okay it's 502 order this meeting regular meeting ofing and Zoning um let go ahead and have the um member Pat Rollins here member Karen Duncan member Carolyn nit um co-chair Carson blo here and chair James here great any public [Music] comments no okay uh we'll move on to the consent agenda um approval of regular finding meeting from November 6 2024 I think we can just have a gr vote on that all in favor of accepting okay we move on to regular agenda U you know I was going to ask you changed it around you're now the LI I serve as to all the commit right are you going to should we insert a regular report on the agendas from you or yeah anything that anything that you want to report out to council I Council anything that that counil wants you to take up I'll bring okay all right so you'll just notify me when you want to be inserted on okay okay so move on item number two Workshop to discuss issues involving wood Comm service okay it's 504 Workshop the reason this was put on here just

so we were asked last November which was our last meeting by the council a and Chris to have on the agenda um where we discussed the survey the community survey up and coming survey um but we were told that it was going to be a professional firm that was going to actually put together the survey based on that we agreed that it would be best if we looked at the first draft of what they came up with that would be better to to critique it um and so that was what we agreed and that was advised to council but I attended last month the uh presentation and it's it's it's arguably not a professional organization that is doing the surve who's doing it's a professor uh from Texas State and her graduate class now it is their area of study about survey but um again they are an academic organization doing it based on that and I don't criticize the choice at all but what what really stood out to me is perhaps we should give some kind of input based on the fact that it's a AC MC organization of people who aren't used to actually going in real studies with a municipality and it's doubtful that any of them really know Wood Creek that was my question and as this is a workshop we can just casually talk about this

there's no taking turns or any of that no yeah because that you know when you said that I thought okay what are these graduate students I don't see a lot of them going around door too or calling up and pulling people to see you know what sort of things they are concerned about I mean you could just pick some random issues what they have right now is this the prior survey um and so we've done two the original comprehensive plan survey that that went out the big one um so they've got that and the results theyve also got the secondary survey that we sent out what a year later this is that was sort of some of the questions that did make that one we wanted to get some some input on so they got those and so they're sort of what they what they've been doing in and in draft stage is to take all those where see what needs to be updated or or throwing out what might what might be new so that's what that's we are now if we take that as the B we want to know what has changed since then so it's important to have some of the same same question areas and see what so that's that's what they're working on right now so we have the compreh and this Committee just before I joined did a complete review of the comprehensive plan to say where the city is with those particular items that have action and which ones were completed and which on had been started and blah blah blah I'm not clear on what the actual and I may have forgotten since November what the purpose of this particular survey is

and how it fits into the planning of the state okay so So the plan is to um it's a requirement every four years it is so so it's it's one thing to one thing to look at at the progress on the on the bullet points but a lot of that stuff has been knocked out we cheed those things so so so this is sort of like okay so what next so is it going to be an update to the complete updated comprehend okay so behind done L pretty much drove This is Gonna Roll back into updating the comprehensive plan and collecting demographics as well as concerns okay L Lydia's report and bless her heart she basically worked on it by herself but um her report was not in effect a revision of the of it was the status of each of those and in some cases the response was we're working you know and that so that's not a well no it's a you know Green green is at a good place in time yellow we're working on it or red we haven't even thought about but that's kind of what she needs right and and again in my opinion what should have been done in that case was it shouldn't have just been planning and zoning although Planning and Zoning I agree is is given the task tree pars each committee should have prepared their portion a little bit more extensively resp and also talking about what future is is going to be worked on and

then planning and zon could have created perhaps a more comprehensive now what I've done here what I've just given so these are the issues to be covered no the these These are the last um I took this from the community um report of the Comm and I basically these are issues that were in line first there was roads roads was everything okay but I'm considering roads as having been done okay so now there may be some small issues on roads and and I'm sure that will be in the survey but these are the main issues that were listed in priority behind roads and so I brought these up one will would assume that for example walkway okay walkways were the number two issue at on the on the survey um so I'm assuming they will also be on this one but I brought up questions asked like if you if you were to ask someone from San Marcus or Houston or whatever about walkway they would think sidewalk they would think concrete sidewalk and I think if you put in a survey for wood creep do you want sidewalk probably get 100% no yeah and I remember on the previous survey the questions on a number of things were General enough to cause a number of Mis interpretations I remember specifically with parks there were a lot of issues and things because I was on the Parks

