Good evening everybody. Let's go ahead and call this meeting to order. Um you may see I've got a guest up here. Uh this is the honorary mayor of the day, August Balini. He's an eighth grader at um St. Benedict, and I'll introduce him in a in a minute, but he's going to help me run the meeting tonight. And uh appreciate him being here. Before we get started with anything, uh we have Pastor Jesus Perez with Alpha and Omega Apostolic Church. And I understand you brought a bunch of folks from the youth group with you. Come on up and lead us in the invocation and pledge, please. Everybody come on up. And uh everybody, please rise. Hallelujah. Praise the Lord everybody. Let's pray. I want to thank mayor and every the council here for this opportunity. Let's pray. Heavenly Father, we come before you Lord this moment Lord to just ask God for your blessing, for your guidance God. Lord, I pray over these men and women, Lord, that you have chosen, that you have appointed for this time to lead, God, this city. Lord, I pray over them, Lord, that you protect them, that you anoint them, Lord, that you give them guidance, Lord, for every decision that they make, Lord, that they make righteous, God. Proclaim, Lord, your your wisdom over them, God, your protection, your love, Lord, peace over this city, God. We pray over every municipality, Lord, for every department, God, in Jesus' name, Lord. I bless them in your mighty name, Lord. Hallelujah. And we pray for a revival, Lord, over this city of Smyrna, Lord. We pray, we praise you for what you're doing, God, and what you're going to do. Thank you all so much for being here. And youth group, thank you for coming, too. It's quite a crowd. That's the crowd we've ever had for a invocation. I'm pretty sure. All right, we're going to go now to We don't have any agenda changes. Um got a few items under the mayoral report. I want to just mention a couple events that we've had here since we met last. Uh we we uh revived the homecoming parade. Um week ago Thursday and um got it finished just in time for it to rain like crazy that one night. Uh it was really good. We had a bunch of folks down in the Village Green and um along Powder Spring Street over to the school. Uh wish the game had gone a little bit better the next night, but I I'm really glad to have that parade going again and hope that um that'll be a new tradition, a revived tradition here in Smyrna. Uh that same night, uh I want to thank those of you who came out to the support Smyrna uh second annual gala at the Reed House. We had 200 and some people there. In fact, the band, the marching band had planned to come over to the reed house and play for that event in the yard, but it was pouring rain. And so, the marching band played on the porch. You can imagine how loud that was, but we had a lot of fun and a lot of people came, raised a lot of money for the most vulnerable in our community. And I'm I'm very pleased about that event and looking forward to those in the future.
Rose Garden had their fall festival um which I understand was a I was out of town but I understand was an excellent event particularly for the children in the neighborhood. So um appreciate that. We had our spooky fest downtown. A lot of kids dressed up in their costumes and trick-or-treating and doing all that kind of stuff. And then I want to make everybody aware and remember we've got our crafts and drafts festival this coming weekend and hope to see y'all there. So, um, the next item is the introduction. I told y'all I've got August Bini up here. Um, parents Devon and Blake are in the audience and, um, August is an eighth grader at St. Benedict's. Um, he is an avid tennis player. I wouldn't be surprised if we see him at Wimbledon or US Open one day. He's a percussionist uh, and a star student. And, uh, we're we're super happy to have you here. Um, we're gonna step down and get a photo and I've got a uh proclamation here. City of Smyrna, Georgia. Be it known that August Bolini has been bestowed with the esteemed title of honorary mayor of the day in rec in recognition of his exceptional spirit, enthusiasm and curiosity, August Bleini is hereby granted the full authority and admiration that accompanies this prestigious role of honorary mayor of Smyrna for this special day. Given this 20 20th day of October, 2025 and you you can call him the honorable, but you don't have to, but you can. You want to go down and get a picture? mayor of the day and then they go behind the scenes tour of the police station fire stationer.
[Applause] Seems like we have a neverending parade of uh exceptional young athletes coming through here. We just recently recognized the little league state champions, repeat state champions. We've had gymnastics and basketball and soccer and all just all kinds of stuff. Tonight we are honored to have uh the Junior Spartans here who um a little bit about them based here in Smyrna. The program develops young athletes through competitive play, teamwork, and a strong commitment to the community. Um they're the feeder program for the Campbell High School fast pitch. uh and the Junior Spartans uh prepare student athletes for success both on and off the field. So, we're here to honor them tonight because the gold team just brought home the Cobb Metro Championship. How they did it in the playoffs alone. They outscored their opponents 18-2 with two run rule victories and across the season had 219 runs versus 60 allowed. Now the silver team also had a great run and reached the Cobb Metro finalist game uh to the championship game. their season. They were totally dominant with
a 16-4 record, 226 runs scored verse only 34 allowed and had 178 hits verse only 27 given up. That is awesome, y'all. So, I'm going to invite the coaches up now to say a little bit about the program and then introduce your players. And I have something I want to give each one of them. Come on up. [Applause] Microphone and and tell us a little bit about program. And Sure. Hi, my name is Nicole P. I'm the president of the Smyrna Girls Softball Association. I'm also the director of the Junior Spartans Fast Pitch program. Um, this is our head coach of the gold, David P. Um, the coaches. We have a lot of coaches. Come on up. We got room up here. Rico. And I want to bring up I want to bring up coach Rico as well. He is the head coach of the varsity program. So, we're really, you know, this this program is for fifth through eighth grade girls who are zoned for Campbell High School. Our goal is to develop them and create a community of players and families and deliver them a big blue bow to coach Rico um for his program. You okay with that, coach? I'm good. Yeah. So, we also have coach Corey Spivey, coach Nana, coach David Selki, Coach Brittney Ferrell, and coach Cass Emerson Fox. So, these are our silver coaches right here, and these are our gold coaches. Um, And I can't say enough. They, you know, they give up all of their time for the so much time for the girls. I say to the parents before we start, buckle up. It's three months of
