PROJ-25-0784 Housing Element Implementation Program No. 15 / By Right Approval
The purpose of this item is for the Planning Commission to recommend an Ordinance Amendment authorized by City of San Buenaventura Municipal Code (SMBC) Chapter 24.540, establishing a ministerial review process for new residential projects meeting a minimum percentage of affordable unit count. This process fulfills the City's 6th Cycle Housing Element (HE) Implementation Program Items 15.1 and 15.2. This amendment creates a new section in Title 24 - Zoning Division 4 - Development Regulations and Standards - Section 24.446 - Exempt Housing Projects and Section 24.501 Administrative Permit to regulate it. It amends other parts of the Municipal Code including amendments to referral and appeals procedures reflecting the streamlined administrative processes to support affordable housing development and compliance with state housing law. Recommendation: That the Planning Commission vote to remove the item from the meeting agenda. A new publication notice will be processed to reflect the new Planning Commission hearing date in compliance with AB 2904. PROJ-25-0859 Anti-Harassment Ordinance
The proposed Anti-Harassment Ordinance will clearly define harassment, protect tenants from several forms of harassment, and meet the goal of Program No. 32 Tenant Protections of the Housing Element. State Density Bonus Law Informational Presentation
The purpose of this item is for Best, Best, and Krieger LLP to provide an informational presentation on State Density Bonus Law to the Planning Commission. The City recently updated their municipal code to reflect current State Density Bonus Law. Recommendation: Receive and file.
PROJ-25-0749 Midtown Corridor Overlay Ordinance Amendment
The purpose of this item is for the Planning Commission to make a recommendation to the City Council on a proposed Ordinance Amendment to the Municipal Code Midtown Corridors Development Code Section 24.595.150, Residential Overlay One, to help achieve the "Infill First Strategy" articulated in the 2005 General Plan, with the intent of prioritizing infill development instead of urban sprawl. This will fulfill the City's 6th Cycle Housing Element Implementation Program Items 14.8, 18.3, and 26.3 to allow properties within the Residential Overlay One to allow three story development. California Environmental Quality Act: 15601(b), Common Sense Exemption Recommendation: Staff recommends the Planning Commission hold a public hearing and adopt the following resolution: 1.
