So, I'd like to start off by saying, and please, I'm sorry for my back being too. I'd like to start off by saying six years ago when I got on council seven years ago, one of the things that was most important to me was the community and what we do in the community. And the staff got so tired of hearing it. And one of the things that was most important was starting an awards program. So I have certificates for Emma for Liam. Oops. I'm sorry. And I'm gonna actually read Jessica's because Jessica came today thinking that these were for the kings. Town of Smyrna helping hand award for Jessica Sers. And each of them have their own names on them. A family making a difference. Ser's family receives Simrna's first helping hand award for community service. in recognition of their outstanding dedication to being a mother that has chosen to teach hands-on community service and inspire a commitment to teaching the next generation the true value of volunteering. As a proud Simra native, Jessica has led by example, instilling in her children, Emma and William, the importance of giving back to the town they love. Through their self-initiated town cleanup efforts undertaken with no expectation of reward or recognition, Jessica and her children have significantly enhanced the beauty and spirit of Smyrna. In Smyrna alone, they have collected in March alone, they collected over 800 pieces of litter across a 12 block radius, demonstrating that meaningful change with simple consistent acts of care. Their motto, as Jessica has put on her Facebook page, the ground is not your trash can. It stands for a powerful reminder of the responsibility we should all share in preserving our community. In honor of their accomplishments and their compassion, leadership, and unwavering civic pride, the town of Smyrna is proud to present the first ever Helping Hands Award to Jessica,
William, and Emma. And it is signed by all of town council and uh police chief and town manager. And that's part of it. So, next part is there's a there's a little thing running somewhere. There it is. Um, that is what the rewards look like. And moving forward, I'm going to actually give Jessica a stack of card stock that she can have the kids put one handprint per page on. And that will be the helping hand certificate that we use to print on for the rest for the duration of this project. Um, and with that, um, let me introduce Chris Nine. Chris is a diesel truck driver. He's a truck racer. One of the things that I noticed about William was that William had racing stuff all over his jacket the day that I saw him for the women's picture out front. Chris was not able to bring his diesel truck today. Well, his race truck, but once it gets a little bit warmer in the season, we'll bring it over to your house so you can see it. Okay.
Chris, this is William. Nice to be here, man. I got you a little present. Thanks. That's a t-shirt from Chris's race team. And Emma, the opera house is so excited with what you guys have done that you have tickets to the Taylor Swift concert. Wow.

Good afternoon mayor and council. Um over the last say four years uh the the ex police chief now the town manager and the current police chief have played an intricate part in the Kent County Wildcats special Olympics allowing us to meet every two to three months in the conference hall and we are greatly appreciative of it. Tonight I would like to introduce one of the athletes that has been playing a major role in the in the Special Olympics. He's asking the council, you have his flyer, any support that could be given to him over the edge. Some of you have heard about it on the news. He is actually participating in it and he's also involved with the Polar Plunge, right?
But he's actually doing over the edge. I will give you Richard Dunn. Welcome Richard. Thank you for joining us. Now this is my first time talking in front of a camera. Okay. I talked to him well at the corner of Airpl I did. I talked making nervous by yourself now. Good. I promise you we're nice. We don't bite. And we smile a lot. Still up.

Hello, my name is Richard Denny. I would like to thank the mayor and the council for allowing me to participate or this opportunity for actually for sponsorship. I have been in been a special Olympics athlete for over 20 years. I'm active member of the council leadership athlete council and I'm an athlete chair for the law enforcement torch run committee. My sports are basketball, softball, bowling, botchi, and golf. I have done the polar bear plunge, boarding the ride to the tide, and been a camp counselor at Camp Barnes. This is my first time going over the edge. I would think would like to thank everyone for this opportunity.
Thank you. Keep appreciative after everything that the town has done for the Special Olympics. All right. It doesn't go unnoticed. All right. It doesn't go unnoticed. I know you all notice. Do you have extra flyers to leave at the door in case anybody wants to take I got somebody here. Yeah. Again, we wanted to make sure the council got it. All right. And again, we're only asking for sponsorship if you know, again, I know it's not a talent function, but to help the kids in Special Olympics, it's a big thing. You know, it's been dear to my heart with my daughter for over 30 years, basically. It's very important that we support these children. Absolutely.

