Good evening everyone. Welcome to the Shannondoa City Council meeting for April the 8th, 2026. The time is 6 p.m. Everyone is here, so we do have a quorum. Uh we're going to stand up and say the pledge of allegiance to both the uh US flag and the Texas flag followed by a short invocation.

Yes, sir. Thank you. Would you please join me in a word of prayer? Father, we thank you for giving us the privilege of serving our city. We pray, Father, that tonight as we discuss our agenda, make decisions, and craft policies for our city, you will always put us in mind that our people come first. Father, we ask that you bless our public servants, our public safety personnel, this city council, and our citizens, and surround everyone with your holy angels. And we ask this in Jesus name. Amen.
Amen. All right, we're going to move to item number five, citizens forum. Citizens are invited to speak for three minutes on matters related to city government that relate to agenda or non-aggenda items. Thank you. My name is Sarah Warmath and I live in Canwell Forest on 11 Eatenshar Court. I have three small issues. One is I45 and Vision Parkway where people are pulling out onto the feeder road. The way it's marked is not clear and there people are still using the right lane and it's marked right lane closed. They don't see the sign and then there are people coming up the left lane and you got sometimes you've got two cars trying to go out at the same time. So, that needs to be better marked, please. And my next thing's about the upcoming debate. And I've been to most of the election debates, and I hope this one at this next one next week, the uh incumbents haven't suggested all the questions for the candidates and haven't seen the questions in advance because in the past, they've had just their answers have been too smooth. And that's the way it comes across. It may not be the way it is, but that's the way it comes across. So, give your challengers a chance to be heard. And then the other is from the last city council meeting. I wasn't able to come. You were talking about communication and um we used to have constant comment and that went out as an email and that was a much better way to contact the citizens. I know there's a lot of people that live here, but our church has over a thousand members and they can send out important announcements through an email. Not everybody has Facebook, not everybody texts. And you know, I don't I have Facebook, but I don't look at it regularly. So, an email coming from council would be much better communication. Mr. Alex Warmouth. I live at the same address as that lady. It's pretty. I figured that in case have been there for 20 plus years. I have a little map I'd like to hand out so I can orientate everybody on what I'm going to address and talk. Yes. that one for administrator and all you councilman and this mayor it would be obvious that I can control what we're talking about east is that east west north south in between or what
thank you Alex thank you welcome good to see you having you're looking today. Okay. So, purpose of this my asking for time and I appreciate you granting me this is at the end of the day we have a massive road problem, traffic problem on Vision Parkway and Canwell Forest.
I hoed this road five years ago with Mayor Really and made several had several meetings with him, made a proposal to him and nothing happened. It's only gotten worse and it's only going to get worse and we have to do something about it. I noticed that the survey that you currently have out addresses only the valley. Nothing is addressed on where the biggest roadblocks are in our city. And oh by the way 25% of the residents pardon me 24% if 3600 is correct population number uh they live with only one exit to get out of their neighborhood and it exits out division Parkway I'm quoting one exit where in the valley there are five ways to eress out of the valley. So we are really challenged. So, what I'd like to do is just go through this map real quickly and then make two closing two or three closing comments. Number one, uh, I've numbered the streets that egress off of Vision Parkway and Groven. One, as we go from the north to the south, two, three, four, five, six, and seven. Those neighborhoods collectively hold 24% of the residents of Shannondoa. count. I used 2.5 people per home. I didn't know what the right number was, but that's good enough. And then secondly, uh I've marked on here in green where there is constant backup. As we start to the north, you see the backup. It's uh at the frontage roof. It'll go down around the curve down at Railman Road. It's constantly backed up there. And then you see there's solid green and then dashed greens. That's an occasional backup that goes uh from Wellman Road going north. Uh the backup oftent times goes through
the roundabout. Today the backup going from Wellman Road down Grogens Mill was backed up past Park Gate. It frequently packs up past Park Gate. So all the people are very challenged to get out of the neighborhood. So something has to be done. There's several things that can be done. And oh by the way, the streets all of Grogan's all of Vision Parkways inside Shannondoa. And plus on top of that, if we so desired, we could probably put a stoplight in front of Park Gate because we have a 24 or 25, I don't know the exact footage. which is 24 25 ft rightway across that is which is part of Shannidoa. So we control that we have control of that. We have control of Vision Parkway. The root cause of our problem is that planning and zoning put too much commercial here. We have so much traffic from all these buildings with all these people coming and going all these patients for the doctor's office back and forth back and forth all the time. So we have a major problem. But yet there's several ways to address it. The proposal I made earlier with Wheeler was we would put in a new roundabout uh as you move uh west on uh Vision Parkway at about where 50 is marked on the map. And that would allow us to cut Vision Parkway from Groen's middle and then we would no longer serve as the Woodlands thoroughare bypass as the Shannondoa is doing now. So there's other ways you could put speed bumps. You could put four or five stop signs. I mean right now the stop sign at the Wellman Road backs up extensively. Extensively. I don't know how, you know,
I'm not a traffic engineer. I'm just a geologist. So, uh, I'm I'm trying to figure out what the best way to do is. So, Mr. Warmouth, for the sake of the time, gone. I'm out of time. Yeah, he's gone beyond the three minutes, but let let me suggest this that uh that uh I'll put you in touch with with uh Councilman uh uh Summerland. He's in charge of that traffic study. And why don't you do put your heads together? Let's And I'll do that. I'd love to do that. I've already done this once. I did this with the former mayor. And he says, "Yeah, we need to try to do something here."
