Thank you, Mayor. Thank you, Council. Tonight, especially, we're wanting to do our badge pinning for the promotion of Josh Gorder, battalion chief, and Cameron Moultrie as a captain. So how we'll do this, I'm first going to, and we'll make this as brief as we can, but I think it's appropriate to to explain not only to you as a council, but to the public what goes into the testing. We had great applicants for the first week to the battalion chief promotion. We had some great candidates. All of them were equal to that position, but Josh did an exceptional job and came out number one on our process. I just want to go over real quick about the process. It's not easy at all. So they were assigned an assignment before the testing that they had to do a presentation on some things that we felt like that we could approve on as a department. And so they were assigned this. They had to do a PowerPoint. We do that purposely. They have to do it in a certain timeframe. And then they're given certain criteria that they need to present on. And so when they come into, a lot of all of our testers were third party outside of the department, very credible captains, battalion chiefs, and chiefs from other departments. And so they came in and did that. They're also assigned questions. So they came in, did their presentation to a panel of five chiefs and battalion chiefs. They were scored on that. Right after that, they're given a five minute break, come back inside for their questions. They go back outside, come back in for six interview questions. That's just the beginning of it. Then they go into a scenario based, it's what's called a static, where it allows them to stop more so like a tactical. They were taken upstairs to the administration office where they're given 20 minutes to review a scenario, which was very challenging. AND TWO WEEKS LATER WE HAD THE BIG FIRE IN ROY. THAT WAS THE FIRE OF THE SCENARIO. IT WAS ROW RUNNER, APARTMENTS ON FIRE, A TRAFFIC VICTIM ON THE EAST SIDE OF THE TRAIN TRACKS, ACCESS PROBLEMS, SO A VERY COMPLEX SCENARIO. The two chiefs I did, one was the Northview chief who teaches for Euphra, very experienced. The other was the battalion chief for South Jordan who also teaches for the fire academy and they couldn't imagine a more difficult but appropriate scenario. So they'd go through that. The next one was they had to also do a tactical scenario. And this is a live one. We had the EFR trailer here where we had testers and role players. So all of this went into the testing. And so I think it's important you know how difficult the test was. It's unlike a lot of different tests that you see. But we feel like the tests need to be difficult and challenging to see who the best applicant was. With that being said, Chief Gorder is now what his title will be. I'd like him to come up and whoever he selected to do his badge pinning, we're going to do the badge and also the lapel bugles. And I've asked him that he can either have one person or two, whoever he wants to do it. So after that, I'll have Chief King come up and he'll explain the captain's test and do the same thing. With that, I just want to congratulate Chief Gorder. As the sunset is fading on my career, one of the best things that we can do as Chiefs is to promote exceptional individuals with high character, and I am absolutely confident that Chief Gorder is going to do exceptionally well. It's not just in the position, it's the influence that he will have on the next generation of firefighters. So this is critically important to me, that I know the safety and well-being of our firefighters will be in good hands. And so, with that being said, I'd like to invite Chief Gorder up, and whoever he selected, and family members, please feel free to come take pictures, okay? Chief Gorder.

He likes to speak a lot, but just a minute. But these moments are very precious, and I'd like him to have a moment to say something real quick.

I'll keep it short. I just want to say thanks to everybody that's here. This is kind of a big deal for me. Getting promoted is very honoring to me. But it's not me that really does this. It's like my family, first and foremost, my wife, Nikki, she has to, people say it a lot with our career that it's hard, but it really is. Like we miss a lot of stuff, which means she has to do extra to take our kids to places. And she just kind of keeps the family going. So it's not really me that does this. So I have a lot of credit to her. My two boys, this is pretty cool to have them come up and pin me. It's pretty cool for me. and then all my family that's here. I got a big family, so I've had support my whole life. My brother Jason that's here, he's a firefighter out at Northview, a captain at Northview. He's the one that got me in the fire service to begin with, so a lot of this is owed to him. And then just my family, support I've had from them has been awesome. And then the rest of these guys, along the back wall. Most of them are on my crew. So when I first got promoted, I went to this crew and it was awesome. And then I got moved for about three years and then now I get to come back. So pretty excited to come back and work with them all and just look forward to the future and it's exciting. So thank you.

