Thank you so much. good job congratulations are there any visitors here that aren't already on the agenda okay we will move to our first item of business An engineering services agreement with JEO for Santa Fe Lake dam design.

Staff. Yes. Mayor and council, we're going to go ahead and have our city engineer, Brad, come up and help me with these two items. I'm not going to steal too much of his thunder. The Santa Fe Lake project has about a 10-year history for us. We've been moving towards this goal for a very long time. And with JEO's help, we've finally gotten to the point of being able to move forward into a design and then later into a construction phase. I believe we've settled what we need to settle with the state, and now we're trying to turn that into an actual project. So I'm not going to steal too much of Brad Sunderland. I want to go ahead and turn it over to you. I know the public may not know this. Council is aware during our strategic retreat process you guys presented the results of some of that study. So if you want to just give a quick overview of the work that you are doing, why we're doing it, and where we stand at this moment with this particular action.

Yeah, thanks, Josh. Yeah, I think Council probably knows a lot about this from the workshop that Josh mentioned, maybe for the public. You have an existing weir, and I apologize, we don't have a presentation for you, but you have an existing weir that's crumbling, falling apart. And basically we performed kind of an engineering back and forth. There's a great picture of a crumbling weir. Thank you. to just replace that was not gonna satisfy the agencies. One of the options to just replace that in-kind would be we're lowering the lake level and that's gonna have significant impacts on a variety of things. So kind of a traditional solution, which would have been replaced in-kind and come back that green line there on the screen, raise the levy, it's a very expensive solution. The pink area to the north, is an additional area that the agencies that we were dealing with identified as there was some issues there where water would come up and cross there. We've come up with a creative and most important to the city, a cost-saving solution that the agencies have bought off, which is to, yeah, that section right there, Josh is anticipating me very well. So we're going to extend the top of the berm or levee with the concrete, basically what I would call a kind of a cantilever retaining wall structure. what that does is now we meet the freeboard requirements that the agency requires for your lake so we do not have to drop the water surface elevation of your lake we can build a if you remember that green line to the south we're going to build that cross section running along the levee we're going to replace your weir in kind and we're going to add some fill where the green line is i'm sorry where the pink line is so fill where the pink line is Red we're going to replace in kind essentially and that cross-section that he showed you that we're building along the top of levy By doing that we satisfy freeboard requirements. We've also we're actually dealing with two agencies. We're also verifying that we're not changing The floodplain map downstream of this we're so to me. It's a win-win solution I'm really proud of our guys for coming up with it. It's kind of innovative and i think it's 25 of our initial estimate for what a traditional solution would look like it's still a very expensive final solution but it does allow you to preserve this lake and continue to use it the way you are using it anything um i guess the other ad and maybe this isn't super relevant we are there is a It's not a huge part, but it will help. There is a grant that we are going to help the city pursue that could help with some of this cost. Anything else, Josh, you wanted me to cover there?

I think that's about it. That grant that he's referencing, we have secured it in the past. So we have a level of confidence in doing that. There's never any guarantees in a grant process like that. It's not a program that I think there's a lot of projects for all the time. Sometimes they're searching for projects to do. around the state so i think we'll be able to put together a very good application because this project has been on their radar for a very long time as well council has essentially identified your funding source for how we're going to to pay for that project out of the water sales tax fund and then we can put 10 years of work with the state and all the regulatory stuff that we had to do to get to this point behind us and then that that reservoir should be good for HOWEVER LONG THAT STUFF LASTS, HOPEFULLY ANOTHER SEVERAL LIFETIMES.

Any opposed? Motion carries. Mayor and council, if I may, just real quick, I'll highlight that a portion of that is a lump sum fee. The other portion is a not to exceed amount. So if it takes them less engineering time to do the administration element of it, then that cost could go down. But $132,000 of that is a not to exceed. So it can be that amount or less. Okay.

That takes us to item two, professional services agreement with JEO for the rehabilitation of water towers. Staff?

Yes. Mayor and council, several of you, especially if you've been on council for a while, are familiar with our history with water tower maintenance. It seems like we've done quite a few of them, but we're still not done. And in the case of one of these towers, we're 10 years on from the last one and it is already showing wear and tear that we need to address. What I would say about the water towers is there is a regular life cycle to it. It requires regular maintenance. We do have a KDHE inspection that is coming up in the subsequent year. And so our hope is to move forward with this and try to get this work done ahead of that if possible. Our staff worked with JEO, and they've put together this engineering agreement, which will ultimately get us to a big package scenario where we can bid this out and hopefully award at one of our upcoming meetings to get that work started. But this will apply to both the Arnold Water Tower and to Gulf Street. Some of it is simply painting and the coating. Some of it, there are some actual repairs to be made to the towers themselves. And Brad, I don't know if there's any other specific things you would want to highlight about the scope that I haven't, but.

