailed. I put it in each month. It's detailed. sorry that's another detailed invoice tomorrow oh yeah i understand understand um well that'll be discussed with the city we won't get into that just wanted me to get to my attention uh hc calling for him this is thorny he's not here yet i don't i don't think i see any department here well that's you know reserved because that was a Don't have to take me to the end. And I don't see it in Mr. Rogers. Just in case you do come in, I'd like to reserve it to address that. If you do come in late, you know, we don't see it on the agenda. We just want to reserve it. We'll go down to number nine. Action on order and resolution in the previous minutes. Approve. I mean, the approval of order 264287. The ordinance established a solar panel administration project and standards. Again, in this community, why would we entertain this? I think we made it clear that the community did not want solar panels no more inside the city limit. Why would we even be considering adopting an ordinance to set standards? I mean, know we i believe this matters in court uh this matter have been discussed and i don't i'm just making suggestions that the council doesn't even entertain this particular request to do this because the support matter it's a community matter and we are concerned and we don't want it why put it in the community why discuss it i mean I don't know who keep putting it back on the agenda. I don't know who's gonna do the makeup of the agenda, but here it appears again. I can tell you the last time, and I just found it's a necessary waste of resources of this community to continue to entertain what the community do not know.

Again, There was some confusion with regards to the meeting that you noticed that you didn't get an agenda from the customer that was usually against the agenda. There was an impression that this regular meeting was going to be funny. So kind of threw everything off the schedule. That's why you don't see department heads here. That's why you didn't get a packet when you got it. typically we would get it. So I thought that was the confusion of whether or not this meeting was actually supposed to be rescheduled for the 20th. So that's the reason why we have some discrepancies in what you're used to. And on behalf of the administration, we apologize for any inconvenience that may have brought to council and members of the public.

That's my understanding that just like the previous meeting that got rescheduled, this meeting was going to be rescheduled as well. That's just my understanding. Again, I wasn't in any discussion to force this. That was just an impression that I got because other people had it. Again, that led to the package not coming out, being completed, getting it to you ahead of time. That's what I was trying to figure out. Yeah, I know there was dialogue, you know, way past the last meeting because there was talk about rescheduling the previous meeting and this meeting, but I'm not sure the logistics of it. In all honesty and actuality, the meeting
Discussion should have never been had about canceling this meeting. That's the reality. Doesn't matter who's able to be here, who's not able to be here. If the charter says that we're supposed to have a meeting, that means we should have a meeting. If we're going to reschedule, reschedule any meeting, that means we need to do it in a meeting session, in an open session, so the public will understand from the very beginning Again, there should have been no confusion because some of us were not aware that a meeting was even being talked about for the 20th. The meeting today should have stood as was according to the calendar and according to the charter. I know there was some talk out there about the meeting being rescheduled to the 20th, but for legal reasons, that couldn't happen. So besides that, there should have been should have been no confusion about the meeting that did happen. And so we have to move on from that. But, you know, going further, you know, that's a lesson we can learn and have in our hip pocket. The meeting's by charter. If we don't vote to reschedule it inside the meeting, then it has to go forward. Thank you. Mr. J.

In our last meeting, the problem is we talked about this at the end of the meeting, but we was in a discussion. If you go back and look at the meeting, I'll say it specifically. Everybody was in a hurry to leave because it was late. I said, hey, we got to do a resolution. But everybody was in a hurry. Nobody said anything. So we got to do a resolution if we're going to move the meeting. Nobody stated anything. So this is where we're at. because we represent the people. You don't have to get in a herd. We don't come in for a show. You don't worry about how long we'll be here. You got to do things prop and order. When we left here, we didn't do a resolution. We should have done a resolution. So we actually talked about it at the meeting. It was an open forum meeting. We were at the council meeting. We spoke about it, but everybody was like, Ready to go, and nobody really was focusing in on it towards the end of the meeting, because it was a long drawn out meeting. And if you go back and look at the meeting, we discussed it at the end of the meeting. Everybody was counting like an agreement on it, but we never did anything formal.