really intense softball. The goal is to, you know, the goal has been over the past few years to really build the program. Um, and it is actually, and I do like to give credit where credit's due, we built this ecosystem with Ryan Park as well. And if they hadn't really started investing and seeing what you guys and everyone has done for that park, investing in the girls, investing in the game of softball, um it has fed, you know, the Renegades and then it feeds our program and then it feeds right into the high school. So big things to come. I think we're all we're all on page on the same page for coach's goals state championship by 2030. These are the girls over here that can do it for you. So we're really proud of them and we're proud of the work they they've been doing. I will tell you this city does as much as we can to support all of our teams, including including y'all. There a lot of times people think that Ryan Park is a city of Smyrna Park, but it's it's in the county and then they think that, hey, why are you all putting so much money into the Campbell baseball field and not the softball field? Well, we own a baseball field. in the district owns a softball field, but what we do is get with the members of the Cobb County School District board uh and the superintendent and and the staff over there to make sure that they're putting money into making those facilities better. And then we were able to get a nice partnership with the Braves and the All-Star with the in combination with the All-Star game for Ryan Park. So, very very very happy to see you all succeeding and I look forward to great things ahead. Coaches, you all want to talk or and introduce your teams? Yeah, I can go ahead and introduce uh my gold team. Um let's start with my eighth graders. Calls your name. Uh y'all y'all come up and line up on this side and then the other team on this side. So I'll start with my eighth graders. Uh, Nadia, uh, Kendall, Nava, Harper,
Maddie, and uh, my last eighth grader back there, Riley. And uh now for my seventh graders, uh Gabby, forgot you Sky, Serenity, Ella, Marissa, and Evelyn. So, uh, Britney will now, uh, bring up her, uh, silver team here. So, starting with our seventh grader, we have Sylvia. [Applause] And then moving to our sixth graders, we have Noel, Scarlet, Asher, Liv, KG, Grace, Sydney, and then our two fifth graders, Mlan, and Ara. for exceptional performance. Mayor City, Mr. Mayor, while you're while you're doing that, I got to say, Coach Rico's got to be happy to have a few pitchers coming up through the pipeline. Did I hear that right? Silver had four had silver has four pitchers. That's pretty impressive. How about gold? How many pitchers we have on the gold team? Got three. That's pretty good. So, seven
pitchers in the pipeline. If anything knows about Cobb County softball, if you got pitching, then you're really in the mix of it, right? You can hit and field and all that, but you have to have pitching. So, that's awesome. Um, hey, as a dad of a daughter who played three years of Metro and four years at Campbell High School, I just can't tell you how proud I am of you girls and really coaches what you're doing to raise the program and Nicole and all that for really raising the bar here. It's wonderful. It's really It's wonderful to see and I I really appreciate it. So, and Coach Rico 2030, that's it, sir. All right. If we can't do it sooner, 2030 is good enough. here a little bit. Make a couple rows, maybe. Don't be afraid. Come on over. Make sure you can see the camera. Yeah, you can get behind us. How about one, two, three? Champs. Awesome. Congratulations. about being mayor." And I said, "Absolutely." Yeah, absolutely is. I'm going to give them a minute to make their way out before we do our next thing, which is the Smyrna Youth Council introduction and oath of office. Want to you want to come up and bring y'all? Come on up. Come on up. All right. So, this is our um Smyrna Youth Council. We have a total of 20 high school students from a collection of schools. We've got a lot of Campbell. We've got Westminster and Whitfield as well. Tonight we have 15 showing up because unfortunately cold and flu season is here. Um we appreciate those other ones staying home. Then yes, we absolutely do. We have our youth council mayor who has presented or prepared a little speech just to share a little bit about what we do. Her name is Fatu Deop. So, Hello and good evening. Thank you to everyone for coming. I appreciate you for supporting this amazing moment. I want to start off with first thanking Mrs. Carson and Miss Eevee for making this program so accessible and inclusive for everyone. It is their skills that make this program so special and full of community building. For the past three years being involved in the council, I've learned more about leadership and how to make an impact on my community in so many different ways, more than any other activity. Participating in a variety of community service events has not only helped me build such an amazing community where I can work together with my amazing peers on the council, but has also shown me that I can make a difference and this is a real opportunity to improve Smyrna. We've gone from making an environmental impact to an impact on our senior citizens to an impact on those suffering from food scarcity and that shows the versatility of our organization and the other respect that we have for providing aid to Smyrna in every way we can. I am so grateful for this program as it has given me the perfect platform to express