I'd like to share that um we had a grand opening street Saturday sun Saturday um for elite cuts. It's really nice to have another new business downtown. Was able to go and have lunch with Russ at um Dixie the other day. That was really good. They have really good greens. If you haven't had them, they're really good. Um um and on the 23rd of March, we brought in a program, the National Foundation of Women Legislators all met at the Duck Creek Regional Library and we had a national event there. It was amazing. Um we had I think we had 53 people and I only know that because we gave candles to them as favors. Um, and based on the number we had left over, we had 53 guests show up, which was a big deal because only women legislators were invited and special guests. It was an amazing event. The turnout was so positive. Um, the feedback was positive
and better than that, um, and Jessica's left, but um, Tractor Supply sponsored us, SER sponsored us. Um, when Sers did their 75th wedding or their 75th anniversary, I got a bracelet and it may not seem like a big deal, but it is. It says, "Knowledge is power." And for this event, they donated a bracelet similar to this and a Delaware charm. And the people that walked away with it really, really appreciated it. But it also gave us some more business notoriety downtown. And it also brought more people into the town so that they could see who we are, what we do, and how dynamic our library is. Um, it was a great event with that. Oh, okay. Now, later.

Okie dokie. Thank you. Sorry. Um, if you have a chance, go check out our downtown businesses. As we grow and as more people are really trying to make a difference, we are the ones that make the difference. If we're not walking through their doors, they can't make it. So, so please take the extra time and make the difference. With that, I will go. Vice Mayor Okay. So, for Women's History Month, we had our first ever picture photo shoot on the steps of town hall. It was freezing, but we made it happen. It was a good turnout and expected to get bigger and bigger every year. And along with the um event that Tabby is talking about it, I'm sorry, the mayor was talking about it was um in fact in reference to women's history month. It was her voice, her vote, her legacy. And we had uh elected officials from across the state. the lieutenant governor was present, the uh state auditor was present, um as well as Congresswoman McBride. The conversations that were had um were incredible. Just the opportunity to bond with other women that are in fact elected officials and talk about what we go through and share support. Um again we had several sponsors. We had the SERS. We had uh Focus Pharmacy. We had Howie B um media and social at Maine and Focus Pharmacy.
Tractor Supply. Tractor Supply. I don't want to leave anybody out. Our keynote speaker was um Sherice Burlington Carr who is the director of office of women office of women's advocacy and advancement
and gave a a remarkable speech and the food was amazing as well. The food was amazing as well and the centerpieces were all cupcake bouquets. So, um, everybody loved that to be able to look at their dessert and they were trying to figure out are those flowers or are they cupcakes? Um, and we talked about the sand project. So, Sarah Poor was there to talk about human trafficking and another one of our sponsors was Diamond Technologies and excellent presentation on AI. I wish AI was around when I had to write my dissertation and two thesis and papers. So, you know, um it was just really really a good night. Um and the takeaways were uh red sand uh a bell to encourage people to believe in themselves and also a burnway candle. So as you light the candle, it burns away and it's a a special message in it. So um that was something that the mayor's daughter did for us. Um it was just an amazing event and it was an inspiring event and just so that it we were planning this for months. Um, so that night I know we were exhausted because again we have been planning it for months and it turned out well.
So just wanted to share some of the things that we are doing and continue to put Smyrna on the map. My goal was always not to have legislators drive through Smyrna, but to stop and recognize Smyrna in its happenings. That's all I have for now. Council Secretary, Councilman Pope,

Um, I just want to open up by saying, you know, we may be done with winter, but unfortunately, winter is not done with us, so don't forget uh to look after your plants if they're out there tonight. Um, I do want to thank the staff for the work that you do every day. I know you're gearing up and getting ready for the spring cleanup. Um, so the work that you do every day does not go unnoticed. Um, we certainly appreciate everything that you do. Uh, and also with this week being uh, spring break for our school kiddos, please be mindful. Some of them will be out riding their bikes and having a good time. So, we want to make sure that we're safe out there. So, I want to thank everyone for all that you do. And that's pretty much it. Yeah, we had a nice uh Smyrna town employees lunch and award session and uh also it was good to see the two new businesses opening here in Smyrna with the ribbon cutting uh ceremonies. Uh yes. Uh good evening everyone. I had the pleasure and also the honor to be at the leak cuts uh grand opening which was awesome. Uh it's good to see uh businesses opening on Commerce and on Main Street uh starting to fill up. So that was awesome. So Councilman Miles, um happy belated Easter everyone. Um I don't really have much to kind of update on. I'm I'm getting, you know, fielding calls about different issues around town. So that's interesting. Learning a lot more. Um but yeah, I would like to make a motion. Um, I don't know if this is the correct time to do that in because I don't think we can add any more to the agenda. Under new business.