Um, it seemed to be some problem with, you know, find it to be further. It was some, it was the Dodie. He was moving into a few things, a few things that y'all had a question and then turn it here.
Now, what I'd like to do is table the minutes or in the building plan for the meeting. for the July monthly bills and claims. There are some issues that need to be discussed at another meeting time. I make a motion that we do not accept the monthly bill behind that and we table it to a future, a special court meeting.
We actually don't really accept the meetings. you know, talk about the discrepancy or whatever we want to discuss, because actually we don't have to reject or table it because we're not mandated to accept it anyway. It's just a formality. But what I was hoping to do as chairman, because there was some issues that needed to be continually discussed that we ran over in our finance meeting. So I was giving you a chance to address your concern.
Okay. Well, if we look at the bill, the monthly bill, are a couple of issues on there that I think need more clarity on. One of them is the city attorney's pay and prosecuting attorney. The issue with that would be, as far as I'm concerned, is that I think that should have come by the council. According to what I'm reading in the law, it says that the mayor does not have unilateral authority to decide to pay the city attorney the other funds, the additional funds. That should have been, because again, not only do you have a problem with the payment, you have a problem with what item in the budget it came from. The information I got, it came from item 94. Item 94 in the general budget on the administrative side. Well, if I look at item 94, line item 94 on the budget, this is our current budget. It says Medicare expenses $12,000. So I know we got to put it in Medicaid expenses. That was the information I was given when I asked that, that it was pulled from line item, specifically line item 94. And that cannot be the case. So there is an issue.
with where the money came from to do that the only question i have i mean that's the budget question yeah when you first find out what do you mean where the where the extra funds were being paid from i'm asking what line item what budget you're talking about or national no this year's budget this is budget It should be out of special service. I don't. Yeah, but somebody told me something.
Right, right. That's the information I was given legally that it was coming from my 94. So I think professional services are there, but that's not what I was talking. So I have to go back to the information I'm given with.
that can be uh confirmed with the bills and claims with this with the invoice because that's not a medical experience i don't know of course and i'm not i'm not quick i'm not even speaking on that i'm just telling you that professional services is what is being that that's the funding that that comes out of now what line item it is you have to budget you can tell me what line item it is on what page so somebody gave you something
Okay. If you, it's page 416, and this is the current fiscal year's budget. Professional services is at $140,000.
That number, I think, should be in discrepancy as well, because when we did a work-up of the budget, it was changed. If it wasn't, I don't know if you remember. I don't remember, but that's what I'm saying. This is an issue that we need to revisit. Until we get full clarification on it, then I think the minutes should be accepted, the minutes from the finance that should be taken. Well, since we're here.
professional service, then line. Who all was paid on that particular line?
Uh, professional service, you have me, you have Joan, you have, uh, M5, uh, I think it's...
So, can you tell me that, Kate, can you tell me the standard rate for all three of them? I can't tell you. I don't know. You can just give me the monthly standard rate for each one of them. The answer is $4,000 monthly for the city clerk, which is $48,000. $4,000 for the budget and policy, which is $48,000.
THE SPECIAL ADVISOR TO THE MAIL ORDER, CHIEF OF STAFF, WOULD HAVE BEEN, HIS RATE IS $33.54 A MONTH. SO THAT ROUNDS OUT TO ABOUT $120,000. NO. CHIEF OF STAFF. ALL THREE OF THOSE SHIPPING HERE AT $120,000.
what is the in the budget 140 because i because i'm running so you got two two of those names 48 000 a piece because 48
And you do 20 times 30. That gives you your rate.
So yeah, that's running.
The other issue is if it was paid out of professional services out of that line, since I have a copy of the budget, should that number have changed or do we have to wait? because this is the living, breathing document, right?
Yeah, it will change if the projection when we get to Q1 just about to change. Just because the change outtracks the budget, that's the decision we have to make. Because if we get to Q1, there's more than 25% when we have to change.
Okay, thank you a lot. That's why I have a question. If it's being paid out of the $140,000, when will that number show up at each check?
When we do Q1, because Q1 is the first quarter. So the baseline would be 25% expended in other categories. And then we make adjustments, just like we did the other ones. We use that as the... engaged to assess whether or not we need to either reduce that capital or increase it.
Okay. If money is being paid out of this particular line item for the last three or four months, then again, we've exhausted the $140,000 already.
if the current trend goes from 52 weeks. That's the reason why you do, that's why they recommend you do budget revisions while we do affordably budget revisions, because that number is going to jump out of, you're going to go to each category, everything on 25 cents. It's like we did the first time. You question every line item that's exceeded budget, except for the ones like, I remember you had a question we had, I think it would be insurance. We pay all that at one time. So it was 90% because we paid it. So those line items you kind of set to the side because that's not what Brock gave. So you'll see that when we do Q1. Everyone, like I explained to you before, whenever we do Q1, Q2, Q3, or whatever, Whatever that target is at the top, anything that's over there, that's what you should draw your attention to. That's the reason why we're doing it. So when I give it to you, you can look at it. And the first thing you do is if at the top it's at 25%, you go down each line and you make a note. Which one's on 25% in Q1? And then you figure out, okay, what's driving it? And those are the questions that you develop. And we'll look at it.
and we'll be able to judge that's why we're going that's why we're not going to blow the budget up because we're going to look at it more times i understand but i think one of the consequences making is trying to fix a situation instead of waiting to keep one because we are saying that it's going According to the numbers that we have, because we only budget for $140,000, just our base salaries, it was equal to $136,000. So that's a little wiggle room with $4,000 a year. So you're looking at now an increase to the amount of $4,000, it's going to be an issue.

