Thus, what is presented to us today includes all the amendments that we have brought. I would like to start by thanking the councillor for presenting this text and for all the context she shared concerning the evolution of this bill over the past few weeks. I would like to say that when I first intervened on this bill, the first thing I expressed was my agreement on the importance of implementing these regulations to ensure that we have strict rules for data centers here in the city of Saint-Louis. I know that the last time we talked about it, I also proposed two amendments that the Deputy Mayor described and shared, and I am grateful to my colleagues for having adopted them by this instance and for having transmitted them to the Urbanism Commission for examination. For me, the most important thing was that these amendments raised questions that, in my opinion, still presented gaps concerning this bill, and this allowed the Urbanism Commission to examine these points and to give its opinion. I think it's the responsibility of this office and I recognize that the legislative body has done it. I also had the privilege of attending the meeting of the Urbanism Commission and listening to the Mayor's Adjoint and the members of the committee on these same amendments. Although as an elected official, I could not fully express myself, I expressed myself as a citizen and I had two minutes to share my reflections on these amendments and the reasons for which I proposed them. I know that two minutes is not enough to explain something as complex as what these amendments do. Before talking about the first amendment proposed by the Mayor's Adjoint, I wanted to add a few points that I wanted to share with the people present on this day. I believe that two realities can coexist simultaneously. The first is that our environment is undeniably in danger as we see technology progress over the years. We know that some improvements will have to be made to protect our environment and it is important to ask ourselves about the social cost and the cost for the public good of these technological advances. I also think there is a second point. It is that if we continue to adopt technology and its innovations, while implanting them in areas and communities that are already neglected and vulnerable, what do we do to help strengthen these communities in the face of this cost? By listening to the debates in our city, one thing has become very clear. We have not taken these two aspects into account simultaneously, as they should have been. One of my amendments, the one we are discussing today, aims to address this second crucial point, namely what happens to the communities where the authorized data centers will be installed, especially knowing that many of these communities have already undergone investments year after year. When we talk about density and concentration, it is important to know that by regulating data centers in a given area, we actually create density. It is therefore important for us to think about the tools that we will give to these communities so that they can move forward. When I talk about HIL districts, of which a third of my neighborhood is made up, let's say I'm not talking about only dense areas that people imagine with skyscrapers, towers and stadiums. That's what people normally think when they think about density. I'm talking about small areas, restricted spaces, factories on the river's edge, where there may be only one factory standing in the middle of the other and which has not received any investment for a very long time. I'm talking about dense areas in the corridors and in our city centre, not the ones where people feel comfortable walking, but the ones where they are not, but the ones where they are not. The streets, the corners and the places where you may not want to turn left because you don't know what's going on. Two things can be true at the same time. I would like to thank the Prime Minister's councillor, because since this meeting of the Urbanism Commission, I know that we have had many conversations on this specific question. She understood why I raised this question and why I wanted to present this amendment. The problem for me with this amendment is never the objective that it was aimed at, but the process that we have chosen and the state of mind that we have adopted to address it. What I ask my colleagues today is to reject the amendment so that we can examine a second amendment on which I have worked closely in collaboration with the Mayor's Office and the staff of the Urbanism Commission. I think that this amendment meets the concerns raised during the meeting of the Urbanism Commission, while addressing the points that I wanted to raise by proposing this amendment. When we talk about the density of data centers and their location, we must give these communities, where they will remain, the necessary tools to bring the improvements that they need. I therefore ask my colleagues today to vote against Amendment 1 so that we can present Amendment 2. And I hope you will all consider supporting Amendment 2, which seems to me to be an equitable compromise in responding to these concerns, while offering these communities the chance they deserve. Thank you, Madam President, members of the Council. I simply wanted to try to speak to the microphone for each amendment to express what concerns me and explain the process a little. First of all, I would like to thank the Councilor of the First Arrondissement for her work on the bill as well as the Councilor of the Eighth for our many exchanges. I think that both versions of these amendments bear witness to ongoing discussions and that some of my most serious concerns have been eased. But first of all, I would like to explain to the people who are watching us or who are present in the courtroom that regarding all the amendments in front of us, I have received letters from us. I have received letters asking, please, do not vote for them. So I would like to clarify the legislative process. If we do not vote for any of these amendments today, this means that the amendments voted previously will remain in the bill. Thank you. I had the chance to attend the meeting of the Commission on Urbanism a few weeks ago and to hear the debate around these different amendments and I think it is useful to underline that the Commission unanimously rejected the amendment of the Municipal Council which softened its