Authorization to Schedule Public Hearing for CDBG Application

WHEREAS, the Office of Community Renewal is expected to solicit proposals from municipalities under the 2026 Community Development Block Grant (CDBG) program to assist low- to moderate income citizens in Wayne County with the proper application; and WHEREAS, potential applicants for CDBG funding are required under 24 CFR570.486 and NYS's Citizen Participation Plan to schedule and conduct an advertised public hearing prior to the submission of such applications to give the public the opportunity to suggest projects for municipalities to consider; and WHEREAS, the purpose of the hearing is to gain citizen input as to their needs and potential CDBG-funded projects for consideration by the County, including Housing, Economic Development and Infrastructure, and Slum and Blight remediation; now, therefore, be it RESOLVED, that the Board of Supervisors hereby will conduct a hearing to permit the filing of a Community Development Block Grant application; and be it further RESOLVED, that the hearing be set for Tuesday April 21st at 9:05 A.M, in the Supervisors Chambers at 26 Church Street, Lyons, New York; and be it further RESOLVED, that the Clerk of the Board is hereby authorized and directed to publish notice in the legal newspapers for the County for the first available publication.

Authorization to Accept CDBG Award and Issue RFP for Wayne County Derelict Property Study Update

WHEREAS, resolution 425-25 authorized the submission of a Community Development Block Grant (CDBG) Community Planning and Technical Assistance application requesting $50,000 to update the derelict property study to continue to monitor conditions and inform decision makers; and WHEREAS, on January 22nd the Housing Trust Fund Corporation (HTFC) notified the County that the application has been selected for a $50,000 award; now, therefore be it RESOLVED, the Wayne County Board of Supervisors approves accepting the grant and authorizes the solicitation of a consultant to assist in completion of the study; and be it further RESOLVED, that the Board of Supervisors hereby authorizes the Chair of the Board of Supervisors to execute any agreement documents necessary to implement the resolution, including acceptance of the CDBG award, and be it further RESOLVED, that the Wayne County Budget Officer is hereby authorized to amend the 2026 budget as follows: # A8020 Economic Development & Planning (Revenue) $50,000 to 44091 DPS26 CDBG (Appropriations) $50,000 to 54400 DPS26 Contracted services.

Resolution Making SEQRA Determination for Modification of Agricultural District 1

WHEREAS, Wayne County (COUNTY) has undertaken review of Agricultural District No.1 pursuant to AML §303-a and §303-b to consider requests for modification of Wayne County Agricultural District 1, and WHEREAS, the New York State Department of Agriculture and Markets (AGM) and the COUNTY are agencies as defined in Article 8 of the Environmental Conservation Law (State Environmental Quality Review Act, hereinafter "SEQRA") and which requires agencies to review environmental impact in its related planning and decision-making processes, and WHEREAS, the Agricultural Districts Law, Article 25-AA of the Agriculture and Markets Law (AML), establishes a process by which county legislative bodies may create, review, modify, consolidate, or terminate Agricultural Districts throughout the State, which the Commissioner of AGM then certifies, and WHEREAS, the Department of Environmental Conservation (DEC) has determined that the creation, modification, consolidation, termination, and certification of an Agricultural District are all actions subject to review pursuant to SEQRA, and WHEREAS, AGM and the COUNTY have entered into a cooperative agreement to establish procedures to eliminate the overlap and duplication in comment and review, and WHEREAS, The COUNTY, as the agency with principal decision making authority, is designated Lead Agency for all actions within the scope of this Agreement and AGM is designated an involved agency for purposes of compliance with SEQRA and has prepared the Short Environmental Assessment Form, and WHEREAS, The COUNTY elected to hold the required public hearing for purposes of compliance with SEQRA and Agricultural Districts Law concurrently, and has met all statutory obligations and responsibilities, now therefore be it RESOLVED, that based on the review and analysis of the short form EAF, and any supporting documentation, that the Board of Supervisors determines the proposed modification of Agricultural District Number 1 will not result in any significant adverse environmental impacts.

Resolution Approving Modification of Agricultural District 1

Authorization to Accept New York State Canalway and Parks Grant

WHEREAS, resolution 365-25 authorized the submission of a 2025 application requesting up to $150,000 of grant funding to develop the 143 Water Street as a park and up to $150,000 matching funds and in-kind services for this project; and WHEREAS, Wayne County has been awarded $150,000 from New York State Canal Corporation to make park improvements at 143 Water Street in Lyons, New York; now, therefore, be it RESOLVED, that the Board of Supervisors hereby authorizes acceptance of the New York State Canal Canalway and Parks Grant and authorizes the Board Chair to execute any agreement documents necessary to implement the resolution on behalf of the County of Wayne, subject to the County Attorney's approval as to form and content; and be it further RESOLVED, that the Wayne County Treasurer is hereby authorized to fund the 50% match of $150,000 from the unassigned general fund balance, and be it further RESOLVED, the Wayne County Budget Officer is authorized to amend the 2026 budget as follows: # A8020 Economic Development & Planning (Revenue) $150,000 to 43305 NYC26 NYS grants (Appropriations) $300,000 to 54400 Contracted services.

Authorization to Submit Application to Empire State Development for the County Infrastructure Grant Program

WHEREAS, Empire State Development (ESD) has made $50 million available through the County Infrastructure Grant Program to support infrastructure projects that create new housing or support economic development; and WHEREAS, the County Infrastructure Grant Program is only available to Counties in New York State, with awards capped at $1,000,000 per applicant with applications due April 1st; and WHEREAS, the County Economic Development and Planning Committee solicited proposals from County municipalities to identify a qualified project; and WHEREAS, the committee chose water and sewer projects proposed by the Town of Lyons in cooperation with County Regional Land Bank to bring water and sewer service to two locations in Lyons on Clyde Road and Old Lyons Road to serve up to 20 new single-family homes, with estimated project costs of $2,120,000; and WHEREAS, the Town of Lyons has committed to providing a $1,000,000 local match, and WHEREAS, there is a $250 application fee to apply to the program to be covered by the County; now, therefore, be it RESOLVED, the Board of Supervisors authorizes the submission of an application to the County Infrastructure Grant Program under the direction of the County Economic Development and Planning Department; and be it further RESOLVED, that the Chair of the Wayne County Board of Supervisors is hereby authorized and directed to execute any agreements or documents necessary to implement the resolution on behalf of the County, subject to the County Attorney's approval as to form and content.