But you have to put it for some work. Not if you don't approve. But then how do you, okay. So if you don't approve it, then how do we get paid?
There's always that that's outside.
That's even better, even better. Because now, because now, because according to the facts that Mr. Douglas just gave, the work has been done. So someone had to approve it if you haven't come before the board. Because think about how else would the work be performed if it wasn't approved. And then if it was approved, I understand the work being done. But now at that moment, that's when this board get involved because we have to be, we still have to learn money. we have to agree or we have to move money somewhere else to cover the improvement that wasn't made by the board. I'm not saying you're right or wrong. It's not a good question. No, no, no. I was right. Councilman J.
Green? Point of information was done. You stated
chief of step when he was calling out those budgetary numbers yeah uh what would you you say chief of staff was what how much was they it's 33 people a month okay well that's right having some clarification so cheaper step is a permanent position not an outsourced position so somebody to be chief of step they would have to be I'm just saying what you was reading on there, I see that also. That's a question for the administration. I'm asking Mr. Smith.
I disagree. That's not a budgetary question, so I don't have an answer for you, boss. Titles and staff and level, that's not something that's in my purview. I was just asking, maybe it was a type. It could have been, because I don't ever recall anybody being referenced in any meeting as a chief of staff. And that's just my recall, and I don't mean anything. I don't remember anybody being referred to as chief of staff.
Can you read those categories in the budget?
Oh, the category in the budget is for family service. I'm telling you that. Great.
Who are we paying in professional services now?
myself uh myself mr jones if i we still do we have a yes you all three because i could i mean i mean i know we were addressing this long ago we also kind of just effected if i'm not mistaken that attorney doing extra work now so i'm assuming i'm assuming this would have to be extra work
According to the contracts that was brought before the council, Mr. Mayor's position was contracted as not Mr. Mayor himself, but his company, M5 to provide chief of staff services to the city. That's what that contract said.

Thank you, Debbie Rogers, planning and zoning president. First item we had on our agenda is the front porch garden and gifts. That's at 111 East Madison. It's the side where Steve's jewelry is, but it's back towards the police jury office. She's going to open up a shop there to sell little gifts, candles, jewelry, things like that. So it was approved by right. Our next item was Butler Substitutions. It's an online business. It's all digital, no personal sales, and it's a recipe sales. People provide recipes to this lady, and then she sells them online. next item is gin root properties 1220 south washington street it's just going to be an open space for parties like birthday parties anniversaries and things like that okay this is a special use permit um well Let me address the question that Mr. Bradford had. If they submitted their application after our last meeting, which was the 20th, it will be at our next meeting. So it's kind of bad for some people because if they do it like a day after our meeting, you've got to wait 30 days before your application is heard. So it may be that there's . All right, this is a special use permit and it was voted to send to the city council for either approval or decline. Shannon Walker, it's 212 Terrace Street. I'm sorry, 212 Terrace Street. She wants, there's like a concrete slab where a house burned, but it's been completely torn down and it's just a slab there. Well, she has a brother who is homeless and she wants to put an RV there and for him to live in. Right now, the RV only has a generator. but if he's allowed to move there, they're going to get an electrical pole and water and all that to hook up so that he can run it on electricity instead of the generator. She said she did check with the neighbors that live next door and the neighbors were okay with that being there. But it is an RV, it's not a mobile home. So, anyway, that's something that the city council needs to either.
What was the report of the recommendation?
Yeah, it was a recommendation that we send it to the city council.

Yes, we're working on a way of procedure for people to watch our attention. Very serious things are going to place. I will not share right now, it's paramount, but once we establish a way to deal with the complaints with City Attorney Mr. Jones, we will call a special meeting and we will came upon telling something that I left that we have to address soon. If I get more information, I'll let the council.

