So since we were last here, nothing has changed planometrically with the proposed lot line adjustment, but we did go before the zoning board and we were able to obtain the three necessary variances for the project. Thank you. The first is there was a request for an extension of time for a pending application. For PLPB 20260023, it's 158 4th Street. It's Pork Store. I believe they're waiting on archaeology. And so they just requested additional time before their time lapsed. And they had made that request for last month's meeting, which was postponed. So they'd be seeking a resolution from you to grant them a six-month extension.
Is there a motion to that effect?
i make a motion that we give them their six months extension the park start discussion all in favor say aye aye opposed say no and the motion carries unanimously cool and and then the second item um is relates to eddie's lane apartment project which you approved in i believe late 2025 um they are currently applying for benefits to the city IDA. And part of the city IDA application process is them providing a fully completed environmental assessment form. When we went to go complete that, we realized that technically when you approve that project, you never approved a Seeker NEGDEC resolution. Clearly, if you approve a project, you meant to negdeck it. There's no question. And all they need is the form completed and signed by city staff. So I just wanted to confirm with all of you that your intention at the time was to negdeck it, and then we can have Eric sign it and provide it to them so they can move along with the IDA.
So, Andy, do we need a motion to that or just authorization for negdeck?

Next item is PLPB 2026-0049, 272 Hoosick Street. Are the applicants present or representative?
Hello.
My name is Adam Patella. I'm an architect and one of the design professionals for this project. The pre-store project on Hoosick Street, if you recall, is a redevelopment of the former Rite Aid site on the corner of Burdette and Hoosick Street. We presented last at the June meeting. Excuse me. There we go. At the June meeting, most of the discussion then was about the operations and the nature of the project itself. excuse me, the majority of kind of public comments and comments from you guys circled around preventing site access during close of business hours to prevent people from leaving unwanted items and things like that on site. As such, we responded by providing a retractable gate along the Burdette Street entrance. And after speaking with the fire department, they noted that in the event of an emergency, they would only use the Burdette entrance so uh to close up the hoosick street entrance there'd be a fence would be put across the hoosick street entrance instead of um we had offered retractable bollards and things like that but the fire department did not want those to be installed so we'd be providing a fence over there did you say then you're just going to close it off completely yeah it would be closed off completely um the the amount of traffic is not we don't need two entrances for that There were a number of other items in the staff recommendations that were addressed on the site plan. This included, excuse me, This included adding bike racks. There was a discussion about the detailed nature of deliveries and when those are happening during our previous discussion, so we took care of that. We provided an updated Complete Streets form. I discussed the nature of the Burdette entrance as well. We revised and provided snow storage locations. We also had an extensive discussion about the logistics behind unwanted items being disposed and how there's kind of someone that will always be managing what is dropped off through appointments and things like that. So there won't be unwanted or large items that would not be able to be disposed of other than just kind of a traditional dumpster. So no large couches or anything like that. That was a previous concern. So we discussed that at the previous meeting. We also discussed the gate. There were two items related to the parking lot redevelopment that we sought area variances for. One was providing the required number of shade trees on the site and the other one was related to pedestrian circulation in the form of extending the sidewalk across the Burdette Street entrance. At last month's ZBA, we presented our case and they granted us area variances for I believe it's four shade trees and appropriate kind of landscape islands in the parking lot instead of the required 10 trees. And we're going to be, we got a variance to do striping across the Burdette Street entrance instead of building a new sidewalk there. Both of those were related to kind of just like feasibility questions. There was another note about security cameras. Security cameras are noted on the site plan as well to be installed.
Well, I'm sorry, security cameras, what?
They're noted on the site plan to be installed just kind of as normal operation. The staff comments for tonight's meeting, there didn't seem to be any kind of actionable items on our part. Just notes about the variances that we've previously received. And that's all.

Well, shopping is also an appointment-related kind of thing. So you show up, you sign in, you do your shopping, and then you sign out.

