Conditional Rezoning Petition CD-001-2026
Information: Petition CD-001-2026 is a request by property owner GiGi Stover for a conditional rezoning on approximately 0.3 acres (tax parcel number 05112062) located at 300 North Providence Street. The property is currently zoned R4 - Single Family Residential. The applicant is requesting a conditional rezoning to CZ-NC - Conditional Zoning - Neighborhood Center to allow for general office use. Staff recommends a favorable recommendation of the proposed conditional rezoning petition CD-001-2026 and the reasonableness and consistency statement. Recommended Action: • MOTION to approve the Conditional Rezoning Petition CD-001-2026 and the Reasonableness and Consistency Statement. Reasonable and Consistency Statement: The request is not consistent with the Waxhaw 2040 Comprehensive Plan Future Land Use Map, which designates the property as Medium Density Residential. However, the parcel is located within the Downtown Center and is adjacent to properties designated as Downtown and zoned for commercial and neighborhood center uses. Therefore, the requested general office use is compatible with the broader character of the surrounding area. The request is reasonable and in the public interest because it limits the property to a lower-intensity general office use, received support from neighboring property owners at the required neighborhood meeting, preserves the existing house, trees, and screening, and satisfies the applicable Land Development Code requirements for parking, accessibility, and engineering.