I had the honor, super exciting, uh, I had the honor of giving out the first mayor's award to our town staff. and our staff is dynamic. They are second to none. Um, but when it came down to it, I got to choose a whole team and our electric team, our electric department was the team that I chose to thank for all that they've done um, and for going above and beyond. And I have a feeling a lot of the people at the event were a little bit younger than me and didn't get, you know, the little analogy that, you know, winter, spring, summer, fall, all you've got to do is call. It was a James Taylor thing, right? But that's really what the electric department does. They are there at the drop of a hat. So, um, I was very honored that, um, the staff gave me the opportunity to participate to do that. Chief,
you guys have my monthly report. So, I'll take any questions on that if you have them. Reminder, we are still taking the junior police academy uh applications. That academy tenatively will start on July 13th. Again, grades 5 through 7. Preference to Smyrna School District, but if you're outside, please apply. Looks like we may have some open seats that we could uh give to you. Um excited to tell you that hopefully in the next couple of months, we will have a couple of our officers getting certified in police mountain bike. Oh, we haven't had the bicycles out in the community in 10, 12 years, probably the last time we had one out. Wow.
We still have the bicycles. They do need some work. We have some grant money that we can use to get those back in tiptop riding shape, but we have three or four officers that are interested. Um, I think it'll be great for events like Smart Night, July 4th. Large crowds, condensed areas, bicycles can be a really good uh tool, and it's also good for community policing. Um, luckily some of our partners at the beach are going to train us for free, get us certified, won't cost us anything. So hopefully this summer uh you will see some of our volunteers out on their bicycles riding around. Are you gonna ride around? I am not gonna ride around. If you've ever seen the dancing bear, that's what I look like on a bicycle. No, I will not be doing that because you're
I will I just want to say this. Um when I was driving home um I saw a car broke down on the side of the road and I want to highlight um an officer, Mr. McNat Jr. Um he and his other officer got out the car and actually pushed the car to the side of the road. So I remember you saying don't make me look bad. They're not making you look bad. So but that was an awesome gesture because I I got on my car about to help. Right. But they jumped on it right away. So that was awesome. Awesome. Appreciate it. Yeah. town manager.
Um, I'd like to thank everybody for taking the time to come out to our first uh employee appreciation. Um, I I think it went well. Uh, I think it was well received. So, again, thank you and congratulations to anybody that got some type of an award. Um, just kind of a few updates that we have. Um, you know, I I want to also say thank you to our community engagement team who has really started with their uh their series of that they're putting on. We just recently had a fraud education that was put on at the library. They did a budget 101 um as well and uh it's was so wellreceived that we're doing a secondary um fraud event that'll be coming up sometime in May. Just found out today. So um it was awesome to to see the amount of people that are actually coming and taking part in those things. So, um, we are working on some, uh, as, as the summertime is coming and we're starting to turn stuff on in the buildings, we're finding some issues. So, you will start seeing some, uh, some updates to to some things. Our HBA systems are unfortunately not keeping up very well with uh, with weather. So, we're doing some updates in multiple buildings as well. Um, with that being said, there's probably going to be some updates here to town hall. Um just with how things have recently been happening over time, uh we're looking at kind of limiting some access to to the building. Um so in in the coming months, you'll probably see some changes just for safety reasons. So just wanted to kind of put that out there. Spring cleanup is about to start. It starts on Monday. Um and that is for the residents. And then we as the town will be starting our spring clean up, which means you're going to start seeing some of the curves getting painted, some stuff getting cleaned up around town, the flowers are going to get painted, the mulch is going to get start getting refreshed, anything like
that. So please, if there's something that anybody sees, please let us know. Um, with that, we have a new system that is in place as of today. Very well.
Yes. Um, so we have a new permitting process that is it's the online. It's still kind of the same, but it it allows us to do a little bit more. It also will allow anybody that puts a permit in to kind of see what the process is of where it is in the process. We were getting lots of complaints about people that were putting in permits and they didn't know where it went. It just kind of stalled. So, um, you will now see as it moves and progresses through. You'll be able to watch it. So, I'm hopefully that will eliminate some of the questions and concerns that people have had throughout the permitting process. So, um, again, I I just want to say thank you to everybody that was part of things, Jason, Kathleen, Walt, um, they've all been amazing and and helping with things and the girls upstairs to make the whole process for the appreciation um, happen. So,
so since Tori didn't highlight it himself, I'll go ahead and do it for him. Kathleen was actually our employee of the year because financially she is dynamic. She has made our budget process so much easier, so much more clean, so much more legible. It's a blessing to have her and she deserved that.