my desire for helping people and that's what we do and plan at every meeting. Every voice is heard and I've built such amazing relationships with the people involved. It is this attitude that has inspired me to start a website of my own ba based on of my own based on community building and how to give back. Thank you so much for giving me this outlet to show my appreciation for the city and every person living in it. And I am thrilled to see the amazing things the council will achieve this year. [Applause] And I I want to just say something for one of your posts. I love following your Instagram. You guys stay up to date and the fact that you guys are having an adulting class that's going to be happening on October 21st. Is that correct? I want to make sure that we as council are sharing this information to get teens out there to do that. Um I I believe you guys are doing adulting 101 about finances and things like that. I mean I might need to go just send it myself just but um no I think that's great and any way that we can help support uh some of the projects that you guys are doing please do not hesitate to reach out to us or even if you might want us to show up um we're there for you. Thank you so much for what you do. super talented group and uh I know some of you as we talked earlier have been doing this for three years and I would imagine those that just graduated out will come back and visit and still want to be part of this. So uh what y'all are doing for the for the youth in our community and getting the message out and learning. I know y'all been down to the Capitol a couple of times. Um I know it's a really good experience for y'all. And there are three new members of the council. Correct. Yeah. Well, seven new Oh, I thought it was three. Okay, good. Seven new members. That's awesome. Well, we're glad to have you. And Councilman Oglesby is going to u make the introductions and administer the oath of office. All right, great. I get to do the fun things here. Uh this is the Smyrna Youth
Council oath of office. So, uh we're raising our right hand here. All right. Uh just repeat after me. I do affirm that I desire to be a member of the Smyrna Youth Council. that I will honestly and faithfully perform the duties assigned to me, that I would abide by the rules which govern Smyrna Youth Council members, and that I will be a good role model for all youth in Smyrna. talented youth. Love it. Um, we have a couple of items on community development here. Uh, one of them is going to be tabled. Item A is a zoning request, uh, reszoning for 250 multif family units on Highlands Parkway. This is going to be tabled until the November 17th meeting and I need a motion to do that. Please, do I have a second? Before we before we take the vote, I I should have said earlier u Councilman Lindley, who as you may remember joined us virtually from Antarctica where he went for milestone birthday recently, currently finds himself in China and is called in and has joined us uh virtually from China this evening. So, Councilman, do we have you on? Yes, sir. Good morning from Shanghai. Unbelievable. All right. So, we have a motion and a second. Uh, any discussion? All those in favor, please vote. Mr. Lindley, how do you vote from China? I vote yes. All right. Passes unanimously. Item B. Um, this is a public hearing reszoning for 13 single family attached dwellings uh at a density of 6.4. four four units per acre. This is Ark One Construction on Cooper Lake Road. Joey, I assume you're going to handle the background. Yes, sir. Good evening, Mayor Council. I'm Joey Sts, Planner 2 in the community development department. The applicant is Ark1 Construction. Um, this was heard by the planning board on September 15th. They recommended approval 5 to one. This subject parcel is approximately 2
acres. It was reszoned limited commercial in 2006 for 19,000 foot medical building that was never constructed. The applicant is requesting to reszone this to TD conditional for 13 town homes at a density of 6.44 units per acre. Future land use will remain neighborhood activity center. Um to the north of it is the Wellstar office building and a daycare. To the south a little bit is um fire station and then there's residential on either sides. This is the proposed site plan. There are a few variances for the setbacks. So, I'll have a front set back on North Cooper Lake of 23 feet. On the Cooper Lake side, it'll be 10 feet. On the interior side will be 10 ft and the rear is 30 ft. There's 13 rear entry town homes, 24 by 50. They will all face North Cooper Lake. There are 17 guest parking spaces. And there'll be five foot sidewalk and two foot grass strip around around the whole perimeter of the property. Uh there's a 20- foot sanitary sewer easement along the front and a flood plane in the back of the property which kind of limits where development can occur on this property. Maybe storm storm water will be at the rear of the property. We're requesting a crosswalk along North Cooper Lake and a crosswalk along across Cooper Lake.
These are the v variances that are requested. The front setback on North Cooper Lake from 25 to 23 feet. Reduction of the front sap set back along Cooper Lake Road from 25 ft to 10 feet. Reduction of the side setback from 25 ft to 10 ft. and allow reduction of the side to side building separation from 20 to 16th. That's just for the one section of the town homes. These are some of the proposed elevations and this is a picture of the subject property and some adjacent properties. Community Development recommends approval of the reszoning from limited commercial to TD conditional for 13 town homes at a density of 6.44 units per acre with standard conditions regarding the architecture of the homes and the tree ordinance requirements. Special conditions are nine are the setbacks I discussed. 10 is a minimum 20 foot driveway length. 11 is if North Cooper Lake Road is damaged, it'll be milled and overlaid um after construction is uh complete. We will document that before and after for the developer to know what our expectations are. 12 is the crosswalk across Cooper Lake Road. Um that may be modified where the location is, but uh that's what we're expecting is some type of crosswalk to get to the southbound um sidewalk on Cooper Lake Road. 13 is a rideway dedication of 5T. 14. uh the retaining wall and footing
shall not encroach the FEMA zone AE. 15. A guardrail shall be in installed on top of the retaining wall. 16. A letter of no conflict from Cobb Water and Sewer regarding the sanitary sewer easement. 17. Curbon gutters will be installed along Cooper Lake Road for the length of development. 18 and 19 tie this to the site plan and the elevation submitted with the application. I'd be happy to answer any questions questions of Joey. Thank you. I'd like to invite the applicant up. Where are you in? Before you sit down, Councilman Welsh is asking if we can pull back up the elevations. Welcome. Thank you. Good evening, Mayor and Council. My name is Josh Mahoney. I'm an attorney at Battle Law PC 3562 Hashammer North Lake in Tucker, Georgia. and I'm here this evening to speak on behalf of the applicant for this uh resoning. We're looking to develop 13 high-end luxury town homes uh on this on this property and I've got a short presentation to walk you through um what we've come up with. So, the property we're discussing is at the corner of Cooper Lake Road and North Cooper Lake Road, just across the street from WellStar Medical and Woodchase at Vinings Preschool. Um on the other side of WellStar Medical, you've got the East West Connector and to the south of the property, Smyrna Fire Rescue 5. Um just kind of give you an idea of where we are in the world.