No, you covered it very well. I think we're, so maybe one thing to add, you have had a vendor do an investigation of the water towers. It's a reputable vendor that we have worked with before. So they are the ones that put eyes on the tower and then we design the repairs based on what they have found. So we actually do not do tower inspections. We can't seem to find a lot of engineers who think that's exciting to go climb up into water towers. They're not all brave. So we rely on these vendors. This is not just City of Augusta. We do this for nearly all the cities we serve. But we will design the repairs. We will get the bid documents for the repairs and answer questions during construction.

Just a quick side note. I remember I got a couple emails from people that live out by the Arnold Tower. that that strobe wasn't working and that was about a month month and a half ago and i forgot all about it till just now so i don't know if it's been fixed already or not i will check get a helicopter to fix it no any questions for anybody on this

She was on TV a lot. It moves us to item three, your utility easement dedication at 114 Lake Crest. Staff?

Thank you, Mayor and Council. I'm going to give Josh just a moment. I've got a PowerPoint presentation to help the visuals. All right, so what we have in this case is a request for an easement dedication at 114 Lake Crest Avenue. There is a new single family home being built on the lot. There is an existing overhead electrical line that exists where the building envelope is being proposed. That electric line is not currently placed within any kind of easement. And that line really only services a singular street light essentially at the front of the property. As we've gone through the process, we have created an easement document that's going to create a 15-foot easement along the southern property line. What we have here is essentially the existing line here. You can see how it goes from the rear property line on the west side up to that front property line. The blue dots there are the street lights that are currently existing according to the city's GIS systems. we have here is a site overlay from what the builder has proposed and a little bit hard to see on here but right at the very bottom southern part of that the overhead electric line essentially clips that that section right there it's going to make that difficult for our electric distribution team to maintain that line if and when they do need to go in there and do whatever work and so that's become problematic Right here is that 15 foot easement I mentioned earlier highlighted in the red. We have that surveyed and easement documents drawn up, which is in the staff report for you. That area is easily accessible to electric distribution. We've communicated with that team and they feel comfortable being able to service that line there. We also took a look at potential alternatives for locating this line. So the two relocation alternatives are to run electric poles, either through the metal arc right away, which is the north south street there, or running additional electric poles through the lake crest right away. And then a third option is potentially just to decline to run the run power to the street light. These alternatives were not pursued for primarily two reasons. Running additional poles through the right-of-way would increase cost to the city for relocation in terms of we'll have to put up new poles. that just increases the cost in order to service the streetlight. And then the option to not run power to this streetlight, it would leave essentially no streetlight service for that entire corridor of Meadowlark. So the recommended action we have for you tonight is to approve the utility easement dedication at 114 Lake Crest Drive as legally described in exhibit A of the utility easement dedication instrument. I want that all stand for questions.

do we need to change the street name because that's it's got on their metal arc it's metal lake i'm going to assume that i'm just misreading it then okay we've already they've already moved the pole for the streetlight correct not that i'm aware of because there's there is a new pole there and it's on on the south side They did? Okay. I thought it looked like a brand new pole, so. Okay. It was not the one I was aware of yet at this time. Are we going to, because it kind of runs right through those trees. Are they getting rid of some of those trees, taking some of the tops off of them?

Potentially. So this all originated from a variance case. I don't have the date in front of me. As part of that variance case, that was granted, the property owner granted us permission to alter, adjust the trees as need be so that we could put the line in there.

