and welcome to this first meeting of the new year of the Syracuse Planning Commission. We have a very full agenda and uh after we take care of our minutes, we'll get to both items. Minutes from the last meeting of 2025 have been distributed distributed in advance of tonight's meeting. That was our meeting on December 15th. Uh second. And I don't have any additions or corrections, but I do have just sort of a clarifying question about how we want to deal with it in terms of our agenda for tonight or in in the minutes. But uh you know for the uh the application regarding the uh R-25-59 uh for the reubdivision of the uh uh parking uh the shopping center at Shop City. uh that was we approved that as a a 30-day conditional approval contingent upon them uh completing the easement. It's is my understanding that in fact the easement came in the next day unfortunately. So I'm not sure how we want to take care of noticing that in the record if we want to make an adjustment in the minutes or if we want to deal with it as old business tonight. So, you guys told them to do an easement or they they were

we approved it with a 30-day condition that the easement had to be completed within 30 days because it was the assumption that the easement was on its way. But but the easement's completed now. It arrived the next day in the mail, I guess. Okay. Yeah, it it actually came in that evening, but we weren't aware of that till the next day. But shocking how we brought it up and then it got received that quickly. But be nice if everything happened that way. Yeah. Yeah. So, yeah. So, there's no issue. The condition satisfied. Any extensions? The minutes of our last 2025 meeting are approved. We move into new business. Uh I feel funny saying this but um by way of process uh for those who might be unfamiliar with our process as each application is announced by a member of the staff we ask that the applicant or the representative come forward to the podium in the center of the room provide their name and address for the record and then a brief summary of the application involved. Following questions from the commission members, um we will offer an opportunity for the public to speak in favor of the application and likewise an opportunity to speak in opposition to the application. Where comments are offered in opposition, the uh applicant will be uh encouraged to return to the podium to address the comments made in opposition. So those are our uh rules of procedure, if you will. So, with that, I think we're ready for our first item of new business.

Good evening, commission members. My name is Heather Lamadola. I'm with Barkley Damon at 125 East Jefferson Street here in Syracuse, New York. And with me this evening is the owner of the property, Mr. Gary Shire, who requests this reubdivision tonight to divide his property into two new lots. As far as we know, and with research that the city zoning office has conducted, this property has always existed in its current configuration with two residential structures on the lot. They were built in the late 1890s prior to zoning regulations coming into effect. Um so Mr. Shy and his family have owned this since uh the 1970s and now um they wish to sell one of the residential structures which is necessitating the need to divide it into two lots so that each structure sits on its own individual lot. Uh we worked with the city zoning office with respect to lot size, frontage and setbacks, which is why you see the irregular shape as well as elements that were in the right of way. And all of that feedback was incorporated into the resubdivision map shown and prepared by land surveyors. Thank you. Are there questions from the commission members regarding the application?

Seems pretty straightforward what we're trying to do here. We have some nonconformities that can't be gotten rid of, but because we have continued residency, that's not a problem. We have some other non-conformities that we are getting rid of. Driveway problem, the fence problem. That seems all all good. Uh, I just have one question. A concern regarding a comment from finance about unpaid taxes from January and April of 2025. Okay, good. That was my question because normally we don't do anything with taxes, but so Okay, great. Yes, sir. on the environmental form. It mentioned that the site is um mentioned the presence of a bald eagle and it's such a small site. Is there an active nest on the site or did one fly over once upon a time? Perhaps when you fill out the form using the EAF mapper, it automatically fills that in. So it's it's some of the answers are unknown. When it automatically says yes, you don't really know what they're saying yes to. So that was and you can't change the answer. So I'm not sure about the eagle. It just caught it caught my eye.

Those being one, the applicant shall successfully file the uh resubmission map of R-25-62 in the Onai County Clerk's Office within 62 days of uh reubdivision approval to the two asphalt driveways in front of properties shall be removed as shown on the submitted reubdivision map to prevent illegal frontage uh fronting front setback parking. And three, the existing encroaching fence on Essie Street from 922 Willis Avenue must be removed. Is there a second? Second.