So I'm showing you the zoning map. Now, this red hatch, that's the uh limited commercial zoning that's in the area. You can see there's this little small pocket of commercial, but everything else in the area is zoned residentially of some kind. Um, so we'll be moving away from the commercial use into something a little less intense, a little closer to what we've got in the area. So this is our latest site plan and this um has been a process. This has come about uh as a result of a lot of work with the planning staff uh even some work with Cobb County DOT. So, we've landed on this um this layout here. Uh and we think it is ultimately the the best product that we put forward so far. Uh we've got some connectivity, some pedestrian connectivity for folks who are walking along Cooper Lake Road. We've got a really nice inviting layout with these tower homes being uh facing out. Um so, as you're walking along North Cooper Lake Road, you're not looking at the back of someone's house. You are looking at the front of someone's house. So, it looks like it's nice and inviting. Uh there's lots of pathways that connect to the sidewalk. So, uh if you were visiting, you could even walk right into someone's front door and say hello. Uh our point of ingress and egress is right off of North Cooper Lake Road. We've only got one of those. And then we've got 17 um guest parking spaces, so folks won't be clogging this uh street. They'll have a dedicated place that they can go. Uh we mentioned these elevations a little bit. So at the top left, this is kind of what you'd see if you were standing on North Cooper Lake Road looking at these units. Uh to the right of that, that's what's on the back side. So there's a drop in grade. You go in, you can park. You won't see those garages from the street. And then down here at the bottom, you've got an idea of the types of finishes that we're talking about. High-end um using brick and other high quality materials.
Uh here are some example floor plans for you all. Uh this is a really cool out in my opinion because here on the left you can see that ground level. Uh there's the garage but then there's uh one of the bedrooms. This is a bedroom but you know in my opinion I think I would convert that to an office. Maybe use it as a form of you know to work get away from everybody. Get down there and and get some work done. Uh whereas on the main level in the upper floor you've got your living room, kitchen, dining room, two more bedrooms uh as well as you know a couple of patios. Um, you can really see them here on this on this cutaway. On the rear of the property, on the rear of these units, you've got two patios and then uh one on the front as well off of the primary bedroom. Um, so I appreciate um Mr. Stabs going through all of the conditions. I included them here just to let you all know. We appreciate you not going through them again. I'm not going to do it again. I just brought him here to say we agreed to each and every one of these. Uh it was it was a little back and forth there for a second, but we have landed on something that we all agree on and we are good to go for each and every one of these. Um I think I'll end by saying I was really happy to see that recommendation of approval from the planning staff as well as from the planning commission. Uh while I'm not sure if they're here this evening, we did have a couple of folks speak in support at the planning commission. I was really happy to see that as well. Um so with that, I'll reserve the rest of my time and if you'll have any questions, I'm here to help. Any questions of the applicant? Yes. What What do you think? Welch. Oh, sorry. sure and I have nothing against Hardy PL but I just want to make sure that we don't have one full side of that building that is nothing but hardy planks. Um is that the case or do you have that decided at this point? So I've got the applicant here with me who can answer that question. Do we are we using Hardy Plank on the side? Come on up. This is my client. His name is Andy Kumar. He'll be the developer. He just wanted to make sure that we're not seeing that from the road. Yeah. Yeah. It's facing I I guess it's it's not North Cooper Lake. That's Cooper Lake. Oh, so Cooper Lake down here. Will this be Hardy Plank on this side? Uh we haven't really decided on the exact material and stuff. Whatever the recommendation for the TD zoning is, we'll comply with those particularly and then any improvements on that, we'll probably talk with them and make sure that they they recommend. All right. So from from our stand, from my standpoint anyway, u I would like to require that none of the end of those buildings be solid hard. Yeah. Okay. Yeah, that sounds good. Thank you. Um what is the price point you're looking at? It's a great question. So, it's hard to nail down a price given the economic climate today um with things kind of coming online and going offline. Um that being said though, we're looking somewhere in the realm of 700 $800,000 potentially higher if things uh change. It's in line with what is in the market. So we kind of studied what is around there and keeping the price point around that and if the you know what's going on in the market with materials and labors and stuff. So things change then we have to adjust accordingly. If approved how long uh until construction begins and what do you how
long do you expect the project to to take to build? Well um we generally uh estimate projects like this to be 18 months to 24 months. But it will depend upon how quickly we go through the process of obtaining permits LDP to start with. Build on your question, Mr. Mayor, to make sure. Are will you will your company be the builder? Yes. To sell on the property after it's approved. Uh we don't have that part right now. Like to see it built. Yeah. Okay, great. That's what we intend to do. We're all on the same page then. That's good. Any other questions for the Right. Thank you. Appreciate you being here. This is Are Are you finished with your presentation? Yes, I am. Okay. This is a public hearing. I'd like to invite anybody who wants to speak for or against this item up now. Be sworn in by our city attorney. Come on up. Welcome and thanks for being here. Running away. If you'll just state your name and address for the record. Certainly. It's Rebecca Johnson at 568 Lake View Terrace Smyrna. Um, right down the street from where this development is going to be. So, I'll be very I thank you, Mr. Mayor and Council, for allowing um these these statements. I wish that I had uh been at the earlier zoning hearing, but I didn't know about it. So, um I wanted to make these uh comments um on not officially on behalf of a whole