And during, well, when you're closed, you're going to have a gate that goes across the entrance and be locked.
Yeah, the gate would be... locked in such a way that in the event of an emergency would be able to be opened by the fire department. But yeah, it would be closed off. So someone can't just drive a truck in and dump a bunch of stuff, which seemed to be the biggest fear, if that's the right word.
And the entire perimeter is going to be basically fenced when the gates close.
Correct. There's already an existing fence around everywhere.
No pedestrian access, though?
No. Oh, and we're requesting a three-month window to install these different kind of infrastructure pieces, such as the gates and the parking improvements as well, as part of our, as a condition of approval from this case.
Maybe you can just... Yeah, specifically with respect to the gates, we estimate it'll take about three months to get the gates installed. So we would secure it with a chain initially, subject to the obligation to get the gate operational within three months. That was reflected on the site plan that went in last month.
Do I understand also that your dumpster is going to be in the far southeast corner of your parking? Is that where I saw it? And is that also going to be fenced and locked?
Yep. So we've got a note to replace and or restore the existing dumpster corral. So the dumpster corral would have a chain link fence with a lock around it.
Okay. And your security cameras will be? poised on those two so that we can see the whole sidewalks, driveways, parking area?

In May, people leave that great university and tend to get rid of the stuff. So, you know, without us incurring more costs to the city to look at your property, have you looked into this program at all?
No. No.
Might be something they might want to look into if the community police are there or whatever could be called or happen to be going by. They would have the authority to deal with whatever trespassers or you have might be something, you know, you can coordinate it with a community police if you wanted to.

We also would like to suggest an operation and maintenance plan for the site. Like to know, provide 24-7 point of contact. In case anything goes wrong, somebody needs to be called. Are you going to have an alarm system on your building? Will there be an alarm system when the doors or windows or anything?

The distinction is theoretically in the winter, you may be open at night, but the gate would need to be open if you're open. So rather than tying, closing the gate at night, closing it, closing the gate when you are no longer operating. So when you close the gate closes.
Well, would I be able to leave it open if a snowstorm was coming and needed to be plowed?
Well, whoever's controlling your security won't have the ability to open it for the snow plows?
I hope so. I'm still working on that.
We could address that in the operations maintenance plan. Describe how that would happen.
Okay. I think it's the sense of the board that they would like to make sure that it's, if you're not there, the gate should be closed. If somebody is there plowing for you, then obviously that would be understood. Okay.

Just that you'd agree to, if there are any dump goods, a prompt removal of those goods. So, for example, somebody dumps something that you don't feel like it's going to be suitable for whatever you're doing with these products. It wouldn't just lay around.
We would agree to that. People don't come and dump stuff. That's the whole point, is that it's an appointment-based thing. So if something is not approved, it would not be left there.
I mean, I could see somebody throwing a couch over the fence. I mean, if they're going to throw it over that fence, they'll throw it over any fence, wouldn't they? But the implication is that they think they're donating.

Okay. And you also will have to be taking care of some grass, some landscaping. You think you have a bush on the corner or something and you have grass around the around the perimeter on the other side of the sidewalk. So you need somebody that will be taking care of that.

I have a question about the appointment system. Is it done online or by telephone?
I just got a website up and going and I'm going to provide an online portal. I don't know when that'll open up. Until then, it will be by telephone, by phone number that is for the store.
So you'll be able to track, essentially have a log of who's making appointments and you know, I guess it would be a way to help not have the issue of people dumping stuff or being, at least you'll know who's responsible if you're tracking, keeping an appointment tracker, so to speak. Because I think, again, back to their point, people may just dump stuff anyway. So suggestion, I guess, would be once you get that portal up and running, make sure you're able to, or at least try to be able to track who these appointments are. That way, maybe you can look back and see.
The appointments would not be anonymous appointments. There would be a name attached to them. And we're currently using Oasis Insight for that.

I think you've told us this before, but could you just refresh my recollection? What are your days of operation and your anticipated hours of operation?

