All right. [clears throat and snorts] Next we have resolution CM-26-10, a resolution accepting the resignation of D. Jeffrey Sheridan as municipal manager and authorizing the mayor to enter into a separation agreement with Mr. Sheridan. Whereas the council for the municipality of West Milton has received the resignation of current municipal manager D. Jeffrey Sheridan and whereas the council and D. Jeffrey Sheridan desire to enter into a separation agreement. Now therefore be it resolved by the council of the municipality of West Mountain, Ohio. That [clears throat] [snorts] section one council hereby accepts the resignation of municipal manager by mutual agreement of D. Jeffrey Sheridan and the municipality and waves the 60 days written notice required in section 3 of the employment agreement. [snorts] The effective date of the termination shall be March 6, 2026. Section two, Mayor Jeremy Sauders is authorized on behalf of the of the municipality to execute a separation agreement with D. Jeffrey Sheridan [clears throat] substantially upon the terms and conditions contained in the separation agreement attached here to as exhibit A. Section three, this resolution shall take effect and be enforced from and after its passage. All right. [snorts] Do we Yeah. Do we have any motions?

Uh, I'd just like to uh say that appreciate uh the work that Jeff's done uh being here for almost 5 years uh with as a city manager and uh wish we wish him all the best uh in his future endeavors and uh whatever uh job or position that he uh obtains from here forward. So wish him the best of luck. Yep.

All right. [clears throat] Next we have ordinance CM-26-11, an [snorts] ordinance appointing an interim municipal manager for for the municipality of West Milton and declaring an emergency. Whereas due to the resignation of D. Jeffrey Sheridan, the municipality of West Milton needs to to appoint an interim manager for the municipality. Whereas the municipality needs to employ an individual who has the necessary background to handle the responsibilities of municipal manager while the municipality searches for a full-time manager. Whereas Ben Haron is currently employed as the director of service for the municipality and has served in the dual role of director of service and interim manager at various times when the municipal manager was unavailable. [snorts] Whereas the council wishes in the best interest of the community to authorize an increase in salary and appropriate the necessary funds to permit council to appoint Ben Haron [snorts] as interim manager pursuant to the attachment to the attached contract while also fulfilling his duties as director of service. Now therefore be it ordained by the council of West Milton, Ohio that section one, Mr. Ben Haron, while continuing to serve as the director of service, shall be appointed as interim manager by the council beginning March 9th, 2026, pursuant to article 5, section 5.04 of the West Milton Charter due to the former manager's resignation and pursuant to the terms in the contract attached here to as exhibit A and incorporated herein as fully fully rewritten. [clears throat] Section two, council has appropriated the necessary funds to pay Mr. Heron an increased salary due to his dual role. This appropriation shall continue during his duties as interim manager until a full-time manager is is selected and appointed. The benefits Mr. Haron

receives from from the municipality as the director of service will remain unchanged as he takes on the additional responsibility as interim manager. At the time a full manager is appointed, Mr. Heron shall resume his full duty as director of service at his previously designated salary. Section three that this ordinance is hereby declared to be an emergency measure [clears throat] necessary for the immediate preservation of the public peace, health, safety, and general welfare and shall be effective upon its passage.