All right, well, I will skip reading that subtext there. It's kind of mouthy. So what we have for us today is a one-step plat application that would address nonconforming lot concerns, adjusting boundary lines to reflect current land use and establish easements to facilitate potential future commercial development. um the the plat was heard by planning commission um and recommended for approval uh the site overview um i don't know how well you can read it it's essentially at the intersection of tuakini and southwest highway 54. uh the excuse me, site size is about six acres. Currently, there are four lots that would be consolidated into three lots. All our zones, C3 commercial, the adjacent zoning to the west is going to be residential, to the east is commercial and residential, to the south commercial and to the north is residential. For the governing body, the primary responsibility and duty is to take a look at the plat, review it, and either accept the dedication of streets, alleys, and other public ways and such plans, or to recommend it be sent back to Planning Commission for further review. So this is kind of a messy image here, but I wanted you to at least have the visual of the entirety of the plat image. All of the easement dedications are on there. And then on the next slide, I'm gonna have a little bit, hopefully better color coordinated section for easier viewing. Over on the left-hand side is the Prairie Village Platte and the Combs Platte as they currently exist prior to approval. The only easement dedications are going to be those areas in green. Excuse me. And then over on the right-hand side are the new easement dedications. The magenta, which are going to be on that north side, running north-south, are 10-foot drainage and utility easements. There's going to be an extension of the green area there. And then, excuse me, the yellow areas that are running north-south on the south side are 10-foot drainage utility easements. And then it's kind of hard to see on the visual, but just on the north half of the green area is the blue where there's a five-foot drainage utility easement. The blue area was existing, but there's new language added to it to indicate that it is drainage and utility, which will allow to have greater utility in the future should both types of utility uses be required. The County Commission considered to improve the easements after May 26th meeting, and we have received the signature on the Mylar. So our recommendation for council tonight is to approve the final platen drainage memo for case 202,606. Um, and again, I'll skip the subtext there. And with that, I will stand for questions.

Good evening. We have Brian here with Olson as well. It's our airport engineer. This has a lot of moving parts. So I really appreciate his help getting these on the agenda this evening. This is a project that started last year. I mean, probably even longer than that, but we had official action last year to relocate our AWOS, or Automated Weather Observation System. Yes. And last year we brought you an item for land acquisition to purchase the land and necessary airspace, I don't know, easements to relocate the AWAS. And then we also brought you a contract earlier this year with Olson to do the design and to create those bid documents for us. So these are those next steps in this process. So I'll turn it over to Brian. Thank you.

Yeah, thank you, Cami. As Cami mentioned, my name is Brian Coombs and I'm airport engineer with Olson and happy to be here this evening. um no relation to the coombs plat that you just considered a slightly different spelling so um just as a another brief refresher as well um one of the items that you're asked to review tonight is a grant application so some of you have seen me here before but i'll just give a little bit of a um refresh on how that works in the fa world you may be asking how are we at this point we're just now applying for the grant um so In the FAA world, the grant is more like the legal instrument that they use to transfer the funds to you. So we're in contact with the FAA on an annual basis to submit a capital improvement program. Back last summer, they provided us with a go letter that basically said, you will receive a grant, proceed with your project, which is what we did with the design phase. And then FAA's preference is to write the grant based on actual bid costs and engineering costs versus, you know, sometimes with like a kdot grant or some other agency grant you may apply based on an estimated amount and then that's what you get well the faa works with you so that kind of is an explanation for um why we're at this stage here this evening and so cammy explained it pretty well your existing awas uh is over 20 years old and um is experiencing issues where as parts go bad, it's becoming more and more difficult to get replacement parts to keep it operational. And then in addition to that, with the newly completed runway, part of those easements that we acquired last year, we're creating critical areas, which is about a 1000 foot radius around this piece of equipment. that needs to be free of structures and trees. So when it's current location, it really prohibits, um, any hanger development on the west side of the field. So acquiring the easement on the east side, and then proceeding with the construction to put it over on the east side clears, we'll clear that west side for, um, some new, uh, hopefully building development, um, that I know the city's, um, gets interest on with the completion of the new runway. So, uh, The other item is the overall. So this grant will both pay for the construction. It will reimburse the design agreement that you've already executed with us and would pay for the construction services agreement that you have here tonight. The total project costs, including all of those phases and some administrative costs is $645,000. The FAA grant is covering 95% of that this year. So applying to ask for $612,750 from the FAA for a resulting city share 32,250 would be your city share for all of those items combined.

And for that city share, Mayor and Council, you normally allocate a placeholder amount for any matches for airport grants that we may receive. So you regularly allocate for those matches, whether we know we're getting a grant or not. So you already budgeted to pay for that as well.

So I think that concludes everything in advance. Happy to answer and go into any more detail based on questions that you may have.

Mayor and Council, if it's helpful. So this shows you that map. This point right here is where the existing AWOS is. And the white line represents what a 1,000-foot circle would look like. So you can see in its current placement, it technically prohibits development on our prime development. ground where we would want to put hangers and so when you went through that process over the last year 18 months you've acquired land over here in in this corner of this property so we're moving it to this far opposite side so that all of this land along Indianola road can become developable and so there's a lot of history to it but that's that's the move that is being made is relocating that to this opposite corner here

And that was in accordance with the master plan that you've adopted. So again, great timing in that the runway is completed, existing systems at the end of its useful life. And so we're able to replace it with where it needs to go based on your master plan, so.

