Want to welcome everyone to the Stomach County Council Public Infrastructure and Conservation Committee for Tuesday, November 4, at ten a. M. We're meeting in the Jackson Boardroom and remotely. Before we do roll call, I do want to read our public comment script. We'll take public comment beginning with in person and then remotely. In Zoom, click on the hand icon to raise your hand. With that, we'll go ahead and do roll call.

I do want to mention when we get to number seven, there will be a little bit of a change and adjustment with that that Deb will highlight for us. But with before we get to number seven, let's start with number one, ordinance 20 five-sixty nine.

Good morning, committee chair Low and council members. For the record, Deb Eveson Bell, council staff. Proposed ordinance 25 dash zero six nine would establish the twenty twenty six monthly vehicle allowance of certain elected officials, including but not limited to the county auditor, assessor, clerk, prosecuting attorney, treasurer, county council members, and county executive pursuant to Snohomish County three point three six point zero three five paragraph two. The code also requires a report to be presented each year to the council on an average monthly ER and R cost for replacement, maintenance, insurance, and fuel expenses of a standard sized county pool vehicle. An elected official using their own vehicle for travel on county business is allowed to be paid a vehicle allowance on a monthly basis of not more than 99% of the average monthly ER and R cost for a standard sized county pool vehicle as determined by the director of facilities management.

The calculated rate for 2026 is set to be $698.10 per month. So a decrease, excuse me. It's that is an increase from last year. The requested action is for council to move the motion to GLS on 11/12/2025. Is that time and date for public hearing with the suggested date of 12/03/2025 at the hour of 10:30AM. Thank you. Proposed motion 25 dash four nine five would approve and authorize the surplus of 22 units of equipment rental and revolving fund equipment valued at $25,000 or more. A full list of the vehicles is included in Attachment A to the motion. These are surplus vehicles and equipment from solid waste and road maintenance. Thank you. Proposed Motion 20 five-four 88 would approve and authorize the county executive to sign Amendment 12 to the Master Services Agreement with Applied Data Systems Inc. For providing professional services for creating the county main campus space catalog and Archbus software under Snohomish County code three point zero four point one four zero subsection 11. The proposed amendment would add the ability to create a space catalog for the main campus buildings of Admin West, the RJD, the courthouse, and mission buildings. This will assist in tracking and location of assets, assigning assets to certain rooms, space reporting, and on demand work orders within the Archbus software for a total cost of $32,420 Requested actions for counsel to move the motion to GLS on November 12 for consideration.

Thank you. Proposed motion 25 dash four seven zero would approve and authorize the amendment of an easement under auditor's file number 841561. This easement was first acquired in 1947 for a road easement. However, the easement was never opened or noted in the Snohomish County public Department of Public Works right of way inventory. The request is for counsel to find that it is in the best public's best interest to relinquish this easement and approve the property officer to prepare and sign all documents required to complete the relinquishment process. The request today is for counsel to move the motion to GLS on November 12 for consideration. This concludes my staff report. I'm available for any questions.

Thank you. The proposed motion 25 dash four seven one authorizes and approves the abatement excuse me, the abandonment of a leachate and sewer easement granted under the auditor's file 200506030657. The easement with is with Snohomish County School District number two zero one, which is Snohomish, and the easement is no longer necessary for the tenant purpose or use. The request is for counsel to find that it is in the public interest to relinquish the easement and approve the county property officer to repair and sign all documents required to complete the relinquishment process. Proposed motion 20 five-four 86 would approve the real estate purchase and sale agreement for the county's purchase of real property identified by tax assessor parcel number 578000000600 in the amount of $5,000 and authorizes the property officer of the Department of Facilities and Fleet Property Management Division to sign the real estate purchase and sale agreement, the statutory warranty deed, and escrow closing documents, and then the all other documents necessary to effectuate the transfer of the property to the county in accordance with the terms and conditions of the real estate purchase and sale agreement on behalf of the county under Snohomish County code four point four six point one one five, paragraph 14. Snohomish County Conservation National Resources Surface Water Management Division in conjunction with floodplain by design desires to purchase Lot 6 of the Skyview River tracks for the purpose of a flood control project. This is one of two properties not yet acquired by the county for this floodplain project. Requested action is for council to move the motion to GLS on November 12 for consideration.

And we'll move to motion 20 five-four 81. I do want to say there's a cut and paste error in attachment three of the relinquishment of easement, on the e CAF. And, the clerks are aware of that. And so we will make that adjustment at the end when we approve this. So go ahead.

Yes, sir. Thank you. Proposed motion 20 five-four 81 would authorize and approve the surplus and disposition of a drainage easement and authorize the property officer of the Department facilities, and fleet to prepare and execute all documents and take any and all action on behalf of the county necessary to effectuate and complete the surplus and termination of the easement. All parties and departments involved in this matter have been conferred with and agree with the proposed council action as described in accordance with Snohomish County code 4.46. The county entered into a beneficial easement for drainage in 1969 under auditors file number 2106831 affecting parcel tax number 00373100800301.

