Agendas are available on the rails, so please help yourself. We will take the items as they are listed on the agenda. Request by Mike Thackers for a conditional use permit at 1021 East Broad for the purpose of operating a record service. Property is legally described as all of Block 1 of K211 Subdivision, Section 20, Township 15, Range 28, Miller County, Arkansas, containing 1.5 acres, more or less, Ward 3.
Okay. So this property, this property, this is broad. Jefferson Dog Park is right here. Arkansas High is back here. Tri-State has their land over here. So the property is actually accessible off 12th Street back here. Now, this is a unique situation because our city ordinance says that you can't have a record service within 500 feet of a residential district because of the type of vermin and rodents it attracts. So this property does back up to residential, however, that residential is not actually residential. It's the dog park, it's Arkansas High, and it is, there's a swept coast substation over here. The only residence over there is right here, and it's actually in a commercial zone. And I'll show you that in a minute. The property is actually zone C3 right now, which is why they need a conditional use permit for it. There's water and electric there. This is the property. This is the property across 12th Street. This is the only residence right down there, and then that's Broad Street down there. This is the property going the other way on 12th Street. This right here is Nix Creek. So it's separated from the dog park in Arkansas High by Nix Creek. That's the dog park and that's Arkansas High way off in the distance. To make it even less desirable for residential, all of that area is in a floodplain. So it's probably never going to be developed residential. This is the 500 feet circle around this property. As you can see, there is no residential anywhere in what is zoned residential. The only residential is this one right here in commercial. This is Sterling Crest Apartments, which right now are mostly vacant, I think. They had some flooding. Now, in the comprehensive plan, none of that within 500 feet is zoned residential. It's zoned civic. It's zoned recreational. It's zoned multi-use highway. This right here, for reasons I don't know, is zoned neighborhood node, which is residential, but this is the property tri-state owns. So it's probably never going to be developed residential. So that's the situation with this property. Mr. Thatcher is here. We sent out notices to everybody. We got no opposition to it. Okay.

My name is Mike Thacker. I live at 5307 Boykin Lane, out of town a little bit. But we had inquired this land and tried to fix up everything around there. Then when I went to rent it out, I found out I couldn't. So that's why I'm here tonight, to talk to y'all and see what we can try to do to get this rezoned or whatever we got to do to get this to where we can use it. new to me so i'm pretty much here to i went through a few things on zoning on texas side but this first time on arkansas and just make sure that we're not resigning so with the conditional use permit with it being a business would there need to be a fence a solid fence well
They actually have stricter laws to put in a tow yard. They have to put a
privacy fence all the way around the whole place to even open it.
I'll let the tow guy explain that if y'all don't mind. Glenn Roberts, 1415 Cleveland Street. I'm the one planning on opening this, but yes, on the fence, I will have to fence off where the office is that's already fenced off. From what I read, if it's a city, I have to put up a seven-foot privacy fence around that area. Wherever the damaged vehicle is going to be sitting at, it's going to have to be enclosed from city view. Because we weren't rich, fatalities and all that, they didn't want people looking in. Plus, it looks like a salvage yard if you don't. So I will have to fence all that in per city code.
Will your access be from 67 and won't be from 12, will it?

Right now, I've got four. I've got two medium-duty rollbacks, a winch truck with a wheel lift, and I just bought a heavy. So I'll have four total. Sounds like good use of the property, doesn't it?
