All right. Good evening, everybody. We're going to start with item number one, citizen participation. As usual, three-minute limit per person, 12-minute limit per topic. And first up, we have Ms. Linda Agee.

I'm speaking to you this evening as a resident of Shawnee Lake. I sent an email to all of you and to the city manager about a month ago about the short-term rental ordinance in relation to the Twin Lakes District. And I'd like to thank the mayor and commissioners O'Neill and Fichtner for responding or acknowledging my email. I appreciate that. Some of you were not on the commission at the time this ordinance was passed. So what I'm asking is that you look over this handout and bring it back to the commission at a future agenda for discussion and possibly some changes. There are environmental issues why some other cities, like Oklahoma City, Edmond, Norman, do not allow Airbnbs on the shores of their water reservoirs. Their frequent turnover of gas increases pollutants into the lake. There's an increase in trash, fuel spills, and overloaded septic systems. These septic systems were designed for residential use, not large parties. There are also safety issues. Transient tenants not familiar with water safety and city regulations are at a higher risk of accidents. And they don't take as good a care of these properties as what the full time residents do the roads around the lake. We're not designed for heavy traffic. Many are narrow winding gravel roads with steep ditches and dead ends with no turnarounds and no lighting in the evening. except during peak summer months when there is a lake ranger on site. Emergency services are about 15 to 20 minutes away, so there's definitely some safety issues there. And that's a strain on city resources with very little revenue in return. The city must issue licenses, inspect the rentals annually, and respond to nuisance calls. There are currently six lakefront Airbnbs advertised, And the city clerk's office can only find the annual inspection reports for two of those. I'm not sure why the discrepancy is there, but there's obviously an issue that needs to be addressed. And there's the community impact, last but not least. The majority of these are occupied full time. At one time, most of these were vacation properties, but that's not the case anymore. There's two clauses in the Cabin Site Lease Agreement that give the city control over and oversight of who occupies and uses these properties and how they're used. No lease shall be assigned or sublet and the transfer shall not become effective until approved by the Board of Commissioners. This short-term ordinance takes that control and oversight away from the city. Transient tenants tend to have parties involving alcohol, create more disturbance, and increase traffic on rural roads and shared driveways. Frequent turnover of tenants in a remote area, and a lot of these properties are close together, and frequent turnover a long way from any emergency services creates security concerns. So I am asking if you would please look this over and consider putting this on a future agenda for discussion. Thank you.

Your Honor and city commissioners and the assembled multitude here. There will be some who will quickly say, preacher get back in your lane. Immorality, wherever it may be found, is a concern of all. I believe, underline, special font, I believe that the data centers are immoral from their conception, they are immoral for their implementation. Following last month's meeting, I took a deep dive into this subject. And like some say on the internet, once you look, you can't look away. Data centers contain a lot of information about you and I. They contain information that is so predictive that the Iranians, please listen, Iranians use anthropic, which is one of the larger sites, to predict where some of these ships were going to be before they shot them. That is not a good thing. What is happening now is across our land we have almost 5,000 data centers. The largest one being, and this is great, great wave cover-up, the largest one is in Loudoun County, Virginia. Not up in the hills, but across the river from the big, deep Who do you think is excited about it? Why, the people there in Loudoun County. They have $200,000 annual incomes. That's a pretty good chunk of change. There's one being planned for Louisiana that will be as big as the borough of Manhattan. in New York City. It's estimated it will take more electricity than what is used by the city of New Orleans. It is wrong to have information about citizens predicting who they are, predicting what they'll do, predicting where they will go. I hope, I hope we stand firm against it. I have seen some citizens, and right now there is an uprising across our great land. Some citizens have been barred by armed guards from coming in to council meetings and shuffled off to side rooms where they cannot ask any questions. I urge everyone here, including those behind and those that may be observing on TV, take a look at what's going on. I close quickly by a comment that I... Non-disclosure agreements. You heard of those? Where you can buy a farmer's property worth about $200,000. It's been a privilege addressing this Augusta group.