So those are gonna be big shoes to fill. So Cameron Moultrie is our captain that got promoted once Mr. Gorder decided to move up the ranks and help out. So he opened up a spot for Cameron Moultrie. So I wanna take a moment to share how we approach our promotional testing process and why it matters so much to our department and the community. As we open a position, especially one as critical as a fire captain, we follow a structured, transparent testing process. This includes written assessments, practical skill evaluations, and interviews designed to measure their leadership, experience, and decision making, and the ability to perform under pressure. Our goal is simple, to ensure every candidate is evaluated fairly and based solely on their qualifications and their performance. We are committed to promoting the best candidate for the position, someone who not only meets the technical requirements, but also demonstrates integrity, professionalism, and a strong dedication to the service of the residents of Roy. Our firefighters deserve strong leaders and our community deserves the highest level of service. Thank you for our continued trust and support. To think about doing this without her seems unimaginable. And then obviously Cal and Harper, they're the sweetest kids. We love them. As far as the promotion goes, I didn't get here on my own. I've had a lot of great leaders that have challenged me and helped me a lot in this room. I'm grateful for the opportunity and for the trust that's been placed on me. My name is Kevin Homer. I live here in Roy. I just wanted to make a couple of comments on the action item coming up, specifically for 26-10 and 26-11. That project is about a block and a half south of where I live right now. And I had the chance to review the packet information of what this proposal is going to involve. And it's a very interesting proposal. I think it will result in some good things for the city. It'll ultimately provide a little bit more housing in the city. I would let you know that I support 26-10 and 26-11, and I would ask you all to vote in favor of it. On a little bit of a personal note related to it, it's only in the last week that I've learned about these two families that helped out Roy 25, 30 years ago by selling great big chunk of land where my house now sits. And all of my neighbors now have our houses there. So for me, I didn't know it, but I owe them a little bit of debt of gratitude. So I appreciate what they're trying to do. Good evening, Mayor, Council. Thank you. Action item number one is consideration of ordinance 26-9. This is changes to Title 10 of Roy City Code, specifically allowing what is called detached ADUs. This was brought on by specific legislation from the state which requires cities to have ordinances that allow essentially what we put into code. The state statute gave us until October 1st to comply with that requirement, otherwise they're allowed via the state law. This went to Planning Commission. There was a public hearing as required. There wasn't any comments made by the public on this issue. Planning Commission, Had some discussion about the language and then forwarded unanimously the language that's before you. And honestly, we've had a few lawyers look it over. It seems to fit what's required. It seems to make sense in our brains anyway. With that kind of introduction and summary, I'd ask if there's any questions of me and otherwise give it to you as the counsel.

Okay, Mayor and Council, ordinances both 26-10 and 26-11 are regarding The property's located at 3934 and 3960 West, 5500 South here in Roy. It's just west of the canal, I believe, right there. Two parcels, it's a little over 3 1⁄2 acres. This came to the city via the applicant and property owner, Mr. Obershaw, who I believe is here. I'll just kind of introduce this item and then let him talk to the council and then... Ask any questions you will of him. I'm happy to answer any questions as well. But this is a rezone request. 26-10 would amend the general plan and the future land use map to be consistent with any zoning change, which is required to do before any zoning change. 26-11, the request is to change it from an R18 zone to an R4, which is a multifamily residential for those three and a half acres. And if there's any specific question for me now, otherwise I'll turn it over to Mr. Openshaw, the property owner in Appleton.

Thank you for letting me present this to you today. I appreciate it. My name's James Openshaw. I live at 3066 West, 5500 South. I'm here to represent my brother and my sister and myself and the Binions on rezoning the property of R18 to R4. I've got a background in the city. I was born here in the city. I've been here my whole life, 66 years. I went to Roy Elementary, Roy High, and worked for Roy City for 28 years. So I've seen a lot of growth in this town and seen a lot of things that has happened. So to give you a little bit of a timeline of what's happened here, back in 1970, my mom and dad bought this property to build a house on and have some animals there. We had cows and horses and pigs and chickens We even had a few racehorses there too. And my uncle on the piece right next to him, he had a lot of racehorses there. And that's what was done with the property for quite a few years. In 1998, the people sold the property, my uncle's portion there where you can see where the new development was. They sold that to him and then they wanted to buy my dad's property. And my dad says, no, he wasn't gonna sell and he wasn't ready to get rid of his property. So they come up with an agreement where they would trade property. So we traded that yellow part there in the front for part of the, that we gave back there in the back and then let them have all that green space right there where it says, where it starts from the yellow and goes up to the other yellow. He traded that portion for that portion there. And so that gave us that frontage on 5,600. But in 1998, well, and my dad, he had four lots there and he sold those four lots. But in 2018, we had the same property there. At this time, the Banyans had moved in. And I think they moved in in about 1993 is when they moved in next door. And they had that piece of property there. Well, we was going to develop that back piece right there in the green. And when they did the other development, I was working for the city at that time. I told my dad that it'd probably be a good idea if we put in the improvements and everything into that road back there so when we did decide to develop there, that then we'd all be in place and we wouldn't have to care up a brand new road. So we traded that prop when we traded and then we had that, so we sold that in 2018. That's when my dad just died right after we sold that and we had those, we had seven lots there and the Bennions had three. We asked the Bennions, if they wanted to get on board with us and do the same thing that we was doing, and they said they would like to. So on to the next one there. So right now, this is what we had planned to do. We need to go. It's not lining up with, there we go, right there. Okay, so after we did those lots in the back there, we was going to keep the original house where it was at when my mom, my dad, after my mom passed away. And we was going to leave the original house, and then we was going to sell those three lots. So the state come in and put in the new curb and gutter. We owned to the middle of the road at that time. We had to donate the property so the state could come in, put the curb and gutter and stuff in. That wasn't a problem there. But at that time, they wanted us to move our access where our home was. And they wanted to line it up with that road right there. And I asked, well, why was that? He says, because you guys can only have one access there. And I says, well, we've got plans to develop this property. He says, we won't give you no more access to this road. There's too many cars going to be going up and down this road. And you guys are going to have to do something else, because we won't allow any access. So at that time, we thought, well, now what are we gonna do? So my mom just recently passed away, and we decided, now it's in a trust, and me and my brother and my sister, we don't wanna keep it. I'm the one that's been taking care of it now for the last 15 years, helping my mom and dad out, and I've got other plans for my life, and it's not taking care of two acres of ground. We could sell the house just like it is. but then we have all that property next to it. We sell it to an individual. Who knows what kind of an individual's gonna move in there. We could have somebody move in there that's a very clean person, very great person, that just does nothing but just mold the field and make it look nice, kind of like what my dad did, because at one time, we was not able to have animals there no more. It'd be a perfect place for somebody that wanted to have some animals there, but that's not gonna realistically gonna happen. Because people, once they move into a residential place like that, they don't like the smell and stuff. So we understood that. So at that time, we were trying to figure out what we was gonna do. So if we could move on to the next slide. So we decided that, why don't we just try to rezone this and then we'll just sell it and whoever buys it can do with what they want with it as an R4. So we put in our paperwork to come to the Planning Commission last week and we was able to talk with them and they approved us to come to this point. So I'm here today to ask you That with the hardship that we have on this property right now, we can't do anything with it but sell this to Only House. And what we would like to do is sell the property as R4, have a developer come in. They could do one access for the property, okay? And that would be right straight across the road, which the state wouldn't have a problem with. The Banyans, we've asked them to get on board with this if they'd like to, and Kathy Banyan agreed to do it. Her son is here today, and he would like to get up and say a few things, too, after we get done. But we are here today to ask that we can rezone this from R18 to R4 for this purpose to happen so we can go ahead and move forward with this property and sell it. And if you go to the last slide. Oh, no. Anyways. Yeah, it just shows basically what we just seen, but it wasn't in color. But it just shows what it is today, just with the Banyans there and us there with nothing else. So we're here to do that. So if you guys wouldn't take a minute and listen to Mr. Banyan, I appreciate it.

