PROJ-25-0859 Draft Anti-Harassment Ordinance

The proposed Anti-Harassment Ordinance will clearly define harassment, protect tenants from several forms of harassment and meet the goal of Program No. 32 Tenant Protections of the Housing Element. Recommendation: Staff recommends the Planning Commission make a recommendation of approval to the City Council to approve the proposed Anti-Harassment Ordinance and the Schedule of Civil Penalties imposed through administrative citations for violations of said ordinance. PROJ-25-0784 Housing Element (HE) 15 / By Right Approval and PROJ-25-0992 Senate Bill 35 (SB 35) Streamlining Ordinance Amendments

This item considers related amendments to the City of San Buenaventura Municipal Code (SBMC) to establish and implement ministerial approval processes for qualifying residential development consistent with state housing law. The proposed actions integrate requirements under Assembly Bill 1397¹ (AB 1397) and Senate Bill 35² (SB 35) to ensure that qualifying housing projects—particularly those providing affordable units—are processed through objective, streamlined, and by-right review where required. Recommendation: Staff recommends the Planning Commission hold a public hearing and adopt the following resolutions: 1. RESOLUTION NO. CD-2026-____, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN BUENAVENTURA THAT RECOMMENDS THE CITY COUNCIL AMENDING TITLE 24, DEVELOPMENT REGULATIONS AND STANDARDS, OF THE SAN BUENAVENTURA MUNICIPAL CODE TO ALLOW FOR A MINISTERIAL APPROVAL PROCESS OF RESIDENTIAL PROJECTS PROVIDING AT LEAST 20 PERCENT OF THE TOTAL BASE NUMBER OF UNITS TO LOWER INCOME UNITS ON REUSED AND REZONED SITES OUTLINED IN THE 5TH AND 6TH CYCLES OF THE HOUSING ELEMENT. 2. RESOLUTION NO. CD-2026-____, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN BUENAVENTURA THAT RECOMMENDS THE CITY COUNCIL ADDING CHAPTERS 24.501 AND 24.502 TO THE SAN BUENAVENTURA MUNICIPAL CODE TO ESTABLISH MINISTERIAL REVIEW PROCESSES FOR QUALIFYING HOUSING DEVELOPMENT PROJECTS AND AMENDING RELATED COASTAL AND DESIGN REVIEW PROVISIONS.