And he said, "You propose what you think needs to be done." And I did. And he says, "Well, okay." Yeah. I've got your number. I'll give you a call tomorrow. Yeah. I can do a call also tomorrow at any time. Yeah. Good. Awesome. Okay. Thank you. Thank you very much. Thank you. That was good.
Next is Brenda Booth. I'm Brenda Booth. I'm at 292 01 Cedarwood. I live next to the park. So, my concern today is the park. Um, I'm so thankful that the council approved the new hours for the park. Unfortunately, not many people know that. And so, there's always people in the park uh either before the hours or especially after the hours. And I know I have clocked um probably five calls after hours in the last two weeks to um the sheriff's department because it's after hours obviously and someone has to come out. Um the only um suggestion I was uh going to suggest is to have a sign closer to the basketball um fence or the basketball goal, but the one sign that we have is not lit up. So once it's dark, nobody can see it.
Um and it's in it's in my yard. but signage and the only other suggestion is lights out. So, um having a safety issue, you might not want to go there, but I'm just asking for something to be um you know, added for that uh signage and perhaps how it's going to be policed. you know, I mean, you you don't want to rely on an old woman like me calling that there's black people playing. So, just thought I would mention that. Okay. Thank you. You Thank you. Thank you.
All right. We're going to move on to item number six, discussion and possible action to approve a contract for the city administrator. Mayor, council, uh, I, uh, I prepared a contract. Hold on one second. Well, one more speaker. Commissioner Wheeler, third precinct. Sorry for the way I'm dressed. I didn't recognize you. Thank you, Mayor and Council. I was uh, all the time.
I was originally supposed to meet the sheriff up here tonight, but apparently he had an emergency, so he couldn't make it. Um, obviously, uh, the reason for the visit was to come up here and just give you some food for thought as you, uh, consider this future topic about whether or not to cons continue with the Shannidoa Police Department or move into, uh, some sort of a contract with the sheriff's department. And the sheriff and I have talked about this as recently as last night, and he knows my thoughts on it. We have a great sheriff right now. Uh, Sheriff Wesley Doolittle is second to none. Yeah,
he has done amazing things with the county. No question. But having said that, as elected officials, what we all realize is that our jobs is not just to handle the here and now, today, tomorrow, next year. Your jobs are to think about the future of Shannondoa 5 years, 10 years, 20 years, 30 years from now. And when we all sat up on that dice together, that's what we made the decisions based on. Charlie will tell you because he's was sitting there 40 years ago. And so you make decisions for the end of the runway. And the problem is is you don't know who's going to be sheriff 30 years from now. You know that you have a great police chief right now. And when he's gone, you have the opportunity to hire another one because the police chief serves at the pleasure of the council. And so I would encourage you as elected officials to don't just think about the here and now, but think about when you make decisions, which I know you do because I know each and every one of you. Think about what does the end of the runway look like 30 years from now, 50 years from now. How can you help Shannonoa not only be the great place that it is today, but continues to be a great place long after all of us are gone. So thank you for the service that you do for the city. You all know this place still holds a special place in my heart. Even though I don't live here anymore, I will say that is still in precinct 3. So, I I feel okay to come up here even if none of the residents are. Um, but think about that. You know, you y'all are here to help plan the future of Shannondoa, not just today, but a long way down the road. Hopefully one day my kids who are sitting in the back of the room decide they want to move back here and we want to make sure that Shannonoa is the place they want to come back to. So thank you everybody. Thank you for the jobs that do. Thank you for serving. I know it's a thankless job. Uh look have look forward to having my meeting with you. I guess we have coming up in a little bit. And it's great to

And uh the contract has been prepared in accordance with your direction and the mayor's uh and uh our city administrator, Mr. Miselle, has agreed to that contract. Great. Let's get to work. All right, we're going to move uh item number seven. We're going to uh move to a future date. Uh we have some scheduling issues that a presenter is not going to be able to attend. So, we're going to move it to a future date. Uh moving on to item eight, discussion and possible action to adopt the following resolution. Resolution by the city of Shannondora approving the submission of a grant application to the office of the governor for the rifle resistant body armor grant for fiscal year 2027. Mayor and councel, the res resolution was actually passed in January, but the officer uh the office of the governor wanted uh specific language and so we're bringing it back for approval with the specified language that the office of the governor requested.