Board and uh the other thing I'm looking at here I see this chickens issue does bird flu have any influence on chickens I mean this this is not this list here yeah just a suggestion by me yeah I would say that question should be tabled until they get bir under well yeah I mean nothing's going to happen on any of this stuff bir we could have the next round of you know comes back around yeah and wasn't that PR decisively eliminated wasn't what very was it see and what what I would suggest is that we uh as the commission consider these issues and maybe try to Define them a little better or like you said um bring in periperal issues that might make it a difference for example on the chickens I mean are we how many chickens are we talking about uh what kind of uh coups yeah are they wandering around the yard so they can interact with wild birds I've got a Merlin app on my phone and I was sitting there and I had seven different birds all making sounds in my backyard at once and we're on a migratory pathway where every bird in North America tends to go back and forth so if indeed you know the city ever decides to do something in the ordinances about chickens um all of that would be I mean that would be address I mean they would have to be in I my my my thing was like I've always said even when it was first

coming up what four or five years ago that if you come to the city with ordinance that completely protects the chickens completely protects the neighbors you know then bring it to the C but you know that I haven't seen but I'm talking about on the survey for example um should everybody be allowed to have chickens in Wood Creek or should you have at least a half acre lot so one of the things that we're we're watching closely on on all of this is the legisl because there is at least one bill right now that would allow I think up to six chickens and then and then municip or maybe even anyway it's like by area like you can have six Chicken in 40 square feet well if you had a two layer coup you could have chicken right so so that's that's what legislator saying um and rabbits you know rabbits are in the mix to so you have chickens and rabbits but understand we're not writing the ordinance here right that's what I'm saying if the legisl we're asking people and if you if my fear is that if you don't ask a homeowner and an issue he doesn't feel like he's contributed he may if you if you say well we don't want chickens on less than a half acre well maybe the state will come in and and you know make it so that can happen but ask the homeowner because the homeowner say well I don't I don't mind chickens if it's a big enough lot but that's my point the legislature says you have chickens it's not it's not matter it's not going to matter how big a lot you they're going to say you own your property and if you want ticket you

have ticket that's what we're worried about but don't you want to be asked well that's what that's what we're getting at is that if the legislature comes down and says you can't tell people they can't have chicken but you can ordain no roosters or you know this or that or the other or you can ordain distance from the neighboring residents or you can ordain some of that stuff but but to have this you know chicken run and on your survey at some point you should all looped birwood on it to make people look at it through that lens well or just say we realized that FL is an issue however the state is also looking like to begin a conversation I want to chickens is not I'm like what I'm doing is I'm making not like these are big things that some people like food trucks so the first question I would ask yes no and woodrey what is your opinion if your opinion is no you're done if your opinion is yes then we ask conditional questions should they be allowed in Parks only on Des on certain days like when the when you guys did the tree day and the food truck was there that was so much fun and you know should they be limited in number and then we start we but if the answer is no that's okay that's their but then like you said if it's yes maybe then we need to dig in and get some and then also let people we don't cover what their thoughts are give them a place to respond I don't know if that's the methodology they're looking at I would add Tree Management and I don't know how to do those questions for the city but well let's let's not knock around say for example on the food

truck what if they want to park a a food truck by that cigar line in the doing that I think the cigar outside one day they did for a party oh that may be for opening yeah I think this is a survey it is an inin so we're just asking trying to help drill into if they say maybe under certain conditions because they can also say no which doesn't mean there won't be then we're kind of drilling into conditions but then we can leave a blank area and I mean that would go under retail I you could say food TR retail properties yeah it's just the that we want to make sure that when they in their survey when when they ask a question it's a good one it's a good one and it can be expanded into different areas well but every one of these they can have no opinion although we are C and and what about like ice cream Tru going through it's a food truck and I would personally say Yes um you can't I mean like the old fashioned ice cream truck I love them yeah at first I was thinking about well well like in the summertime at at the park would someone want to if someone wanted to could they Park their food uh ice cream up there for a couple of hours or something and you know have the Bing yeah you'd have to have a little background check on whoever's driving it but the question is when you ask someone do you want food truck maybe they're not thinking about an ice cream

