We thank you for this opportunity to represent our village and and may you guide and direct the the hands and the decisions as they move forward with Council business tonight and keep the village and really the entire country and the world under your hand and guide and direct us with everything we do. It's a resolution authorizing the municipal manager to renew insurance with the Public Entities Pool of Ohio. Whereas the Municipality of West Milton, Ohio has been a member of the Public Entities Pool of Ohio since 2022, and whereas the insurance is due for renewal effective April 1st, 2026. Now, therefore, be it resolved by the Council of the Municipality of West Milton, Ohio that Section 1, the Council hereby authorizes the municipal manager to execute the proper contractual documents to renew said insurance with the Public Entities Pool of Ohio for a policy term of 1 year from April 1st, 2026 through March 31st, 2027 for all coverages at a rate of $75,712 in accordance with the invoice attached hereto and incorporated herein as fully rewritten. Section 2, this resolution shall take effect and be in full [clears throat] force upon its passage. Any discussion? All right. Any motions? I motion we accept CM-26-24. Second. Roll call. A resolution to award a consultant for the design and engineering regarding the wastewater treatment plant. Whereas Council believes that replacement of our aging wastewater treatment plant is of the utmost priority, and whereas the interim manager has secured three responses to requests for qualifications regarding this project. And whereas after the consultant selection process was completed, staff have chosen the
consultant that will perform design, engineering, and estimates for the wastewater replacement project. Now, therefore, be it resolved by the Council of the Municipality of West Milton, Ohio that section one, the Council hereby awards a contract to Woolpert Engineering of Indianapolis, Indiana to perform the service. Section two, the interim manager is hereby directed to execute all the proper documents relating to said project. And this should be section three. Yes. Um Mayor, just so I can make sure that you guys are fully aware. So, after the RFQs, Woolpert would now be in the consultant. So, this is a part part one of three parts. So, the second part will be we will have a it's mainly a kickoff meeting where we will discuss the scheduling, um the design, uh estimates for the project, and all of that. Uh once that is secured, then we'll come back to Council with actual dollar amounts. Um and the third one would be the uh permission to do the um grant or loan for the design. Um and then hopefully that will be able to be rolled into um a low interest loan um with the project. Uh so, that would be part three. All right. [clears throat] Next is CM-26-26. It's an ordinance amending section 53.03C and D, storage of garbage, refuse, and recyclables of the code of ordinances for the Municipality of West Milton, Ohio. Whereas the Municipality of West Milton, Ohio has established its own refuse collection program within the Village of West Milton. And whereas changes are necessary to provide the safest, best, and most cost-effective bulk refuse waste collection service to West Milton residents. And whereas the Municipality of West Milton, Ohio needs to make changes by adding language to section 53.03C and D of the West Milton code of ordinances. Now therefore be it ordained by the Council for the Village of West Milton, Ohio as follows. Section one, section 53.03C and D of the West Milton code of ordinances is hereby amended to read as follows. Section 53.03, storage of garbage ref- That should be refuse and recyclables. C, all other refuse for collection shall
be stored in Municipality of West Milton toters. The containers shall be of adequate capacity and provided in sufficient number to contain all refuse accumulating between collections. All refuse set out for collection must be completely inside the container. Refuse set outside out beside the container will not be collected. Toters will not be emptied if they are not accessible. Toters must be placed in a location that is not by vehicles, trees, signs, mailboxes, wires, etc. The refuse driver will not empty any will not empty any can unless it is the toter provided by the Municipality of West Milton. No private containers will be emptied by municipal equipment. Toters should be placed for collection the evening before your scheduled collection day to avoid missed or returned pickups. The toter shall be placed with the opening toward the street side. See directional arrow printed on the toter. Toter shall be kept free of combustible materials. If the resident's toter is habitually overflowing on the refuse collection day, the director of service shall determine if a low volume toter must be replaced with a standard volume toter or an additional toter or an additional standard volume toter is needed at said residence. Toters shall be removed from the right-of-way within 48 hours of the day the refuse was collected. Containers shall not be stored anywhere in the area considered as frontage, front yard of business or residences. Exemptions can be made to this rule by the director of service. Reasons for exemptions include, but not limited to, frontage areas with specifically built container storage areas that hide the container from being seen from the street. Another example of exception could include frontage where side or rear container storage is not safe or possible. Section D, any large refuse items that will not fit into the residential standard volume or low volume toters shall be considered bulk refuse. Normal bulk refuse will be collected