Council, you got any ideas on how you want to proceed?

Josh, with the way this is written, three separate motions in sequence? Yes. I move for the approval of the bid award for the Automated Weather Observing System AWAS-3 project at Augusta Municipal Airport to Atlas Electric LLC of Wichita, Kansas in the amount of $490,803 contingent upon FAA concurrence and receipt of the grant and authorize the city manager to execute the contract documents.

Yeah, Mayor and Council, this is a mayoral appointment. This person was on our list when we had put together the list for all of the previous appointments, but we hadn't been able to confirm with them yet. So when we went through the list of previous folks and appointed all of those, we didn't have this one included because we were not able to make contact and confirm that they were available and interested. We have subsequently done that. And so we're bringing it back for your consideration. I believe that Patty was in that grouping when we had the last council person opening or the vacancy on the council. And you had encouraged all of those folks to try to stay involved and get involved on boards. And several of them are following through and trying to be involved in that way.

I'll make the motion to approve Mayor's recommendation of Patty French to fill the remaining vacant position on the Convention and Tourism Committee for a term ending April 2027. Second.

Any opposed? Motion carries. That brings us to matters from and for the council. Before I go to the city manager, I've been... Tasked by Mister Kip Richardson, who's a member of the 250th celebration committee to ask about allowing a couple more signs to be put up in town. I sent you all emails earlier this evening with a picture of the sign that's up there on the screen. One of our local people, Daryl Thornton, designed and painted that sign, and he would do three more if we would allow them to be put around town, specifically on North Ohio, on West 7th somewhere, and then just at the bottom of the overpass, maybe in Docking Park or just at the bottom of the overpass.

And these are intended to be temporary just for the event?

Temporary, yes. And I haven't talked to the church I belong to, but we're just outside the city limits at 70th and Ohio. And I know I'm pretty sure we would allow that one to be put up there so it wouldn't have to be a big deal with the city limits.

Yeah. So, so mayor and council, it's been a while since I looked at it, but I believe under your zoning regulations and in the sign regulations specifically, you have a temporary sign permit or something that you can issue. Does that sound correct to you?

Yeah, there's a temporary sign permit, but it usually applies to private signs on private property. Okay. So if it was going to be on public property,

I mean, I think we can, they could approve it.

We could still make sure that it is. I'm not sure if there's anything.

I think you would still want to do it as a permanent process with any sign installation. You are still going into the ground and you have to deal with one dig and, and all of that sort of stuff so that you don't hit utilities and other things. So at least having a permit on file would give us something to reference and a

call that back too so i still think you just follow that normal process but we allow it in the right away is this the city installing the signs mr beyer or is this i was i'm not aware that the city was asked to do that i believe that would be taken up by that committee the current sign that's the one right behind the museum correct that's that's behind the historical museum on walnut

I guess we just start the temporary sign permit process, then we'll see where they want to put them. And if that creates any issues, there's just a lot of kind of unknowns at this point to give a definitive answer, but there is a process that we can get them on. If you are all supportive of that, I would say we'd need direction on if they want them in there, want to allow them in the right away, temporarily, typically their own private property. So, if we have support for that piece of it.

We would have to make a motion that we, or just general support?

You can make a motion in support of their installation, and then as part of the motion, just recommend that the applicant work with staff to identify appropriate locations and then follow the permit process.

Mine's just the longest section in our zoning reg, so.

I know the museum one is kind of tucked away, but something by the Dalton Palmer Park or the Depot or the Veterans Memorial, all the things right there.

um josh go ahead and explain it yeah so uh mayor and council on this one i would just like if you're willing to do it i want to keep it on the schedule and perhaps just allow staff to make a call by thursday or friday if we're not feeling like the content is ready we reached out to butler county and it sounds like we're not going to be getting our property tax data until the 15th. We were planning on doing some general fund stuff and normally we don't present anything general fund until we have tax data, but there are some other things we could potentially discuss, rates and otherwise. So if you're open to that of just leaving it on the schedule for now, but letting us make a call towards the end of the week and if it's not looking like we're going to be ready to move forward on that, then we can cancel on the 8th and then we will plan on targeting the latter Mondays in June to actually do our sessions once we get the property tax data from the county.

we did not receive any i do have that um i do have their submittal okay so i haven't been able to turn it in anything for you guys to review but it was the only submittal that we received craig hit me up the other day so thank you bob after this mayor

My understanding, we have a new inspector, code enforcement. Recently started. Recently started. We might want to take a move into silence for him and his new career. He's got a backlog of stuff, especially in Ward 2 to look at.

