It's been a long time, Artie. It's been a long time.

I'm Artie Torres. I'm your accountant. And I think for tonight specifically, I'd like to give you a little bit of background on the audit procedures that the village goes through every year. Prior to 2024, audits were quite simple. We were able to handle the requirements of the audit and still stay current. From 24 on, it's been just the opposite. I have samples here I'd like to give you to show you the requirements with these new auditors. It's very, very expensive. I am still working on current files, but I do have to prioritize my time answering these boxes for the auditors. On top of that, I was just informed that you've got a three-year audit coming up on community services revenue.

Yes, thank you, Council President. There's more to discuss coming up on the attorney's report about our last bid that we put out for our construction project, our stormwater project, so we'll discuss that more under the attorney's report. But FP&L, an update on the FP&L labs, met with our representative who's been overseeing the project. We met with him yesterday, the day before, this week. Oh, and today. So LABS will give us an update on that project. I was a little concerned. It's been like a skeleton throughout their last couple of business this week. And we have a project coming up, and they know that. So I won't steal your thunder. I'll let you talk about that. What else do we have? Those are the two main things there. The state appropriations, I don't think it's set a date yet. Have they set a date yet for a budget? No. No, so they have other issues, the property tax issues going on, redistricting, and the budget. So everything's going to get crammed in, I think, in the last minute. I think the governor wants to see who's playing ball with him with the tax issue before the budget happens, in my opinion. So there's no update on that as of today. And I think that's all I have. So I'll turn it over, and then we'll discuss it. these other items here in a little bit.

You know what's so funny? Just to piggyback on that, I've talked to a few people outside about the tax thing. And when you hear comments like, oh my god, this is going to be great because we're not going to have a tax bill anymore, people don't understand that your school taxes are not going anywhere. And that's 75% of your bill. And they're like, what? I'm like, yeah. People don't know what's on their bill. Look at your bill, and that amount there is not going anywhere. They're taking away your fire, your roads, your city, all the utilities, all the other things. I had a whole list of things, and they're like, oh, and who's going to pay for it? I'm like, you know, the people aren't, people aren't, they're not informed. They just see, oh, my property taxes are going to go away, and they're going away, and that's it, and, you know, hooray, and they're going to vote for it, and then we're all going to be, you know.

The last thing I heard, they're not going to do away with it completely. It's a percentage. We don't know what's going to happen.

I mean, I talked to our state senator. First I heard that whatever the House passed, they're going to throw it out the door because they're not going to go anything with it. And then I hear they may work with them. Who knows? They may get a additional amount to the homestead, $200,000 to the homestead.

I don't know. Nobody knows. Your guess is blizzards. Exactly.

That would be a more logical thing, getting more homesteads.

Well, we'll see. Either way, it's going to affect the city, depending on how you look at it, because if you've got homestead, for every homestead property, if you take away the taxes that they pay towards the village, you've got to make up for it somewhere else. So with that being said, I do have two more items I didn't forget to mention. Next Friday night, we're having a movie night. The movie's going to be sponsored by our commissioner. We don't have the flyer yet. Right, Macbeth? Did we get the flyer? Did the flyer come out yet? Okay, so next Friday, we'll start advertising I think it's how to train your dragon. How to train a dragon. How to train a dragon next Friday. So I think it's 630 starting. I think it will probably come on at 7. So, again, more information to come on that. And the tax collector will be here on Saturday, May what? 9th. May 9th. So instead of being here during the week, he'll be here on a Saturday from 9 to 1. So it will be like a half a day. What services will it be? renewing your driver's license, vehicle registrations, anything you pay taxes on besides your homestead, he'll be here to assist with that. The mobile unit will be out here. Usually we have soccer games going on.

I wish I would have known. I was at the driver's license Saturday doing mine.

I went to the spring thing that night.

But I have to tell you, since this guy has been running this, He stopped all the scamming of people buying me appointments and you not being able to get an appointment. I went online and got an appointment for the next day. And it was, I walked in and in 10 minutes I was out with my license. And that, a couple years ago, would never have happened. I mean, the lines would have been out the door. So he's doing a really good job. The guy's everywhere, man, everywhere you go.

He's like a clone. He's like two clones.

Well, just like our commissioner, though.

Yeah. Our commissioners, well, they're locked, they're tight because his chief of staff is her husband. Yeah.

So they're always, we wait to see the other everyone. It makes sense why they're both everywhere. Yeah. Yeah. Yes, Counselor?

I don't think so. I will say one thing. We are going to move on. We are going to talk about FD&L, but the next phase is going to be from east of 59th Avenue, so year block. Year block, 57 plays, 58 plays, 58 court, 57 plays, that whole entire east section. If you go by there now, you'll see the stakes in the yards, and they're actually painting lines in the ground. Yeah. So that means they already have approval from the residents. We're looking for the transformers. And so that's what's coming up, the east side. The only thing they have left is pretty much 65th Avenue to the west after that. So that should be a pretty quick process. What's that? No, the FP&O. Oh, I'm not happy with FP&O. And, yes, they're cutting off electricity here and there intermittently.