once per week on the date chosen by the director of service. Until curbside recycling is available, municipal staff shall ensure residents to self-deliver all cardboard to the recycling area for free disposal rather than set it out for bulk collection. During high bulk refuse periods, additional days of collection could be added. Bulk refuse can consist of the following, but not limited to, furniture, appliances, mattresses, box springs, televisions, etc. Specific items that cannot be collected during bulk collection include full-size pianos and full-size spas. All smaller bulk items set out for collection should not be loose. These items should be boxed, bagged, or bundled. Loose metal or wood planks shall be bundled into in 3 to 5-ft lengths. Hazardous items will not be collected, such as liquid paint, chemicals, and auto batteries, etc. Large rocks and concrete will not be collected. Bulk refuse will not be collected in alleyways. Bulk collection is not intended for entire residential cleanouts. The director of service has author- has the authority to deny bulk collection if it is deemed that the bulk quantity is too large. Each household will be limited to a certain number of bulk collections annually. This number will be set by the director of service with advice from the mayor, [clears throat] Council, and the municipal manager, and be monitored and adjusted if needed. After the set number is reached, the Municipality reserves the right to refuse collection or charge the householder a fee decided upon by the director of service and the municipal manager. Section two, this ordinance shall become effective from and after the earliest date permitted by law. All right. Any discussion? Um I'll basically just say that the majority of what was read was actually already um in the ordinance. The highlighted sections were um refuse set outside the container, um which has been a problem. Um containers being stored like in the
front yard, like right out in the right-of-way but next to the street, has been an issue. And then um it's full-size pianos [cough] and the full-size spas are kind of a strain on this the equipment and the system of trying to get everybody's bulk in a timely manner. Um that would be the three major changes. All right. [clears throat] Moving on to CM-26-27. An ordinance amending section 53.06, [clears throat] joint use of containers prohibited, of the code of ordinances for the Municipality of West Milton, Ohio. Whereas the Municipality of West Milton, Ohio has established its own refuse collection program within the Village of West Milton. And whereas changes are necessary to provide the safest, best, and most cost-effective bulk refuse waste collection services to West Milton residents. And whereas the Municipality of West Milton, Ohio needs to make changes by adding language to section 53.06 of the West Milton code of ordinances. Now therefore be it ordained by the Council for the Village of West Milton, Ohio as follows. Section one, section 53.06 of the West Milton code of ordinances is hereby amended to read as follows. Section 53.06, joint use of containers prohibited. The joint use of any garbage or refuse containers by any plural combination of householders or commercial operators is prohibited. The use of a refuse container not belonging to said resident or commercial operator is also prohibited. Section two, this ordinance shall become effective from and after the earliest date permitted by law.

Next we have CM-26-28. A resolution to award a contract for the 2026 Municipality of West Milton annual paving program. Whereas it is necessary to maintain our streets and service areas within the Municipality. And whereas this project has been properly bid according to chapter 33 of the code of ordinances. And whereas the project [clears throat] will be funded out of the 2026 operating budget, street levy, and street construction and maintenance funds. Now therefore be it resolved by the Council of the Municipality of West Milton, Ohio that section one, the Council awards a contract to Fillmore Construction LLC of Leesburg, Ohio in the amount not to exceed $165,000 for street resurfacing. Section two, the municipal manager is hereby authorized to execute all the proper documents and contracts required to complete said program. Section three, this resolution shall take effect and be in force from and after its passage. Any discussion? Any motions? Make motion we pass CM-26-28. I second.

A resolution authorizing the Municipality to host a Dayton Dragons baseball game at Day Air Ballpark for municipal employees to attend on June 28th, 2026, which will consist of each municipal employee being entitled to reimbursement from the Municipality of up to two tickets to the ballpark. Whereas Council for the Municipality of West Milton recognizes the importance of the municipal employees and values their service. And whereas in an effort to promote a positive work environment and show their appreciation, Council would like to host a Dayton Dragons game at Day Air Ballpark for West Milton municipal employees to attend on June 28th, 2026 with the arrangement of reimbursing employees for the cost of up to two ballpark tickets including fees. And whereas Council believes this to be in the best interest of the municipality as it serves a proper public purpose by promoting employee appreciation. Now, therefore, be it resolved by the Council of the Village of West Milton, Ohio that section one Council hereby approves to host a Dayton Dragons game at Day Air Ballpark on June 28th, 2026 for West Milton and municipal employees to promote employee appreciation. Section two, Council hereby directs the Finance Director to reimburse each municipal employee for up to two Day Air Ballpark tickets for the day of June 28th, 2026 to include fees within a reasonable time upon receiving a receipt invoice from the employee. Council members are excluded from receiving reimbursement. Section three, this resolution shall take effect and be in full force upon passage. All right. So, you want to finish talking about that? Sure. Go ahead. You're good. So, Mayor Sodders and Levine, I went down to
um the Dayton Dragons ball stadium and Mayor Sodders and Mr. Sodders did a phenomenal job job of managing this. Um it's going to be a community day in West Milton and we want to make sure that our staff is able to attend with a you know, another person. Um just as a thank you, but then the other side is they're donating half of the ticket sales back to Project Revival which does events in town. So, anybody that wants to come is welcome to come. We've got a whole section. I think it's 300 How many tickets? 320. 320 [snorts] tickets um for a whole West Milton day of Dragons and it's on Sunday, right?