Good evening mayor and commissioners. Um, I want to start by saying, thanks to commissioner seahorn for his service to our community for a lot of years. Um, we really appreciate all that you've done. For this community and appreciate your service and I'm excited to. Work with our new commissioner as she joins you guys up here this evening. Just a couple of items that I wanted to talk about. This weekend, as I was driving to Pedalpalooza, I drove down Bryan Street and I noticed 50 people, I counted because there were so many people on the Bryan Street Trail this weekend. So about nine o'clock on Saturday morning, about 50 people were walking, jogging, and there were about 10 strollers. So it was really great to see a bunch of families out using the Bryan Street Trail. I think this is proof that people want a safe place to walk in our community and are actively using that space. Pedalpalooza was this Saturday. We had a great turnout. It was down at Rotary Briscoe Boy Scout Park and it was highlighting safety for both drivers and riders for bicycle usage. It was our largest community bike ride of the three years that we've had this event. We gave out free helmets to kids. There were bike giveaways and lots of other great stuff happening down at that event. And I wanted to highlight this Friday morning at 10 o'clock in the morning, we have our Shawnee High School Homecoming Parade. We invite all of you to join us as we pack downtown. Wear your navy. And then I also would like to extend an invitation to each of you to join us for National Walk to School Day on October the 7th. We invite each of you to join at one of the participating sites in our area, including Grove.

and this event will highlight the importance of safe routes to school for our students so thank you thank you ma'am next up we have crystal romanition good evening mr mayor and commissioners thank you for having me this evening to share some of the things that have been happening at shawnee forward i had a project pipeline report that I shared with each of you. And I wanted to comment on a couple of things that I am able to share, that we have nine projects in the pipeline right now, totaling nearly a billion dollars in capital investment and representing nearly 1,500 jobs. And while we won't get all of those projects, I think we could probably all agree that a portion of those 1,500 jobs and a portion of that capital investment would be very welcome in this community. A few of the things to note is where those projects are coming from and what sectors they represent. The majority of them, seven out of the nine projects, represent jobs in manufacturing. And filling those vacant buildings, the larger industrial buildings, has been a priority for Shawnee Forward for the entire time that I've been here, the three years that I've been working here. We've been trying to fill those and create jobs for this community in those buildings. One of the things that is very apparent is that the relationships we have built are bringing those. Those leads to us, most of them coming from the Oklahoma City partnership, but our retail contract with the retail coach has brought 2 of those projects that we're working on to us. And then other sources are always coming to us. Some of those coming from site selectors themselves. and as well as other sources of folks we have relationships with who know our community well. I wanted to just expand on one of the projects. We did a second visit with a community, with a company last week, and after the 30-minute windshield tour that we took them through this community, I wanted to share their notes. They really recognize this community as just a lovely community, and they appreciated not only our educational institutions but our housing, both the established neighborhoods as well as the new residential. And they really loved going through this community, and I think that will serve us well in their consideration. We also have a small business growth grant that we have six businesses who have applied for it. These are businesses that are smaller. I think most of them are less than 30, although the grant does allow for under 50 that we'll be reviewing shortly. We did take a portion of the city contract that we're contributing to that fund. I also wanted to thank Commissioner Sehorne for your support. While I have been here, and certainly in the years before, and congratulate MS. IRVIN ON HER JOINING THE COMMISSION THIS EVENING. AND I WANTED TO THANK CITY STAFF FOR ADDING THE BUSINESS LIAISON POSITION. I THINK THAT WILL BE A GREAT ADDITION FOR HELPING US WORK WITH BOTH OUR EXISTING BUSINESSES AND THE BUSINESSES WHO ARE LOOKING TO INVEST IN THIS COMMUNITY. good evening. Two things in business and one thing that's actually kind of fun. Last month when, I'm going to bring up the data centers too, last month when we talked about it, I went and did some research, and two days after last month's meeting was the actual cutoff for the November election. So technically, and I know that's short term, technically it could have been on the November election. However, in the future, February 9th is the next possible time for an election. December 10th is the cutoff for that. April 6th is the election after that. The cutoff for it is February 4th. And here's the beauty of it all, and this is why we should ask the peasants more questions to be answered at election time. It costs less than $15,000 if we pay for it ourselves. That's if nobody else has an election and we pay for it out of pocket. It only costs us $15,000 to ask everyone in Shawnee, what's your opinion on a topic? That's cheap. That's really cheap. So I hope in the future, instead of making decisions about data centers, we actually put it up for a vote of the people. Because for good or bad, the majority rules. And if the majority of Shawnee doesn't want it, it shouldn't be crammed down our throats. So with that, the next one, I don't have a license plate or I'd be more than happy to give it to you, but someone needs to have a discussion with some of the city employees that you can't flip on your orange lights and go around a school bus with the stop sign out. Everybody knows that means you don't move. Because, and I hate to be extreme like this, but a city employee comes around a school bus and kills a kid, and then that parent beats that employee to death? Not guilty, Your Honor. every single time because all it took was not going around the damn school bus that's simple gang and that's something we really need to approach with some of city staff last thing the fun part this coming saturday on the 26th at 9 30 a.m at the community center down there in farrell park where washington school or the alternative school for my generation is we're going to open up the time capsule that came out of Washington School. It's a box about, oh, yay big, about yay thick. It's copper, been soldered shut for about 89 years. Should have some pretty cool stuff in it. And for everybody around here, if you really want to learn some history, because none of us were alive back then, well, maybe one or two in this room maybe, but most of us weren't. So this could be some...

