Recommendation: APPROVE the minutes of the City Council regular meeting on July 28, 2026.

26-2945 APPROVAL OF WARRANTS

Recommendation: APPROVE City Council, Successor Agency, and Fire Protection District warrants dated August 2026.

26-2952 2026 LOCAL AGENCY BIENNIAL NOTICE FOR THE CITY OF SAN MARCOS CONFLICT OF INTEREST CODE

Recommendation: RECEIVE AND FILE the Fair Political Practices Commission 2026 Local Agency Biennial Notice for the code reviewing body to review the conflict of interest code for the City of San Marcos and file said notice with the agency's code reviewing body before October 1, 2026.

26-2941 RESOLUTION NO. 2026-9653 - EXPENDITURE OF FUNDS PURSUANT TO COMPENSATION AND REIMBURSEMENT POLICY, EVENT TICKET APPROVAL

Recommendation: ADOPT a resolution approving the expenditure of funds for attendance at events which are in furtherance of a public purpose.

TMP-2503 RESOLUTION NOS. 2026-9654 & 2026-9655 - SUMMARY VACATION OF MAP 806 PUBLIC RIGHT-OF-WAY FOR AN UNNAMED ROAD WITHIN NORTH CITY WEST PROJECT TSM24-0004, DECLARATION THAT VACATED PROPERTY IS EXEMPT FROM SURPLUS LAND ACT REQUIREMENTS, AUTHORIZATION FOR THE CITY ATTORNEY TO SEEK CONCURRENCE AS TO EXEMPT STATUS FROM THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT, AND IMPLEMENT A TRANSFER OF SUCH PROPERTY FOR CONSIDERATION CONTINGENT ON RECEIPT OF SUCH CONCURRENCE

Recommendation: APPROVE the following, in the order set forth below, as recommended by the Planning Commission: APPROVE resolution (VAC26-0002) ordering the summary vacation and abandonment of public right-of-way for a portion of unnamed road within the boundary of Tentative Subdivision Map TSM24-0004 for the North City West project. APPROVE the resolution declaring that the transfer of the real property proposed to be summarily vacated and abandoned is exempt from the Surplus Land Act; authorizing the City Attorney to seek concurrence from the California Department of Housing and Community Development with respect to such exemption; and, upon receipt of such confirmation, authorizing the City Manager and City Attorney to negotiate, finalize, and execute all documents necessary for the transfer of Real Property to the developers of the North City West subdivision for the negotiated price and associated costs.

TMP-2506 RESOLUTION NO. 2026-9656 - ADOPTION OF THE DISCOVERY STREET LEVEE SYSTEM EMERGENCY RESPONSE PLAN

Recommendation: ADOPT a resolution adopting the Discovery Street Levee System Emergency Response Plan for the San Marcos Creek District Infrastructure Capital Improvement Program CIP Projects

TMP-2507 RESOLUTION NO. 2026-9657 - DELEGATING TO AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE, FINALIZE, AND EXECUTE CONTRACT AMENDMENTS FOR THE 2026 SURFACE SEAL PROJECT (CIP# ST011-2)

Recommendation: ADOPT a resolution delegating to and authorizing the City Manager to negotiate, finalize, and execute contract amendments for the 2026 Surface Seal Project (CIP# ST011-2).

TMP-2511 RESOLUTION NO. 2026-9658 - REPEALING RESOLUTIONS 2002-5865 AND 2022-9034 RELATING TO SAN MARCOS BOULEVARD RIGHT-OF-WAY CONSTRUCTION AND EXCAVATION WORKING HOURS AND ASSOCIATED WAIVER PROCESS

Recommendation: ADOPT a resolution repealing Resolutions 2002-5865 and 2022-9034 limiting construction and excavation working hours within the San Marcos Boulevard right-of-way and providing a waiver process relating to the same.

TMP-2505 ORDINANCE NO. 2026-1582 - ADDING CHAPTER 20.270 TO THE SAN MARCOS MUNICIPAL CODE AND AMENDING THE ZONING MAP TO ESTABLISH A SENIOR MOBILEHOME PARK OVERLAY ZONE OVER SEVEN EXISTING NON-RESIDENT-OWNED SENIOR MOBILEHOME PARKS IN SAN MARCOS

Recommendation: INTRODUCE (First Reading) Ordinance 2026-1582, an Ordinance adding Chapter 20.270 (Senior Mobilehome Park Overlay Zone) to the San Marcos Municipal Code and amending the Zoning Map to establish a Senior Mobilehome Park Overlay Zone, and Notice of Exemption (EX 26-042).

TMP-2512 RESOLUTION NO. 2026-9652 - APPEAL (AA26-0004) OF AN ADMINISTRATIVE RESOLUTION OF THE CITY MANAGER (ADM 26-5226), WHICH DETERMINED THE DRAFT MITIGATED NEGATIVE DECLARATION (ND26-007) FOR THE LANIKAI SENIOR RESIDENTIAL DEVELOPMENT PROJECT TO BE INCOMPLETE AND UNABLE TO BE CIRCULATED.

Recommendation: ADOPT a resolution denying the appeal and upholding the decision of the City Manager.

TMP-2509 DISCUSSION OF THE FUTURE OF THE SAN MARCOS HOLIDAY PARADE, INCLUDING WHETHER THE CITY SHOULD ASSUME RESPONSIBILITY FOR ORGANIZING AND PRODUCING THE EVENT, AS REQUESTED BY COUNCILMEMBERS LEBLANG AND MUSGROVE

Recommendation: DISCUSSION AND DIRECTION regarding the San Marcos Holiday Parade, as desired.
