Adoption of Minutes of the March 3, 2026 Special Meeting - Closed Session, March 3, 2026 Special Meeting, and March 11, 2026 Special Meeting.
ORDER OF BUSINESS•Item 1.B.
Staff recommends that the City Council adopt a Resolution (1) accepting an allocation of Fiscal Year 2025-2026 funds in the amount of $62,546 from the California Low Carbon Transit Operation Program; (2) authorizing the City Manager, or designee, to execute requisite funding documents, certifications, and assurances; and (3) appropriating all $62,546 to the Transit Fund for free student fares.

Staff recommends that the City Council adopt a Resolution establishing a vendor list for the Public Works Department Operations and Utilities Divisions for an annual not-to-exceed amount of up to $300,000 per vendor for a term of five (5) years per City of Tracy Ordinance 1380 Section 2.20.140(3)(b)(3).

Staff recommends that the City Council adopt an Ordinance approving an amendment to Chapter 10.08, Article 7 - Low Density Residential, and adding Chapter 10.10, Article 10 - Housing Element-Opportunity Site Development, Chapter 10.10, Article 11 - Cluster Development, Chapter 10.10, Article 12 - Tiny Homes, and Chapter 10.10, Article 13 - Manufactured Homes of Title 10, Planning and Zoning, of the Tracy Municipal Code (project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3)).

Staff recommends that the City Council adopt an Ordinance approving an amendment to Chapter 10.08.3470 – Off-Street Parking Requirements - Exceptions* and adding Chapter 10.10 Article 14 - Affordable Housing Water and Wastewater Service of Title 10, Planning and Zoning, of the Tracy Municipal Code (Exempt From The California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061 (8)(3)).

Staff recommends that the City Council adopt an Ordinance 1) determining that the project is categorically exempt from the California Environmental Quality Act, Pursuant to CEQA Guidelines Section 15378 and/or 15061(b)(3), and 2) amending Section 4.04.040 of the Tracy Municipal Code, Relating to Card Rooms.
ORDER OF BUSINESS•Item 1.G.
Staff recommends that the City Council adopt a Resolution approving Amendment No. 1 to the Professional Services Agreement with Gilbane Building Company for continued construction management services associated with the extended construction duration of the Tracy Recreation Activity Center (CIP 78178), increasing the not-to-exceed amount by $1,640,504.80 for a total not-to-exceed amount of $5,074,404.80.

The Tracy Finance Committee recommends that the City Council adopt a Resolution 1) amending the City's Operating and Capital Budget for the Fiscal Year (FY) ending June 30, 2026, to reflect actual expenses, revenues, and requested augmentations to fund various departmental needs; and 2) Authorizing the Budget Officer to amend the City's Position Control Roster for FY2025-26.

Staff recommends that the City Council adopt a Resolution authorizing the execution of an Irrevocable Right of Entry and Permission to Conduct Investigation and Begin Work Agreement between the City of Tracy and ARP Minimart Corporation for the Interstate 580/Patterson Pass Road/International Parkway Diverging Diamond Interchange, Capital Improvement Project 73147.

Staff recommends that the City Council adopt a Resolution (1) accepting public improvements as complete for North East Industrial Specific Plan (NEI) Phase 3 Big Bird Street Improvements for Grant Line Road, Chrisman Road, Paradise Road, and Skylark Way constructed by Prologis, L.P., a Delaware Limited Partnership, (2) authorizing the City Engineer to release bonds in accordance with the Offsite Improvement Agreement and Tracy Municipal Code Section 12.36.080, and (3) authorizing the City Clerk to file the Notice of Completion with the San Joaquin County Recorder's Office.

Staff recommends that the City Council adopt a Resolution approving and accepting the dedication of Parcel N of Tract 4084 from Tracy Hills Phase 1 Community Association and authorizing a Public Landscaping Maintenance Agreement for Tracy Hills Phase 1B.

Staff recommends that the City Council adopt a Resolution (1) accepting improvements for Tracy Hills – Phase 2 Choke Points as complete, (2) authorizing the City Engineer to release the Developer furnished bonds in accordance with the Offsite Improvement Agreement and Tracy Municipal Code, (3) authorizing the City Clerk to file Notice of Completion with the San Joaquin County Recorder’s Office, and (4) authorizing the City to release the Maximum Reimbursement, less authorized City Construction Expenses, to the Developer.

Staff recommends that the City Council adopt a Resolution (1) accepting the public improvements for Tracy Hills 2nd Neighborhood Park of Phase 2, constructed by Lennar Homes of California, LLC, and assuming all future operations and maintenance, (2) authorizing the City Clerk to file the Notice of Completion for Tracy Hills 2nd Neighborhood Park of Phase 2 with the San Joaquin County Recorder’s Office, and (3) authorizing the City Engineer to release the improvement security in accordance with the terms of the Conditional Subdivision Improvement Agreement.

Waive the first reading by substitution of title and introduce an ordinance to amend Chapter 4.24 - Licensing and Regulation of Nonprofit Organizations for the Operation of Bingo Games, of the Tracy Municipal Code.

Staff recommends that Tracy City Council introduce and waive the first reading, by substitution of title, an ordinance amending and updating Tracy Municipal Code Chapter 11.04 – Water Rates and Regulations, Article 2, and retitling the ordinance as “Backflow and Cross-Connection Prevention.”

Staff recommends that the City Council conduct a public hearing and, following such hearing, waive the first reading by substitution of title and introduce an Ordinance Amending Title 2 – Administration of the Tracy Municipal Code to Add the Following Sections Under Chapter 2.01 – Elections of the Tracy Municipal Code: 2.01.000 – General Municipal Election Date, 2.01.050 – Campaign Contribution Limits, and 2.01.060 – Filing Fee for Processing Nomination Papers.

Staff recommends that the City Council adopt a Resolution to approve the Tracy Arts Commission’s recommendations for the final designs of the Civic Art Pieces at the Tracy Recreation Activity Center and El Pescadero Park CIP 78178.
ORDER OF BUSINESS•Item 4.B.
With respect to the proposed refinancing of an outstanding installment payment obligation of the City of Tracy and related 2004 certificates of participation (2004 wastewater plant treatment plant upgrade) staff recommends that the City Council adopt a Resolution approving the issuance and sale of wastewater revenue refunding bonds, authorizing the execution and delivery of an installment sale agreement, and approving related documents and official actions.

The Tracy Finance Committee recommends that the Tracy City Council receive an update on the Measure V revenue projections, current spending plan, and current fiscal year interest allocation, and provide direction to staff regarding priorities.
