RECOMMENDATION: That the Planning Commission approve the Minutes of the November 17, 2025 Planning Commission meeting, as provided.

CODE AMENDMENT 2025-0002 (ORDINANCE NO. 1574) - (CODE STREAMLINING AND IMPROVEMENT PROGRAM) CONTINUED TO JANUARY 27, 2026

SUMMARY: This Project is a City-initiated request to amend various sections of Tustin City Code (TCC) Article 9 (Land Use). The proposed Code Amendment (CA 2025-0002) is a result of the Community Development Department's ongoing Code Streamlining and Improvement Program. The primary purpose of this proposed amendment is to clarify existing regulations, maintain consistency with recent State housing legislation, update Accessory Dwelling Unit (ADU) provisions, and implement programs of the 2021-2029 Housing Element. The amendments also clarify the City's prohibition of short-term rentals, consistent with the 2024-2025 Orange County Grand Jury findings and recommendations; and updates the "Minor Variance" provisions to clearly define the review and approval responsibilities of the Zoning Administrator. Collectively, these changes improve clarity, resolve outdated or inconsistent code sections, and ensure the TCC remains aligned with current State law and City policy. Staff will continue to evaluate land use-related codes on a regular basis and introduce amendments when appropriate. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4538, recommending that the City Council adopt Ordinance No. 1574, amending various sections of Article 9 (Land Use) of the TCC to provide clarity, ensure consistency of terms and definitions, implement General Plan 2021-2029 Housing Element programs, clarify the prohibition of short-term rentals, and ensure compliance with evolving State laws.

APPLICANT/PROPERTY OWNER: Aaron and Alyssa Goldsmith, 535 West Third Street, Tustin, CA 92780 RECOMMENDATION: That the Planning Commission approve the nomination of 535 West Third Street to the City's Historic Register Plaque Program and select "Advent Parsonage - 1908-1948" as the most appropriate historical name and period of significance for the property.