truck if they if you give them options like I don't know what the W is but they do need to drill it absolutely yeah I mean so again I'm not for food truck or ice cream truck but I think the the the question of when you bring up food Dr I think it should be expanded a little bit in their question there so that's that's where you know the academics are their focus is on designing good questions that aren't leading I mean you do if you do a chicken thing and throw bird F in there that's that's leading that that's starting off with a negative I mean basically you say would you consider you know would you consider H at all yes no if you say yes then what are the condition you say no like you said answer you but if you if you say food trucks yes well you know you don't want ice cream Mexican you know but you know it's like like if it's a food truck it's a food truck now there would be some question about you know ring trucks such as ice cream or stationary trucks you know stationary trucks at the park stationary trucks on retail you know we have a food truck at Dev personal you on private property there's really nothing you can do except they still the best Hur in town I haven't been there forever so you said on private I could have a food truck the drive one days but it wouldn't be a trailer it would be self [Music] power

can is an RV basically we tried to bring up RV didn't we but anyway anyway right now it stands right now what they're what they've got in front of them is our old survey um and there's looking at that and saying okay well this question is good but it could be worded better because the former survey was not academic nor profession I mean it started professional and then they fired the the company they was doing it and then it sort of got messed up so it ended up being as much or more L person question so they're just we approve the question you know what questions need to be I like like the roads thing we don't have to ask about New Roads so we might want to know about you know maintenance so it's still still so that's what they have in front of them and and all we're doing right now the council is is right now just voting on budget for the actual distribution of information and we just just now you know got a draft of survey questions they first start it because they're contracted to do this they have the right to for example should we decide to write a report a list of these type question they have the option of just toting trash I'm not suggesting they have to do this but I think we would be uh not doing our duty if we didn't at least give some input because they are an outside person and they're not yeah do this as a livit yeah right right now all they're getting is is

Council input and we want to expand that um and then even the council input is limited because you know um I don't think I talk school but um but Dr Edwards sent out something like I think like late last week said here's here's a a very first draft I mean we've gotten the questions from before we've done a little bit of work on them here's the first gra where sent out BCC to all council members well can't really do that because then she is the repository of I she's basically creating a quum by by asking people to respond to her and then she's going to take all that information to do something with it so it's It's Tricky you know you sort of have to Workshop it you know basically have to do this you say okay let's all break it out let's go through the questions and then and then tell Michelle what it is you know what what we think it's going to be what we think that question should be or what changes on that so so it's it's going to be a process that that shouldn't you have like a town hall or something to get input from people and say we would like to see this on the survey rather than just having the Council a survey on the survey remember well no just have an open discussion about well remember some years ago when they had that deal at the and they had that those are great I don't know how you can do those but let's no I'm not talking about spending a lot of money or let's take walkway he said well if you ask about bird food that is is negative cure but you shouldn't ignore it either right like oh no we can't talk about people let's say let's say walkway

okay now you have a display board now I have as a question should the project be limited to connection with wiberly Trails um I I don't know if you've seen the map Wily Trail but um they're show they're showing U walkways right from wiberly down down wiberly wood um but we also have the uh the loop walkway I mean if when you discuss walkways it shouldn't be like I said everybody has a sidewalk in front of their house and it goes house to house I think a lot of perhaps the the gulf course lot the houses there maybe they don't want a sidewalk I don't know but if you also ask them and show them look this is the trail I mean going up to Jacob's well all the way around or you could go into town I mean people might think well I'd like to connect with that and if the connection went up Wood Creek Drive um and I guess it would go like B Meadow it it originally that that trail plan that was that was thrown out as a proposal um Ed golf courts eement to to go parallel to W drive on the golf property and then cut across and go througha I think yeah then they hooked up with Jacob's Well yeah um but the point is someone who might be against sidewalks yes that would be a leading question in effect lead them toward a