Our family has lived in the home since 1993 and have enjoyed our relationship with the Openshaws. Grateful that they were willing to consider us in as they were considering what to do with their property. We too kind of are in a similar circumstance where the one access point makes it difficult for us to do much with the property that's there, especially the property to the west. My stepfather died in 2018. My mother's health is not good. she's unable to take care of the property my brothers and i have been working to maintain it and keep it in condition but we're at a point too where we need to do something with that property because we cannot continue to do what we've been doing and with mother's health the way that it is she's looking at additional options we feel like this would be a great benefit to her personally to give her as much as she can out of this property if she were to sell so that she can kind of maintain her living. So we fully support what the Openshaws are doing and would like to be connected with them in this consideration. Thank you. Okay.

Thank you. So the next items for you are very similar procedural. This is a request for approximately 3426 West, 5300 South. This is a request for a zoning change from RE15 to urban corridor. Again, 26-12 is an amendment to the general plan future land use map to allow that to be lawful, and then 26-13 would change that. change that zoning designation. This parcel abuts another parcel that is connected right there on 5200 South, I believe, which is the urban corridor kind of down by the clinic right there. And what's essentially kind of the summary of this is the developer of that parcel is purchasing the land in question. and there's a house on it now and essentially they're going to subdivide so the house would stay and then the parcel that connects to the the commercial project lot that's what we'll call it they would like to add this to be part of that and use the urban corridor i know a representative is here so i'll let him speak more unless there's questions specifically for me at this time okay

My name is Jerry Robinson, live in Sandy. I'm an architect working on the property on 5200 South. My client was approached by the owner of a lot to the south of it about buying part of the parcel. And after looking at it, it seemed like it would support the whole project by providing parking, perimeter landscaping, trees around the outside. Our purpose on the property to the north is to put multifamily housing, especially 55 and older people who might be of retirement age or approaching that can live there and have a nice place to live. Our hope is to put a pickleball court on the property. and make it a nice addition. The whole idea of this project is to provide affordable housing and it's a great location because it's next to a clinic, down the street from a recreation center and a golf course and a church. They can walk everywhere. Maybe they don't need a car. So I wanna emphasize that the remaining lot will meet the zoning standard of a minimum 15,000 square feet. And we plan to have no pedestrian or automobile connection onto the property to the south. So no impact at all.

In the past, we've had, just the background, we've had Roy High students come in and represent the youth in our community, but many cities around us have their own Youth Council, and I thought this would be a nice way to get the youth more involved in civics locally. So anyway, hopefully had a chance to read through it, and this was the first one I had to write out by myself, and then it got checked by the lawyers, so that was... so i feel pretty proud about that he only had to fix you know a billion things so it was fine so anyway um but i just think it would be a great benefit to our city and i would love to answer any questions you might have

I think we're doing the large auditorium. and then on friday the we're matching the theme for the football game so class colors seniors white sophomores black and juniors gold or yellow and then our football game against clearfield at seven and that'll be the last day to buy homecoming tickets until three o'clock and then saturday we've got the dance uh eight to ten on the football field okay well because of the fire restrictions this year that um