It is on a Sunday. So, do the kids get to run the bases? 1 o'clock game and afterwards all the kids get to run the bases. So, that'll be cool. So, it's going to be a fun day. We've got a whole West Milton section. It was really neat being there and I'm I'm really excited about the opportunity just for our community to do something together. We've it's America 250. We've got a lot of events and hopefully we'll be together a lot this year, but I think that's a really fun experience to have. Plus, it's going to help support those events. All right. Any motions? Next, we have CM-26-30. An ordinance adding vacant property and building registration to chapter 92, exterior property maintenance code, section 98.20, 98.201, 98.202, 98.203, 98.204, 98.205, 98.206, and 98.207 to the code of ordinances for the municipality of West Milton, Ohio. Whereas Council for the municipality of West Milton has determined there is a need to ensure the health, safety, and welfare of the residents of the municipality by requiring the registration and maintenance of vacant property and buildings within the municipality. Now, therefore, be it ordained by the Council for the Village of West Milton, Ohio as follows. Section one, chapter 98 of the codified ordinances be amended to add sections 98.20, 98.201, 98.202, 98.203, 98.204, 98.205, 98.206, and 98.207 as set forth in the document entitled vacant property and building registration attached hereto as exhibit A and incorporated herein by reference. Section two, this ordinance shall become
effective from and after the earliest date permitted by law with a grace period regarding fees lasting until December 31st, 2026. Do you want to have any more discussion on this or Um so, what's the uh all these changes or additions that will be posted for people to review somewhere? They can come in and see it. How does this work? It gets posted. I don't know if Laura does the posting or if the municipal manager usually does the posting, but yes. Okay. Where I I post it in the I just put it in the newspaper. Okay. And then if somebody puts it on the website, I don't do that.
Okay. We'll make sure it's on the website. So, we've had pretty extensive discussion, some would say exhaustive discussion about this. I think it sprung up uh a while back from it was a suggestion from Retail Strategies, Mike. Am I incorrect? No, it's we this is something that we've been discussing for several years, honestly. Um most communities have these. If you look around the county um and around the state, it's kind of a standard. As we're working towards community revitalization and downtown development, this is one of the first steps. There's going to be a lot of different steps we've talked to um with Retail Strategies about that. And you know, it's a carrot and a stick and you kind of have to have both. Um and this really isn't even a stick. It's just if you have a vacant building, this is something you have to do. It's not punishment. It's just something so that we're aware of what these vacant buildings are um and we can help if somebody if a homeowner or a building owner is not sure what to do, we can, you know, try to guide them in the right direction, but just getting that information. There's, you know, it's also a safety issue. If the building is in disrepair and falling apart, it could hurt people walking down the sidewalk. So, it's it's just it's part of the process of community revitalization and downtown redevelopment. All right.

That [clears throat] sound like that? All right. Moving on to CM-26-32. An ordinance to amend the official zoning map of West Milton as adopted by charter or chapter 150.006 of the West Milton Code of Ordinances. Whereas the West Milton Planning Board received a petition to modify the zoning district boundary of a parcel of real estate located at South State Route 48 in the municipality of West Milton, Ohio known as parcel number L39-024-202, approximately 8.6 acres from R1A residential to B1 highway business district. And whereas Council has received an affirmative recommendation from the West Milton Planning Board to amend the official zoning map of West Milton by changing the zoning district boundaries of the parcel of real estate being described as parcel number L39-024-202 from R1A residential to B1 highway business district. And whereas section 150.319C requires Council to modify zoning boundaries by ordinance as prescribed by West Milton Charter sections 4.13 and 4.14. Now, therefore, be it ordained by the Council of the of West Milton, Ohio that section one Council accepts the recommendation of the West Milton Planning Board to modify the zoning district boundary of the parcel of real estate described as parcel number L39-024-202, approximately 8.6 acres from R1A residential to B1 highway business district. See exhibit one attached. Section two, this ordinance shall take effect 10 days after the second reading and approval by Council. You Can you explain, Ben, what this is?
