Yes. So, Nene, we'd like to hear from the members as to what your commitments are with regards to bringing forth formally an ordinance for review by the full council and for a vote. From what I understand, typically ordinances can't be passed in the same meeting, but given the timeline that the county has requested that they have enough time to kind of administratively deal with this, They're requesting it in November. Statutorily, you have until January 1st to pass an ordinance. I think it's January 5th to submit it. However, they're asking.

I think the November 3rd is a... a request, but obviously you statutorily have until January 1st, but we're just, you know, wanting to hear from the members as to what you can commit to in terms of bringing toward the formal petition, excuse me, a formal ordinance and vote by the council. What I understand is that typically it can't be voted, can't be passed the same meeting that it's introduced first, unless the vote is unanimous. And so there could be a vote the same day, the same meeting that it's introduced. And if the vote is unanimous, then it can pass that same meeting. So we're just curious to hear what your thoughts are.

Yeah, we're willing to do that. It makes sense. It gets into the 21st century. The only issue that I have with it, my concern is, is if we do pass all this, are people really going to be involved? I've been doing this stuff for over 25 years for this town. And every time we have an open position or we have somebody resign, We have to fight tooth and nail to find somebody to volunteer to help us. That's my only concern. I mean, I'm not saying I would not pass it because of that, but it's just one of the concerns I have. People want to get involved. They say that, but then, you know, they don't. And so then we fight tooth and nail to get just sometimes to meet a quorum for some of our committees.
We're doing it.
That's my only concern about it. I'm willing to pass it and make an ordinance and go forward, but I just need involvement from people.
How are you letting people know about what is needed?
As far as I know, we advertise newspaper and we put it, they were putting it out on the town site while it was still up.

Yes. I very much appreciate what you're saying about the involvement. And I think the problem with the convention is town versus primary town process is that the convention process is not something that's as understandable, you know, widely by the people as a primary is, you know, everybody knows when a primary happens. There might be a difference in that it's in an odd year, but it'll be in May and people campaign and put their signs out and there's polling stations. But as far as a convention process, you have to know you have to be, first of all, a Republican in the town to even have a part in the process. And then you have to know when the Republican conventions are held to even be a part of that. And then, you know, knowing when the rules are, it's very obscure. I mean, even me and being as old as I have been, don't even know. I've been talking with people, actually, the next convention, we don't even know when the date is. It's sometime next year, you know, and But we know that a primary is always going to be in May. I just think the process is much more understandable when it's what 95% of the towns in the US are doing.
So the date of the convention changes according to when the position is going to be filled. I personally took the place of Ben Castle.
You're talking about something different. That's a further complication.
That has nothing to do with what we're talking about tonight. Okay. That's if someone would leave the position before it was able to be elected. So that is done by the Republican Party. It has nothing to do with what we're going to talk about here tonight.

So invention has to do with if you have four people that are running for three seats. In the 33 years I have been here, it has happened one time. So we go to primaries, but we're not probably going to have four people running for three seats or even two people for one seat. I have to beg people to run. So we can do it. It's probably not going to cost any money because we're probably never going to have a primary.
But if we do, it is $2,000 left, right?
It's $8,000 for election results. That's if we go to staggered terms. We don't have to go to staggered terms. Right now, everybody's on the same year. Everybody's elected. The election time is up the same year. So if you go to staggered terms, you'd have to go, you know, One in 27, one in 28, one in 29. Or if the county or the state only wants us to do it on odd years, then it'd be 27 and 29. You'd have one and then two.
And I think we discussed that. It's very important that we have at least somebody on the board that knows how to run a meeting so they understand this. Because getting into this, there's a lot of stuff, guys. I'm not in this for a year yet. And I'm still learning.
there's a lot of things and obviously um i feel so important that we do have some uh some knowledge some history behind understanding how to work and process and run a topic it's really important that one board member remain uh so that you always have one person who knows what's going on or what the path has been to bring that forward to the new additions um So for us, we would have to go to a staggered so that not all three are leaving at the same time.
How do you prevent that? At the same time?
Well, we won't be because I'm leaving.
Just a simple question. All three of you are If all three terms are out, you have the possibility of all three of you leaving or not being back the next year. It seems like by going to a staggered election term, hopefully by going to a staggered election term, you're preventing the very thing that you're afraid of that could happen if you don't.
No, that's actually what we've talked about as a council. If we move forward, and you guys are going to see us vote on this tonight, is when we do that, that is the way we would like to do it. Because we have had discussions about this. Obviously, there's a cost involved. We have looked into this. You know, unbeknownst to some of the information that's been out there, we have worked on and talked about.
I'm just saying, it sounds like going to this election system helps prevent the very thing that you're worried about. It seems like a good thing.
Yes, I agree. Yes. And one thing I actually want to say is I appreciate everybody being here and showing the vested interest in your town. Like I said, I've been on this board for not even a year now. Like Cheryl said, there's been maybe at the most 10 people, I think, at the biggest meeting. So I love seeing this. Deidre, you've been here a lot. And I appreciate that because I want to see people love their community. You guys should. You guys should have a vested interest in what's going on in the city. But again, to Cheryl and Kurt's point, we need you guys at the polls too. We need you guys helping out. Not just because you get a letter in the mailbox to show up. We want you guys here all the time and helping us because this is your town. We're community members just like you.