density requirements. And I also find it very interesting that last week, there was an article in the Post-Dispatch explaining that the shops in the city center, those on the ground floor, the animation we're talking about, are in trouble because they no longer have the influx of employees, of offices from before. That's not what's on the ground floor that counts. That's what's in the towers above. And there's no one in the towers, and that's what prevents these shops from surviving. I understand the concern about dark streets where people don't want to venture, but if you walked on Olive, it's a dark street, lifeless, because there is no animation on the ground floor. There is a windowless building that occupies half of the patio. And right next to the street, there is another data center, of which all windows are condemned. No entry or exit activity. The residents say they don't see anyone getting out of the day. That's where my concern is, we're not creating any more holidays, because a data center is above all a human void. Few people work in these facilities. Few people go out for lunch. They won't cross the street to eat at Chrysat de Dauquette. Or go down the street to go to Ucraft. They won't go shopping in the neighborhood because they don't work there. Few people actually work there. They are buildings full of machines for the most part. And I recognize, of course, the economic interest. I recognize that there is an important tax revenue to be drawn from these projects and I think that if a data center can complete the development, it can be done in a way to attract people to the building, while allowing to cover the real costs of rehabilitation necessary to fill these buildings again. But the reason why I oppose to the softening of these demands and to the implementation of measures that focus only on the activation of the sidewalk is that I fear that this is not enough. When I walk in the city center today, I see no one around. Unless there is a match of the Blues or the Cardinals, the sidewalks are crowded during these brief moments. People go to the stadiums, but the rest of the city center is sadly empty. This is what the Post-Dispatch article highlighted this week. We have a holiday rate of 30% in the city center, higher than the national average, and we have a hard time converting these buildings to . I also note that we have made great progress recently. Missouri legislature has adopted incisive measures that could help to convert some of these large office towers into housing. That's where my concern lies. That's why I would really prefer to stick to the recommendation of the Urbanism Commission. They devoted much more time to this subject than we did here at the Council. They are the experts. They are the ones who sought to understand this issue. The Urbanism staff went to study different cities. They examined the data centers that currently exist in our city. They analyzed the impact of the latter on their immediate environment and sought to find a fair environment. They published a note with this project of law when they sent it. And the note specifically said, it is not a ban, it is not an intentional ban, because we recognize the need for economic returns that it could bring. We recognize that it is an industry that could represent the future. We must find a balance with the needs of our fellow citizens. And when I think about data centers and people, they are two very different things. Because data centers do not attract people, they bring an activity of a different kind that does not really benefit the surrounding community. And so that's where I think the regulations as written and as initially sent by the urbanism committee and as recently sent with a unanimous rejection of any change to these density requirements. I think we should hold on to it because these are the regulations designed to make people go first.
Any other discussion on the amendment? Thank you, Madam President and members of the Council. I would like to bring a little more context here. One of the reasons why I support Amendment 1, the recommendation of the Urbanism Commission on Density, and why I believe that the Urbanism Commission has also supported it, are the months of research that we have devoted to this bill and the different opinions that we have received. Some opinions come from users of already existing data centers. In these districts, they currently operate data centers that make, you know, 10 megawatts or less at the moment. To put things in perspective, about 1 megawatt of electricity corresponds to the consumption of 700 homes. So a lot of electricity. If you imagine that, 17,000 homes correspond to a data center in the city center. And all these data centers told us that they were planning to develop that it plans to attract more customers, more businesses. It plans to use more electricity. We should therefore see the data centers of the city center already existing, increase the number of generators on their roofs, the number of emissions, finally the amount of emissions they produce on site, the amount of emissions they are responsible for the energy that is provided to them, you know, mainly natural gas at this stage, with perhaps 10% renewable energy, but above all gas. And so we will see all these data centers develop. I think that what the bill also tries to predict, if we adopt this amendment, it is a really reasonable growth outside the current perimeter and which allows, you know, all the other things that we want to see in the city centre to exist. We had a very lively discussion and I personally intervened at the microphone to say, hey, I have the feeling that five years is too long. I have other concerns about some of the other processes. So we went to the meeting of the Planning Commission to have this discussion. The Schweizer horses and the Oldenburg horses also had a lot of exchanges, just to try to find the right environment and determine what we can do. I'll be honest, as far as I'm concerned, I'm not a fan of the derogation process. I find it very interesting, as I said, at the Urbanism Commission, that when the public council, the council at the level of the state, votes to increase the rates of Amren, the residents do not get a derogation. When their electricity rates increase, they end up with late fees, penalties, and then cuts, and then cuts. So I'm perplexed about this, but I just want to explain to the public that the