positive but it also gives them a lot of information about about a different kind of wet the quality so if they're not drilling into those kinds of things they're GNA Miss what people really think because they don't know what's going on and I I think you know I hope that they're really into the issues I think walkways is a lot more neutral to talk about than Birds chickens but um food trucks is pretty Neal to talk about but say I want food truck is different than saying I want food trucks everywhere I mean what does that mean so are they doing how the methodology they drilling again with the questions that they sent or what was odd was if you look at the the community plan it it it has food trucks but it doesn't clearly discuss them or Define them or anything um and I'm not but same with well with retail shops it did go into it there were types OFA I think it well they talking about etj another thing with the legisl there may not be an etj yeah I well it's not they want to take away etj Al together it's not necessarily etj these slots here border 12 anybody could apply for change of Z no no no no I just mean I just mean you know to put a to put you know food trucks outside the perimeter of oh and

the ET because that was one of the you know question like well if you could if you could have something in the city limits or in the etj would you want these things right so so that may not even be well I I you know Concur and I don't know where to go because I don't know what they're what kind of questions they're framing are they allowing drill in those subjects or they I mean if you think about if you think about what the original what the the comprehensive plan survey was I a few years ago I remember the survey yeah there were there were some there were some questions that didn't I drilled in um this is also going to be online um unless specifically request I mean somebody said no I'm not going to do it online I'm only going to do it on paper then you can come get a piece of paper and fill and fill it out but it's it's going to be mostly online which does allow you know a lot of if then so if you enter this then you and hopefully that's a very mobile friendly interface get a lot more respons it'ss I think it's Ian it's a it's a very highend very well re so it's not just a website that you view by turning your phone so you can somehow read it no it is and they are they are so they are giving us access to their things but we will have full access to the university S one hous one one for household that now that you can get out of the um city council meeting minute so so we we got into the weave on that but it's but you had to spend and see this

is one of the things that concerns me is you as a council had to spend at least 30 minutes explained to them they wanted to do a sampl and they were talking about a s that reflects the adversity of the city and Etc and you you quite rightly got him back on no no we want you to S query all them but still it's a it's a one survey for a household and and then whoever had the last birthday answer the question but the last birthday the last birthday in that house so if you've got you know with you and Linda and you you get one survey for the house okay well who's going to the oldest whoever had the last birthday the most recent birthday that's just a way to quite frankly that is issue it's a standard if you and your wife get a survey it's not going to be oh your wife's younger it's not it's not based on it's based the last birthday most recent the most recent birthday I yeah it's it's just a selective process if there's more than one adult in the house but kind of arbitrary so you something right it's just a selected but but again again you know y all get the survey and it's his birthday was the most recent but he doesn't want to do it so he's gonna do it you're do it nobody cares in our household I will

off and my wife will tell me what yes exactly but then but then there's also a a secondary survey that you weren't part of the survey but you still want to provide answers there will be a chance for you to do that as well I mean they'll be kept separate but they'll be you'll be able to do that as well going be Cod or because the swimming pool I would love for a genuine survey with genuine statistically valid respons for well we can't even do that anymore because we um we have adopted the international building code International building which we did several years ago the international building code you know doesn't differentiate between above ground and below ground it's just swimming is that good or bad it's well depend whether you above ground swimming pool you know they don't differentiate so if you say you can have swimming pools it doesn't matter whether again you can your your ordinances can designate but like for instance you know we've been told now a few times that above ground s has nothing to do with your zoning it should not be in your Z you know if you want to do that knock yourself out get they call cowo I remember on that issue though the city was divided by age the older people do not want to loveer people of course with family they're [Music] like yeah and and above ground pools um are considered temporary I mean they're movable you know so so it's it's there

there's a lot of questions but again to the drill down question you know so so the question is if we were not in drought right and you could you know fill a pool would you want yeah if you're not in drop never going to be well and that's okay but you still get a sense of what the general population rather than people that have time to show up at counil right I feel like the survey is a chance for homeowners to have their say to give their opinion that's that's exactly even if even if at the end of the day they can't have it we can explain why they can't have there's there's another driver in all this in that we um we have we just received rfps from Grant administrators to help us apply for and get a general land office resilience Grant um which can be up to $300,000 um for um professional work on you know looking at code and plan wimberly's in the process of doing that now they got a $300,000 Grant to completely redo their comprehensive plan um you know and as it relates to Cod and CH codes to so what we had budgeted for to get legal help for um out of our out of our tax money um would all be PID by and so and we have been told by a couple of gring that they have won every Grant they' gone for at the