I am still in the final process of doing that. The bank and the software company are trying to finagle just some dollars and cents points. They're not transferring over correctly to the bank, right? So when it says $4, it's saying it's 40 cents at the bank. We're trying to get that fixed, so hopefully by the end of this week they should have that completed and we should be able to get that started.
I did reach out to farmers to make this happen. This has been the third time we've talked about it, so it needs to be done. And we'll move that to next month. Ordinance to add 35 mile per hour speed zone.

I don't really particularly mess with it, but other officers will, so I don't really have, but as far as state law goes, you can't operate a golf cart on a county road. Dustin, the position of the sheriff is that it is not legal to drive them on county roads.

I don't want to confuse the issue, but here's a question that I've had for a long time. The bike paths, okay, if you happen to run in our community, especially on the levee and stuff like that, it says no motorized vehicles, okay? How do you define a motorized electric bike versus a golf cart? Because every day I go on that, going on nine, either going north or south, I see a bunch of 13, 14, 15-year-old kids driving 20 miles an hour, and I know they can't pedal that fast, going up and down the bike paths. But yet me having a golf cart, they're not permitted to drive on that. And it's being motored by the same process, electric battery.
That's regulated by the state of Indiana as to what's considered a class one, two, or three bicycle. So they allow them.
We have no choice because we're following the laws of the state.
So an electric bike going 20 miles an hour is permitted on those where it says no motorized vehicles, where me driving my go-kart, which can't get in anywhere near 20 miles an hour, it's not permitted on that because of state regulation?

Well, Noble Trails owns it, the majority of it. The section through town, part of it's the towns and part of it's the conservancy districts.
So who owns the ledger?

No, it's the group in town, the elected group in town that takes care of the dam.

They're elected by the body in Rome City. It is a government entity.

Can I ask another question, please? Who paid for the improvements on the levee where all the pavements sat down? Wasn't it the town of Grove City that paid for that?
Conservancy, yes. Well, the town paid for some of it. The Conservancy paid for some of it. Noble Trails paid for some of it. The state of Indiana paid for some of it. And the Lake Association paid for some of it. The Chamber, other people who made various donations.

So under that broad scope then, I guess I'm asking that. Since it's very difficult to determine where the distinction is between who paid for what on the bike paths and stuff like that. Can I ride my golf cart on that then?
Even though you have a difficult... It's a bike trail. It's a bike path. And it's the state of Indiana that says you can't do that. It isn't any of those entities that provided those improvements. It's the state of Indiana.

We were on the trail yesterday and a bike went by us at 35 mile an hour and about took us and the dogs out. And it's like, how is that? It was a young kid. But yet, we get yelled at for being on our longboards, manually pushing to go down the trail, and people say, tell us to get them off of there. We're going seven mile an hour.

And they're a government entity. It's a bike path, so likely no, unless they make it a motorized path, then you're going to have people riding motorcycles. golf carts, UTVs, all those on it. I don't know if that...
The problem is not that. The problem is how do they get across the bridge. You cannot get across the bridge using what's the NDOT put in for the bike path. So you can't have motorized vehicles on that portion for NDOT.
So the new bridge. Okay.

It seems to be a difference between 750 watts or less. There's distinctions. I'm not sure who's checking the watts on bicycles, but we'd have to make a distinction there, probably. But I think we should be able to check that out with the states. If we can make it open, the town where we're sitting is the big old groups of alcoholics. You can be more descriptive there.

would enjoy being able to bring their golf carts into town. There's a way to figure it out.
But ultimately, then you stop at the bridge, and we have no way to make it an ordinance of any kind for the state of Indiana, even if it's in our town.