I don't foresee having to advertise this. Word will get out and we'll probably put it on our website. A phone number will be attached or an email and things are going to evolve because the website's brand new.

I spoke with the surveyor because Eric said he would be able to provide the lines, the water lines and the waste lines. He said as a surveyor, I can only survey what I see. He said that if you will have maps, he'll add it to the survey. But other than that, he doesn't know where those lines are. He did mark on the survey where the water is and where the waste cap is. So I don't know where those maps are. I looked online myself. There is none, utility maps, as far as those lines.
You're not going to develop this second lot yourself? Not at all. You're planning to sell it?
Yes.
So surveyors will often locate and place approximate lines on plans using numerous things such as contacting the city, asking us for what information we have, contacting other utility agencies such as Verizon or Spectrum or National Grid, For existing utilities. For existing utilities. They'll use various manners to approximate the lines. One of the primary ones is reaching out to the city and asking for our information. But of course, they can also look at structures that are visible during the surveys. Almost any line has... cleanouts, valves, manholes, catch basins to help identify, you know, they're usually in a straight line between the two, right?
You would think the city could provide locations for the sewer and the water.
Yeah, but usually the surveyor reaches out and asks us so they can actually place it.
Even so, like the surveyor, a survey is going to have a stamp to it. So putting, you know, that stamp on that paper with the location of those utilities in concert with one another, that would be something that would. I mean, as far as the homework being able to.
So the surveyor. Being able to locate where the I mean. Yeah, I wouldn't put it on a homeowner. I'm just saying, you know what I mean? It's a surveyor's job to contact a city to get a location.
Yeah, the surveyor's going to use multiple layers in order to create a final product. Maybe this one's just not familiar, but...
Troy actually gave me this surveyor. He came from Troy because originally I was going to do an ADU. So he was given to me. I also understand that the zoning was not correct, the zoning regulations. But I did look on the site and the newest one is for 2023. So is that the most recent regulations you want on the survey?
Yeah, I think the original, some of the original paperwork just had information from our old zoning code.

Specifically, the square footage is about 1,000. Right off the top of my head. 1,600 feet. 1,600 square feet.

I'm sorry. The question I think that also needs to be investigated is the survey shows the existing home to be on a septic system. And while the proposed lot number two may be a conforming lot under the zoning code, I think it's still important for the applicant to show if there is not sewer service available to that lot. And there may be sewer service available. We don't know because utilities aren't shown. then it should show a building envelope with a septic system in place to make sure that it remains a conforming lot. Sometimes the size of a septic system and the leach field renders an otherwise conforming lot non-conforming because you can't build the house and the septic. So also another reason why you should seek confirmation on where the sewer lines are and whether or not this proposed lot would be served by sewer.
It would be because when I originally was doing the ADU, they came down and they did say that because that's where I was going to put the ADU on that second line. And they said it is accessible to the sewer system.
Then I guess that's great news because if your surveyor contacts that department, he'll receive the same information.
All right. So I, you know, I, I'm like in the middle with him because, you know, I don't, I've never done this and I'm only saying what he said. He's only does what's on the visible and yeah.
Yeah, so I think that, you know, that would be in your interest to get that updated.
All right, so you're telling me I need to tell Mr. Haley to contact the city?
You know, Mr. Brick's point is that, let's say it was not accessible by city water and sewer, and you did have to have a septic, but your soils are no good anywhere on the 20,000 square foot lot. That would turn into a non-conforming line.

So we need to, you know, we need to make sure that we see that and it goes into the file with Eric. And then the next meeting when Eric says, oh, yeah, we've got that.

No, soil wouldn't factor.
So it's not something you have to worry about for the subdivision. But you do have to worry. And again, this all depends upon whether or not there's sewer access. And you indicated that there may be. So this is a non-issue. But because your property is showing as being on septic, If the second lot has to be on septic, then the soils have to be conducive to allowing a septic system and be approved by the county department of health.

But that would be subsequent to the subdivision.