Do we know what any of that change in verbiage is? What is the change? So, I believe it's regarding the um CFO that who they wanted and as put in as the CFO. I believe that was the verbiage.
Yeah. It's actually they they wanted a person in charge and I think we put Lisa. Yeah. So, what it required was the uh authorizing um official and the financial official had to be listed in the resolution because it has to match the grant application and then the title of the grant had to be reworked to what they preferred and then we had to have the grant number also included on the resolution. Item number nine, update regarding the the IDC, the integrated development code. Mayor Council, this is a continuation of the uh sum of the updating of the integrated development code that we call the IDC. Tonight, we're going to talk about what planning and zoning has recommended for chapters 6 and 7. I will say that chapter 6, uh the city has a fair amount of discretion as we'll talk about chapter 7. It is regulated in large part by chapter 211 of the Texas Local Government Code. And so a number of the changes that you will see to chapter 7 uh are actually mandated by our legislature. First, I'd like to talk about chapter 6. What is chapter 6 in our IDC? It sets forth the six or I'm sorry, five governing bodies that deal with the IDC. And if someone wants a variance, a special exception, wants some change to something that's in the IDC there. This sets forth the procedure and who would handle those changes. Our current IDC is divided uh into five six parts but five parts that deal with each of these review bodies. One being city council which is in section 6.1 planning and zoning which is in 6.2. The board of adjustment
which city council currently sits as a board of adjustment but that is 6.3. our community development director who is currently Jackie Thompson her duties responsibilities are set forth in chapter 6.4 and the development review committee a committee that was set up in the IDC but which has never been put into existence is in section 6.5. If you want to look at how someone appeals or or ask for a change in our IDC, the order of review is set up uh if you'll switch the the order of review is set up in four areas. The first is the community development director who has certain abilities to make changes or allow changes. The second if it existed would be the development review committee. The third is planning and zoning which makes recommendations only to city council. And then last and the final decision maker is the board of adjustment/c city council since you are one and the same. In practice, our procedure is the community development director handles minor things and and interfaces with someone who wants a change. Our planning and zoning commission, listens to the change proposed changes and makes a recommendation to city council who then city council makes the final decision. You'll notice what's missing in our discussion again
is the development review committee and that is section 6.5. We'll get to planning and zoning has recommended that that be eliminated since it's never been used and we don't see a current use for it. Now going through some of the specific changes in uh chapter 6, the first real change that we have is has to do with planning and zoning commission and those changes are found in sections 6.2.3 and 6.2.4 four and it has to do with membership, vacancies and terms. And what we propose and what planning and zoning has proposed is that those be adopted handled by ordinance as we have one now for this. But this avoids if we want to make a change to the membership of planning and zoning or if we want to put term limits or how we handle a vacancy, we can easily change that through an ordinance. And so you will see the change in wording here that's proposed all will say in accordance with city ordinance or pursuant to ordinances of the city of Shannondoa. The next change actually is to variances and that is uh what would be section 6.3.4 or page 183 in your handout and that is dictated by the legislature who decided that uh variances should uh be handled slightly different than they have been in the past. And so
the language that you see there is taken right out of chapter 211. Uh the next change is on the next page, page 184. And that is the same thing. The legislature decided that if someone wants to appeal the decision of the board of adjustment or in our case city council that that can be handled by a district court or the new addition a county court at law. Uh so that those is is another governmental change. The next page you see is section 6.5 and you'll see the word omit that was that is the development review committee. You can see even if we had a committee the members were the wastewater utilities department, the fire department, the building departments we don't even have. Uh and so recommendation there is to omit section 6.5. And then turning the page to section 6.6, you'll see four items. And this is a chart and it is a summary of the review authority and actually based upon recommendations from city council. The only changes there would be that uh planning and zoning commission would review variance request, special exception request, appeal of an administrative or interpretive decision, and an appeal of a site plan decision. In other words, instead of that going straight to city council, first it would go to planning and zoning for a
recommendation. And those are the changes other than a few typos and things that are part of chapter 6. When we move to chapter 7, chapter six talking about each of these entities and their powers and how they're organized. When we go to chapter 7, these are the procedures to be followed by the planning and zoning commission or city council when someone has requested a change, a variance, a special exception, some type of modification. This is largely governed by state law, even though we do have some say so in this. And what you'll see is in the first is section 7.1.3. Again, this was a city council recommendation and it fits the chart that you just saw where we added that planning and zoning would take the first look at a variance request or an exception request instead of going directly to city council. The next uh uh change is in section 7.1.5 and that is those are appeals where someone is appealing the decision of the planning and zoning commission uh and the procedures before the board of adjustment. And those changes are directly uh the result of changes in state law. Uh this next page, who can appeal section 7.1.8?