They won't monitor it until there's an accident. And then when they're back, then the liability is going to come back to us because we've allowed it.
How do other communities allow people to ride their golf carts down State Road?
That's up to them. If they want to take that liability on. There you go. We don't, we don't want to take, I am not going to say that the town of Rome city should take that liability on. That's huge liability. And I'm, I mean, it's up to them because they're elected for it, but as the town manager, I'm not going to advise them that they should do that and take that liability on for all of us.
We ever had any catastrophic golf cart wrecks.

Okay, so we move city ordinance report. It's a four. It's a four. In order to amend the ordinance 2505, ordinance 2408, there's a whole bunch of ordinances that it's referencing. Fixing the schedule of rates and charges to be collected by the town or city. Indiana from the owners will probably serve by the sewage works of said town and other matters connected therewith. Then, whereas the town of Rome City has constructed, maintained, operates, or works for the collection, treatment, and disposal of waste and sewage. The maintenance and operation of site collections, treatment, and disposal of sewage has been in effect since 1976. And then there's a couple other paragraphs about whereas. And then B.R. We're being by the town council of the town room so the area section of the ordinance, I just repeated up top and it gets down to the proposed monthly schedule for the region. So residential each each single family resident unit preventive collection he 150 a month plus an additional dollar for billing would be a total of $83 a month. For commercial. RETAIL ESTABLISHMENTS, FIRST THREE EMPLOYEES, $85 A MONTH, PLUS $1.50, WHICH EQUAL $83 A MONTH. I'M SORRY, $81.50 PLUS $83 A MONTH. FOR EACH ADDITIONAL EMPLOYEE, $14.50 PER MONTH. PROFESSIONAL OFFICES, FIRST THREE EMPLOYEES, $81.50 PLUS $1.50, WHICH EQUAL $83 A MONTH. AND THEN YOU GOT EACH ADDITIONAL EMPLOYEE AT $14.53. And then restaurants, drive-ins, bars, taverns, organizations with eating and or drinking facilities. First two employees, $81.50 a month plus $1.50, which gives you $83 a month. And then each additional employee is $19.34 a month. And then it says commercial continued for beauty and barbershops. First employee is the same, $83 a month. Each additional employee is $2,902. Gasoline service station without car wash, $109.94 plus $1.50 is your $111.44. With car wash, add per automatic wash bay, $167.24 a month. And then a car wash, it's automatic. $136.34 plus $1.50. $178.84. Each additional car wash bay, $167.24. Car wash manual, first car wash bay, $81.50 plus $1.50, which gives you $83. Each additional car wash bay, $81.85. Laundry mats, first floor washers, $125.08 plus $150 gives you $126.58. Each additional washer is $3,189. Shopping, residence, $118.78, $1.50. Additional billing gives you $120.28. And then event center is $305.69, $1.50, and then $307.19. And the next section is schools and daycares and lodges. Does everybody want me to read all of those too? The school for 25 students, 83 a month. Additional students, 232. The daycare, first people enrolled, $83. Each additional people enrolled, 232 a month. Churches, lodges, and veterans organizations without eating or drinking facilities for 200 members. or a fraction thereof, $83 a month. With eating and drinking facilities per 200 members or a fraction thereof, $103.72 a month. And then governmental, first three employees is $83 a month. Each additional is $12.53 a month. And then the industrial, Manufacturing domestic use. First three employees, $83 a month. Each employee additional $13.56. Process load must be on liter grade. And then it goes into large volume meter users, which is like the treatment rate for 1,000 gallons of U6 per month is 360 a month. And then base rate per month, up to 250,000 gallons of average flow per month. For the previous calendar year, it was a bill of 866.66. And then for each additional five gallons, average flow per month. Previous calendar year, it was 1797. And then there's fees for path connection fees, system development charge. I don't think any of those change. They're the same or they're the same. And that's it.
You accept the first reading?
There was a study that was again it's we're studying. I don't know earlier this year.
So what percentage is that for residents? What are the questions, sir?
It was a $10 increase. It's a $10 increase.
So that's 16%, almost 16%.
And this, according to our ordinance that we passed with it, this increase will be the last increase until another new study is completed, which will be, what, two years?
Is that study available for review, please? Mm-hmm. And you used to determine that you wanted a 60% increase for your cultural rights?