neighborhood, but unofficially on behalf. Um there are really four strong issues that that make us against this development. Um, traffic is, any of you who have been down there, uh, on Cooper Lake Road trying to get on East West Connector, horrendous. It's It's horrendous. Uh, particularly morning and evenings coming to and from work. Um, I mean, we see traffic back up from uh, east west all the way close to a mile up Cooper Lake, past Nicac, over the hill, and it it last and last and last. So, um, this will only exacerbate, particularly because it's so close to east west, how those cars are going to get out in this little half block, not even a half a block area onto Cooper Lake in order to get on East Lake, East West is not is not practical in our minds because it truly is only a distance as from here to your police guy out front. It's very short. So that means that there's going to have to be some way for those cars to come and turn left to get on east west. So that's one big issue is traffic in general and that particular issue is is going to make it difficult. Um there are um concerns about the daycare center being so this being so close to the daycare center with the traffic and so on. Uh there are concerns about the fire fire department having uh the ability to get out easily. It's already difficult enough for them. I've been here for 22 years in this same home and have seen of course Smyrna's growing. We love that. Uh and particularly in that area. So um there's you know the fire department's right there and some and when they have to get
out to east west it's it's difficult. And and finally, um there are at least 750 homes within a quarter mile of this intersection where this development will be. At least 750. Almost all are against this development. No, they're not here unfortunately. But um it may seems like seem like a small development because it's only 13 town homes, but it will have a very large impact we we believe on the um quality of our life and living in in this area of Smyrna that we moved to. Our safety as far as traffic, the accidents, I have pictures of the accidents at north at Cooper Lake and East West. You don't want to see them. The number of accidents there are huge. It It's one of the most dangerous intersections in Cobb County. I'm you have probably heard things about this intersection before. Um so our safety is a big concern. Um and our home values were concerned about that. Although 700 800,000 is not where I would be able to go either. So, but um because of the traffic we and and and the other issues, we believe it could decrease our home values because nobody will want to come down there. So, that is my short presentation. I appreciate your your um attention and I don't know if you want to ask any questions or anything, but I appreciate it. Thank you. Sean Murphy, 3282 Lee Street, Forest Hills. Um I think my uh I'm generally in support of this uh project and I think uh when you look at the site um there's a medical office building across the street and for some of the same reasons she just said she's concerned about
traffic. Well, if we don't zone it residential for 13 town homes, what's it going to be? It's going to be something commercial. that means it's going to be another retail building or an office building or something that's going to generate far more traffic than 13 town homes would. So, I would argue actually that town homes is probably the least amount of traffic you're going to get if you develop something on that corner. Um, the other thing is it's it just makes sense as a step down zoning. We're going from office, we've got a daycare, we've got a fire station, and then all around it, we've got fairly high density or moderate density uh very small lot residential developments except for the one house that's to the north. And so this these town homes, which in a town home sense, it's not even a very dense town home development. There's quite a bit of green space there, just seems to me a good a good fit for that piece of land and a good a good way for us to get some tax revenue and do the right thing at that that corner. Can you present this to us? Yes, sir. This is reszoning KC25-012. Uh applicant is Brookwood Home Designs. The Planning and Zoning Commission recommended approval 6.
This property is on Belmont Circle. It's about one and a half acres. It is a non-ontiguous property that's split by one single family home in the middle. Um it's currently vacant and they are proposing four single family detached homes at a density of 2.61 units per acre. This would be a reasonzoning from R15 to R10 conditional. has a low density residential future land use and that will remain. To the north is high density residential and to the east is community community activity center. South and west is low density residential. I'm going to go over the proposed site plan. Um, lot one is one front entry single family home and then on the right side is three front entry single family homes. They all meet the our 10 zoning district setbacks of front 25 ft of side of 7 and 1/2 ft and rear 25 ft. They all have storm water detention at the rear of their properties. On the three lots, we're requesting a five-ft sidewalk and twoft grass strip. On the one lot, we're requesting maximum 5ft sidewalk. There there's a retaining wall that limits how wide that um sidewalk can be. So, that will have no grass strip. There's a sanitary sewer easement on the on lot four and no variances are requested. Here's are some conceptual elevations, pictures of the subject property and
some adjacent properties. Community development recommends approval of the reszoning from R15 to R10 conditional for four single family homes at a density of 2.61 units per acre. The standard conditions special conditions. Nine is the setbacks. 10 is a minimum lot size of 10,000 square feet. 11 is a minimum lot width of 50 feet. 12 is a min minimum driveway length of 22 feet. 13 is a condition regarding the sidewalk. 14 is the sewer for lot four will connect to the sewer line from the easement in the sideyard. 15 uh they'll be responsible for any water and sanitary sewer improvements. 16 they'll have a maximum height of 35 ft. 17 and 18 tie this to the elevations and the site plan submitted with the application. property ID lot is uh between two R15 zone lots and I'm just clarifying that that um their plan uh requirements for an R15 even though They are showing the R10 setbacks, but the location of the home as they're showing it does meet the R15 setbacks of 35 foot front setback and 10 foot side setbacks. Sean Murphy again, 3282 Lee Street, representing the applicant, Rick Cob and his partner. Um, just first to talk a little bit about the history how we ended up here. Uh, this site from I'm not a 100% certain of this. Okay, so this is coming from the neighbor and the seller, but it was all one piece at one time. And when they inherited it, there was a brother and sister involved. And the brother got one piece in the middle which was parcled out and sold. And what was left was two pieces. And for whatever reason, the city did not divide that into two separate parcels at that time with two separate tax IDs. The sister kept both pieces under one tax ID. And that's why we have a situation where we're really looking at two separated pieces of land that are all under one parcel and one tax ID. And that's why we're not reszoning them separately. We have to treat them as one