Um, so the appeal committee met uh at 5:30 today and heard from uh several of the individuals that wanted to appeal. With that, uh the committee recommends to council that we approve a waiver for both uh 356 Paul drive and 119 West Cook Avenue that their assessment upgrades will remain unchanged until next year. So I think I need a motion. So I can't make a motion. Can't make a motion. Okay. I'd like to make a motion that we adopt the recommendation uh for that was stated. Second.
Is there any discussion? So I would just state for the record that the reasonings or No, no, no. Um, I would just state for the record that I got on my papers here that that written appeals were also received for various properties, various other properties, but nobody ever actually appeared to appeal those um assessments. So, so those are just not going to be considered since no evidence is really presented before. Do we have to articulate those addresses like we did with the ones that were appealed? And do we also have to acknowledge if there's anyone else here that
So there's one of the property owners has like a dozen addresses on here. I don't think we want to go through all that. You can just say that a number of appeals were filed but three appeared to actually be heard. One of them was resolved and effectively withdrew the appeal and then two of them the committee is making a recommendation as Councilman Miles has articulated. Thank you. That is a 70 vote for yes. Motion has been moved and passed that we approve the resolution 004-26. First Barrett. How do I want to say this to make sure that I do it properly or is this the yes first and final?
So, so the next agenda item is ordinance 003-26 amending chapter 58 street sidewalks and other public places in order to establish special event regulations for the town of Smyrna. So, that's the ordinance um that'll be considered and the mayor communicated with me prior that there might be a desire to wave the three reading rule requirement on this ordinance. And so, just how the procedures work under the town code. In order to wave that reading, there needs to first be a vote specifically on the waiver of the three reading rule. And whoever makes that motion, if they could state the reason why that rule should be waved, then we can consider that before we consider the ordinance.
I would like to move that we wave the three readings for this ordinance due to the fact that we are entering in the time of year when special events are most frequently held. So the town will benefit from the expedited adoption of this ordinance. Second. Is there any discussion? So what exactly does this ordinance entail? Did you read it? So, so right now the motion on the table is to wave the three reading rule. The next motion would be to adopt the ordinance. We could talk about the content of the ordinance now or we could talk about it when we uh vote on the actual ordinance. Doesn't really matter to me.
Well, let's talk about it now since the question's been raised. Um so as we go through this what this does this basically replaces so before the town for currently the town has regulations in um article 4 of chapter 58 right this pertains to procedures that we follow when there's parades or um in town right it has like application procedures and stuff like that. And so what this really does is this expands it to not just include parades but special events. It goes through and it requires um a permitting process. Certain information has to be provided as part of the permitting process. You can only get so many special event permits every single year. There's a period of time you can't just show up and ask for one for the next day, right? you know, you have to give at least 21 days notice and you can't get one for, you know, 2028 or something like that, right? It's got to be within the next 12 months. You have to kind of articulate what um the application is going to what the event is going to involve. Uh there's an application fee which would be standard and then within five days of receiving the application the town manager is responsible for either approving it, denying it based on reasons or um yeah. So the um so we go through we have what the actual permit needs to include, right? starting and stopping time for the event, where you plan on actually having this. If it's going to be a parade, you know, just kind of what you anticipate happening with the parade. You can only
get again no more than two in a 12-month period. Under exceptional circumstances based on standards in here, you can potentially get one on less than 21 days, right? But you have to be able to make that case. It's very clear in here that you cannot discriminate discriminate based on viewpoint, political, religious, ethnic race, disability, sexual orientation, gender related. You know, this is not it should have absolutely nothing to do with the content of the event. The idea of this is really just to make sure that, you know, we are operating safe events, that they're not destroying the town, that there's adequate parking facilities, stuff like that associated with it. Um the in here reasons why the town manager can potentially deny a permit. The application wasn't fully completed or executed. It has materially um inaccurate information in it. Um the applicant on previous occasions has received or has held a permit held an event in town and they've caused damage to the town that hasn't been fixed or remediated. Right? that would be a reason for denying that. Um, if there's already something else permitted for that area, right? You can have competing events. If the event is going to violate a provision in the code, um, and then with respect to a parade route, it defers to the chief of police if the chief believes that it's going to present an unreasonable danger to the health or safety of the applicant or other users. Right? And then in here there's appeals processes. you know, if your uh permit is denied, you know, there's a procedure for appealing it. There's indemnification and insurance requirements, which would be standard. There's cleanup requirements, right? If you hold an event, you're responsible for cleaning up. After the event, you
have to provide a refundable deposit of $1,000. If everything is good, you get your $1,000 back. If not, the town can go in and clean things up and they can, you know, whatever the town's expenses are, they can pull it out of that thousands and if it exceeds that, then the town can charge you for additional amounts. Um, so um Barrett, thank you so much. Because the information is available on on board, so all we have to do is look ahead of time and the information is there. I suggest you do that in the future. Yes. Well, it'd be nice if the people in the audience knew something about you. Well, the information available.
So, I will say this is probably um you know, I've planned events around the country and so even in small towns, this is typically standard for small towns to kind of adopt making sure you know the town knows what's happening for the event and all of that. I've seen a lot of these before. Well, it also prevents the residents of the town from having to cover the expenses of events that don't cover their own expenses. And this is our this is our our safety for that. This is the right thing. And
really, our our town manager and our chief are the ones that hear the complaining the loudest and see the dollars come out of their budget that make the tax increase that have to be made because people don't respect our town.