We're still working on what I talked about last month, which is an amendment to ordinance pertaining to alcohol in the historic district so we're still kind of working on that and i will um probably give it with uh devon about some aspects of that mr doughty has one question for you mr can you remind us what the uh what the uh for this year
refer to what needs to change with the ordinance.
Okay, I wouldn't expect him to speak.

But as it stands right now, there's nothing in the ordinance. All the ordinance says is that restaurants and alcohol are allowed within the historic district. There's no guidelines whatsoever on the sale of alcohol, or if there's somebody that just wants to open a bar, there's no guidelines that says he can't in the historic district. Our position is that the historic district, and most especially the square, needs to remain a family-friendly atmosphere. And any businesses located within that historic district needs to, there needs to be specific guidelines to exactly what can be served in the whatever historic district, which is the square, round, match up in the block. completely around.
So, are there alcohol in the historic district? Yes, they're at the restaurant. At the restaurant. And so, have you and your people, have y'all looked at, I know you say there is no specific thing in the ordinance now, do you have a presentation
Or what you would like to yes, we're working on that and we're looking at, we, we looked at the city of Hammonds historic district guidelines. And also, I believe we see, because we had a special call meeting Monday night. Or Tuesday night, I can't remember what today is. As well as. Covington, we're looking at historic district guidelines. and as they pertain to the sale of alcohol, the sale of everything, you know, exactly what is allowed inside their industrial industry. So we're hoping to possibly model it by something that's already done. We don't want to recreate the wheel and have to go out and do all that. So we're looking at a couple of other ones to see, we like this and this one, we like this and this one, and kind of put it together. to be able to present. Jay Green. Mr. Jay Green.

Those laws you referred to, that was in the conception of the historic, when was the historic district established?
Instead, if you have that, you have the. It was.

I have been on this for at least 20 years and it was probably five or six years before.
So this is what you referred to as the original law. It's always been like that. That's been amended when.
We became a Main Street town. And please don't hold me exactly to this because I'm trying to think and I'm 57 years old. So when we established the Main Street project here, that is when, about that time, that is when the historical district came in around the same time.
Okay. It's not a gadget question. I was leading. I'm going somewhere because I want to know. The laws you read in the ordinance, that was when it was first established. That's all I'm asking. Yes.

That's what I'll do. So you've been on it 20 years. Yes, sir. And there have been, that call has been, have y'all have any, besides that restaurant up there now, have y'all denied anyone else the right to?
We've never denied anyone anything. We don't have that power.
No, I'm just saying when y'all been historical district, you know, uh, recommend or whatever. So it's always been, they have always been able to say, you just try to get another ordinance to proactive before, because we do have Sarah.

And historically they have been retail, the restaurant, he teased as a restaurant. other than those two historically it's been rejected and so as we do have empty buildings and um you know how it comes up well what about if somebody wants to do this what about if somebody wants to do that we're trying to be proactive to say you know we want the area to stay family friendly and um along with the concept of what the historic district means

Chief Reed. i'm looking at i don't see any department chief chief williams hc code enforcement officer lee thornton d public works assistant director karen thompson e city clerk miss clark i know she was here does she know too much I'm here. Well, I know this meeting was posted. I know it's in confusion, but this meeting was posted.
I know nobody else can answer why nobody is here or nobody is not here. That's not for any of us to do. We've had and we've asked for these officials, department heads, to be present at council meetings. That's been the way that we've made it, because there's still business and there's still questions and answers that need to be had inside the meeting. And if we don't have them here to answer that, then I pose the question, you know, what do we have in the meeting for? because that's very vital part of why we have these meetings. And this is in response, all of this is in response to the public need. This is about the city of Bastion. So I'm just going to go and say that because there are no department heads here, that begs the question, why? And nobody can answer that. So that's a question for the administration. And again, I want to go on record to state that in our future meetings that department heads need to be present. If they are department head and they are listed on this form, they need to be present. Mr. D. Green kind of gave some of the update that we're working on with Quality Assurance, working with some process forms, resolutions to come out of there. We've also worked forward with dealing, we had a We had a training back in July with the police department when it relates to their legal updates and their enforcement. And issues like that report Friday and everything else. So they're able to do lunch with it. It's able to update them on all the legal aspects of necessary to also satisfy. Okay. Yeah. Mr. Jake.
Mr. Joe, I know it's on down on the, on the list, but he was supposed to, did you check? He was going to get back with me on that moratorium consecutive moratorium.