And there would have to be enough room for both the house and the septic system. Is your current septic system all on what will remain as your lot?
Yes, it's north of my house. So the second lot is on the other side of the house.

Good evening, Chair and members of the Board. My name is Rob Goldman. I'm Chief Operating Officer for New York State Marine Highway Transportation Company. Thank you for the opportunity to present this application, 75 Water Plant Road. By way of background, New York State Marine Highway Transportation is a Troy-based marine transportation company founded in 2004. Our business offices are located at 427 River Street. Our maintenance yard and dispatch operations are at 391 2nd Avenue. The proposed facility at 75 Water Plant would be supplemental, not replace these locations, and it would be used to provide warehouse space for our marine equipment, parts, and supplies, along with limited secure crew parking. Projects is a low-impact use of an existing building and developed site. No building expansion, major exterior alteration, or significant site development is proposed. Existing footprint and circulation pattern remain unchanged. Pro's warehouse use is compatible with the immediate area, except for the residents across the street. Properties along Water Plant Road are commercial and municipal. We realize that a use variance is required. The ZBA review is scheduled for September 2nd. Next meeting. No new parking spaces are said grading or proposed. The building will be used primarily for storage and not regularly occupied employees. Any limited secure crew parking will be used to use the existing developed areas. On my site plan, I showed a security gate, but we have not yet finalized location design. We've only actually been to the site a couple of times. We do not own the site yet. Both signage would replace the existing Shriner sign with the New York State Marine Highway sign, subject to required permits and approvals. That is detailed on the site plan. No new lighting or landscape is proposed, and no bulk liquid storage is proposed also. In summary, the project will reactivate an existing building and property without expanding the developed footprint. It supports an established Detroit business while avoiding impacts of new construction. We respectfully ask the board to advance the site plan application subject to required use variance. I certainly am not against this project, and I don't want to stand in the way of anybody running the business, but we all know how these things take a life of their own on the exterior. I already heard him say tonight that not at this time when he's talking about Connex trailer storage outside. We're talking about a forklift now. I don't believe there's a garage door on the building, is there? So you're gonna drive a forklift through a doorway? Okay. So I'm more – this is a gateway to the city as far as I'm concerned. It's an entrance point at the furthest north end and probably has one of the nicest views. I think I'm the only guy in Troy that builds houses in North Troy, and I still try to want to see North Troy survive. I think there's a lot of missing details on the exterior of what their intentions are to use the exterior for. The next thing you know, a Connex trailer shows up. Then another one shows up. Then we're putting a roof over the two of them and storing stuff inside. We're stacking stuff on top of things. I think there needs to be a lot more detail about what's going to happen outside this place and how we're going to handle everything outside. We're already talking about two trailers that they mentioned nothing in the report on that. The exterior, all they're going to do is take one sign down and put a gate up and add an EV charging station. I just, coming down, there's already a guy across the street from here that's running a masonry business out of it. It's a mess. It is an industrial spot, but there are residences across the street. I just want to see more feet to the fire on what's going to happen exterior. And if there's going to be things like that, there should be screening. There should be a lot, a lot of things. Yeah, I mean, I think addressing the. Spill prevention plan is appropriate. Weather, you know, quite frankly, I don't know the level of. Documentation or what needs to be done to address something when. Your site is upstream of a water treatment plant. believe they're directly upstream of the lagoons where I think DPU uses that. That's like the discharge of when they're treating the water. But it's monitored by DEC and all that because it's a discharge. So that should at least be addressed through a spill prevention report, which maybe is something that could be pretty simple, honestly, if it's limited to that amount of equipment. All right. could be points of contact and who to call if there is a spill and having absorbent or cleanup materials on site or something of that nature. But I'd like to at least see it addressed or responded to.

The existing parking lot will remain in service with no expansion proposed. New York NYS Marine will continue routine maintenance of the property and re-stripe faded parking spaces and complete localized repairs where pavement deterioration affects safe site circulation. Full construction of the parking lot in the area is not proposed as part of this proposal.