Can you ease him in?

Especially on High Street. I got a lot of issues over there. So I'll be glad to meet him and introduce myself. And secondly, any Any progress on the pot?

Yeah, we're going to be I get I get that all the time. That's why we're going to the easiest thing to do. We talked to Frank about it today. So all of the departments, we asked if anyone wanted to make claims on any of them. So we are going to use some of them in the cemetery as well, because we do have that that decorative area over there and the the columbariums. And so we're using some of that. So I asked them for the final inventory that we have available. We're going to set up essentially office hours where this is going to be the window where people can coordinate their pickup and then they can come and get that. I didn't know if you guys wanted to establish pricing on it um if our guys are there to help load then i mean there is maybe some element of risk and all that they've unloaded them several times without risk but you drop one of those on someone's car like maybe you cause some damage and stuff like that so maybe you'd want some sort of cost just for that that process um but i i don't have that inventory yet they're going to send it to me shortly but we'll be able to start advertising soon so people can can start making claims on them

There is a utility pole on David, like on the southeast side of David, and it is leaning a precarious amount. So maybe have that looked at. I don't know. Maybe it's okay. They lean a lot. I really don't know. But it's leaning enough that is remarkable and people are remarking.

Jake? Couple of things. I've had multiple residents reach out about the donation boxes on 7th Street. Is there any action or any enforcement happening related to those donation boxes? that are overflowing with trash bags, plastic bags sitting just out in the parking lot.

I noticed that today. I will say when they were dropped off, one of them was dropped off to an incorrect area and our office got a call about it. We were able to call the number on the side and tell them it is an out of state company i believe it's not anything local um so i we can reach out to the number on the site again and let them know what's happening there are those there with permission of the property owners i'm assuming they have permission of the property owner from the strip that strip mall area right the interesting thing about that again they are on private property so i think

our available actions would fall into the nuisance realm but those would come back on the property owner i believe that's why i mean that's the solution that's probably how that would pan out that's the solution yeah but it's it's it's reached multiple input levels with people commenting on it and i think it looks bad for the city driving by um it's also my understanding that we've had those previously and that we had the same problem previously. So when these reappeared, this was almost anticipated. But I was also asked to remind the general public that the Caring Center would love to receive these donations as well. So if those are full, or if you're so inclined, the Caring Center would welcome those donations as well.

I was contacted by a couple of people from the Caring Center and they don't have anything for their volunteers to sort through because there's nothing coming into them.

Yep. So second thing, and this is, this is simply a question that we don't necessarily have to chase tonight. But also multiple people beginning to ask with all of the conversation in El Dorado, regarding the proposed data center, uh, has Eldorado engaged any of the surrounding communities about what that conversation looks like, social, environmental impact, all the locations, all the things, as far as that goes. I know there's a big meeting over there tonight for their citizens and their council.

Yeah. I'm not involved directly in any, I don't know if the county has been trying to put anything together. It hasn't really been on, on my radar. Um, So short answer is I'm not aware of it. That doesn't mean that they haven't done some sort of, like, broader discussion. Sure. And I just didn't attend, but I don't know that I missed anything on it. Okay. Because I thought that they had specific projects that were under consideration that were impacting their – their zoning and all of those sort of things that they were discussing. I think they were project-driven discussions, but now I think there's broader conversations in the county that have started up. I don't know how far that's branched out to the other cities yet.

As consumers or customers of El Dorado's water, that was an element of concern that was brought to me from a citizen asking if El Dorado was proactively engaging customers of their water to help make sure that that awareness was happening based on any potential environmental impact from proposed projects. So again, we don't have to hash this out, but I think it's a conversation point that if you could look into just from a, is there something forecasted if this project is voted? Yes. Will that be part of a dialogue from downstream customers?

mike did you have another question yes when shane said something about the pots i wanted to make a mention um i think it's the parks are taking care of the pots downtown now the new ones with the flowers there's a problem with the water when it uh there's a stick shoots the water out on the flowers and it's not even getting on the flowers it's just spraying out all over I don't know if it needs to be regulated on the water side pressure or if the sticks need to be lowered so it gets into the pots.

If they've been dug out, because they just stick in the dirt, and if they've been dug out or moved around, they can slide out.
