Advisory Plan Commission - Regular Meeting

Heat. Heat. Heat. Heat. Hey, hey, hey. They are available on the tables to the right of the audience. We will be conducting business as outlined on the agenda. From time to time, the board may deviate from the agenda. As president of this body, I will inform those in attendance of any deviations. This meeting is being recorded for the

public record. Because of this, we request that personal conversations are kept to a minimum and that all cell phones are set to vibrate. All phone calls shall be taken outside the chambers. Now, there's this whole long section here where I talk about how we have a certain amount of time for the petitioner and the respondents and everything. However, our Christmas gift to you is that everything on tonight's agenda has been continued. So, it's going to be a very short meeting. So, I'm going to skip that whole part to go to We understand that there may be several persons who wish to speak. In order to keep the meeting running in a timely fashion, we request that you not repeat previous comments, which also doesn't apply. So anyway, thank you for your assistance in facilitating a respectful, fair, and timely meeting. Welcome to our meeting. Please stand for the pledge.

Okay. Moving on to the approval of the meeting minutes from November 24th. Has everybody had an opportunity to read the minutes? And are there any comments or corrections or questions? If not, I'll entertain a motion. I'll go ahead and make a motion to approve the November 24th, 2025 minutes as presented. I'll second. Having had a motion and a second, all in favor say I. I.

Meeting minutes from November 24th are approved. We now move on to the public comment section and com comment section. This is the opportunity for those who are present to speak about anything that is not on tonight's agenda. If there's something else you'd like to talk about, like too many chicken places on 36 or or anything like that, uh this is your opportunity to speak. If it's already on tonight's agenda, then we would go to that section. But if there's anything you'd like to talk about that's not on tonight's agenda, now is your opportunity to come forward. Nobody. Okay. Moving on to the request for continuences or agenda modifications. Thank you, President Ransburg, members of the commission. Staff would draw your attention to position DPR 2512, which is the Parkplace Crossing development. Uh this has been continued several times as you're aware. Um we have been working with the petitioner to develop a plan that's consistent with our their plan. So we do have a lot of ongoing discussions and they do they have been doing a lot of uh revisions to the plan. Um but they indicated they do need another month and they anticipate um being able to file uh for the January 26 hearing. Um so January 2nd's our submittal deadline for the 26th and they have indicated they will be able to meet that um that deadline. So we would request a continuance to your January 26th hearing.

Is this a petitioner request or a staff request? Petitioner. And have they had any previous has the petitioner requested any previous continuences?

The last one was from October 27th to December 22nd and I believe that was this one's a little difficult because it's been a lot of collaboration between staff and the petitioner on this one. And so I I without Paul here, this is his case, but I believe they were the first one was staff from September or from October to just Yeah. October to December. That was staff. So this would be the petitioner request. This and this would be their their um first continuing, right? Okay. And they've been working closely. Absolutely. They have.

Okay. That's very good to hear. Okay. Uh questions for staff on this. No. No. Okay. Uh, we'll enter. And they're wanting to have it moved to when? January 26, 26. Okay. There's no questions for staff. We'll entertain a motion to continue DPR 2512. I'll make a motion uh to continue DPR 2512 Parkplace crossing to the January meeting. I'll second. I understand there's a request for continuence on that one as well. Correct. And I do believe we have some folks in the audience for that case that may not have been aware of the continuence request, but um, this is DPR 2518 um, known as the Avon shops and the

No, I'm sorry. There's also folks here for this one, but DPR218, the Walmart Market, Avon Avenue. Um, this one is a request. Sorry. Also Paul's case,

it's for the Walmart market. Is that correct? It is. Um, so the the town's traffic consultant after reviewing their traffic study requested additional information and additional traffic counts. Um, therefore, we're agreeing with the petitioner to continue this so that additional traffic study information can come in. So, this would I would say a staff request. Okay. Because of the additional information that we have requested. Have there been any previous continuences on this one? There have not. Okay.

And this would be to the January 26 26 hearing. And again, they have indicated they will provide us information by the January 2nd deadline. Does the the traffic study um the folks doing the traffic study, do they anticipate they'll have their information by J for that meeting? Yes. Okay. Any other questions for staff on this request for continuence? Okay, then we'll entertain a motion. Move that we move DPR 2518 Walmart Market to the January 26th 26 uh meeting. I'll second.

Thank you. This is uh DPR 2520 uh located in the 10,000 block of US 36, 10,654, 688, and 10,690 East US Highway 36. Uh this is for a redevelopment of this site for commercial um retail commercial development. The petitioner has uh requested additional time to determine any waiverss that they will be requesting and some final revisions of their site plan. Um this would be a request to your January 26th 26th hearing. This would be the first request by the petitioner

and and uh staff has been working with them on these waiverss or is this we're still early days? We've been working with them. I think they're determining if they can meet all the requirements or if they need to request waiverss and they're finalizing details of that. Okay. Any quest any uh questions for staff on this request for a motion to continue DPR 2520 to the January meeting? Good afternoon. If there's no questions, I'll entertain a motion. I move that we continue DPR 2520 Rotail shops uh to the January 26 of 2026 meeting.

Redevelopment from uh December 15th. In addition to invoice approvals, uh we also passed resolution 257 resolution of interest. Worded a bid for Dan Jones phase three utility reimbursement agreement for Duke and County Road 525 inspection agreement. and our meeting approval meeting schedule approval for 2026.

Okay. We also had a BCA meeting and I've slept since then. So, but we did have a BCA meeting. Um, is there anything anything else that we need to speak of for the good of the order? Okay. Well, this is the last meeting of the year for the town of Avon Plan Commission meeting. Uh, I want to say thank you to my fellow commissioners. Thank you, especially to staff who always do a wonderful job. Thank you to our town council for leading us through a a um fairly seamless 2025. Thank you to all of you who showed up tonight. Even though you did things didn't get heard, we always appreciate having our comm community our community members present and we we always listen to what you have to say.