He's picking on you, Glenn.

So this could easily be some pretty interesting history. And we're looking at taking this history and adding it into a new time capsule when they do the memorial for the new park. So we get to keep history going. And maybe in another 89 or 100 years, our grandkids will get to dig that up and go, man, were they weird back then. So with that, thank you for your time. Item number 10, consideration of a resolution supporting Shawnee's application to become an official Main Street designated by the Oklahoma Main Street Center. Calling Stacey Kramer-Moore, Director of Tourism, for a staff report, please.

Mayor, Commissioner, and friends, my name is Stacey Kramer-Moore, and I have the privilege of being the Director of the Tourism Department for the City of Shawnee. This evening, we are asking the Commission to approve a resolution as the first step for our community of Shawnee to regain our status as an official Main Street, certified by the Oklahoma Main Street Center and the Oklahoma Department of Commerce and the National Main Street Center. This is part of the trajectory that you all steered us on about a year ago when we brought Stephen Caranda in as an employee to work primarily with downtown. The proposed resolution would allow the application at the network level, which is the first kind of beginning level. This level provides guidance and incentives of a traditional Main Street organization while allowing the Main Street community stakeholders to determine the best path forward for our specific community. Main Street certification is truly a public-private partnership. Neither the city nor the business owners can do it on their own. We have to work together to make this work, and we have to work together to even complete the application. A certified Main Street is expected to track and report many types of data, including public and private investment, volunteer hours, businesses opened or closed, facades renovated, employees hired, unifications, and many others. A few incentives of being part of the official Main Street program include the opportunity to apply for financial assistance from the Oklahoma Department of Commerce and private foundations set aside grants specifically for Main Street communities. The network level is up to a two-year commitment. At that time, they will judge whether we've worked hard enough to be able to move on to the next level or they will ask us to leave the program. So we are time limited in kind of getting our act together and getting this moving forward. Upon successfully reaching the fully designated level, which will probably take us about five years, many other opportunities open up for us. And those include things like engineering, architecture, and professional design assistance as part of being a member of the official Main Street organization. So I'm happy to answer any questions at this time.

Are there nearby communities that have gone through all three phases?

There are. I would have to check my numbers to see how many are officially in the program right now. I believe it's in the 30 range, about 30 communities all over the state. Some of the most successful runs right now I would say would be Sepulpa. If you haven't been to their Main Street, it's fabulous. And especially if you saw it about 10 years ago from where it is today, it's incredibly well done. Muskogee, there's trend is moving forward for some of the metro areas to have multiple main streets. And so those are several of the members. I can't remember if Ada is still an official main street or not, but it was certainly one for many years as well.

