All right. Uh, we'll get to the audience participation point of tonight. Anyone with comments on tonight's agenda, please step forward and you have three minutes. Um, give your name and your address, please. No, come on up. Yeah, just your name and your address on. My name is Brandon Bess. Address is 1218 Maple A Sunduski. Um, I'd like to start off by giving you a quick introduction. Brandon. I own Pipe Creek Enterprises. I want to speak on the uh agenda topic uh number six, the phase two at Shelby Street Boat Ramp. So, I'd like to pref preface this with um I was in fact one of the biders on this project and I am not up here to fight for my bid in any way, shape or form. I just want to make sure that all facts are presented so that you can make the most educated vote and decision possible on this topic. Um, this topic has been surrounded by some controversy over the last 12 months. Um, I've spent a fair amount of time trying to help uh mediate this this this issue that our community has had. Um, first of all, I'd like to say that Pipe Creek is one of the four Golden uh marine systems dealers in the state of Ohio. Uh it was specifically requested by your request for proposal that we install a Golden Marine 9 series dock. Um with that being said, we are one of two Golden Dealers in Ohio that carry a factory certification. That becomes relevant in a moment. Um the company that has been selected is not a Golden Dealer. Um Lator is a great company. I've done a lot of work with them. They do fantastic work. I am not here to badmouth them either. Um, the first topic I want to address is I believe one

of the reasons the city has decided to go with the the GMS uh 9 series is for the warranty that they offer. They offer a 10-year almost no questions asked warranty. And what I mean by that is if somebody wrecks a boat into it, it's obviously not a warranty item. Um, in order to maintain that warranty, those docks do have to be installed by a Golden Certified dealer and technician. Without that happening, you do not get a warranty. Um, with that being said, one of the options that I know is available is that Latoral could sub this out to another contractor such as myself or one of the other three that can get these docks. Um, unfortunately, the Golden Marine System warranty is a non-transferable warranty. Um, one of the other items on there is Snap Dock that I run distribution for. I have a six state territory. I worked uh with some of the city representatives to kind of formulate this plan and we presented Snapdoc as an option because it mates up directly to the Easy Dock and we can match the color and that's for what I call the little fishing pier area. Um that is also a 10-year non-transferable warranty. However, it doesn't have to be installed by a dealer, right? I can sell that to Latoral and they can register the warranty direct for the city. Um, the big thing is is is the warranty. At the end of the day, uh, there was a roughly $6,700 price difference between myself and Latoral. It equates to about 3 and 12%. And that's why I wanted to come out and give the information that I felt pertinent on the warranty side of things. Um, again, I just want to make sure that you have all the education based on the request for proposal that was submitted by the city. um being that it had some pretty strict stipulations in there. Um I am in constant communication with Golden Marine Systems and Golden Boat Lifts because of the volume that we do on the lift and the dock side of things. Um and it has been brought to my

attention by Mike Shanley. He's the president of GMS which is the docks that no other bidder or in fact no other contractor in the state of Ohio has pulled quotation for these specs. So, I do want to make sure that the uh evaluators of the bidding process did their due diligence and making sure that we are selecting a contractor that is capable of not only performing the job but giving us the proper product that we're requesting and we don't end up with a an inferior or another product when we are uh essentially paying a premium for one of the best products. Um it is it is a uh concern of mine on the evaluation. Um, and I'll I'll go from the facts to the opinions. Um, I I just I I'm I'm curious how the evaluation process goes. I've been involved in a couple city bids. Um, this is probably the furthest I've made it on this. Um, and I know I'm probably short on time. Um, the evaluation is a weighted scale. The heaviest weight is that we meet the minimum requirements of the RFP, a request for proposal. How is it that we have a selected bidder who cannot physically purchase a product and that meets the minimum requirements? That's my question. If there's any questions for me, I'd be happy to answer questions at any time for you.

Yeah. I I I to anthropomorphize the legislative body is difficult. Every commissioner has their own reasons for voting for or against legislation. So I it would be presumptuous of me to put a motive behind every single vote um that was in the moratorum. Right. Right. So I guess the the better question might be if we have any remaining commissioners who are here now who were here when it was established what the rationale might have been and I think I only see one. I think there's only one. I think you are right. Okay. Do you remember we moved I believe two times right on this moratorum. I think it's been twice that we moved it. Is that correct, John? Yes.

That we moved it back because we're still we were uh Mr. Bajali was working on and the background information on that what to present to the commission and then this was the last thing that he presented or brought to us was a protection of the you know for this outside of the moratorum. So that's how I looked at it. Correct. Yes. There was two terms we had that we met with it. I wasn't on that. I think it's Mr. Meisner and Stephen J. This goes back a few years. So, yeah, there was a moratorum and then an extension of the moratorium, right? I took my fish oil today. I have a question.

Yes, Commissioner. Can the moratorum be extended? Well, the commission could uh vote for a new ordinance to extend the moratorum yet again. Madame Chair. Yes, Commissioner. So, would it be appropriate this particular time to uh call for a motion to extend that moratorum as opposed to doing what we're about to do right now? Well, I think we would it would need new legislation in an ordinance form, right? We would have Correct. It would be new legislation. Yeah. Yeah.

I don't want to take up all time. So, if I, you know, but but one of the things that I want to know is, you know, if we're actually dealing with this particular legislation, and I would think we're dealing with it for uh specific reasons, right? I keep hearing that this would make it more difficult for individuals to actually or entities whether you're talking about LLC's or individual property owners to be able to get approval for Airbnbs. But then on the other side, you know, we hear no, this would make it more difficult. But I don't think we would go through this because the question I would have is since we've had a moratorum, how many entities or individuals have we had who actually challenged the moratorum? since we've had it. Uh we are currently engaged in litigation on that very subject. Yes.

