Yes. The annual Easter egg hunt sponsored by the West eight Town Criers is scheduled for Saturday, March 28 at 1PM. Due to the ongoing construction, it will not be at the rec center it will be at Clegg Park in Ward 1. And then I'd ask counsel to consider making a motion to allow the the administration to notify counsel when we have a project or a bid that exceeds the state limit which is being raised and it was raised January 1 to $79,000. We used to have a policy here way back when the bid requirement was 25,000 that we could that the municipality could expend for a project or purchase of items And we kept that policy here in the city at 25 despite the fact it went from 25 to 50 to 75 and now it's at 79.

Now the Westlake City Charter says that we really have to follow the state's limit. But counsel had originally asked that we have a policy even though the charter of Westlake says that we follow the state's expected limit for the purchases. So I'm asking for someone to make a motion to consider that the administration needs to notify counsel anytime we exceed the state requirement for the purchase of items or the construction of a project.

So I know that the these in my world, when you have to when you 75 or 79 and less, then you don't have to do a public bid. You can receive quotes and that type of thing. So is that what we're saying is that if it was a $50,000 project, you would just solicit some quotes. If they came in below that $79 then you pick one or pick the low bidder, I would assume, the lowest and best bid. Is that how is that what the

Nothing's really changing with regard to how the bidding is done in any way. Jim and Larry would, for example, would would continue to do all that the same way they currently do it. They follow the state law. But when it went from twenty five to fifty years ago, counsel said, well, if it's capital improvements over 25,000, we wanna know about it. We want notice.

Obviously, you're gonna get notice if it's over the statutory limit. That's you're for sure gonna get notice and we'll be bidding. But it doesn't change how they do their job with regard to bidding and requesting proposals. It's it's just about what you get notified of. So but and and I guess let's go back to when we do our budget every year, we have all these line items with allocations for different things. And I'm assuming that something like this, if you were bidding for a $50,000 item, you would have still already had it in the capital or in the it would still occur in the budget that we had approved at the beginning of the year. Yes. The dollar amounts have to already have been appropriated and if it was a capital item it would be in the capital sections. If it was normal expenditures and it would be in those particular line items. But sometimes a project has three or diff three or four different contractors and you have to buy you know the one product from one another product from another, but the total is in the budget. But if if one of them and it's not considered you're bidding it out at at one project, you may be buying a material and you're buying that for under 70,000 for that particular purchase and some of it's on state contract.

Thank you. Mister president, the planning, zoning, legislative committee met on twenty five, twenty twenty six. And present were committee members myself, Dwayne Van Dyke, Chair, Dave Del Regno, and Mark Getzay, also present were Council President Dave Greenspan, Council Members Amy Avalka, and assistant law director Robin Leisure, and planning director Jim Bedell. The meeting convened at 06:04PM. Item one, discuss conditional use permit application from Lifebridge Care LLC for a training school for adults with developmental disabilities at 26945 Westwood Road, Parcel 2 Fifteen-ten-twenty 2.

11:48 – 12:31Speaker 7

Planning director Bedell explained that the applicant is currently located at 159 Crocker Park Boulevard, Suite 436, and is relocating to lease an 1,800 square foot office space at 26945 Westwood Road. The business is a training school offering structured day programming and skill building services, will all take place inside with no outdoor activities. There will be four to six staff on-site in compliance with state requirements with 15 to 20 maximum participants. Hours are seven a. To five p. M. Monday through Sunday. He reviewed pickup and drop off arrangements, parking, and the floor plan. Councilmember's question why the building is on two parcels. Councilmember Getsay moved seconded by Councilmember Del Reigno that legislation be drafted relative to this request.

The next item was to discuss conditional use permit applicant application from Kevin Johnson, Forward Fitness for a fitness center providing one on one training and a small group training at 27100 Detroit Road, Parcel 2 Thirteen-three-thirty 2. Planning Director Bedella reviewed this request to lease a 1,600 square foot vacant storefront for this fitness center. All activities will be within the building, and there is ample parking. The hours of operation are within the code requirement time frames and shouldn't interfere with other tenants.

Councilmember is asked about entry to the building from the rear and structural issues involving weights. Councilmember Getsay moved, seconded by Councilmember Del Reigno, that legislation be drafted relative to this request. Motion carried three to nothing. Next item is was to discuss the zoning map amendment application from Greg Davis, g d three Ventures to change the zoning of 29707 Center Ridge Road, Parcel 2 Seventeen-twenty Six-three from office building to R1F80 single family zoning to construct an 11 lot single family subdivision. Planning Director Bedell explained that the parcel is currently split zoned.

The front 3.02 acres are office building and the rear 4.61 acres are R1F80. Rezoning the front portion to R1F80 would not provide would not require it to be to go on the ballot. Proposed lots would be 2,000 I'm sorry. Excuse me. The proposed lots would be 20,135 square feet to 39,438 square feet with high end homes, examples of which were shown.

Discussion regarding the proposed subdivision include tree preservation requirements, landscaping and buffering the detention basin location, and possible easements in donation to city of a triangle piece of the parcel on the east side of Crocker Road. Council member gets a move seconded by council members Del Rego that legislation be drafted relative to this request. Motion carried three nothing. Fourth item was to discuss zoning map amendment applicant application from Edward Pavusic, Hope Point Place Limited to change the zoning of 26814 Center Ridge Road, parcels 213 Dash 16 Dash 034035036037 from general business and office buildings to R1F80 to construct a 19 lot single family subdivision. Planning Director explained that this parcel is currently split zoned, 0.79 acres in general business, 0.25 acres in office building, and the remaining 11.57 acres is already R1F80.

He reviewed the conceptual plan showing 19 lots ranging from 18,010 square feet to 39,939 square feet. The applicant and his engineer answered questions about slope issues, sanitary sewer lines, buffering retention, the angle of the proposed subdivision entrance, and the length of the street. Councilmembers had concerns about the proximity of a couple of the lots to restaurants in the abutting plaza. Councilmember Getsay moved, seconded by Councilmember Dalla Regno, that legislation be drafted relative to this request. Motion carried, three-zero.

General discussion followed procedures when legislation is requested to be drafted. In recent years since 2022, the committee would make such a recommendation of counsel and then counsel would make formal motion at the following council meeting after the committee meeting was reported on to request the legislation be drafted. Assistant law director Leisure explained that per the code, the formal motion is only necessary for text amendment requests, but had been applied to all requests and including legislation coming out of the planning commission in recent years. It was agreed to eliminate this step except for text amendment requests and revert to how it was done prior to 2022 so that legislation would appear on the council agenda immediately after the committee or planning commission meeting. Council member Van Dyke stated that he, along with planning director Bedell and the subcommittee, are working on multiple code changes to fine tune processes, will be forthcoming throughout the year.