Good evening, Mr. Mayor, Commissioners. This will be my third time at this podium about this document. It's only because we're very thorough. the consummate bureaucrat that I am when this body approved the new policy for leasing and setting lease rates for different things we made an update then following that decision to the airport's minimum standards document which is a voluminous document that speaks to many of the different rules regulations processes and procedures for the airport following that adoption of that change of the minimum standards after the change of the lease policy we now have to reach into the ordinance and change the citation date. So this one is really very simple. It's three sections of the ordinance speak to specific dates of the additions of the minimum standards that are currently active. So with your patience and permission, if we could, we could update that section of the ordinance to make it accurate and show the most recently adopted policies.

Yes, sir. As Finance Director mentioned, it wasn't in the budget for this year. Our original plan was for next year. We came across this opportunity that will save us about $350,000 versus a brand new one. Okay. with that i answer any questions you might have any questions anything new for brad i'm just curious what does a paver do lays asphalt and it pushes it down yep so it's asphalt only yes i was just curious okay i do have them for concrete this is just asphalt okay is it specifically for potholes uh or is it just painting in general um We don't typically use that for potholes. We have a patch truck for potholes. Okay. This, if you've been in the area of Draper, Margaret, Alice, Edwards, those areas we've overlaid with this machine. Okay. If you had a chance, you can drive by and see. We just completely overlaid the roadway. Awesome.

I was just curious. Operated by our own staff?

Correct. It's in tandem with the unit rate paving contract, addressing the worst that we can. Thank you.

Item Carrier 7-0. Item number 15, acknowledge monthly sales tax report. Caller, Kimberly, once again.

The sales tax for September totaled $2,707,827.47, which includes $4,595.25 in interest. The revenue is distributed across the eight funds. The receipts in September are from estimated August sales and final sales figures in July. September 2026 collections had a 0.15% increase over September of last year. When comparing collections to the conservative budget, projections for September were 2.08% below projections for the month and 0.64% below collections year to date. Use tax for September totaled $360,080, which is 1.52% above projected collections for the month. When you combine the use tax and the general fund portion of the sales tax, general fund is currently $39,237 above budget projections. On the third to the last page of the report is the sales tax collections comparison chart by month for the last 12 months. This comparison includes Shawnee's peer cities of Yukon, Ardmore, Muskogee, Larksville, Stillwater, and Eden. These cities were selected with three factors in mind, population, city tax revenue, and revenue per 1% sales tax. Some of these cities saw an increase and some saw a decrease in sales tax from September 25 to September 26. On the 2nd, to last page of the report is the use tax collections comparison chart by month for the last 12 months. The comparison includes the same. Shawnee's peer cities, most of those saw a decrease in the use tax from September 25 to September 26. The last page of the report is the graph that shows the year-over-year sales tax growth by month. It also captures the South Region Consumer Price Index as well as the average year-over-year change for Shawnee sales tax receipts over the last 12 months. Four of the last five months have seen an upward trend when you look at year-over-year by month. I'm happy to answer any questions you may have.

Any questions for Kimberly on this? Tax report. Am I reading this correctly that the use tax receipts year-over-year for September were up 42.5%? Is that right? September 25 to September 26? Yes. Wow.

Pretty impressive there. We're pretty high with the use tax so far this year. Yeah. Okay.

