Call everyone. Call to order the 01/07/2026 hearings before the Code Enforcement Special Magistrate. The first matter is old business, CEBD20Four-five24 Mildred H. Neri. Has anyone signed up to speak?

Good morning for the record, Kimberly Brown certified code enforcement officer for the city of Venice. We are waiting to see how the, I guess, the property is going to be transferred out of the current name of the decedent. And we're basically, nothing has changed. No permits in the system. I guess we're just looking to see once it's transferred out whether they want to demolish or they want to rehab the property at this time. But nothing's changed from our last hearing October, I think it was October 1

This is the property the it was in probate, took a while to start probate. It's a summary probate so it's $100,000 As I recall there's not, they're not gonna be naming a PR on that just because it's essentially just this property. They filed a formal petition to declare Homestead to take it out of the probate estate. In this one we have a list of all possible heirs and we sent notice to all of them to be here. Mr.
Neri is the son, he's the one who showed up to all our hearings on this matter. This was a and we request and your order was to either obtain permits to either repair or demolish it at that back in October. At this point again nothing's been done, no permits have been pulled. And my quick review of the again on the probate case it's we haven't had determinations for homestead property not or any sort of closing of the probate case.

Probate has been opened. They filed a motion to determine that this property specifically is homestead and for summary administration of the rest of the estate.

And that's why we also took you out a step of, so I never expected one to ever be actually put forth in this case to have letters of administration ever be filed in this matter. That's why we also put gave notice to all potential heirs who were listed in the petition for probate.

The first notice of violation your honor was, Previously notified by mail dated December 2025, 06/02/2025 and then our notice of violation was Kim do you have the 08/22/2025. 08/22/2025 was the our formal notice of violation on this matter. And then we continued it and we scheduled it for the September meeting because we had concerns that we did not, there wasn't proper notice to all the parties. Right.
And then we continued it to October and we sent notice to all potential heirs that were listed in the probate case.

I tried to file for the permits and I was told I'm not the legal owner so I couldn't. And now I have contacted a contractor. I'm going to meet with him today. But I don't want to go in debt for something that I don't know where I stand on. I don't want to go over. Right. Okay. I'm up in the air just like

I have an attorney, mister Mowry, that's the only one
know of.
Okay. And what is attorney Mowry Has attorney Mowry told you when he anticipates the homestead order will be entered?
The last time I spoke with him, he said that he was waiting to hear back from all the all my relatives, my nieces, my nephews, there's 15 people involved, 16 people involved. They said that they had not received the paperwork. I don't know if he sent it electronically or through the mail. I don't know. But and then the officer said that she had just sent a notice out about this and I didn't hear anything back from anybody. I know with the holidays and everything was probably a little crazy but I don't know.

We're in a quandary. This has been going on for well over a year. I don't see who the city would have the authority at this point to issue a permit to because there's no personal representative. On the flip side, we have a property that's not in compliance and probably is getting worse. But I don't I think my hands are tied. I don't know that there's anything I can do because there's no party for me to find in violation of the order. If there's no personal representative typically it would be the personal representative.
What are your thoughts? And I understand that your honor especially since we're at the point of finding and you can't, one of those aspects is whether the actions to be taken. And if and I so I and I get especially in fairness of that. At this point, if your honor is not inclined to enter a fine which I understand, we would probably have to just continue this to allow the homestead to come in to basically pass their homestead so that we can so that they essentially the records can be updated to be the new owners. And at that point, the new owners would be able to get the permits, legally allowed to receive the permits and at that point And to do that.
to has the authority to get a permit. I would like if attorney Mallory could be present next time or at least provide some kind of status report to us to help us understand where things stand in the process. It just seems an extraordinarily long time. And I say that with some reluctance because I know the Probate Court here in South County now it's Judge Williams is responsible for it. It's no longer Judge Rule.
And so everything is up in Sarasota as opposed to South County. But I'd certainly like to have a status update on the probate proceeding next time we come back here so we can get some idea of where this
is going. And I will reach out to attorney Mowry on that specific point and advise that you if he's not able to be here in person or till we send an update to this court just so that we know where it's going with Yes, this