Here and there intermittently? Try from 820 to 430 the whole day without telling anyone.

Well, I got a message. I got a text message or an email. I think wherever you're signed up through FP&L.

We're cutting your power off at 823. Did it go out at 823? It went out at 830 around there. Nick was able to make it.

We had no control over that. I mean, that's not my thing. It just went out to my house, you know.

It was a planned maintenance thing that they had to do, let the people know that you're not going to have power the whole day. It was fine. I went to work. I wasn't home. And thank God it just came on when I came home from work. And then they sent a survey. And it's so funny. The only question on the survey was, were you advised about this power outage? And I put no. And it says, thank you for this survey. That was the next day.

It was like a week in advance, and then like a day in advance leading up to it. No, I only got that one in the morning. There's going to be more power outages because they transfer over. They have to switch. At some point they have to.

It's perfectly fine. We all understand, but give me more than an hour's notice. Don't worry about it. You're fine.

Have they mentioned how they're going to, are they going to be cutting off the posts?

No. Because one of the utilities sued them, so they no longer cut down the posts at their level. They remove the transformers, they remove their lines, but the poles stay

All the way up.

Yeah, I think it's AT&T, DirecTV, all those people use those poles. Usually they cut it down at the next utility. They're not doing that no more. They're keeping them up. So half of that pole is going to be exposed. That's everywhere. It's not just VT. It's throughout the whole, wherever they go. Okay, we can move on. I'm sorry.

Like the Mayor was saying, FPL, the crews have been out here. We've been a little skeleton crew. So I got in contact with the higher-ups. They weren't aware of it, so they've been coming around and looking, and they agree. So starting next week, there's going to be more activity in the middle portion here. The projected date to have everything installed to the transformers is beginning of June. And then they're going to start knocking door to door. They're going to have to knock your power down for a couple hours to do the connection to the transformers. but everything's going to be set in place hopefully in June. Okay, that's all phases? That's the part they started from 5-9 to 6-4, the middle part. Tomorrow we have a walkthrough for the new section from east of 5-9 to west of 5-7 port. That's the next phase. The walkthrough is tomorrow. Hopefully they're going to start next week. We're just working with them, making sure they don't destroy any of our stuff. Also, they're going to be the restoration crews going to start coming in within a couple weeks. Same guys are going to do the sidewalks. Any damage that was done inside the properties that they had to cut concrete, remove pavers, that's going to be done at the same time. All the restoration will be done at the same time. Talk the good game. So let's see if they – It sounds great on paper. Yeah, it sounds – yes, it does. But the DFL coordinator, James Parker, he's really on top of the ball, and I trust him.

And one thing he explained to us, they're not going to pay by the hour. They're going to pay by the job. So the sooner they come in, get things knocked out, the sooner they get paid too. Correct. So that's that. They get paid by the hour, and they might be out here for a year to finish up this job.

on uh the lighting on 41st street almost go ahead um uh thanks to the mayor um we got more lighting now on 41st street on the vg side every fpo pole has a new street light every concrete pole yeah so yeah that's all concrete so you got a new street light so you'll probably see it if you go by there at night you'll see a little more bright they're missing too because we got to cut some uh the trees back But if you go by there, you probably notice that there's more lighting there.

Two there and three, I think it is, on 66 by Boeing. Those holes there.

So it's been about a year. It's taken about a year to get that project finally almost completed. So it's definitely a big difference with the lighting. I drove by there, I think it was Monday.

It was like every third pole before it had a light. And now every concrete pole, there's a light on every concrete pole except for two. That's great news. Yeah, it's good. You're doing a great job. Thank you, sir. On to recreation. I don't think there's anything to report. No. Then we have a resolution. Mr. Attorney.

Thank you, Mr. President. Before I read the resolution item 11G1, basically I'll combine this resolution with the attorney's report.

If you want, I can give you a little background that way. Sure. You're not in a hot seat over here. Sure. About, what, two weeks ago, three weeks ago, I was up here and Lads and I were talking. He goes, Mayor, I've got to show you something.

There's a little bit of a stake on this plan.