reflection behind this is that in terms of renewable energy, it can be available or not. And so, several parties, including colleagues, say, you know, we should give a derogation since renewable energy could not be available. Once again, I think that if you observe this process, as I said, I had questions on this subject. I feel uncomfortable with the derogations. However, this amendment that has been submitted to us, I think it is really important because if it remains for five years, one of my concerns is that the renewable energy market is changing enormously. And so if you give a derogation and you say only we will talk about it in five years, there could have been changes. Energy could have become available and you could not act. I would also highlight that one of the points put forward by the Urbanism Commission is that, according to the previous formulation of the amendment, if you say we want to do 50 megawatts and Camarines-Cody, there is 40 megawatts of renewable energy available. As the amendment was written, you could have obtained a derogation on the totality of the 50 megawatts because it was not specified. And so the text that is presented to us also specifies that the derogation could only be granted for, you know, for the necessary energy. So I want to make sure as much as possible to explain some of the differences between the previous text and this one. I really think it's much, much better. Better? I think it's a much better compromise. I think it addresses in its own way all the concerns Of course, I understand that for many, this was one of the most controversial points of the bill, but I think that the text in front of us is probably as fair as possible, given all the existing concerns. And again, I feel really relieved about specifically the two-year term, because five years is longer than an automatic mandate, longer than a mayor's mandate, a senator's or a deputy's. First of all, I would like to take the floor to support this amendment and I appreciate the work that the First Lady and the Secondary Councilor have done to lead to this text of compromise. We know that when the text left the Assembly, there was a form of exemption that would allow up to five years. But if I'm not mistaken, they are not necessarily directly located in the region of Saint-Louis. These are non-grouped Rx or renewable energy credits that are simply not local. So I would say that in terms of this amendment, the derogation does not put an end to renewable energy credits. What it stops if the data center, say Amarin, does not have the capacity to produce its Rx is that for two years, they will always have to produce it. But it will be non-grouped Rx. And I really want to be clear on the subject. These are non-grouped Rx. Non-grouped. It is therefore always renewable energy credits, but they do not come from the local level. There is therefore always good clean credits that they will have to respect. It's just that if they get the derogation, they will be non-grouped. I also want to point out that regardless of the derogation, whether it is 2, 4 or 6 years after 10 years, whatever happens with this bill, they will all have to reach 100% renewable energy. So I think there is a very good intention in terms of renewable energy in this legislation. I know that the councilor of the 2nd arrondissement, to whom I supported the amendment, tried with the initial formulation to find a solution. If Amren cannot produce its credits, how not to penalize individuals? And I think that the text between the councilor of the 1st and the 2nd arrondissement improves the situation, avoiding a too long calendar where they should constantly come back in front of the BPS. But I'm going to be very clear, it doesn't matter if a derogation is granted, it is always a non-grouped credit, that is to say a renewable energy credit that they must provide, whatever happens. And after 10 years, all data centers will have to reach the threshold of 100% renewable energy credit. So I ask my colleagues to support this amendment. This resolution was brought to the attention of Saint-Louis public schools and we ask that they suspend the closure of these schools until we develop a plan referring to the municipal plan which required two years of work. Thus, we are again asking the public schools of Saint-Louis de Sursoir to close their establishments as long as they do not have a comparable plan to use these buildings, which would lead to an increased decline in our community. Madam President, members of the Council, I just wanted to take the floor to mention some points already mentioned by Councilor Boyd. We had a solid hearing in the Commission where members of the SLPS came to speak. I know that I often mention the fact that I am a member of the Council of Education, so I am very attached to the public schools of Saint-Louis. And I think that this resolution contains elements that, in a way, have already been implemented. The Future Forward plan and that of the SLPS has actively modified the list of schools that had to close. They have pushed back their calendar and have globally recognized some of the points asked in this resolution, namely that it is necessary to have more conversations, dialogue and engagement with the community. This is why I wanted to bring my support and I also want to officially act that we must do this much more often because I think we are not talking enough about what is happening in our public school district. I am amazed by the number of families and people who have children within the SLPS who do not even know that there are, you know, maybe 20 to 27 schools on the Seylette. And I think that one of the things that we can do as a municipal council to bring our support is to adopt resolutions and adopt resolutions in commission. You know, we have platforms, people pay us a little more attention here than they usually do for the Education Council. And so I am delighted to see that we are beginning to discuss more of what is happening in our public school district. And I can't wait for us to do it more often. And I can't wait to support this resolution and to discuss further how the Council of Education and the Municipal Council can maintain a more collaborative relationship, because I think that when we talk about economic development and economic trajectories, the choice of a place of residence often depends on schools and the quality of education in this community.