So, um I had sent Tom a photo of uh just go ahead and put the parcel up. Uh basically, this parcel is right across from the uh West Milton um RV uh location. Um on the map, you can see like the triangular section. Um so, basically, this was a R1 residential property. Uh the reason that they wanted to zone it central or um the business highway business district was they were looking at potentially a car wash um or other uh commercial uses for that property. Um and the sale kind of determined whether if it was going to be rezoned or not whether the sale would be final. Um so, they did attend the Planning Board Board of Adjustments and um every it was unanimous that this could be changed over to highway business district.
[clears throat] And I have a question. Yeah. In the Planning Board meeting, did they discuss the potential impact to the neighbors around if they put in commercial property? And and with that, were there any complaints from neighbors?
Yeah, so the neighbors behind them are actually it took us a minute to figure it out, but the neighbors behind them are actually in the township. Um so, therefore, they might not have gotten any correspondence about it since they're out of city limits. However, they want to be good neighbors and they had planned on making contact with um the owner of two owners of the properties right behind them. Mhm. Um so, I think they would make every attempt to discuss that with them also. I mean, whether in the village or not, they want to be good good neighbors. Mhm. Now, I have a question. So, that would be going above and beyond. Is there any requirement that they get their approval or in order for the rezoning? Approval, the only the only thing that would come through really would be Mr. Harry, I apologize, but I'm hearing talking from the floor and I just want to remind people the guidelines for decorum not to interrupt discussion um while we're having a meeting. They would mainly just uh their part is done as long as Council approves the ordinance. Um then I I assume the res the real estate deal would be finalized Okay. And I assume at this point there were no complaints about the rezoning. Okay. All right. Next we have municipal manager's report by Ben. I thought I'd take it easy on you guys. I thought if it didn't fit on one page, I'd just bring it up. Um as you can see, we had some work going on on the East Side bike bridge. Um the crews are are moving in for the East Side bike pathway project. Right now they are working on the interior lane because that will actually be the single lane open during construction phase. So what they're going to get that all
patched up and then they'll start on the path project itself. So just be wary if you're out there, there's going to be construction going on probably into August of this year depending on how the project goes. Um also you'll you've probably seen service crews up on North J Street. North J's going to be paving in the paving program this year and due to an EPA mandate, we have to make sure that by 2028 we've identified every line that's in the roadway and every line that goes to a residence and put it into what we have as our water program. Anything that is not copper on that street currently that we expose will be replaced by copper prior to paving. So that way when the street's done, the lines have been replaced and we're done with that plus we can mark them off our list. Founders Park, some equipment's begun arriving for that. Um So we'll go ahead and the sign the sign came today. I think it was For the park? Yeah. So I know it was kind of a draft sign. So I just I'll get it I haven't even looked at it yet. But I'll I'll get you guys a picture and the memo of it as soon as I open up the box. Ben, I just want to tell you I'm so excited.