per what we understand from the city. Um, this site is uh currently mostly wooded site and the house that's in the middle of it is quite nicely maintained. And uh what we've seen over the years and I think some staff can attest to this is that the fronts of this property is a dumping ground for the people that walk back and forth from the apartments and they throw their trash and all that. There's even a small trash can that somebody put out there at some point. And I I questioned during the the during the uh planning and zoning, why is there a doggy pot trash can out here in front of this project? And no one could really explain it, but it turns out it may be because there was a bunch of liquor bottles being thrown in front of these lots. So, our hope is that in doing this, we're going to do nothing but improve the neighborhood. We're uh you guys have seen myself and Rick here many times. I think we've built like what do we say 18 homes now in the city of Smyrna? I'm over 30. Over 30. Okay. So, um And I know that this is the 13th time and I 13th together. That's right. So you you all know what we build and uh we generally build a pretty nice product and uh we're pretty much looking at the same types of houses here. We're going to retain quite a few trees along the backs of these lots. So we will actually meet base density. We won't even have to plant trees to meet the base density. However, there are a couple of large trees that will need to come down. So there is going to be some specimen recompense involved. So we will end up planting a few trees. Um, see what else I can tell you. Uh, we're going to be doing some fairly traditional things that we've done on these other lots with, uh, probably underground detention systems involving gravel and tying the down spouts in and that sort of thing. Uh we did meet with staff uh at least one time uh Bo and uh the transportation engineer and we worked out some details about where these uh driveways and such would would hit and where specifically very specifically we would put in and how we would put in some of the uh
utilities in especially the sewer. Uh because it turns out the sewer line in front of the far right number four is about 18 feet deep out there in the road. Um, so we almost couldn't make this project work. We had to really work out some fine details to try to make this make the numbers work because the cost of tying into that sewer was going to be quite considerable to dig 18 ft deep out in the road and then possibly have to replace some asphalt and things like that. So, just wanted you to know that we did work with your staff and uh went through a number of comments and and dealt with all those amicably. Um, so that's all. Anybody have any questions? I am familiar with the people that live there and the neighbors and that are in W five. Anyway, at the other side of the street is W three, but uh there are some great neighbors in that area and I think you Yeah, we believe we believe that as well. Yeah. Um I've talked to the neighbor a few times. It's right next door. She's a nice lady. Yeah. Um and you know, you talked about the garbage can. They're actually Whether this changes or not, there is a bus stop right there and that may have contributed to some of the trash, but the uh the neighbors were cleaning the street up all the time. And I believe they reached out to the apartment complex that's at the end of the culde-sac and that's um you know the the the management of the apartment complex actually put the trash cans out there to help with that uh litter situation. And that's my understanding. And they I heard that they have a golf cart that they drive up there once a week and uh empty the garbage and um and take it back to their apartment complex. So that all is a good thing. Hopefully we can find another location because I do understand that you don't want that right in the front of your uh new house there. So um but anyway, thank you. And um and part of what makes me more comfortable is because that one lot uh lot number one does meet the requirements for an R15 and I know that there's R15 on both sides and um and the neighbor that's in the middle. Um you know her her lot is quite large as well. Um she did want to be here tonight but she had communicated with me earlier that she was having to work late. Um the one thing she also communicated and I
believe she may have talked to you too. Uh she was was hoping to that you could plant some kind of a landscape buffer between um maybe between some of the properties may uh you know maybe where the town homes are or the I mean I'm sorry with the three from the uh commercial. I I did speak to Cindy on Saturday and uh we talked through it and I as I I'll say to you what I told her that we're going to probably planting some trees regardless because we're going to have to remove some trees unfortunately. And I'm happy to locate those on on some of them at least on on the side if it doesn't impact the root zones of existing trees. Okay. And we want to leave enough room for a fence. Also, if a future homeowner wants to install a privacy fence, they can do that, too. So, okay. We're we'll certainly willing to consider that. Okay. Thank you. I really appreciate it. And I'll add if you look at the site plan that I thought through that when we did the site plan. And one thing you'll notice is there's a lot more room on the left side of lot three, I'm sorry, on lot two than there is on the right side. And that's so that we could provide more of a buffer against her. And then of course lot one is is it's a huge lot. So the house is pretty far. So there's lots of room. In fact, lot one there's going to be quite a few existing trees saved. I don't think there'll be a whole lot saved along the side a lot too, but when we go to plant, we'll put them on that side. Um, you know what? I I actually noticed that too, that you had that distance there, and I appreciate that as well. Thank you um so much. And um I think Oh, I do want to ask another question. The driveway of of lot one, and I know that's it's a difficult place to put the driveway, but that is that curve and the the sign that's on Woodland Trail. It's It's a little awkward, so hopefully it'll out, but I'm sure you get out with
the staff and everything that And you and I, we talked about this on the phone, so I'm want to show this picture because this kind of helps explain it, but the picture with the little trash can there is a power pole um is to the left of where the driveway is on lot one. And there's a guy wire and there are requirements that you can't do you can't excavate next to a power pole too close because it could make the power pole fall over. We have to run the sewer right into the right of this power pole. So then we need to be 10 feet away from the sewer with our driveway. So that basically dictates the driveway be about 20 feet from this pole over to the right. So that's where that why that driveway is shown where it is really just because there are utility requirements we have to deal with. Thank you. I appreciate that. So, uh, that's all right now for me. Um, first of all, I want to say good evening, mayor and council and city staff. I'm here on behalf of my neighborhood, which continues to be neglected despite repeated concerns. Some of the things we're dealing with down in the Riverview area is trash and durables, uncontrolled speeding, no speed bumps on the Smyrna Smyrna owned streets, no traffic coming, poor street lighting, industrial activity next to