Yeah. So the question again was how many individuals or entities have actually done that have taken us to task because we established a moratorum? Well just one there is well it's two entities but it's one lawsuit. Um and I think that's the only lawsuit. And how as of today? As of today.

Right. Right. And so I'm only asking the question because I see some of this as opening the door for actually more litigation. And I say that because I've seen when I looked at I talked about this before. When I looked at declining geographic area, that's really really vague for me. And I talked about this before. When we start talking about a declining geographic area, it seems to me that at first you would have to establish exactly what that is because I've seen some declining areas and there are so many of them in Sanduski that I can identify off the top of my head. So I think that we would run into some problems with litigation as it relates to that particular issue, right? Not being able to establish what a declining geographic area is. The other issue that I have, and I mentioned this before, that if we begin to claim declining geographic areas and you have individual homeowners that live in those areas that take care of their properties and they don't want those Airbnbs in their neighborhoods, why are they not given the same consideration as those who live in homes that cost 400 500,000?

That's why I'm asking the questions. Madam Chair, yes, Commissioner. Couple clarifications, Mr. Hastings. Um, one, with declining geographic area, if we were to pass this legislation, it would have to be specifically defined based on the ordinance. Correct. In the comprehensive plan,

right? The change being made actually is meant to restrict what declining geographic area means. It's not just declining geographic area, but also part of the citywide master plan and strategic plan. And and also my understanding with the declining geographic area that depending on when that happens that could be any area in town. Correct. Like the the most expensive houses could be declining at the same time. The least expensive houses are not declining. Um right. It' just be declining from a higher level, I guess.

But yeah, it this was meant to try to avoid litigation on that very subject. It's not just declining geographic area. If this passes, it's also it must be part of the city's master plan and strategic plan. Excuse me, I'm sorry. And currently, it is not. Right. Currently, there is no strategic plan or master plan calling for more transient rental units. Transient rentals are still allowed in in commercial areas. Yes. That are there areas where it is allowed, currently. And this is protecting the the neighborhood area. This is meant to protect residential neighborhoods. Correct.

And it is. And one last point, Commissioner Cuch, you had mentioned we would have to define it. I think the the actually it's the other side of that. Someone else bring litigation would have to define that to us. And so I think this is great language for that um going forward. It keeps us in a in a good spot. Can you clarify that for me? I'm sorry, Madam President. Can you clarify what you mean by somebody bringing that to us would have to clarify what as as Mr. Hastings said it's not it's not defined in our comprehensive plan and we don't have it in our master plan what the definition of is that that is. So therefore if someone was to bring litigation against you they have to prove that. Correct.

Right. They'd have to not only prove declining geographic area they'd also have to prove that it's part of our strategic plan or master plan. Right. And it's not. That's easy for us to say that it's not. So we wouldn't define what would become geographic. Correct.

Yeah. That's something for the commission. The the other change I the commission has already made in this regard is that from now on or actually from the last meeting on all applications in areas where they seek uh a change in zoning uh is now going to be a conditional use permit brought before the board of zoning appeals. And the change we made last time is that all decisions of the board zoning appeals will no longer go straight to the court of common please will go straight to this commission uh for approval. Correct. Correct. Any more discussion? Last one I promise. Go ahead.

So now now this particular I always like to know the thought process behind everything that that at least I do. And so I'm wondering how much of this also is leaving a little bit of wiggle room to actually approve uh extending like the overlay districts. Um, and how much of how much of the uh our thought went into whether or not this is associated with what's happening at the state level with House Bill 109 and Senate Bill 104 with regard to being able to lay claim to this idea that LLC's and property owners can buy any property in any municipality and actually turn it into an Airbnb. Was that taken into consideration when we began to develop this legislation? And if so, why? Well, the bills that you mentioned have been pending in the Ohio legislature for about four years, right?

Um, they're pending. So, they have not passed. Um, the latest we hear from our sources is that they are stalled indefinitely. Okay. Madam Chair, Commissioner U. My from reading the ordinance, my understanding the intent behind this is to preserve as much housing stock in Sunduski as we can for people from Sunduski to be able to live in it on a long-term basis. Um, correct. And to preserve the residential nature of neighborhoods.

Absolutely. To keep the integrity of our neighborhoods. It's really important. And I I think that's what's really important to remember about all seven of us up here and talking to everyone here. I know that we are all on the same page in on this. It's just trying to make sure we're all okay with the language and and I absolutely understand your points, Commissioner Coun, but um I I I have in talking with Stu and talking with U. Mr. Orzac and understanding that this is actually a greater protection for us. Um obviously we need transient housing in our community. We have a industry of tourism everywhere and we want choices for individuals but we do offer transient housing in our areas that are zoned for that and that's what we've been happy with as a commission not to extend it and make it bigger. That's not what I in the way I understand this. So um and that is our hope by passing this so we don't end up in litigation if if the moratorum uh is to um pass by us. Um and u Mr. Rosac, I think you might have the answer. Um when ODNR's uh forestry grant was in play, it was for $68,550, but that fell out because we it didn't qualify in this particular instance. But now we're paying 86,91672 which is like what 18,000 19,000 more. Why? Um my understanding there was additional trees that were planted and additional sidewalks that were uh put in that area of the uh project. So those cost increased uh because of those um issues. And I don't know if there's anything else, Josh, that you might add.

Um, I actually took this project over from Director Klein previous, but yeah, he he directed that additional sidewalks and I believe there were some connector sidewalks that were omitted from the plans be added. But you're right, the 68,000 that was initially hoped for um paying for the trees that um that didn't come in from ODNR was the 68,000. So instead of not putting trees there, there's still $68,000 worth of trees in that park. Okay. Thank you. Sure. Any other discussion?