Again, this is taken out of the new chapter 211 of the Texas Local Government Code. And so we simply are complying with law as to that change. Now the further have we had any any of the uh appeals that would fit into this process?
Uh so far we have not. Uh everything that since I've been the city attorney, uh we've really had very very few. We we've had none that got appealed beyond uh city council. Zero. Number two is uh we pretty much let anyone appeal. And so this change kind of broaden who could appeal. We we we let everyone that wants to appeal appeal. So these changes don't really affect us in any way.
Question. Question. Variance we've seen plenty of. Yes. When they use the word exception, what would what's the use case for exception? Uh it's defined in here, but a variance is uh an example would be uh I don't I don't want the 30 foot vegetative barrier. I'm asking that it be moved to 25 ft. And I'm asking that parking uh I don't have to have 25 parking spots. I only have to have 24. A special exception. And I'm trying to think of an example. Uh
I couldn't think of one that we've ever addressed. I I don't believe we've ever had one, but but I was curious to know what one would be. it it you're saying I would like uh not an exception from a rule like that, but it's an exception more from the legal uh side. I I'll have to I'll have to try to think of an example because I don't believe we've ever had one. Variances are what we see 99 and 9/10% of the time. believe they're all encroachments on building lines or property lines or something other.
Yes. Yeah. Uh the next change is a change that we're making, not required by state law. It's on page 200 and it is section 7 I got to go back and look at 7.3.1 and that is a dealing with PDDs and the minimum land area in the past our minimum land area for a PDD has been 10 acres we've used up so much of the land developed so much of the land in the City Planning and Zoning has suggested making that five acres so that if you wanted a PDD, you would have to have five or more acres instead of 10 or more acres. That's one for you to consider. Uh the next change 7.3.2 is simply a change. If we eliminate the development review committee, it would go to Jackie or who is now the community development director on submission requirements. Uh then our next change still on PDDs is section 7.3 on page 206. This is an important one again not dictated by state law but would be our decision and that is in the past and our current IDC says that a plan development district if it is inactive for five years can be terminated and planning and zoning is suggesting that that be moved to three years of inactivity.
uh uh then the next change that you see only has to do with uh mixed use properties but I think it's important and that is it is on page 213 and it's section 7 let's see I got to look at the page before to give it to you 7.4.2 two and that is exterior building materials. Uh the planning and zoning wants to absolutely omit tile. They asked at their last meeting to take a second look at this because the suggestion at the end of the meeting was that we divide that into two parts. one building materials. Remember this is a mixed use commercial residential that we divide that commercial building materials a little bit different than residential. And so they wanted to take a look at that and come back to you with their final thoughts on on whether to do that or not and if so how that what those changes would be. Uh and then our last couple of changes uh go to page 226 section 7.5.2. This is again the review process and it simply changes in this section from the uh community uh develop development review committee to the development uh community development director and then
the criteria for v variances and that's the next page 7.7.3 three. For some reason, the legislature decided that it did not like the criteria for variances. And so everything that was our criteria in 7.7.3 that we've had since 2011 is gone. And if you turn the page, there are now five new criteria, all dictated by the legislature. I will tell you that they are not substantially different, uh, but they make getting a variance a little bit easier. Uh, and then the very last one is page 233, special exceptions. This is the one Councilman Ray Maker asked about. And the legislature again made this change to allow from one nonconforming use to another nonconforming use. And that reminds me, a special exception has to do with a conforming use. And uh if if you want a nonconforming use of property, instead of asking for a variance, you would ask for a special exception. So those are the proposed changes to chapters 6 and 7. Uh next time we're planning on handling chapters 21 and 22, the next meeting after that 22 to 25. And then uh the last thing that we will tackle is chapter five because planning and zoning is still regoing through it
again and that's the one that has number of parking spots, vegetation requirements, height requirements and uh they had not looked at that in a couple of years, year and a half or two years and want to that one we deal with so much of the time they want to take another look at. Thank you, mayor. Uh first of all just want to say I'm happy to be here and serving the community of Shannidoa. The past three days have been a little bit of onboarding and meeting staff and I plan on doing more of that and then also uh plan on meeting some of our community partners as well. So happy to be here. Uh I do have a few updates that staff has given uh to me for tonight. The Shannondoa Sharks will start their swim season next week on April 15th. Uh pool registration is open for the season. Uh Saturday, April 18th from 10 to noon, the city will host a cupcake decorating event at the main park. So that should be a really fun event as well. And at the moment, that is all I have for you this evening.

