requests an area variance for Lot# 161.00-1-39.1, located on Liberty Dr, to construct a Battery Energy Storage system (BESS). The applicant is seeking relief for two reasons: the size of the system and the setback requirements. The Town Zoning code limits the size of the system to one (1) megawatt. The applicant is requesting to build a five (5) megawatt system. The Town Zoning code also outlines the setback of a BESS is five hundred (500) feet from any property line. The applicant is requesting a side yard setback of four hundred fifty-four (454) feet on the East side of the property. This proposal was heard on March 9, 2026, and June 8, 2026. It was tabled both times, so that more information could be submitted to the Board. The variance request has been moved to a new location.