It's part of the public records. Yeah.
The reason for the increase is that we've been operating in the red or near the red for several years. That's why we've had to bump it the last couple. And our facilities are in need of upgrades that are going to cost quite a hefty farm at this point. So we're trying to stay above water so the whole thing doesn't fall off them.
A lot of the equipment that is out there, almost all the equipment that's out there is the original equipment. Nothing was done. There was no maintenance made on these to replace them in between to upgrade them or anything.
I would say there was maintenance done, but when COVID hit and everyone was home using the facilities and everybody loves to use the wipes, I guess, that has caused a problem with the pumps that were 50 years old. They could handle toilet paper and human waste, but they could not handle the wipes. And so we had huge amounts of pumps that we've had to switch out and change to high-grade pumps that can handle it, because other ones don't. But they were working fine. I mean, they worked for 55 years with no problem until 2021.
What I meant was no maintenance. I meant no replacement maintenance. And our guys got into a position where they were unable to get parts because the pumps and grinders and everything were just so old, there weren't any more parts available. And in order to upgrade, We had to buy new pumps and new grinders because we couldn't get replacement parts for the others. And what was the cost of that last batch, Scott?
You're talking about the big grinders? Yeah. Big ones, I think they were probably about $14,500 apiece, $14,500 apiece. The small ones we get, they give us a discount, but we got to buy it. 10 at a time, I think they're $2,500 a piece. The old pumps are discontinued. So we can't get part of the hydromatic anymore. And they've been, like you said, Wipes are big factors.
That was actually a question I was going to ask. Since we have so many people in the room, is there anything they can do to help other than the dude wipes, not flushing baby wipes or whatever? Is there anything else?
That's a big thing. Baby wipes, dude wipes, any of those types of wipes, they say they're flushable. That might be in a system that's all grout. Well, our system here is all pump. So it doesn't biodegrade. in 15 minutes by the time I get to my pump and close it up. So if you don't use those and other things I find in there, it definitely helps. Like cigarette butts, I see a lot of applicators, woman applicator stuff. That stuff ends up in there. I don't know why, but it doesn't make it to your pump too well.
So please, if you would, try to help police out with your guests and things because we do want to keep the cost down. This is not fun.
Does the town of Rome City maintain legal easements to access your pump stations and sewage lines that we're paying for?

So Cheryl, you're talking about lift stations? So yeah, we're trying to do two lift stations per year. We have 28 lift stations. We're currently at, we still have 14 more to do. We will have two done next year and they're over $100,000 each. So it's $200,000 to do $100,000 to do a, lift stations. And then the grinders, as they go bad, we replace those.
And those are the ones that are important?
The grinders are the ones that are $2,500, but there's two pumps in each station, so there's $5,000 there.
And our other issue has been at our ponds for the sewer department. We had a wall that failed, and we had to have that taken care of. And they need to be, the ponds need cleaning?

Okay, so Natalie is not here tonight, but we had, you know, the companies, the list for the companies on the upcoming sewer project that we're going to have done. So Bowen Engineering was the only company that came back interested in bidding the project. And the project is upgrading our main lift station and adding a screen to our Um, first pond out there to keep all of the wipes from getting into the pond, because the problem is, is that they don't biodegrade. And so now our capacity in our ponds is filling up because these wipes don't biodegrade. So we're going to have to clean the ponds out at the tune of $250,000. So to stop that we're when you put the screen in, but we are going to be having a meeting with this Bowen Engineering to discuss what they want to do and how they want to proceed with it. And that will be September 21st at nine o'clock. I will need at least one council member present at that meeting.
There's nobody else that has opted to bid the job?
No, we had another company that opted to bid that said they, They might be able to do it if we delayed it. After talking with our attorney, he said, anytime anything's ever been delayed, it's ended up in a lawsuit. So we decided not to delay it.

So I did get the notice to the taxpayers for the 2027 budget submitted. I submitted that on here September 2nd. I have attached also a copy of the budget form one for last year and the budget form one for this year. I have highlighted the changes that I have made. There are some additions that I had to add due to some state legislation changing, the building and permit fees going into a separate fund and being... and only certain things being allowed to be paid out of that fund. So like in the general one, I have the building inspector and the plan commission, and I have put that into the building fund. So those will go there. I just made a few changes to increase the town manager salary, social security per, and the health insurance, just get that in line to where It's projected to fall out for next year. I made a few cuts. I get janitorial supplies, telephones. I did also add an appropriation for marketing for the parks department because they have started to do that. That is for the parks advertising.