homes, minimal or no response from city staff. So I work in municipal government also. I have worked at two cities, city of Norcross and city of South Fton. at the city of Sperna. I worked as a county manager at the city of South Fulton as the revenue manager. I know from working in city government, we have to respond back to our citizens. A lot of times when you email the people here at the city of Smyrna, they do not respond back. They pick and choose who they want to respond to. So, I'm just asking all of my neighbors that are watching to stay engaged. I'm asking if they see something that they don't like to speak up about it. Um, we're tired of being treated neglected in our neighborhood. We feel like we are the black sheep of Smyrna. And this is from not only me speaking this from my own experience, but other neighbors in my neighborhood. I appreciate you being here. I will I will take issue what you said with what you said that we pick and choose who we respond to. And I'll tell you, we have one of the best staffs anywhere. So, I'm not sure who you've reached out to. I haven't gotten any emails uh personally. I sent plenty of emails. I can forward them to you. Please do. I I don't remember getting any email. If if if I get an email from a constituent, you better believe I respond to him. This is in Ward 7. Um he responds back. I'm not talking about the council person. He responds back. Okay. Well, he's the point of contact for I mean, he's the point of contact for what you're trying to get done or what your what your concerns are, right? So if you are working with him on solutions and you're working with staff, we want to get whatever this whatever the problems are taken care of. So talk about what your issues are other than what you've out I mean is there is there other things that you're concerned about? Um yes, we're the planning and zoning the zoning in our area. We're zone
residential then they had something coming up um what is it industrial then we had something coming up mixed use. We have an issue with that. We have an issue with traffic coming. We have an issue with trash in the neighborhood. We have an issue with um poor lighting in the neighborhood. So I think I think on the traffic cal and the poor lighting I think there's a lot that we can do. I think that that area was industrial when it was annexed into Smyrna. And so you you have an industrial and residential mix over there that has been present since that became part of Smyrna. So we're working on those issues. I don't know if you want to speak to what you've been able to accomplish or who you're working with on staff, but I I do know that we are responsive and we take care of the issues that come up from our citizens. So, please explain where we are with this issue. Yeah. So, good to see you here today uh expressing your concerns. I always encourage our uh neighbors to come to city hall and come to our council meetings and speak up. Now, with that being said, uh I do also take issue with uh the statement of city staff not being responsive. Uh in fact, I'm on most of those emails, if not all of them, and they respond when it's a issue that requires a city staff member to respond to. If it's a HOA issue, the HOA needs to respond, not city. Uh because that's not in our jurisdiction. All right. If there are code violations, you mentioned code violations. Obviously, we're working on that. You know that everything's been documented. I encourage everyone to use the 311 app to keep documentation on that. When you use that for these issues, it goes directly to that particular department and they take care of it from there. And I get the email so then I can track it.
In reference to industrial, I think you're now who were you speaking on far as upcoming industrial stuff you mentioned? Um the planning and zoning um in reference to arrow waste. So a waste is there already. Yes. So that that particular piece of land is it's zone heavy industrial. So they are currently trying to get a fuel tank I believe or some type of tank put in there above ground. And that's going through the process. There is a process for these things. And obviously showing up for the zoning meetings and expressing your concerns, that's how we that's how you have a voice, right? Right. We're It hasn't come to us yet. So there's nothing for us to really discuss on that currently. That makes sense. I wasn't trying to discuss that tonight. I was just coming with my issues with the city. And so that's why some of my neighbors that are here today, they have some issues with the city. Also, I don't want y'all to ever feel like you're not being listened to or heard or seen or I mean, this this council and our staff, we we have the best constituent service in my view anywhere. And I know your experience may not have been that, but I'd like to get uh our city administrator, Mike Jones, involved with y'all and what y'all are doing directly if you if you haven't been. Mike just joined us in June. um to address. I've been trying to email Mike. I keep getting um kickbacks from the emails. So, yes, I have been trying. Let's make sure we got the right address. He's not M. Jones, it's ML Jones. So, so that might be the problem right there. But, um we have open lines. Our cell phones are all on the websites and social media and all that kind of stuff. So, call me too and let's let's talk about your issues and let's let's get these resolved if we can. Um, but don't don't ever feel like we're ignor that strikes a nerve with me because that's not how we'd conduct business. Right. That's how I feel too because I can show
you the emails where I email the community services director. He responds when he wants to respond. It might be a week. He may not respond, you know. So, so if I if I could, Mr. Mayor, Co Cody, you and I have had these conversations before and your emails, we see those emails. Everyone sees them. I'm I'm copied on every email. So I know absolutely he's sending emails, but if you want to really get something done quickly, please utilize the tools that city has given. 311. Yes, I utilize that. Believe me, I utilize it. And what happens? They close it. No, you I can show it to you. I can show you what you spoke on trash. 301 was used for trash. The dog poop or whatever was going on at that park that was taken care of. There was 311 requests. We was able to route that to the people who were responsible for that, which was your neighborhood association, not your HOA, but Riverview Road Area Association. They that was routed to them. We realized that they realized that they they had a new management company and they were behind on it. We stayed on top of that for you. And that was something out of our jurisdiction, but we made sure they got it taken care of for you. Okay? We reached out to the developers. Well, just speak city staff that did that. Okay. City with you after this where you can see these tickets. I have the tickets here where they was just closed. Didn't even read them. Just closed them out. You know, I'm talking about the signage um that shows like where Howard's um tow truck company is there. I'm talking about Sweep America Corporation. The the signage issue. We we have to know what the What are you speaking on? I'm talking about the signage. Now, I'll show it to you after. What about signage? We're giving you the four here. Well, the signage um they didn't have the right signage with the city. I guess