Uh just like just like to make a a reminder to everybody that early voting for city council begins on Monday, April the 20th and it's at the county library. So please show up. Yes, Mr. Mayor. Uh I would like to make a comment about uh trash service. We've had uh certainly all of us have had an opportunity I think to read comments from our citizens, but we have some folks that are having challenges. Uh it's been ongoing. You can tell that uh based on their the tone of their comments. I've fielded questions as well just face to face with folks. And I know that we we struggled. we we had to go out to bid a new contract because the one we had expired. Uh that it was our desire to save our residents money as much as we could and still try to maintain the level of service that we've grown accustomed to. But we've off actually lost some of that service, that ability, the the every heavy pickup, every trash day was something I think we know we all enjoyed. I certainly did as well as as uh my uh my friends and neighbors. That's gone. We we only have it once a month now. So, uh I just I don't want to be pennywise and pound stupid. And I would really like to uh address this with um with our staff. I've asked the mayor uh to consider uh addressing the staff with it and he may have something he wants to say about it. I I don't know. But I I definitely want the folks out there to know that I'm I'm anxious to try and find a solution uh to what right now is becoming an aggravation for our residents.
That's all I just by increasing
perhaps uh taking a look at maybe twice a month. Let's get a cost of what would what would what would be involved in doing twice a month heavy pickup and then maybe go back to every every day every every you know trash day. Uh certainly I know there'll be more cost. Uh can we do it do can we do it without rebidding the cont. There's a lot of questions that I think uh certainly our staff can address with us at the right time but sooner than later. Well, actually, Joseph and I have had this discussion and uh for the last couple of couple of weeks since the uh the number of people who have had issues with uh not only just not only the uh pickup or not garbage not being picked up or some some uh bumps in the road there with uh with Republic and their service. We also uh discussed uh uh getting back to the table and discussing multiple bulk pickup days during the month with Republic. And uh Joseph, would you uh bring us up to speed on what the results of those uh conversations have been to date and then we're still we're still discussing this with them?
Yes, sir. Absolutely. So staff has reached out to our account manager with public services and asked them to provide us uh pricing what the price would change if we went to two bulk pickups. So one on the first collection day and on the third collection day and also pricing if we went two bulk pickups every collection day. So we're still waiting on those. The last correspondence we had, they said it's going to be another couple weeks, less than a couple weeks. They should be able to get that pricing to us. Uh, in regards to the contract, as long as it doesn't change the price beyond 25%. You could amend the contract and and get that worked in there. If it does go beyond that, then you would have to rebid the project.

All right. As uh what I have is as as was stated by U. Commissioner Wheeler, uh, Sheriff Doodle, uh, wanted to come and and, uh, address an issue that's been floating around in the city and has become a, uh, uh, kind of a subject of discussion. I've received many phone calls and and and uh and uh expressions of concern about our police department and Sheriff Doolittle has also heard these these complaints and he uh he sent me a letter which I received late this afternoon and he asked me to read the letter to the both the council and the residents and the uh letter reads as follows. Dear Mayor Rscaro, I wanted to take a moment to share the position the position of the Montgomery County Sheriff's Office regarding law enforcement services in the city of Shannondoa. Your city has a wellestablished and effective police department, and it is important to me that there is a clear understanding of our role and intentions. To avoid any confusion about law enforcement responsibilities within your city, I want to be clear that the Montgomery County Sheriff's Office has not entered into, does not intend to enter into, and has no plans to pursue any agreement to provide law enforcement services to the city of Shannondoa.