I got the plan. I got the spec seats. Labs got them. Engineers sent them out. Everything looked good. Everything's on the plans. Well, the spec seat left off the paving of 6-2 to 6-4 on 37th, 38th, 39th, and 40th Street. Four full blocks. Not only four full blocks, those are almost like double blocks because you have two blocks in between there. So I said, oh boy, that's a problem. And I was wondering why, because the paving came in at about $105,000. I said, damn, that's a lot of paving for $105,000. I never even put two and two together. So we're looking at it, looking at it, looking at the spec sheet. The only thing they included was the little side roads, 63rd core, 62nd core, 63rd core, 62nd plate, whatever it is, those little small roads in between 3938. Before we got an attorney involved, met with Laz, met with the engineer. We tried negotiating with the lowest bidder to bring down the price on the milling and overlaying, which we probably should have done, but we did, or Laz did, I should say, not we, Laz did, and the third place bidder was at $18. I'm not even announcing numbers here right now. It's a big difference in price between the third place not even including the fourth and fifth place, but the third place and the first place. If we would put those numbers together and put it into the equation, the third place probably would have been the lowest bidder. So after, we received a letter of, what's the letter?

A protest.

A protest letter. A big protest. We got the attorney involved, and his recommendation was, you know, Don't receive any of the bids for three places. Send a message out right away, which we did to the contractors, and we'll meet tonight. And the recommendation is going to be to withdraw. That's where the attorney is going to pick it up now. So go ahead, and I'll let you know what the recommendation is.

Thank you. As the mayor mentioned, when we discovered that there was a – incomplete scope in the bid package that went out the communication with the three highest bidder seeking some pricing even though well-intended created a problem because we are communicating with three of the five bidders in in that that's an issue that's an issue because in under the spirit of the competitive sealed bidding, while you communicate to one, you communicate to all. So the mayor sent out a letter. Once we discussed it, the mayor sent out a letter suspending that effort, which was appropriate. So no bids, I believe that no bids were received for that supplemental pricing process. So the next step at that point is it's basically I'm recommending to address the protest, the bid protest submitted by one of the bidders. Now, there were several elements in the bid protest that are being addressed by the resolution here, primarily by rejecting all the bids and directing the administration to correct the scope and send it out again so that it's open to everyone's participation, that that would cure any defects that we have and basically closes the protest. As far as any legal issues where it is within the city's authority to basically, since we have a scope problem, that if we had an incomplete scope, that we basically correct the package So what the resolution is doing, it allows you to resolve the bid protest, to reject all bids. It ratifies the mayor's action in suspending the supplemental pricing process that created an issue. It authorizes the re-solicitation of the bid. And lastly, to notify the Department of Environmental Protection, who is the funding source from the state, as to our actions so that we inform them not only of our actions but also to see any possible timelines that may need to be adjusted or any information that they may require from us so we can move forward with the project. So at this time, I'm going to go ahead and read the resolution into the record. If you have any specific questions or additional clarity that you may need from me or from the administration, we can definitely get into that. So item 11G1, it's a resolution of the Village Council of the Village of Virginia Gardens, Florida, resolving the formal bid protest filed by Metro Express, Inc. in connection with RPQ number 001-2026, Virginia Gardens Phase 2 Central Danish Greenage Improvement Projects number 202601, number 202602, and number 202603, rejecting all bids received, ratifying the Mayor's administrative suspension of the supplemental pricing process, authorizing re-solicitation of the process, providing for notification to the Florida Department of Environmental Protection Division of Water Restoration Assistance in connection with the EEP agreement number L0362, providing for severability and providing for an effective date. One thing that I wanted to add is, by mistake, the bid package that went out had a description describing the project with an LPA number. Project LPA number 0362. which basically would require that this bid process, this procurement process, follow all the standards of the local planning agency, everything under the Florida Department of Transportation. We are providing notice also to everyone, the bid clarification, that this was not an LPA project. So we are not, we don't have to follow FDOTs. requirements as it relates to projects and the bid process. It's just a clarification. You went out with the wrong designation, but this is in fact 100% a DEP project, nothing related to FDOT. It is not an LPA project and it is not subject to those LPA regulations.

It's actually a State of Florida appropriations That's where the money came from. BEP handles the contract for any water drainage projects for the state. So it's not federal money. It's directly from the state of Florida. So we've got to make sure, Laz, on the agreement and what we submit on the plan, it's just L-0362, not LPA-0362. And McBeth, too. So nothing says LPA. It's just L-0362. And...

As you may, if you could scroll down please, you'll see that the resolution itself spells out all the information that has been provided by the Mayor and myself, provides all the different directives and actions that have been mentioned to you, including the rejection of bids, re-soliciting the procurement process, notification to DEP, clarification as to the LPA issue, and it resolves the bid protest by basically rejecting all bids. So if you have any questions, I'm happy to address them.

We have a second by Councilman Turr. Any other discussion? Yeah, just for the record, some of the contractors asked for the price and what the bids came in at. They didn't receive a total amount. They didn't receive the line item amounts. So H&R, let's just say, asked for what everyone came in at. They received the total amount of $480,383.90 from on low, so on and so forth. When we do print it back out for bid, they won't have the specs of what everybody else bid on, each individual line item. If that makes any sense.