The county never developed or used the easement for its intended purpose, and county staff recommended the easement be considered surplus and terminated. Cut and paste error was discovered within the relinquishment of easement document, and it is requested that the, committee direct the clerks to swap that document. That is an error for the corrected version. Once swapped, the requested action is for counsel to move the motion to GLS on November 12 for consideration. This concludes my staff report. In the amount of $10,000 and authorizes the property officer of the Department of Facilities and Flate Property Management Division to sign the real estate purchase and sale agreement, the the statutory warranty deed, escrow closing documents, and any and other documents necessary to effectuate the transfer of the property to the county in accordance with the terms and conditions of the real estate purchase and the sale agreement on behalf of county under Snohomish County code four point four six point one one five subparagraph 14. Snohomish County Conservation Natural Resources Surface Water Management Division in conjunction with floodplain by design desire to purchase Lot 29 Of Skyview Tracks for the purpose of a flood control project.

This is one of two properties not yet acquired by the county for this project. The requested action is for council to move the motion to GLS on November 12 for consideration. And this concludes my staff report. I'm available for any questions.

Proposed motion 20 five-four 94 authorizes and approves the county executive to execute the 2025 local agreement and associated work orders and amendments between Snohomish County and the Snohomish County School District number two zero one to provide information technology services. The proposed agreement includes an approved rate model for established contract pricing for any agreed upon information technology service via work orders along with an agreement to share space within the county's data center for cross connections to state, county, and other agencies. Additionally, Snohomish County School District number two zero one is providing the county with a connection to the Snohomish Police Department. Requested action is for counsel to move the motion to GLS on November 12 for consideration, and this includes my staff report. I'm available for any questions.

Proposed motion 25 dash 503 would approve and authorize the county executive to execute amendment two to the order for enterprise nine one one products and services agreement with Ontarado Life and Safety Inc. Under Snohomish County code three point zero four point one four zero, paragraph eight. The proposed amendment would extend the support and maintenance services to continue to provide location information for when a 911 call is placed from the county campus. This would extend the service until 01/31/2028 for an additional $61,790.64. Requested actions for council to move the motion to GLS on November 12 for consideration. This concludes my staff report. Thank you. Proposed ordinance 25 dash zero seven three is for nonexclusive cable franchise authorizing limited use of the public roads rights of way to waive Division one LLC doing business as it's down broadband. Council is to consider if it is in the public's interest to grant the renewed excuse me, the renewable cable franchise. The use of public rights away is considered a legislative authorization, and the actual construction and maintenance activities within the rights of way will be subject to the administratively approved rights of way permits under review of specific plans. The county engineer's report and recommendation conditions of approval have also been received as part of the ECAP and are to be considered.

The request in action for today is to move the motion to GLS on November 12 to set time and date for public hearing with a suggested date of 12/03/2025 at the hour of 10:30AM. This concludes my staff report. I'm available for any questions.

Thank you. The proposed ordinance 20 five-sixty seven would amend title 13 of the Snohomish County code and would update non land development right of way use permit types, conditions, and fees. It would also add new permits for data collection devices, such as license plate readers and utility franchise pre designs and establishing a utility right of way use fee as a condition of franchise agreements. Included in the ordinance is the ability to recover the county's permit processing and execution costs. So in 1991, the established county permit fees allowed for approximately 89% of the permit costs to be recovered by the fee.

These fees have not been adjusted since. And in 2024, the county only recovered approximately 34% of the costs for these same permits. Proposed ordinance increase is to recover the cost for review and executing the permits, including a 3% annual fee increase to help keep up with inflation. The requested action is for council to move the motion to GLS on November 12 to set time and date for public hearing with the suggested date of December 3 at the hour of 10:30AM. Thank you. Proposed ordinance 25 dash zero seven four authorizes and approves the Snomish County count excuse me, the Snomish County executive or designee to sign the interlocal agreement between Snohomish County and the city of Bothell concerning reciprocal mitigation for transportation impacts. A copy is attached to the ordinance as Exhibit A. The previous agreement relied upon the cost of a project as the basis for calculating mitigation. New formulas are proposed that rely on the percentage of boundary crossing trips, such as peak hour average daily trips, that will strengthen safety by requiring mitigation of inadequate road conditions and introduce updated provisions for ultimate capacity and multimodal corridors.

This is a six year agreement that allows for two additional six year terms. The requested action is for council to move the motion to GLS on November 12 to set time and date for public hearing with the suggested date of December 3 at the hour of 10:30AM. Thank you. The proposed ordinance 20 five-seventy five would amend Snohomish County code 7.34.020 and would add two new member positions to the Solid Waste Advisory Committee. The two new positions would represent commercial organics firms with one position being a voting member and the other being a nonvoting member. This integrates organics management formally into the committee structure. RCW 70A.205.45, the organics management laws, were first enacted expanded in 2024 with the goal of reducing organic materials to landfills by 75% and reducing methane emissions by 2030.

This includes enacting organics management, food and waste reduction mandates that require local governments to advance organics division, excuse me, and to support composting infrastructure. Requested action is for council to move the motion to GLS on November 12 to set time and date for public hearing, 12/03/2025 at the hour of 10:30AM is suggested. This concludes my staff report.