Yes. Uh, since we're at the city attorney, uh, can you tell me, uh, Since DEQ came in and shut this project down here, the building up on Main Street, is that project back in progression? Is it back in work?
That's not in my department. That's going to be the Federation of Public Works or wherever that's at. That's not in the city. That would be a legal issue. The legal issue came up, the resolution of that legal issue,
Again, we have a problem because we don't have anybody here to answer the question.
What did DEQ do again? DEQ shut the work down on this project. When? It's been about a month ago or so. You're talking about the project by 113, 1000? because it has invested in it and you got to be certified when it deal with it's best to say when it's
Who are more consecutive buildings or something you got to. Something you got to be certified, so therefore they came in. And it didn't have a. Qualifications or whatever, and they just shut the project down. For the notes, I don't know where we stand at.
Yeah, that was that's the more deal with the contractor than us. That was that was the. The library that was doing it that hit contracts.
So in a situation like this, if I understand that we had somebody contract out to do the job, how do the payment work at that moment? Contract works paid on performance.
So paid on completion. So until completion.
Oh. Mr. Duggan. Mr. DeGreen, there's already been two payments on the work. building, two $2,500 payments for Ms. Hawkins. She's the one that put it on the building. After that, that's kind of around the time the building shut down. Maybe around after that second payment. So again, I only ask the question because we're at the legal part. And if DEQ shut it down, then I'm thinking that it's now become a legal issue. So he's saying that it's more administrative stuff. Yeah, the legal aspect of the contract.
It's kind of because they're performing the work that's whatever it takes to get them legal or qualified. I don't know where they're at with their issue. I know on our side, whether they started back up or not or when they plan on.
But the city would have some liability in that way, would they not?
The DEQ did come in and shut the project down. The site was tested. It was cleared. An engineer went out and did a report on cost estimate to finish demolishing the building. And that's what I know to date. I don't know anything else other than that. DEQ came in. They shut it down. Contractors reviewed the site, the site has been cleared by DEQ and the engineer came in to assess what the cost would be to finish demolishing the site. We are in the process and I'll submit that to you probably Monday to do the closeout queue for budget. We don't make it available for inspection, probably Monday, Tuesday, but we're going to advertise the official journal Thursday. We're going to count the 10 days from Thursday to be inspected prior to that day. Just a little FYI on the budget. Mr. Green, D. Green, I can report to you that those concerns you had with those projections from Q3 on forward, they came in right within that standard deviation. Probably a little bit better than the standard deviation because the standard deviation is 5% up or down. the net was around a little less than 3%. And then I went back and did it from Q2, and it was off maybe 0.3%. So I'm confident, because again, my projection models are based on historical data. And again, that snapshot does give a good indication. So moving forward, I know your concerns, because again, I ran it again, and had I done it again, it would have been almost a little bit over half percent more. So you got 0.3 to a half percent. So you got a negligible amount of the difference it would have been. And the only reason why it's being advertised is because there was a caveat that came in that I'm going to have to revisit because there was some reason why our work has come. came in an unusual skewed way, which wasn't anticipated. And that's the only line item that was out of the ordinary that wasn't captured by those projections. And I'm going to talk to the insurance company to figure out what that was. But you'll be glad to know that we're going to have almost a half million dollar surplus in this budget. balance sheet that's going to be attached to q4 so the numbers are pretty straightforward you're having i'm going to try to get it out to you tomorrow but don't hold me to that for monday um and we're going to do for all three budgets even though they're within that five percent variance um and they're not necessarily need to be advertised but since we advertised the general fund Because we're going to pay for the cost. So we might as well put them all out there for everybody to see.

the Delta Regional Authority DRA for the community infrastructure funding in 2026, I mean fund, 2026 funding. Real quick, members, this is a project that we're trying to get funding for. It is a project, go to page two of the resolution and look at the first two paragraphs. We're seeking funding through DRA. for the 2026 federal award program cycle for the changes and improvement project. It's on Cooper Lake Road to Saturday Drive. The cost of this project is lower than half a million dollars. In this application, the city is going to put up $50,000 in matching funds. The project application deadline is coming up, and this is one submitted application to engineers, prepared the report, updated. This was a project that the engineer presented a scope of work and the cost back in December. We just updated it so we can submit it for this application process.
