Okay, so I just would like to comment on the resolution application of Lynn Culligan submitted to the Town of South Island application for zone change district essentially a spot zoning for one property this application there was an application submitted to the CBA which was to remove for use variance to allow ADU in the property which was which is in near shore overlay so Now another application came back, this time to the town board, for doing the opposite. Instead of putting ADU in an SO, which is not allowed in a town code, to remove the whole property from there. The effect is the same. So my first question is, what's unusual about it is the application showed up only today on the website, literally a few hours ago. And upon prompting from somebody, you know, why is that resolution not there? And second, the public hearing is to be held on 29th day of June 2026, which is like seven weeks away, which is kind of unusual because normally I see the announcements of the public hearing two weeks in advance or three weeks in advance. So how come it's seven weeks in advance? Do you have an answer for that?

Costello Marine Contracting Corporation dated January 16, 2026 and approved by the New York State DEC on February 3, 2026. And whereas on April 27th, 2026, the public hearing was held on the subject application where public comments were received and taken under consideration. And whereas the subject application was referred to the Water Waste Management Advisory Committee and the report was taken into consideration. Now, therefore, be it resolved that pursuant to New York NYCRR 617.5 Section C, number 2, this application has been deemed type 2 action. Reason supporting this determination. The proposed construction consists of the replacement of 128 feet, 6 inches of bulkhead and 12 foot North return is a replacement to existing structure and therefore does not require coordination with other involved agencies. and be it further resolved that the Town Clerk is hereby authorized to issue a permit for the aforementioned construction as per specifications filed after said applicant pursuant to section 53-9 of the Town Code of the Town of Shelter Island as filed with the Town Clerk a certificate that the owner has at least $300,000 liability insurance on the location in operations covered by said permit a copy of the contractor's current home improvement contractor's license and a certificate from the contractor performing the operations covered by said permit that said contractor has an owner's contractor's policy issued in favor of the Town of Shelter Island for the liability limits of at least $500,000, covering operation of the contractor pursuant to said permit. It be of further resolve that said operation shall be completed within two years from the date of issuance of this permit, said permit is subject to the recommended limitations and any requirements that may be necessary under the New York State DEC, the Army Corps of Engineers, and any other agencies having jurisdiction. Whereas the West neck water district board of directors has reviewed the operational and financial needs of the district and has recommended a one half. Percent increase in water usage and access rates and whereas the town board has reviewed the recommended. The recommendation and finds the proposed increase to be reasonable and necessary and whereas the proposed revised rates are as follows. The usage rates will increase from. $11.11 per gallon up to 15,000 gallons to $11.17 per gallon. The usage rates will increase from $14.65 per gallon between 15,000 and 30,000 gallons to $14.72 per gallon. The usage rates will increase from $19.19 per gallon over 30,000 gallons to $19.29 per gallon. quarterly access fee for residential customers will increase from $81.25 to $81.65. The quarterly access fee for commercial customers whose annual usage the previous year is under 75 000 gallons will increase from $162.50 to $163.30 The quarterly access fee for commercial customers whose annual usage for the previous year is between 75,000 and 200,000 gallons will increase from $250 to $251.25. The quarterly access fee for commercial customers whose annual usage for the previous year was over 200,000 gallons will increase from 625 dollars to 628 dollars and 25 cents. Now, therefore, be it resolved that the town board. Hereby approves the recommendation to increase the above reference water usage and access rates by 1 half a percent. So moved 2nd and discussion.

And whereas the town board, police chief, and highway superintendent discussed the request at the board's May 12, 2026 work session. Now, therefore, be it resolved that the town board hereby approve said request with the conditions that all signs be placed in a manner that does not obstruct line of sight for motorists or create any roadway safety hazard. and that all signs be removed within 24 hours after the event. Hi, good evening. So our office issued two review memorandum dated February 10th, 2026 and May 12th, 2026. In those reviews, we requested that the applicant provide confirmation of the wetland delineation date and submit any prior archeological studies and associated agency correspondence. Since that time, the applicant has provided the wetland information and this firm has no further comments regarding the wetlands. With respect to cultural resources, the applicant submitted an archeological report that was prepared for a prior project. And we had reviewed it to determine whether previously studied areas overlap with the areas of proposed disturbance. However, there is no overlap. In both reports, I did request a copy of the lighting plan because their plans do note that they intend to install new lighting fixtures on the barn. We had also had some concerns regarding the proposed overflow parking plan. They did provide a parking plan, however, It doesn't appear to meet general engineering principles. Specifically, backup aisles are recommended at 24 feet in width when you have 90-degree head-in parking. Also, one of the ADA-compliant parking stalls appears to be partially impeded by the ramp that goes into the existing barn, so that is problematic. They did indicate that they are intending to keep the parking grass and that they would put in some trench drains along the southerly portion of the grass parking area for drainage purposes, which is recommended. We did recommend that if you elect to proceed with the parking plan as shown that you double-check with the town engineer to see if they have any concerns. or if they need to get a variance for the required parking. It may make sense in some cases to maybe ask for a variance or maybe require that they use valet parking if they intend to use that overflow parking lot for large scale events. And then again, we're recommending that they submit a revised project plan that shows that the ADA compliant parking spot that they are proposing is unimpeded whether that means shifting things around, that's something that we're recommending. And then finally, again, we are asking for that lighting plan. One other recommendation to ensure that there is no encroachment from any of the parking areas, the board may want to consider installing a post and rail fence to prevent encroachment on those wetlands to the north on the property.

The parking capacity for the project should be updated based on the actual interior square footage based on the methodology and the code, which includes all interior space irrespective of occupancy.