ma the community pool was on the last survey and that was an issue that people want it but the question is location cost engineering study as the cost yeah and it's very expensive yeah and what I mean our little I think they're open and our years because what the regulations are around what kind of qualified person you have to have and you have to have a LIF and the hot tub is even more Mak sense than the pool there the r Clos we not consider not isif so um because municipal pool was high on the list we've been we've been talking um we've been talking with school district the county wiberly about not a municipal pool but a public pool that we'd all have access to and talk to the school district about you know you got all that land right on Blue Hole but again it's like how we going to maintain it it's millions of dollars to build millions of dollars to maintain and the income on it is nothing you know so so how even if you get all these people because I I even went and spoke to Unity Church yeah theyed because they closed their pool and I said well I know it's close but it's still there what if you know what if that were a public cool and

they went well you know we quit doing it because um it was it was gred our well we just the evaporation with us we couldn't we couldn't keep it full and keep water coming to the church and we couldn't afford to truck it in it just got to be too expensive to do plus now we're looking at the ethical issues of having a pool in Brown you know so our our congregation but not everybody agreed a lot of people were very unhappy yeah not everybody agreed to to close the pool in the people that go to the clet private anyway something about rainwater collection on yeah um but but anyway I I contacted them they said well we'll take it to our board and see if there's any don't don't hold um the folks up the hill at the L used to be able to buy a monthly P because we did that one yeah we did yeah I mean they wanted to say just thur I've mentioned it gamb the and there's one in Dripping Springs there the why the found Park is really but they're very expensive I think it was like $5 a person there's a pool at the golf course golf new golf whatever happened to that hotel for [Music] the on what's what are they Bing that's

draft of the service do more than just no [Music] just what we're looking at is to next week we could next month rather we could then have a copy of that survey and um prepare it what I'd like us to do eventually hopefully by next month is to take action and that we create a report or critique or suggestion for the survey and again they may just ignore it or whatever but give do a suggestion for the the surveyor they the surveyors you know Dr Edwards and her her class routine they're not going to ignore anything if we ask them to do it they're going to do it well we're not we don't have the authority we're not asking making a suggestion and I guess since we go to the council with our report it's your decision as to how you present it so I wrote down we we've got the tree C WR which people did a lot of work [Music] on well and then there's also and it's I think it's more difficult but um I don't know do people like know or like that we've done the tree my God they should know we've had big advance and giv away trees and but are there things about how the city is presenting itself that that folks would like to see

like like with the with with the new trees and Park Board um which combines their activities I mean it makes perfect sense to say Okay so we've been we've been pushing native plant um Master Gardeners Master naturalists native plants Native Plant Society we've been put that hard through the tree board in armor day but you know this new group they throw throws in there 2019 when we first talked [Music] the anyway yeah you're right whatever they will do well let's get back to things like this community pool we all know realistically we're not going to have a community pool because of the cost Etc but people asked for it on the last survey they they put that they would like a community pool the question is should the survey say do you want a community pool then say are do you understand or the cost of it are you willing to pay for it yeah because Insurance alone is going to be extremely expensive yeah and know so I think and and there's right that the survey question is leading you to a negative okay but they have to understand what it entails they can't just say I a community pool well you could do that question that said you know in the last survey you know a large number of people that they would like to have a municipal pool um you know

knowing that you know we were under draft condition maybe however long maybe forever um you know you are you still well if you're still interested you know it's like okay so so there different funding mechanisms for that including increasing your property tax would you be will to pay you know $300 of year you know towards your property or would you be would you consider you know going out for a bond pay or conru you know those kind of things when people say oh because they just sort of assume maybe the city play money just you know buy whatever they want you know and it that but you know if you put the fact in front of them well maybe and on the survey should you have just other things have other items that you'd like to see and see kind of a right Ino there are lot of yeah lots of open but I mean not underneath any one of these are no it's built in it's funny I posted on next door where was trying to get more people who sign up for Mid and did and I and I listed these items or some of these items and I said these are issues that are going to be coming out and the first person who who responded said I thought we'd already resolved these issues like chickens and and Sh the point is is that these were questions these were respons that list were respons for the old survey I don't know what's going to be on the next
