City Council - Regular Meeting

Good afternoon. Welcome to the July 7th, 2026 special meeting of the Storage City Council. This time I'll call the meeting to order and I'll ask that you all stand and join us in the Pledge of Allegiance. I pledge allegiance to the flag of the United States of America. All right, councillors. Item 3 is the consent docket. Questions, comments, or action on consent? I move approval of consent.

We have a motion and a second to approve the consent docket. Please vote. We vote a 5-0 that consent docket is approved. Takes us down to item 6, resolution 6A, resolution number CC-2026-13 with a companion resolution on the SUA agenda. This is a resolution amending the City of Stillwater terms and conditions of service by amending section 1, general information. Chapter 1, terms and conditions of service. Section 1.1.1, purpose and terms of conditions, purpose of terms and conditions, adding 1.1.5, customer rates, charges, and fees. Amending Section 2, Policy Manual for Utility Accounts, Billing and Collections. Chapter 1, Contract for Utility Services and Deposits. Section 2.1.16, Lost Checks. Amending Section 2, Policy Manual for Utility Accounts, Billing and Collections. Chapter 2, Billing and Billing Adjustments. section 2.2.12 analysis of applicable electric rate amending section 2 policy manual for utility accounts billing and collections chapter 6 advanced metering infrastructure opt-out section 2.6.2 rates and charges amending section 4 utility deposits chapter 1 section 4.1.1 Deposit schedules section 4.1.2 residential deposit schedule section 4.1.3 commercial deposit and non-residential schedule section 4.1.4 hydrant meters and adding section 6 outage management system.

So the primary changes are removing the fee amounts from the terms and conditions documents so that they can be established in a book of fees and establishing a new section for the new outage management system project. The new outage management system will enable SMS messages to utility customers for billing notifications, service alerts, utility outages, restoration updates, and other account-related information. Customers would be auto-enrolled in the program but have the choice to opt out. implementation of the outage management system is still approximately I believe six weeks away and so this is just the first step is adopting the policy and I know that staff is currently working with communications for messaging ahead of these changes excellent counselors questions about the resolution

So you mentioned that communications is working on announcements ahead of this. I assume that's going to include the whole, hey, you're going to be auto-enrolled in SMS. Yes. If you get a text from us, you can opt out, all that kind of stuff. All right. Councilors, further questions, comments, or action on the resolution?

We have a motion and a second to adopt the resolution. Please vote. With a vote of 5-0, resolution CC-2026-13 is adopted. Item B is resolution CC-2026-15, again with the sister resolution on SUA, a resolution establishing the City of Stillwater book of fees, adopting changes to utility billing and services fees and charges, and approving the annual fee for short-term rental licenses.

So this resolution would establish a City of Stillwater book of fees. Staff has worked diligently to compile one comprehensive fee schedule for all departments. Having one comprehensive document will allow staff to conduct annual reviews in conjunction with fiscal year budget to ensure that the fees are reasonable and appropriate. This project has been challenging, but progress is being made. So as a starting point, staff proposes that any changes to existing fees or adoption of new fees will move to the book of fees at that time. As you'll notice, the book of fees currently will only have utility and billing services fees and charges and the new proposed STR annual license fee. The resolution also specifically reserves that any and all existing rates, charges, and fees will remain in full force and effect until they are adopted into this book of fees by further resolution.

A resolution declaring the necessity for acquiring certain real property, more particularly here and after described, all within Noble County, state of Oklahoma, for the purpose of establishing, constructing, maintaining, and operating the Lake McMurtry Raw Water Transmission Main.

The city has retained outside council to assist with land acquisitions that are necessary for public water projects that are funded through the OWRB FAP loan. Council has recommended moving forward with resolutions of necessity for the two parcels identified in each of the exhibits. Both of these next two resolutions going to have the same summary introduction. These parcels are for the Lake McMurtry raw water transmission main And it's necessary to take this step Because negotiations with the property owners have not been successful. So as such I recommend approval of the proposed resolution Counselors questions or comments Mr. Moore work We're

strongly convinced that this is the route we've got to take these are the parcels we need this is the only way we can get that waterline built absolutely we we've had uh our engineering long time engineering firm uh working on this project for many years as we've discussed publicly here in study sessions and at city council the route has uh well i will say in the negotiations we the staff and the engineering teams have met with landowners and have made many adjustments to the route. And we've received some easements. We've had others agree with the, or we've agreed to their counter offers. But as we've retained this council that specializes in easement acquisitions, they have recommended on a few of these that the city has gone above and beyond. And it's now time to proceed with.

Yeah, I should note, by the time we get to this resolution, much work has already been done, staff has made and will continue to make diligent efforts to acquire the property through good faith negotiations, and will resort to condemnation as a last resort when a mutually agreeable settlement can't be reached in a timely manner.

If it does proceed to condemnation, there's still fair market value is paid to landowners? I'm sorry the question the fair market value is still paid to landowners.

That's just determined by a court Yes, there's a that will follow the condemnation procedures that are set forth in statute. This resolution is the first step before filing a petition in district court then there will be a hearing to appoint commissioners the commissioners will um follow a process by where they issue an award or a report and either they can agree with what the appraised or last final best offer the city is or they can determine a different value and then there's a period in which the landowner can object um after that counselors very brief summary of how it goes any further questions or comments counselors is there a motion on the resolution

On second read, we have ordinance 3611, an ordinance rezoning 702 South Adams Street from small lot single family residential to public zoning district. Councilors?

Item B is ordinance 3612, an ordinance rezoning approximately 20.02 acres, addressed to 6603, 6711 West 6th Avenue, and the north portion of 603 South Range West Road from Commercial General to two-family and multi-family.

Item C is Ordinance 3613, an ordinance amending the Stillwater City Code Chapter 12, Businesses, Article 2, Food Service Operators, Section 12-20, definitions by removing the definition for mobile food service establishment. Amending Section 12-22, exemption of requirement by removing references to mobile food service establishments. Amending Chapter 12, Businesses, Article 4, Itinerant Merchants and Peddlers, Division 1, generally, Section 12-117, definitions by removing mobile food establishments from the definition of itinerant merchant. Amending Section 12-140, application by removing requirements for mobile food service establishments, repealing all ordinances to the contrary, and providing perseverability. Counselors.

So refresh my memory on this one. This ties back. This makes us congruent with the state law, right?

Yes. In particular, this ordinance is removing it from how we currently regulate under our general food operations. And then the next ordinance, 3614, adopts the new provisions that are in line with state law, the Food Truck Freedom Act. OK.

Yes. I just want to take a quick moment to sincerely thank our city staff for an incredible weekend of service to our community, from kicking off America's 250th celebration with Cinema 34 at Block 34, and to the birthday bash the next evening, and then delivering another outstanding boomer blast, which we luckily put on Thursday. Friday, our teams worked tirelessly to create all these experiences for our community and residents and visitors. And I know many of them are actually in the room that also responded to the storms that blew through on the 4th the next day with the power outages. We're just so grateful for our Stillwater Electric utility and their responsiveness and the way that they get power back on so quick. It's truly a blessing to our community. So thank you for all the work you do. And yeah, just again, it couldn't be without the efforts of our employees and their sacrifices and services and working those holidays that make it a better place for our community.

Counselor Clark. The Waste Management and Public Works departments have multiple options available to help residents dispose of storm-related yard debris from the June 26 and July 4 wind events. Regular curbside yard waste collection will continue with additional flexibility on bag limits during July. Residential customers may also use the convenience collection center, but remember no trailers are allowed. A special storm debris collection for those in areas hit the hardest north of McElroy Road will begin July 7th.