So FEMA is now catching up with what they had told us our base flood elevation was going to increase to about four years ago. So it's going to go from 918 up to 900. 18.8 and then indiana requires the two foot free board so anything that's being built along the lake will have to be at 920.8 which i've been enforcing that since they originally said they were going to change that increase that um to that higher level um what we'll have to do is pass a new ordinance once this goes through the process of they'll have meetings and let people speak to whether they think it's appropriate or not. And then once that's done, we'll have to upgrade ours. And that will have to be done through DMR. So they usually give us a boilerplate ordinance, and then we tweak it to fit our information. So I would say in the next two or three, probably in the next three months, we'll be looking at that.
How does that affect people who have to pay flood insurance? Are new people going to have to start paying it if they're raising it?
If their house is not at that level and they have a mortgage. If you don't have a mortgage, you won't have to pay it. Correct. So that's why any new builds, I make them build to that elevation.
You may not know. I have to play much. I have a mortgage. And I didn't want to move here. But I'm not going to say that our lake is at a flood level when we have a dam. I don't get it.
I've had that conversation with them numerous times and I get nowhere. I'm trying to get ahold of people.
Our emergency plan is set that we will open it before it ever gets to that level. And So, but they don't classify it as a flood control structure. So that's how they get around that. Even though it is a flood control structure. It's not classified as a flood control structure.

Because what happens is everything will work. Now it ends up taking two, three months to get it for better, which we don't have much time out at the plant during the season just to discharge. to wait that long. We have 10 building permits issued. One of those was a new home in town and the other was a new house out in the county. We had two variances coming up on Thursday. And plan commission has a rezoning from ag to enclosed industrial and then they'll need to do a special exception for outside storage. It's for Arnis boats. They're Currently In the right zoning. So we're going to get them. correct it and put it in the right zoning. Conservancy district paid bills, balanced books. We're working on updating the district plan and the emergency action plan. We had the dam inspection in August and everything was fine with that. We also did the tabletop exercise and that went well. We had sheriff's department, fire department, marshals, Red Cross, you name it, everybody was there. Park board types of minutes in the agenda. We've got the new benches installed at the pickleball and tennis courts. Bike trail update. So to get the grant finished up. I was waiting on the sign on the north end and Jim had finished that over the weekend so now we can get that grant closed out. Lumber loss landing, I spoke with Mark Webb on the agreement for the town to take over the sewer extension and he's working on that. He has another lot that he sold, but we're gonna pull the sewer from, The name just went, oh, antlers point instead of putting in another grinder station. So Mr. Patton is working with Mr. Webb on getting that easement, that sewer easement and that extension there so that we don't have to have an additional sewer station, which is, yes, it is great. We had 9,460 230 gallons come in. What we put out, we put out 4,001,445 gallons. We had five call-outs this month, 68 locates. On grinders, we sold two pumps, lift stations and post-zero. Some of the stuff we did this month, so At the shop, we installed the wood plows and hit up the chain to mark the boundaries, and a golf cart can be flying through there. And we also cleaned up all the telephone poles and the concrete to make it look a little bit better, and pulled it off the plant. And down by the brush bin, we was having problems with water standing in it. It smelled pretty bad once that brush started to deteriorate. So we dug a trench, and we put some number four natural stone in there to help drain the water out so it's not set in there to make it such a smell. And at the plant, we trimmed back the roadways because it was growing up along the road and we didn't dump trucks and stuff. Diagnosed the problem with the mixer, which we talked about. It was the gear pump, so we ordered one of them. We received it. We haven't installed it yet. We hauled brush five times this month At 8C, we got a call out about an electrical cabinet had caught on fire. Had to repair seven wires and replace the contactor and change two wires. It melted. Also found one of the pumps had burned up, but we haven't pulled it yet. We found out the motor went bad on our bumper crane, on our service truck. At 440 Spring Beach, we got a call out and found both pumps had burned up there. Went out there to pull one of the pumps and the plumbing broke in the tank. So then we ended up putting a pump down there with a hose going to the neighbor's grinder to keep it in service until it's repaired. And I talked to them. It sounds like they may be starting either today, well, I wouldn't say today, The call to locate the call in today that work over there. Work on that. This week is true of it. The more people do that. You have it on schedule and then the bumper train. We also found out that they were not in bed and I can't get part of that on the train that we have or something different.