it has to be a certain sign size for the for um the business and they closed the ticket. I sent several emails telling them that they were saying it was on private property, that it wasn't in the city of Smyrna. We pulled the address, showed them that it was in the city of Smyrna. They kept saying that it was in the city of Mapleton that they couldn't handle it. So, they kept closing it. We finally got them to open it for a little while. And let's see, Tim Freeman. He that was for Howard Recorder. For Howard Record and also with Sweet America Corporation. Okay. And And there you're saying their signs are out of code. Out of code. Yes. Hey, my guess is some of those were grandfathered in. But here's what we're going to do. Thank you. Um, and I just wanted to point out that uh in uh a lot of us were at last week's permitting meeting and I feel like that's where uh our uh current uh challenge or not
current but where uh we feel uh a lot of neglect coming from. Um and uh for me uh I just want to point out that I uh grew up off of Bankhead now Veterans Memorial since uh 1983. Uh so I went to uh Harmony Leland, Lindley Middle School, Plebrook High School. Uh nothing in Smyrna, but uh I know Mapleton in the area very well. Mr. Mayor, you mentioned that the city of Smyrna had annexed the Riverview Road. And so when I came here to buy and invest back in the community, I was thrilled to see that Smyrna had taken over that part. I was thrilled to see that we're investing in parkland on the along the Chattahuchi River. I was thrilled we're investing in other river parks there in the area. And I was thrilled to find a community where I could live and buy with amazing neighbors like this. And uh it was suggested in the last permitting meeting that myself and the neighbors had not done our due diligence on the area. And everyone knows that it was an industrial space. Everyone knows that it's an industrial road. Uh I used to tell people and still do that my dad used to drive me over in his pickup truck to catch turtles off of Riverview Road and now I own a home there that's in the price range of many of the new homes that were spoken of this evening. Uh, and so I think it's important for the council to understand the due diligence that my neighbors have done is the investment the city of Smyrna has put into the area. And our expectations are that if the city of Smyrna has put in an investment, that's why we did it. And so we expect the city of Smyrna to continue with that investment and continue with investment with of my neighbors and
residential spaces and not temporary mixeduse and industrial permits. Thank you very much. Thank you for being here. Yes, ma'am. and I'm here once again. So, so one, I'd like to offer to get you a list of all the issues that we have. Um there are many while we use 311. 311 has not worked this summer. Let's be clear, that's not something that we made up. I put in a submission on September 5th because about 50 neighbors told me they all summer long they've been writing about Nichols Road. I did get something back three weeks later saying that they get to it and it was closed. It was closed before we got an answer. That's not acceptable. I agree. From East West Connector and South Cobb Drive to Riverview Road is deplorable. Bankhead Highway is cleaner. I left Brooklyn 28 years ago and when I go back, it is cleaner than South Cobb Drive from East West Connector to Riverview. We've all made an investment here. We all pay into the city of Smyrna. None of us like coming here at this hour. We have homes. We have families. We have other things to do. We're here because there's a problem. And I don't want y'all to mistake that. We're willing to help these young people. If they send you something that you don't get, point
them to the right direction. They want to be good citizens. They are good citizens. And it's about time we stop telling them not to email and point them in the right direction. Period. And I'm going to stand on that and I'm going to be here every meeting to make sure that we're on the same page. We've invested too much. These are young homeowners. This is their first home. A lot of them, a lot of them are single doing this at this price point. It's about time that we get on board with them and we work as a community. And that's all I ask. We and we are respectful of your time and your f all of your families. We understand it takes an effort to get here. Uh my commitment to you is I'm not going to have you coming to every meeting because we're going to meet before our next one. Okay. Thank you. The fact that you've offered a meeting, I really appreciate the fact that the councilman just sat here and asked my neighbor to share their information is concerning to me. We haven't met. We haven't had those conversations. So, I just want to offer and I appreciate all of you at least hearing us about what we have to say. We want to be proactive. We want to be committed to uh Smyrna. I know I moved here because I wanted to be back in Smyrna. So, I appreciate the fact that you all are going to meet with us and hear our concerns and hopefully we'll get it resolved. So, thank you. Um thank you for taking the time and meeting with us. We really appreciate it and it's hopefully a good step forward. Um, I just had one question or something to bring up. When we first moved into the neighborhood about two and a half years ago, we did go to um, Mr. Oglesv's uh, councilman meeting and we talked a bit about potentially the traffic and the safety at Riverview and Veterans Memorial. Um, more specifically potent like having a traffic light there. Now that there are so many more of us in that neighborhood, I mean, I drive that way to work every day. It terrifies me to make a left onto Veterans Memorial from Riverview. Um, you have you have cars coming this way, you have a turning lane, you have cars coming this way. It's a nightmare. The traffic is awful. And I just think that it's a very dangerous intersection. And now that we do have more people on that road, um, and potentially if there's going to be
more residential, I think it'd be important to consider something there. I just looked over and our city administrator is making notes and I'm I bet those notes say get with the get with the city engineer and traffic folks. Yeah, I mean the traffic is awful there. It gets backed up. It could potentially cause more traffic. I don't know. I don't know all the logistics, but safety wise, I know it's it's scary. That's why we have people smarter than us that tell us all the Right. Yeah. that that that is it's very likely that that intersection was considered at the at the initial layout of that development and there may be a milestone in there that triggers certain types of traffic enforcement or traffic control to your point as as more folks move in more traffic. Um so I'll meet with the public works director and see if there was a milestone that was hit that would trigger some sort of additional Okay. Great. infrastructure. Okay. Thank you. Appreciate it.