I feel like a one minute response time is pretty darn spectacular. And I won't go into the details, but just very well done last week. So I appreciate them. And we need more rain. uh i also want to echo uh the fellow commissioners here and thinking uh mark um yeah now he's now he's a citizen right so mark seahorn for his service um i also kind of want to bring to uh the topic here that we at the city have a lot of committees and commissions and authorities and we just had an authority a position if you look at the consent agenda that's been vacated. So I want to encourage citizens to participate and go to our website. You can fill out an application to join a committee or one of our authorities or commissions that we have. I think, you know, we're always looking for people that are interested in helping serve the community. So I wanted to kind of point that out since we had a gentleman leave. I also would like to encourage everybody to come to our homecoming parade, 10 o'clock, Friday. It's been a while since we've had one, so come on down. October 7th, Walk to School Day. That's posted all over Facebook. If not, call me. I'll tell you where you can go. Looking forward to being part of the Main Street program again. I'd like to see what we can do for downtown. And then... Also echo what Mr. Morris brought up, the Washington time capsule. It's going to be a good time. It's pretty great. We're going to have teachers that used to teach at Washington School be there. Students that attended Washington School will be there. Like everybody in here that was alive then, I'm sure you remember exactly where you were when this happened. It was a world-changing event. We're still feeling repercussions of it. Welcome you aboard, Shawna. I hope you have so much fun with it. You're going to love it. Every single minute of it. And I kind of wanted to point out the tourism department because I have had, you know, I'm back at work now. I'm in the Midwest City area five days a week. And when people figure out that I'm from Shawnee, that I live in Shawnee, I usually get the unsolicited comments of, I saw them on social media. And it's usually good. Some of it's tourism-based, though. I'm seeing, you know, commercials like the Cellular Company. I saw that commercial recently. That was shot at Lunchbox a year ago or half a year ago or something like that. So we have outreach even when we don't feel like it. So I appreciate all the work that you're doing, and I love the affirmations that I get from outside of our community about us. That's all I got.

Good evening. The staff received an unsolicited proposal from this company to provide detailing services for based and transient aircraft. If it sounds familiar, this will be our third company seeking to set up shop at the Shawnee Airport. They are an ad hoc, on-call sort of service, so we don't have a lease agreement with them. In order to protect the interests of the airport authority, we do ask folks who provide this kind of services to work with us on a commercial use agreement that ensures that we can have insurance with our name on it.

The Ishani Alano or Alano Club has been a tenant of the airport since 1972. Several years ago they got into partnership with Gateway to have Gateway sort of administrate and manage their program for them and at that time they asked to transfer the lease over to the Gateway. Unfortunately Gateway has C-Story business or is the process of C-Story business. And so they've asked us to please, if we would consider trenching the lease back to the folks who are just that segment of service, which is the Alano or Alano Club, because it depends on which part of the country you come from when you say it. It's for a very small plot of land just across the street from the airport. It's right next door to the Shawnee Little Theater? Right next door to the Little Theater, yes.

Item 4, carry 7-0 on item number 5, consideration of granting a right-of-way easement to Oklahoma Gas and Electric, OG&E Company, to provide electrical service to the Oklahoma Military Department Readiness Center. Once again, Bonnie.

So thank you again for taking the time to review this. The Oklahoma Military Department is in full swing construction on the new readiness center on the west side of the airport. In order to provide power to that new site, OG&E needs an easement. In order to do it at the airport, we had to do it just slightly differently. And I'd like to compliment Joe, please, helping me go through the standard easement paperwork and turn it into FAA compliant easement paperwork. So thank you for the efforts he put in on that. So as we continue to develop at the airport, we now have some opportunity to do it so we can stay in compliance with everybody's rules, which makes things really nice. And we'll be able to provide power to this development without creating any kind of hazards to aircraft operations.

Item number 6, consideration of a resolution to declare a certain Shawnee Airport Authority personal property surplus and authorize the donation of the property to the Gordon Cooper Technology Center Aviation Maintenance Technology Program. So this is another opportunity to partner with the community. We had a tenant who was hangering his aircraft and some equipment in one of our smaller hangers. The lease has been terminated, and he chose not to remove his personal property. The good news is it's a biplane, which is fairly uncommon these days. And the students at the Gordon Cooper Aviation Campus were just, please, please let us have it. And they wrote us a letter to say that, so we have it for the record. It is very small. It will fit into their existing facility. so there won't be any need to push something out of the way. But it is unique and different from the types of aircraft they have been able to work on. So if you will approve this action and grant the request to declare the property surplus and available for donation, the students are waiting to come pick it up tomorrow morning.

Correct. We use it to spot other utilities as well as dig up, excavate meter tiles to repair those with the newer set of call OKI rules. We use that instead of call and locate for all of our daily activities. Very useful piece of equipment.