Yeah. I think it's This is amazing. This is good stuff. Hopefully they spelled everything right. [laughter]
Uh Uh most of the gases the gas lines have been bored for the city hall for the generator project which is good because um Righter Plumbing had a lot of things to work around. There's a lot of utilities out there. And of course like usual they did an excellent job. Next they'll be putting in electric lines especially on the south and west side of the building and then there'll be a pad going in next to the dumpster where the generator will sit and then a pretty large box it's a transfer switch that basically transfers the power in the event of the generator is needed. So that's moving along really well. Um As you may or may not know, we've had phone issues here at city hall. We'll just come in one morning and they we have no dial tone or we will get a dial tone and then they'll cut off the call. We've had instances where the voicemails are going to different people that aren't supposed to get the voicemails. Um and it really really comes down to the fact that the lines that are serving city hall are just just south of us and they're old they're very old phone lines and any moisture that gets in there affects the signal here. So Jill and Megan Hall have been putting a lot of time in to try and find the best possible update that that we can get for this that's the most economical but also the most reliable. So that's continuing. Uh the personnel review board, they've completed their they've pretty much completed their review of the final rules draft. Chief Wright and Joe Bryce, Megan Hall and Lynae we met once more um to make sure that everything was still good. Lynae suggested some changes on just some language and things that because of the layover we we kind of missed. Um the board's going to meet next Monday in here to go over the personnel to go
over any changes or anything that they would recommend to the personnel rules. Uh the pavement striping I know Washington Street our downtown parking lot has been without parking stalls for quite some time now. The issue was is after the paving we we got some weather and then they didn't make it back in to get the striping done and it's once it gets cold it's just kind of a waste cuz the material won't last if you put it down and the weather's not right. They will be coming in next week to get those areas striped and also because Steve's reminded me, we had to move all the parking blocks on Washington Street. So they're all sitting up on the the wall all over the place down there. We want to get the parking blocks back. Um at the same time I reached out to uh Mr. Croplin who owns a newer business downtown and talked to him and assured him that we were going to be putting in some right away some kind of nice stone or something next to the buildings where our overgrown shrubs were at. Um We're just going to kind of look for a nice landscaping gravel or something low maintenance and he likes the idea because he can put a table and some chairs out there wherever he would want to. Um and we also have so we have the section that's beside the old Poling and Croplin's building on one side and then on the other Did I say Poling? I'm sorry.
about like Marketplace 28 and Sugar Lane Social, right? In between there where like there's that It's not Sugar Lane. It's that antique store. Yeah, antique Okay. I know where you're talking. Yeah. Reserve Salon and that rental house. Yeah. That big alley. once you go across the street where Poling's office was, we actually have that on the south side too. That's all part of that sidewalk right away. So we just we planted some bushes or some shrubs in there and we were told they'd never grow and instead they growed like we were putting Miracle Grow on them every year and they just got to be hideous and hard to maintain. Um so we thought a nice landscape gravel would be much easier to take care of.
[snorts] Can we talk about that for a second? Yeah. In case you probably need to help me. Um So part of the retail strategies we met with them last week and we are talking about getting some like getting one project in those two alleys were kind of on that list. So I don't know if you've ordered anything. No. Good. No. Not yet. We talked about just if there was something downtown that could be done a smaller scale but have a big impact that everyone sees and that kind of came up as one potential artwork or light
Yeah. Well, we have money in the budget for that. Yeah. So and that was that downtown I think it says landscaping downtown landscaping. That's for that corridor. That was smart. So yeah, we won't we won't move on anything till we get that figured out. Cool. We don't really have the with the crews kind of stretched thin on alignment exposing and stuff going on, we wouldn't have got to it for a while anyway. So. Okay. Is that Are you good with that? Yeah, absolutely. Yeah.
I think that would be and so we will have like a small committee that's formed not necessarily council but volunteers from the community to kind of like make a plan and well, I talked to Tim a little bit but we can kind of work through that. Yeah. For sure. That would be great. Okay. Thank you. Um Let's see. Uh where was I at? Oh, so the planning board will be having a special meeting on April 22nd and it's the purpose of the meeting that will be publicized is just to cover the comprehensive plan draft. I hope councilperson Rick Grubbs is in. Yeah, I'll I'll be there. Awesome. Yeah. Thank you. Uh Officer Jan Setters is being promoted to sergeant as Chief Wright let us know. His swearing in ceremony will be next Is that Tuesday? Monday? Yes, next Tuesday. Tuesday the April 21st at 4:00 p.m. if anybody wants to come and watch Officer Setters get sworn in as sergeant. He's a fine young officer and we just have a great We just have a great department back there. We're so lucky. So. Uh I provided you guys copies. Union Township did apply for the small first responder grant and then as we get other other application grant applications, I'll make sure you guys get those also and I've given Megan the originals so if anybody would need to see it and don't have their copy, they will all be with Megan Hall. Uh regarding the community pride awards, I believe we wanted to start that in May and I think we pretty much narrowed down who we were looking at. So if we don't hear anything else, um we'll plan on using the addresses that were voted upon and then have that ready for the May council meeting if that's acceptable. Okay. Uh lastly, the park pavilion committee, we were we have a meeting on Friday morning.
Basically we've met with present with three different presentations kind of different styles of builders whether it's a design build or kind of a prefabricated build. So I think I think we've got enough information there to digest. We're going to kind of start meeting down in the park so we can start discussing location, sidewalk possible potential and the parking potential just so we can start getting an idea of that so we can keep moving forward. And I'm done. Yeah. And I want to thank you too about the pavilion.
